Politician: Steven Avery's eyes prove he's guilty

Manitowoc County was flooded with negative emails from across the world after the release of "Making a Murderer" in mid-December, but there was a spirited minority who came to the defense of the embattled sheriff's department.
"I will never forget the look in Steven Avery’s eyes when he was being brought into the courthouse ...," Manitowoc County Board Chairman Jim Brey wrote in an email to sheriff's detectives. “I know a person cannot be convicted based on that, but I made up my mind that day. Avery was guilty."

City of Manitowoc Police Chief Nick Reimer sent an email to sheriff's Lt. Andrew Colborn proclaiming his disgust with the Netflix series.
Colborn and now-retired sheriff's detective James Lenk came under fire in the Netflix series. The show revisited the possibility that Lenk and Colborn ensured Avery's arrest and conviction in the death of Teresa Halbach by fabricating evidence in the disappearance of Teresa Halbach, a free-lance photographer, who was a regular visitor to the Avery Salvage Yard.
Lenk and Colborn both denied planting evidence during their trial testimony. The jury from Manitowoc County found Avery guilty of murdering Halbach and he received a life sentence. His teenage nephew, Brendan Dassey, was also found guilty of homicide in Halbach's death.
The emails from Brey and Reimer were recently turned over to the USA TODAY NETWORK-Wisconsin to comply with a public records request. USA TODAY Network-Wisconsin sought access to written or electronic correspondence involving several current law enforcement officials at the Manitowoc County Sheriff’s Office.
The sheriff's office has received hundreds of emails and voice-mail messages from people all over the world. The vast majority were harshly critical and suggested the department consists of crooked cops.
In his email to Colborn, Reimer wrote:
“I know you to be a great person and crime fighter. I find it not only difficult as a (law enforcement) officer, but also as a citizen to hear what is being said about the 2nd Avery case. It’s hard not to lose faith in the world, knowing that a Netflix movie can make people believe guilty people are innocent and then those people feel moved enough to contact (law enforcement) and say terrible things.”
“For every misguided hater there are many, many, many more supporters and intelligent people that don’t fall for this profit-making movie," Reimer wrote.During an email exchange with Manitowoc County Sheriff’s Lt. Dave Remiker, Brey stated,
"I know what is going on and I feel the pain too."Brey has served on the county board since 1996. He has also been on Manitowoc's Common Council since 1992.
“I will continue to defend all of you that were involved in the successful prosecution of a ruthless killer,” Brey wrote Remiker. “Keep the faith my friend. The vast majority still believes in you!”A retired Wisconsin State Patrol Trooper from Manitowoc County emailed Manitowoc County Sheriff Rob Hermann, thanking the sheriff's office for securing Avery's murder conviction.
“My thoughts and prayers are with you, your agency and all law enforcement agencies involved in the investigation of the Halbach murder,” wrote Laurence “Buzz” Burzynski, now a supervisory special agent for the National Insurance Crime Bureau.
“Nothing is stranger than the truth," Burzynski continued, "and the truth is that with Avery’s history, there was case oversite (sic) and it is inconceivable to me that there is anyone with a badge in our county and Calumet Co. that would conspire to frame Avery or any other citizen!"
In the wake of the sea of criticism, Manitowoc County Sheriff's officials have monitored the internet and social media in search of public comments or news media articles that have justified Avery's murder conviction, the USA TODAY-Network determined.
For instance, Manitowoc County officials emailed Hermann about a Facebook post published by Tom Aziere, a long-retired FBI agent from Green Bay.
On social media, Aziere denounced the Netflix series and even questioned Avery's 2003 DNA exoneration.
In 1985, Avery was arrested for a brutal attack of a female jogger along a Lake Michigan. After being convicted and locked away in prison for 18 years, Avery was freed in 2003 after DNA evidence proved that Gregory Allen was the real rapist and Avery was innocent, as he always proclaimed.
"I know what type of person Steven Avery is," Aziere wrote. "And I know there can never be a grand conspiracy theory. He is not this innocent person you were led to believe. I even question whether he should have been released on the DNA evidence, but that would take too long to explain.”
Molly Dewane also wrote the sheriff entitling her email, "thank you."
Dewane said she was an acquaintance of former Manitowoc County District Attorney Mark Rohrer, who is now a Manitowoc Circuit Court judge. Back in 2005, Rohrer was one of about 35 people, mostly county employees, who were deposed in Avery's $36 million wrongful conviction lawsuit against Manitowoc County.
“I am outraged by the hysteria created by the Netflix ‘documentary’ over convicted KILLERS Avery and Dassey," Dewane wrote to Sheriff Hermann. "It is astounding how many people fail to use any critical thinking skills."
“The officers involved are people I know to be ethical, honest people," Dewane wrote. "Suggesting they would deliberately sabotage a homicide investigation is ludicrous.”Dewane also said she doubted the sheriff had received very many positive comments since the Netflix series aired.
“Let’s hope the uninformed people incapable of critical thinking find a new conspiracy theory soon,” she stated. “Thank you for all that you and your staff do.”Elsewhere, Randy Sigley of Colorado emailed Hermann thanking him for a "job well done."
“I am sure you receive a lot of emotionally charged emails after the Netflix broadcast – keep your heads up,” Sigley wrote.
"So I view the outpouring for Avery with horror - stand strong - I can only imagine how difficult the investigation was and how closely all of you invested yourselves into making sure the job was done properly - that is what Ms. Halbach deserved and you did it ... justice was done."A California woman who said she worked as a Manitowoc County Sheriff's Office dispatcher during the early 1980s also sent Hermann an email of support.
"I am sickened to see how this entertainment piece has hurt the name of the Manitowoc County Sheriff’s Department,” Julie (Pelnar) Dutton wrote. “What Avery did made me sick. Years later I hear about this movie and have been outraged ever since. I’m just a former employee and it’s bothering me so much. I can’t even begin to imagine what you and your fine deputies are going through. I will keep all of you in my prayers.”In late December, sheriff's detective Remiker circulated emails to Manitowoc County's top elected officials. He wanted them to rally around the sheriff's department after fellow detectives Colborn and Dennis Jacobs were becoming recipients of angry voice-mail messages and emails after the release of "Making a Murderer."
“This is the most despicable, unfair and intolerable situation I have ever witnessed,” Remiker wrote. “This has and will change a lot of the employees that have been targeted by these actions."Although special prosecutor Ken Kratz told the news media in early November 2005 that the Manitowoc County Sheriff's Office would not be investigating Avery because of a conflict of interest stemming from the $36 million lawsuit, Remiker was one of a handful of Manitowoc County detectives who continued to remain a regular presence at the Avery Salvage Yard, in hopes of finding evidence to tie Avery to the murder of Halbach.
“Clearly, the story that was portrayed has damaged our reputation and the integrity of these officers for their entire career,” Remiker wrote Brey. “As one of the lead investigators on that case I am very proud of what we accomplished and completely disagree with the portrayal that is circulating everywhere. In reality, nothing can change the damage that has been done. It’s a pretty helpless feeling. I can tell you there are several here that feel like they have a target on their back. If you do not believe me, take some time to read some of the hundreds of comments online. It’s horrible!”
Remiker also sent an email to Manitowoc County Executive Bob Ziegelbauer indicating,
“I do not know what my expectations are from individuals that represent our county but I would hope that there will be some discussions and potentially support given to these professionals that did exactly what they should have done in some very difficult circumstances.”A political independent, Ziegelbauer, 64, has been county executive since 2006. Ziegelbauer also served in the State Assembly from 1992 to 2013.
After receiving Remiker's letter, the Manitowoc County politician emailed him back a three-word reply: “hang in there.”
Remiker forwarded the county executive’s response to fellow sheriff's detective Dennis Jacobs.
“Look at the response I received from Bob Z, ‘Hang in there,’” Remiker wrote. “The best he could do is respond with three words. Wow!”“That’s leadership,” Jacobs wrote to Remiker. “I only had to use two words.”

Funny, I've looked at every piece of evidence presented in the case as well as read about half of the court transcripts, and I can't come to that conclusion no matter how much I want to believe he's guilty. It just doesn't add up, especially when recently released documents show that Avery was named as a murder suspect to the FBI before a murder investigation was even opened. They decided he was guilty before the investigation even started.

Bernie Starzewski ... You mean the ones were he was told his mom already knew everything (that the interrogators told Dassey they knew), and were present for? When he says to her, "You know," it's obvious she didn't.
Then when they were left alone and she asks him about did he do it he said "Not really." She asks him further and he says he guessed the answers like he does in school. She tells him that's not something you guess at and why did he say those things and he says, "They got to my head."
Then he stops as soon as the interrogators come back into the room. When the mother asks about whether they coerced (she said a different word) Brendan, the investigator wants to know what she means. What else could she mean? Plus, answering a question with a question is a diversionary tactic to stall while thinking about what to say. This stall was from the interrogator. Then they decide not to take Brendan to his house to pick up the jeans. Probably worried he will start recanting to family. They controlled every aspect of that interrogation and time with him. The short face to face time with his mom seemed to sink in that she was not on board with what they were having him say and that was when he first indicated what he said wasn't really true.
True watching all four interrogations and how they progress to Brendan saying what they keep searching for. They give him or hint at details. The only story that didn't change from his initial interview to the courtroom was the version where this rape and killing didn't happen.

And how about that phone call that from a fellow "crime fighter" that he ignored for years and then added to the log the day after Avery is exonerated? Yeah. He's not shady at all. All of the people who defend MPD point to all of the "evidence" against Avery, whether circumstantial or otherwise (ahem, planted). But what about all of the evidence pointing to MPD intentionally violating Avery's civil rights? What a great coincidence for them he happened to "kill someone" with so much documentation of their appt and magically disappearing blood other than anything Colborn and/or Lenk (also coincidentally) found after original searches turned up nothing. Give me a break. How anyone can defend any actions on the part of MPD is beyond me. Obviously that traumatized woman was manipulated. And more women were raped. On that's on MPD, no matter how you twist it.

Their attempt at damage control is just making them look even worse than they already do. They dug the hole themselves by imprisoning an innocent man even though Manitowoc police told them they had the wrong guy and the real killer went on to rape again. It's obvious they wanted to avoid the pending lawsuit so they had to do something. I think Zellner is going to free him with new evidence. She already has evidence that Halbach left the Avery property alive. If true, they had her phone records but failed to follow through. Defense didn't even follow through with that. Further, first tower pinging is more understood now and has been used to convict, setting precedence. If Strang and Buting noticed it, it could be that they didn't have a clear specialist to attest to it at the time. Sometimes they feel it won't sway a jury unless there is sound precedence.

The logs Zellner have now are ones the Kratz craftilly concealed from the defense. The defence received an amended log. Basically a shorthand version hallbachs log. Zellner got the whole shebang. Furthermore, cell phone data is much better understood nowadays. Technicians are now able to basically autopsy the cell data to its exacting transmissinal components. Zellner, I am positive has this locked up. This type of science is no secret anymore. And this is only one simple aspect of her evidence combing. Her team is all over everything.

You wanna question DNA evidence that freed an innocent man after serving 18 years in prison? The same DNA evidence you use to convict criminals every day? The DNA evidence that was planted by your wonderful Manitowoc sheriff's department to wrongfully convict an innocent man? Not a man innocent of wrong doing in his life time which he was punished for justly and openly admitshis wrong doing, but a man innocent of rape and murder which he served and continues to serve time for. What scares me is that you sick,inbred, soulless sad excuses for human beings at any point in time band together against anyone and pound someone's life into the ground. This man's entire life is gone. His kids are gone. His right to the pursuit of happiness is gone. Why? Because he deserved it? Nope because the police decided he didn't matter. The police decided also that his 17 year old nephew didn't matter and took his life away also. It's disgusting.
After that trial it only took the opinion of 3 people to lock Steven away for the rest of his life. Only 3 jurors believed he was guilty and refused to give in. The one man that stood strong left the jury because he knew and refused to be apart of a wrongful conviction. I get that everyone had lives to get back to, hell I don't know what I would have done in my own life but thing is it should have never even been up to a jury.
He should have never been on trial. That's why I don't hold much anger toward the jury. The majority knew he was innocent but they caved because of their own trials and tribulations.
So take your dirty disgusting self love and support for your evil organization and shove it. And keep it to yourselves. We don't need to hear you hopeless try taking shots at our intelligence and our ability to think critically. I had an IQ test done on me about two months to check for brain damage from a car accident, I have an IQ of 130, which is close to double the Avery's by the way, which also means I can probably withstand the interrogation you put that man and child thru if I were guilty, but they couldn't. Wanna talk about critical thinking, hmm... you're so sure you got the right murderer's, with out one shed of indisputable evidence other than Steven Avery admitting she visited the property. You're so sure you got the right men that you are terrified of giving these men a second trial... hmm... if I were so sure I'd say take your best shot as many times as you want, I know I'll win.

The biggest hole is that they were able to pin a charge on Steven based on a certain bone piece that was found in the quarry, not on Avery's property ~ how illogical is that?

They also found a second burn site, the quarry, where forensic specialists even said was the location of the burning, then the bones were then dumped into the Avery burn pit. the bones were also spread around the burn pit basically so they could be spotted easier.
Doesn't make sense for a murderer to want to be caught to bring evidence on to his property, but all these "holier than thou" "critical-thinkers" like the ones in this article it makes sense to them. Anyone with even the slightest bit of independent brain power can see this was a set up. Police officers are dirty a lot of the time, not saying always, so for every one that just takes a police officer at their word is foolish. Police officers are regular people that get to put on a special uniform, drive a special car, and get to use an unbelievable amount of power... for about 40,000 a year... not a whole lot of money is being paid to these wielders of power...
And with great power should come great responsibility.... a higher standard is expected of them, but like I said they're human, they probably feel under paid, over worked, dare I say bored in a quiet area. And they wield this power knowing there's somebody that's a real bother to their department. There's a family that's really just not worthy of being in their county. And they know, hey we could be hero's for getting a quick prosecution for this lovely lady who fell victim to rape and we can take this family and this man down and drag them thru the gutter. We'll be hero's. Probably get a promotion. All kinds of good publicity. Everyone look at how great we are! We arrested this horrible man for raping this wonderful lady of a great family of our community.
He has an alibi of every second of the day and 22 eye witnesses of his where abouts. O yea and the sketch drawing the artist did that the woman said looked like her rapist looked nothing like Steven Avery that day but it looked like Greg Allen or Avery of 3 years prior. Yet they still go to this man's house and arrest him, taking him from his wife, his children and his family. They still convicted him and would have held him even longer than the 18 he served had it not been for DNA evidence. They had no evidence it was him other than a sketch that looked like an old picture of him. Seriously?
How in the he'll do people have this blind faith in the police and justice system? How about this? Remember two days prior to Theresa's RAV4 being found, an officer by the name of Andrew Colburn calls in to dispatch... remember the RAV4 was found with out it's plates in the salvage yard... he calls in her plates and gives the dispatch a clear description of the vehicle...but wait.... if he found the plates not on the vehicle, how would he know what the vehicle looked like? Hmmm.... Because he found the vehicle plates and all not on the Avery property!
He planted the Damn vehicle took the plate off to try giving himself an excuse for calling it in, but he forgot that he gave a description because my guess is he took his time to figure out what he was gonna do with it exactly probably talked to some of his buddies, they came up with the idea, but he says "well I called the plates in so how could we explain that" that's when they just say take the plates off and then plant it on the property. I mean seriously people.
Look when they first discovered the car on the property and he called in to dispatch again while on his way there, first thing he asks is "do we have Steven Avery in custody yet?" Seriously? This was a clear as day set up. How many people lived on that residence? How many people could have snuck that car on to that property in the late night/early morning? You need evidence of Who actually committed the crime, but see he already knew who the target was.
I can't believe there's still people out there that don't see the way this man has had his life wrongfully taken from him. The even sadder part is this is just one man, who was at least lucky enough for the world to hear his story and get some support, imagine how many other people this has happened to and they have nobody hearing them... it's a sad world.
And I've never been so moved to want to save someone I have no connection to, as I was with this story, because this could happen to anyone and it's wrong. We get one life to live and his had been spent on the inside of jail for crimes he never committed. It's absolutely heart breaking. This man list everything over a petty little family squabble and looking like a bit of a cave man. And the fact that he continues to fight for a normal life even tho he's done nothing but suffered and lost his entire life, it's truly inspiring and should make everyone appreciate their own lives a little more.

The MCSD is incredibly incompetent. I had my house burglarized in their jurisdiction and I TOLD THEM WHO DID IT. The only investigation they did was to call the guy, and when he denied it they dropped it. It not only illuminates the deep bias the county and its officials have toward Avery, but places on display the rally calls and back massages these guys are giving themselves over the matter. A proper investigation never took place. How can they say they did a good job? It was light years from a good job. If Calumet deputies had found all the eveidence without the help of Manitowoc it may have been different. If anyone other then Culhanes lab had tested the evidence it might have been different. But it didnt happen. Manitowoc HAD to insert themselves at every level of the "alleged investigation" and find all of the damning "evidence" against Avery.... All when they should not have been anywhere near the investigation. I think we all know why that is. They had the access, the motive and the balls to destroy Avery at all cost. They were not worrying about how it looked to others on the sidelines or who was watching closely enough. They behaved as though they had nothing left to lose and if they didn't succeed it was very likely they would have lost everything anyway. The article demonstrates a mindset perpetuated by LE. If they do not like scrutiny, they should do their job or find one they can do. Public officials are supposed to be scrutinized when they are serving the public. Thin skin has no place in our city, county, state or federal government's. If they don't want to serve the public who scrutinizes them, make it official and stop accepting the checks paid by the public. They want their cake but eat it too.

Confirmation bias at its best. But let's play the game together, shall we? Below is RAW footage of Steven Avery on Nov. 6. filmed in his family's place in Crivitz. In this video, he explains that he thinks someone from Manitowoc County is setting him up for Teresa's murder. He says they have had days now to plant stuff. He has been trying to figure out how the Rav4 got there and he has no clue but suggests that the cops look at tire tracks. To me he looks sick to his stomach and terrified as is the entire family, because he feels powerless. He of course could be guilty. In which case, one wonders if his behavior would show guilt. Okay here is what he has done so far: - invite a major news organization to his family's kitchen table and his grounds in Two Rivers and Crivitz - speak with news every single day since Teresa was annouced she was missing - speak with cop in Crivitz until his lawyers step in

If it was one or two bad apples, they would weed them out. When you look at Pagal's role in this, you have to ask why? Why would the neighboring sheriff have so much venom against Avery? Why Fassbender at DOJ. This seems like more than the thin blue line. I guess the entire state was worried about paying out the 36 million. I could see them all having to tighten their belts, if Avery won the civil suit. That or a cult is the only explanation I can come up with.

Most of these Manitowic people fail to realize that most people are shocked and upset about the behavior of all the law enforcement people involved from sheriff to investigator to prosecutor to judge REGARDLESS of whether Avery is guilty or innocent. They are the ones who don't see what kind of garbage they come out looking like in the docu-series. To me, Avery could be as guilty as OJ but they will forever remain garbage to me.

ReplyDeleteKeep in mind, in that part of Wisconsin there is a sheriff's department that was (is?) incompetent, blows evidence handling 101, is so filled with hubris they can't admit mistakes, and these people have guns and power. That means if you get on their wrong side in that part of Wisconsin, it could be you, your kid, your parent, your best friend who gets tagged and put away, either in jail or taken care of Peterson style (it would be easier to eliminate Steve Avery fame).
The locals get who they vote for and what they are willing to accept if they don't speak up. I find that very sad. As long as it happens to someone else, they think it's all just fine. I'm not Christian, am pretty irreligious actually, but I remember something Jesus was supposed to have said: whatsoever you do the lowest of the low, so you do unto me. Maybe a few of those self-righteous MCSO supporters should read their Bibles a bit more.

ReplyDeleteSo many replies that mine will be lost probably. I have to say that (a) I seriously hope Avery and Dassey are innocent, and want to believe that, and yet solid evidence that someone else killed T. H., or that she was not killed, seems very much missing. I can only hope that Kathleen Zellner really does have the solid evidence she promised. It is hard to wait but nothing else to do.
ReplyDeleteA quarry full of 'possible' human remains which were never processed????????????.....that could possibly have been Halbach's remains that possibly could prove that she was murdered and burned elsewhere..............and lets not forget the absolutely PROVEN fact that not only did Manitowoc CSDep. frame an innocent man and send him to jail for 8 years for a crime he did not commit, who then decided to LEAVE him in jail for another 10 after they were told someone else admitted to the crime, ?...were they worried they would get in trouble for grossly mishandling the case. Because they were probably going to be sued for possibly the absolute worst police work ever carried out and would be on the hook to pay massive amounts of compensation to a man who lost most of his life in prison because some ridiculous self righteous politician decided he was guilty because of his eyes! I sure hope she does too because I would LOVE to see them go down for it this time instead of getting off like they did the first time. The first time they convicted him was bad judgement and forgivable, leaving him rot in prison after someone else confessed to it was an absolute crime. That shame they will carry forever and has nothing to do with Halbach's murder, and they got away with it too. They needed to make Avery guilty to prove to everyone and themselves that he deserved to be there the first time, which he didn't. What they did is disgusting.

The investigators didn't eliminate all suspects, they rigged the game in order to favor Steve as the culprit.
The Manitowoc County Board of Supervisors should have called for an independent investigator to conduct an autopsy of what went wrong in the 1985 case.
They did not do that.
The same actors in 1985 were also some of the same actors in 2005, and like /u/knowjustice so succinctly said, a zebra doesn't change its stripes.
Pre MaM, I was right there with you Mike, after MaM I was on the fence. After perusing the the crowd sourced documents and reading this sub, I'm absolutely convinced that Manitowoc County has some serious issues regarding police corruption that need to be addressed.

Fear is how we got in this justice system mess. The powers that be know that the more fear they can instill in people, the more power they have over those people.

Just think how fearful they would have been if they had been told the facts about GA. My assumption, nothing was ever publicized about a violent rapist lurking in the neighborhoods of Manitowoc. In fact, TK told PB to ignore the MPD's concerns GA was the person who attacked her. Wow, just wow!

Completely new to this case?
A long contentious past history between Avery and the county including a false conviction and an ongoing eight digit lawsuit. A public acknowledgement of a conflict of interest and recusal, only to have people closer to the case than the average recused person working the most sensitive areas of the case. Unprecedented delays between when a search warrant was served and when the majority of evidence was allegedly found. An eye witness stating he saw someone plant the RAV4 and also saw cops entering the crime scene in the dead of night. A prosecutor who was at the time engaged in proven, heinous ethical violations. Evidence moved to the crime scene. State witnesses whose testimony was radically different than initial statements, one of whom says was under threat of arrest and intense pressure. Another state witness allegedly told a completely different story of events privately. Routine procedure ignored as the victim's remains were neither photographed nor examined by a coroner at the scene. The recusal which at that point had been treated as a joke used to bar the coroner. Cops on video tape feeding a witness details and then using the details the cops themselves originated to obtain a search warrant. Orders to the lab to produce a certain result and the lab changing the result of a completed test to comply with that order. A flyover video unable to spot the vehicle the day before and edited for no ascertainable reason. The prosecutor lying to the court about the cops' awareness of prior blood samples of the defendant. Teeth allegedly burned to a greater degree than facial bone. Bones in multiple locations with no clear working theory as to how they arrived that way. Blood spatter on the back of the RAV4 in contrast to the state's theory of the case. A theory of the crime with no motive that alleges that the defendant half the time did a miraculous job of cleaning evidence and the other half left strongly damning evidence in plain sight in his own backyard.
There's a lot more but that's a good start.
