Ken Kratz Wrote the Script for the Murder Trial of Steven Avery


He crafted the false testimony. He even had hand signals for them on the stand.
Ken Kratz orchestrated the planting once the crime scene was moved to Avery Auto Salvage. The “evidence” reads like a trial checklist for the jury, with no real thought as to how it got there or whether it makes any sense. Kratz wasn’t expecting the eyes of the world on everything. He tried repeatedly to get Making A Murderer footage seized so it couldn’t be seen, and even now he keeps bleating about the documentary to keep everyone’s attention off of the illogical evidence and shoddy investigation. Kratz dotted every "i" crossed every t"" to ensure a conviction, even offering up an eyewitness to the crime; and if that meant sacrificing a mentally-challenged child like a lamb to the slaughter, so be it. He delighted in creating his masterpiece fantasy sex crime and basked in the limelight it provided him. Regardless of who killed Teresa Halbach or why, without a doubt that conviction was sealed and delivered by Kratz. The entire scenario was left for him to design as he wanted, calling the shots, not having the forethought to give a rats ass if the pieces wouldn’t fit together when put under the scrutiny, such as has been cast upon him and his poorly thought out, horribly unorganized story, because he never dreamed this case would be given a serious look, outside his safely guarded state-level court systems. How could county-level employees, such as a the sheriff’s office and a county district attorney, get away with this sham after the release of Making A Murderer? You have to look much higher as to who gave the green light for this travesty. [Source]

Ken Kratz wrote this about himself in the forward to his book:
In his 25-year prosecution career, Ken Kratz has handled many complex and high-profile cases including homicides, sexual assaults, child abuse cases, and property crimes. Widely considered one of the state’s best criminal trial attorneys, Ken dedicated his career to advancing the rights of crime victims, serving on the Attorney General’s Crime Victim’s Council, and as Chairman of Wisconsin’s Crime Victim’s Rights Board from 1997 to 2009. Ken also proudly served as President of the Wisconsin District Attorney’s Association in 1996. For his work on the Teresa Halbach homicide case, Ken was named “Prosecutor of the Year” by the Wisconsin Association of Homicide Investigators in 2008. The story that Brendan Dassey told in his coerced confession is Kratz's perverted sexual fantasy. Between Ken Kratz and Steven Avery, the one most capable of abducting and raping Teresa Halbach is Kratz:
  • Kratz spoke about a room he has where he ties woman up
  • Kratz indicated he had a private room at his house and that no one went into the room except Kratz. 
  • Kratz talked about how he was into bondage. Kratz said he ties woman up, they listen to him, and he is in control.
  • Kratz said women have to listen to him or he hits them.
  • Kratz told her, "I know everything about you; I can make trouble for you." She said she did not know what Kratz meant, but she did not want to take the chance. She thought he could make things up, and she had been guilty of things in the past. He told her that if she did not listen to him he could "get her jammed up." She said Kratz had such "seniority" over her and it was "really scary." Kratz wanted her to engage in bondage with him. She said he instructed her to give him a "blow job," and she did. She stated that the blow job happened on her couch, and she was bent over Kratz. She said that he held her hands behind her back. Kratz also "clamped her mouth shut to swallow" with his hands. She said that while Kratz was still at her apartment she went to the bathroom and puked. After he left, she "puked her brains out" and stayed in bed for about a week. She said she had been raped when she was 16, and she said "this feels a lot like it."

The title quote comes from a tweet by Ken Armstrong, which was retweeted by both Drizin and Zellner.

It highlights the case against Encarnacion Salas, in which the Washington Appeals Court just ruled to reverse his conviction and grant a new trial based in part from "prosecutorial misconduct in the use of PowerPoint slides."

While the magnitude of PowerPoint influence and prosecutorial misconduct varies by case, I was reminded of some ways PowerPoint was used by Kratz and company in the Avery case.

Avery's case opened with Kratz blatantly lying to the jury, by showing a slide with a circle and arrow pointing to a dot on the tailgate. He suggested that was Avery's blood alongside with Teresa's from his actively bleeding finger, after tossing her bloody body into the back of the RAV4. When the slide was shown with the arrow pointing to a dot on the tailgate, Kratz remarked:
The rear tailgate, remember I told you there was a droplet of Teresa's blood; because Mr. Avery is actively bleeding, there is a droplet of his blood as well.
Despite Kratz and the state knowing the ins-and-outs of the lab results and investigation for 1.5 years, he still consciously worked a major falsehood into a PowerPoint slide to present to the jury. There was no mixture of blood found of Avery and Teresa in the reports. There is no evidence that Avery was ever bleeding over the tailgate, nor any evidence that he was actively bleeding from his finger when allegedly fighting with Teresa given the lack of blood mixture anywhere.

There was also Austin's Forensic Mapping PowerPoint, created "under the direction of Mr. Kratz" that provided incredibly amateur and incomplete CGI scene "reconstructions." He utilized consumer 3D modeling tools like Rhino3Dto construct crude and poor-lit scenes that only tangibly resembled anything like the actual areas. Many details were missing from each modeled scene, and he seemingly improvised with the materials as he went along. In the Dassey case, he presented a new arrangement of the bedroom that absolutely did not match anything like how Brendan drew it. He later admitted it was not based on any one depiction, but rather creatively constructed to fit the state's theory and Brendan's tall tale (and based more on Jodi's recollection, which was months obsolete).

The EDTA PowerPoint presentation also included cheesy finger bleeding animations with big pools of blood to at least sub-consciously remind the jurors of the state's theory that Avery was actively bleeding from his finger all over the car (despite only a few tiny drops being founds in a very particular location, nowhere else and not mixed into Teresa's).

I've been really surprised how much visual aids have insinuated their way into the courtroom. I'm glad you brought this up, because it's been nagging at me quite a while.

Kratz went beyond including visual aids—he was very slick about substituting visual aids for actual evidence. I saw several instances where he was pushing the envelope, to the point that I suspected he was knowingly tricking juries (and apparently, opposing counsels and judges as well) by using inauthentic visual aids deceptively.

Visual aids are not evidence. I'm guessing though, that both sides have learned to take advantage of today's computer/printer technology, to produce attention-getting visual aids as part of presenting their case.

However, litigators are going to have to start paying much closer attention to these exhibits. It should be a straightforward objection, but it means careful scrutiny is going to be required when such exhibits are offered into evidence.

I've always believed Timothy P. Austin had an alternative purpose for the State. His official purpose was to "map" the Avery property with animations (cartoons).

My pessimistic and skeptical thinking leads me to believe he was used to help edit audio/video possibly photo records. The rest was smoke and mirrors. I hope you take the time to read his CV and crappy PowerPoint presentation.

Did Ken Kratz Plant All the Evidence to Frame Steven Avery for Teresa Halbach's Murder?


To believe in Steven Avery’s innocence is to believe that someone must have planted evidence to frame Steven Avery. There is no way around this as Avery’s blood is in Teresa’s Toyota RAV4, to say nothing of the key, the bullet or the bones in the backyard fire pit could not be plausibly explained any other way. The usual suspects, so far, have been Colborn and Lenk, and really all of law enforcement in that area, but as I have made clear, I have reason to believe that there is plenty of reason to doubt their involvement as Ken Kratz is a far more likely suspect as the chief, if not the sole, depositor of false evidence.

There is this thing I read about awhile ago called theory of mind (ToM) which, so far as I can tell, boils down to a formal way of describing the ability to get inside someone’s head.  It can be useful too, especially in sorting out what might have motivated a person’s behavior.

Kratz is a compulsive, pathological liar as has been fairly well established.  I would point out that there is something about the pattern of the supposed “evidence” against Steven Avery which, in its sheer volume and variety, bears the tell tale signature of his lies. If we know Kratz to be a liar, and there can be zero doubt about that, what is the one thing that would propel someone accustomed to performing relatively trivial acts of wickedness into crossing a certain mental threshold whereby more consequential and daring acts of turpitude would be attempted?

A high risk tolerance. 

Some people are risk averse, while others seek their thrills. So, where, might we surmise, does Ken Kratz fall on this scale? I would argue, and adduce evidence, even, that Ken Kratz has shown, even in his own words, that his tolerance for risk is very high; and in light of this personality trait, I think my argument that Kratz is the likely depositor of false evidence is further bolstered.

Consider, then, Kratz in the words that he sent Stephanie van Groll, a woman who had sought the services of his office after she found herself the victim of domestic abuse at the hands of her boyfriend:
‘Are you the kind of girl that likes secret contact with an older married elected DA … the riskier the better?’
The riskier the better. Of course, I don’t know what risk there might have been for Ms Van Groll to have a sexual liaison with Ken Kratz, but there was clearly a lot of risk for Kratz, and we know this because it had been exactly these sort of unwelcome texts, along with even more outrageous and immoral acts, that caused Kratz to lose just about everything he had: his job, his house, his status, his relationships, and possibly much else. For a person in his position to send out even a single text of this sort was to court utter ruin.

So, if, by now, I have convinced you that Kratz was capable of depositing false evidence, the next question is whether Ken Kratz would have colluded with anyone else? Well, why would he have needed to? We have to assume he had unrestricted access to the entire crime scene, and that would have included Steven Avery’s trailer and garage (and the trailer used to transport the RAV4 to the crime lab and the crime lab itself). Even if Kratz had been seen entering any corner of Avery’s property, be it inside or outside, this would not have raised any eyebrows.

Couple this with the fact that Kratz worked out of Calumet County. As the District Attorney, he would have probably been the person in the highest position of authority there, and therefore had unrestricted access, night and day, to the areas where evidence in pending cases was stored. That means he would have had access to Steven’s gun, to Steven’s DNA, to pretty much the whole megillah, as they say.

The timing of the discovery of the evidence also comes into play. If it had all been there all along, you would expect the discovery of one piece or the other to be staggered. Maybe the bones on day two, maybe the bullet on day nine, the key at some other random time. But if the evidence was planted more or less at once, then one would expect the discovery of the evidence to happen all at once, and that’s exactly how it happened.

Kratz, in a stroke of sheer, multifaceted, mastermind, criminal brilliance, knew that others would find the evidence that he left behind. He could then just sit on the sidelines while they took the blame, while at the same time confidently, and, as it turns out, accurately claiming that the theory of a conspiracy on the part of law enforcement was patently absurd.

He could fool all of law enforcement while at the same time doing them all great harm by bringing literally global scorn upon them. He could fool all of those who believe in Avery’s innocence by erroneously getting them to think Lenk and Colborn played a role (and do a great deal to ruin their lives, as well). And on and on.

As I sit here and write this, I fear that I will convince no one and probably alienate a lot of people, maybe everyone. Almost everyone who believes in Steven Avery’s innocence believes Manitowoc County Sheriff’s Office had a hand in framing Steven Avery. But I am not of the constitution to be able to play to an audience, even if that audience agrees with me, and even if we might get along swell if I pretend to agree with them. I don’t expect anyone in Manitowoc, Wisconsin, much less in the sheriff’s department there, to read this and find any of it persuasive. But it’s what makes sense to me, and  and owing to some constitutional infirmity, I go, unswervingly, wherever my powers of ratiocination guide me.

If Ken Kratz planted one piece of evidence, he planted all of it: the bones, the melted phone and camera, the blood, the “hood latch” DNA, the key, and the bullet. What we’re left with is a Toyota RAV4 in the remotest corner of a salvage yard on the edge of town and really not much else, except for Teresa’s appointments that day and the murky circumstances surrounding the visit she was paid by her ex-boyfriend the day before.

I have listened to the audio of Colborn calling in the plates, but I cannot rule out that he had simply called in to confirm what was on the flyer that was widely distributed in the community that had the license plate and vehicle description printed on it. And because I cannot rule that out, I have to default to the simpler explanation of the two, as the simpler explanation is usually the correct one (Occam’s Razor). It is also much easier for me to accept one, rather than multiple planters of evidence for the same reason. A facile explanation would be that all of law enforcement in the area was corrupt, and to leave it at that without providing further detail, but if we implicate Kratz, a person who probably didn’t even know either Lenk or Colborn, we are forced to explain why one or the other would have risked involving the other in highly risky, nefarious deeds.  

Kratz is the seeker of glory here. He is the one who had the most to gain by successfully prosecuting Steven Avery. Kratz is the one with the chequered past, and a string of highly questionable deeds. Both Lenk and Colborn have always struck me as milquetoasts, Mayberry-esque kind of. That impression could well be wrong, but no one has ever come forward to ever describe them as doing anything remotely like the sort of stuff we know Kratz has done and continues to do.

And I would return to this: if Kratz had all of the evidence in his possession, and he had unrestricted access to it, and he had as much time with it alone as he desired, why is it necessary to involve Colborn and Lenk? I’m not saying that I’m right, but I think about this matter a lot, and this is the only scenario that I’m satisfied with. It is the only one that allows me to put all of the pieces together. I have scratched my head about all of this for a long time, and it’s only when I put Kratz squarely in the center of it as the grand puppet master does it fall into place. I think the reason people have trouble seeing it, including myself, owes to the sheer audacity of it all. But speaking even to this point, Kratz’s behavior continues to be audacious. He is an audacious man who does audacious things.



Ken Kratz, Crime Watch Daily, March 3, 2017, on the letter from jailhouse snitch Joseph W. Evans Jr., who claims Avery confessed to him: 

Kratz: There's many parts of Mr. Evans letter that are plausible.

Kratz: I don't know if it's authentic or not.

Kratz: It may or may not be believed, [it depends] on all those other circumstances. I don't know, I don't know.

Host: You have to have an opinion on this, Ken.

Kratz: And, if I did, I wouldn't share it with you because it isn't a rabbit hole that I would really want it to go down.

Kratz: The main actor clearly is Steven Avery, it's not Brendan Dassey. Brendan Dassey, in my opinion, never would've raped or killed Teresa Halbach without the involvement with Steven Avery.

Host: Could this letter in some way affect Brendan Dassey's appeal?

Kratz: Probably not the appeal. Unless there is a piece of physical evidence. His appeal is going to rise or fall on whether or not that confession is going to be upheld by the federal court.

Host: Is it possible that there is some new information in this inmate informant letter that's been made public?

Kratz: Absolutely. We didn't find a knife or any other cutting instrument that at least Brendan said was involved. I've got a sneaky suspicion though that law enforcement will be looking into the new allegations that are made in that letter.

There is a new development in the Steven Avery murder case that may contrast with his post-conviction lawyer’s attempt to free him.

In a 2016 letter obtained by Rockford Advocate, a man who befriended Avery in prison says the “Making a Murderer” subject confessed to him how he raped and killed Teresa Halbach on Halloween 2005.

Joseph Evans Jr., a man convicted of killing his wife in 2009, says he met Avery in 2010 at the Wisconsin Secure Program Facility in Boscobel, Wisconsin. He recognized Avery from news coverage of Halbach’s murder, and Avery knew of Evans’ Marinette County case.

After small talk about their respective cases, Evans said Avery unfolded a chilling, detailed confession that started with the contention that he would have gotten away with murder had Brendan Dassey not talked to police. Avery then walked Evans through how he lured Halbach into his trailer, raped and strangled her, and continued to have sex with her after she was dead.

“Steven Avery told me that he had seen Teresa out at the salvage yard before,” Evans wrote in the nine-page letter. “He said that he had thought that Teresa would be an easy lay because he didn’t think she was all that pretty or anything. …but she did have a sexy bottom on her.”

Evans said when Halbach arrived at the salvage yard, Avery was being flirtatious and asked her to dinner. Teresa refused the date, but agreed to go inside Avery’s trailer to talk about about the sale of the vehicle she came to photograph. After talking with Halbach at his kitchen table, Avery grabbed a knife from a drawer and Halbach by the back of the hair, Evans said.

“He said he put the knife to Teresa’s throat as he guided her to his bedroom,” the letter continues. “Steven said Teresa was crying and begging him not to kill her.”

Similar to the prosecution’s theory gleaned from Dassey’s now thrown-out confession, Avery tied Halbach to his bed, only he used one of his shirts and pair of his socks, Evans said, not the leg and arm irons found by police.

For approximately 90 minutes, Avery raped, strangled and sodomized the 25-year-old freelancer, stopping periodically to choke her to make sure she wasn’t breathing.

Enter Brendan Dassey.

With the freshly killed Teresa Halbach in his bed, Avery cleaned himself up, knowing he called his nephew over to “give him a hand.”

“Steven had said that Brendan had asked him, ‘Why is she just laying there like that,’ (and) Brendan thought she was just sleeping,” Evans said.

Avery then gave his nephew permission to have sex with Halbach, but said to “hurry up because they had to get rid of her.” The teen obliged, later asking if she was a heavy sleeper because she never moved. That’s when Evans said Avery laughed at his nephew “for being so stupid,” before telling the boy Teresa was dead. To make sure, Avery cut her throat but did not believe the wound was very deep, given the lack of blood.

“Steve said that after he had Brendan help him tie Teresa up with rope and taped her mouth shut, they carried her body into the kitchen.”

Avery moved Halbach’s Toyota RAV4 closer to the trailer, and Dassey placed her body in the back of the vehicle. They pulled the SUV into Avery’s garage and placed her on the floor, Evans said. That’s when Avery grabbed a .22-caliber rifle and shot her: twice in the head, twice in the chest and once in the vagina.

“Then he had Brendan help him put Teresa’s body back inside of the Toyota, and drove it to his burning pit.”

While Dassey covered Halbach’s body with old tires, branches and debris, Avery got busy hiding the RAV4. He disconnected the battery and GPS wiring and removed the license plates, Evans said. He put the Toyota’s key in his front shirt pocket. He placed her phone, handheld computer and camera on the ground and covered the RAV4 with boards so it would blend in with other cars in the yard, Evans said.

“Steven then stated that after he was done covering up the vehicle, he had gathered up the items that he had placed on the ground and took them back by the burning pit and tossed them into it.”

With Teresa’s body in the bottom of the pit, Dassey and Avery wiped the trailer and garage clean using bleach and  Gojo soap. Avery put Halbach’s clothes, bedding, rags and a throw rug in garbage bags and transported them to the burn pit in his car. There, they became part of the gas- and oil-fueled bonfire, Evans said.

The key

While millions of Internet sleuths claim Manitowoc County deputies had time, opportunity and motive to plant the Toyota key, Evans said it ended up in Steven’s bedroom because Avery mistakenly dropped it there.

“Steve said when he was in his bedroom, he had taken off his flannel shirt and tossed it up on the dresser, that’s when the key to Teresa’s Toyota must had (sic) fallen out of his shirt pocket and fell between the dresser and the bed.”

Burn barrel items and a vow of silence

After tending the fire with Dassey for about an hour and a half, Avery promised the teen he would buy him any car he wanted with proceeds of the lawsuit he had pending against Manitowoc County. All Brendan had to do was keep quiet, Evans said.

“Steve said that he told Brendan that if he said anything to anyone he wouldn’t get anything and that the two of them would both go to prison. Steve said that Brendan promised to remain quiet and keep his mouth shut to everyone, then Brendan left to go home.”

Avery tended to the fire, Evans said.

“He remained out there by the fire for a few more hours and as it was dying down, he could see some of Teresa’s bones and some other items that had not burned completely, so Steve said he had taken a shovel and broke up the bones and scattered them around, then he shoveled the bones and other things into the burning barrel.”

Evans said Avery discarded the shovel, knife, Teresa’s jewelry and some of his clothes near Crivitz, Wisconsin, where Steven was when police discovered the RAV4 and Halbach’s bones.

A parting promise

In March 2014, Evans and Avery were transferred to the Waupun Correctional Institution. By then, Evans said the deal between “Making a Murderer” filmmakers and Netflix was in the works, and Avery had been advised to stop talking about his case. He said because they were friends, Avery promised to pay his restitution after he won a multi-million-dollar lawsuit he planned to bring against the State of Wisconsin and Manitowoc County.

Evans told Avery he needed to turn to God and admit to Halbach’s murder, if only to help Dassey, but Avery refused.

“‘Your (sic) f–king crazy,’ that kid is on his own, he shouldn’t had (sic) spoken to the police.”

Evans said Avery initially planned to pin the the murder on his brother.

Advanced forensic testing

Famed post-conviction attorney Kathleen Zellner is still waiting for results of forensic testing that began last year on several pieces of evidence. She claims she has proof that Manitowoc County deputies planted evidence in the case.

Evidence subject to forensic testing are:

A vial of blood Avery’s blood drawn in 1996 and filed with the Manitowoc County Sheriff’s Department. It is the vial attorneys Jerry Buting and Dean Strang claimed may have been the source of Avery’s blood found in the RAV4. The blood was previously tested for a preservative and none was found.

A DNA swab taken from the hood latch of the RAV4. This is the swab prosecutors say contains Avery’s sweat DNA he left when he touched the latch in the process of disconnecting the Toyota’s battery. The hood latch was tested six months after the murder.

Since Making A Murderer came out and all of the web sleuthing began, all of the countless hours of pouring over details, uncovering facts or inconsistencies, and theorizing in an attempt to discover the truth, those responsible have certainly not been resting on their laurels.

For as long as we’ve been trying to uncover the truth – they have been trying to figure out ways to keep us finding it. This goes up high into the State of Wisconsin’s judicial system and branches of their political structure, and there are potentially some very powerful people involved.

We are fighting for justice and for Steven Avery and Brendan Dassey’s freedom, but they are fighting for something far more important in their minds.

When the fallout from MaM was becoming evident, and Zellner came aboard, the state knew it was incumbent on them to do whatever it takes to not let this happen. We're not talking about the bumbling “cops on the ground” that were instrumental in making this happen in 2005. No, were talking about well educated, intelligent, powerful and connected people who have a vested interest in making sure this isn't successful.

IMO with so many aspects of this case handled in such a bumbling keystone cops kind of manner, I believe this leads us into a false sense of security and confidence. We know Zellner will bring it – and hope when she does it'll bring us the answers that we've been looking for.

BUT ARE WE UNDERESTIMATING THE OPPOSITION???

Because they have a plan...

THE PLAN

The plan is being executed in stages – the first stage:


PROPAGANDA, PLANTS AND PR!

The objective of the first stage of their plan were simple: slow down the negative publicity and public perception. Their answer to this was to hire a PR firm to plant and spin stories and try and discredit MaM as a biased flawed docudrama that left out evidence and had an agenda. They would get the view they wanted the people to have out there by shows like Nancy Grace, Dr. Phil etc.

THE REDDIT FACTOR

Never before has a online group become so involved in an investigation – with some amazing results. This created another problem for “them”: new evidence was being found and some of it very significant. At some point in time I'm sure they realized they weren't going to be able to justify or defend everything that was being found out - there were just too many things.

Most are also aware of the stooges or plants in different MaM forums, placed there to create havoc, argue, and basically disrupt any open minded discussion, inquiries, or theories, and they had some limited success – they were able to convert some fence sitters, I'm sure, and cause some grief to many a poster. But TickTockManitowoc split, and eventually change of policy pretty much has put an end to any effectiveness they once had. Just look at those boards now – they're virtually dark, why – because no one wants to play their ridiculous game.

The point is they've been listening to every word we've said, ever discovery, every theory.

The reddit factor was also the reason they put a stop to all FOIA requests being processed and was enacted in order to minimize what redditors would be able to discover or connect the dots with.

Keeping Brendan Dassey in prison is also part of their plan – if Brendan were to be released it would weaken their position and the heighten the public's perception of their misconduct.

Michael Griesbach with his books and countless hours on the taxpayers dime attempting to lend credence to the prosecution of Avery and Dassey. MG talking out his ass about things he just wasn’t too knowledgeable about to anyone who would listen.

Public perception and opinion is very important to them.

DEALING WITH ZELLNER

Katherine Zellner scares them, and rightly so. They needed a solution that would sway public opinion, make Zellner's arguments less effective, and preserve the case if it was necessary to retry.

They knew evidence testing could be their undoing, with Zellner claiming new testing technology would prove Avery's innocence, and they knew she was right. While Zellner was contacting leading scientists about new tests they could perform – the opposition was also finding out from their experts on what could be done to render Zellner's tests inconclusive.

We recently learned that exposure to UV light could remove traces of EDTA transparently. There are other things that could be done to alter other samples transparently – these wouldn’t be common knowledge, but the experts would know what techniques could be applied. Biological evidence can always be manipulated.

Remember these are influential men with intellectual contacts, power and clout. The abnormally long time that it took for a testing agreement to be reached and for them to allow Zellner to start testing was this – whatever they had the ability to do to the samples to render Zellner's testing inconclusive – whether it be exposure to UV light, or anything similar that was transparent, was done. The evidence that could not be manipulated or had greater evidentiary impact they would refuse to allow her to test.

Their objective was to minimize any shock and awe or increased interest Zellner's testing might have created.

THE INMATE CONFESSION LETTER - Joseph W. Evans Jr.

Ken Kratz, the narcissistic, ego-maniacal, douche bag prosecutor was most likely the one who requested the coerced confession of BD, after all it didn’t just happen – it had to be someone’s “idea.” IMO, it was him who told them we need more to get a conviction.

Kratz, or the “prize” as he likes to call himself, has been disgraced, shamed, had his practice ruined by MaM – he has tremendous incentive in his mind to return himself to the respected prosecutor that he thinks he is. He has a book coming out in which he claims he will reveal evidence of Avery's guilt that only he knows (which would be impossible unless he discovered it and was silent about it OR he manufactured it).

So I believe he was instrumental in this inmate retelling of an alleged SA confession, and he will have things in his book that will somehow relate to it.

I believe they have been strangely silent on this intentionally.

I believe they will announce miraculously that these items had been found and that the Halbachs have identified the jewelry as Teresa’s and that SA's and TH's DNA was found on the items.

Here's how I think they envision this going down –

Setting: A newscast days before Zellner is to release the results of her testing and file her appellate brief…(speculation)

Newscaster: Today there’s breaking in the Steven Avery case – there has been new evidence found that authorities claim make his guilt certain – Steven Avery, who is serving a life sentence for the killing of a Green Bay woman, Teresa Halbach, and who was the subject of the Netflix series “Making a Murderer”, had a large following that believed him to be wrongfully convicted a second time. Now prosecutors believe they have evidence that proves his guilt beyond any doubt. Last August a fellow inmate serving time with Mr. Avery sent a 9-page letter claiming Steven Avery confessed to him while they were incarcerated together in 2011 – the detailed letter chronicles the horrific last hours of Teresa Halbach's life, including a list of items he said Steven Avery had told him that he disposed of in the Crivitz area. In April, Crivitz resident Joe Somebody was out deer hunting at a camp in the Highs Falls area of Stevenson as the snow was beginning to thaw, and he came across a hefty bag sticking partially out of the snow – when he investigated he found in the bag items, including a women's necklace and rings, a bloody knife, men's clothing – Joe took the bag home and called authorities. According to Jerry Pagel of Calumet County Sheriff's Department, the rings had been identified by the Halbachs as belonging to Teresa and Steven Avery's DNA had been found on them and on the knife. Here to talk to us today is the man who prosecuted Steven Avery and who has just released a new book on the subject, Kenneth Kratz.

Imagine the effect that would have swaying public opinion – Nancy Grace would be everywhere saying, “See, I told you he was guilty, now this proves it!” This would dominate the news cycle, and basically people would not even listen to what Zellner has to say. The news would say there’s no way getting past the fact that the exact items described in the inmate's recounting of Steven Avery's confession were found where the inmate said they would be found – meaning the confession was true. Steven Avery IS guilty. They won't care that parts of the confession show it to be a lie, and they won't care about anything Zellner would have to say. Public opinion would keep questionable judge's rulings away from public scrutiny or criticism and deflect attention away from any LE wrong doing – after all, they did put a murderer away. Kratz would be promoting his book and, in his mind, be seen as a hero again. It also potentially would be detrimental to Zellner's case in other ways. I imagine more than several people have come forward based on the fact they believe Zellner would undoubtedly uncover the truth, and if they perceive her chances becoming slim, they might change their minds about testifying. All we can do at this point is have faith in Zellner's abilities and pray it doesn’t go down this way.

I think the state knows it looks bad for them, BUT I think that they know it would be more in their interest to just throw one or a few of the lower officers under the bus to take all the blame for the frame up. They will try to use the PR smear campaign till the very end, but IMO they end up looking more desperate than genuine even to the non informed public.

Basically the only thing they could have done was to switch out the samples with blood taken from SA at the time of the arrest in 2005, which would also contain EDTA. They could remove it, but they also gave her the car cuttings from the RAV. They would have had to make new cuttings from the fabric to do this.

The regime in Calumet has changed since the trial. Hopefully the new people in charge wouldn't have allowed this to happen to the evidence because if done and proven could drag them into this mess as well.

If the top in charge see this is a sinking ship I think they will just let the fall guys take all the blame. Those fall guys should be scared, really scared, including the non LE that look like they had a huge role in the mess.

Besides, where will they get the DNA evidence from? I'm sure KZ hasn't allowed them to take any blood samples from SA for at least a year plus some. With the ability to age DNA samples, they'd be taking a big risk planting anything at this point.

I've been reading all of the documents specifically the victims statements in the Kratz Scandal from 2010 and I am disturbed beyond measure. I am appalled that the media has only reported a few texts. There were many women who came foward and gave statements, and his behavior goes far beyond just some inappropriate texts. Their stories are very similar as well. There are a few instances where the victims describe an incident that hints at pedophilia! I'm not even kidding. Several also state the bondage comments and how he likes to physically hurt the person he his having sex with until they say the "secret word" for him to stop. I've heard of this practice before and sometimes people die.

I urge everyone to go through these documents and spread it like wildfire. This man should be investigated and, to be honest, I'd like an alibi for his whereabouts on 10/31. The reason I say this is because he has been meeting women in newspaper ads and the internet, giving them a fake name and having sex with them in hotels since as early as 1998. This is so disturbing to me I cannot even finish it all now. I have made screen shots of some of the things I have found appalling. Please be aware this is graphic and disturbing. If you didn't like KK before, trust me, you will loathe him now. If it is possible to hate someone even more I promise you will.

I have to default to the simpler explanation of the two as the simpler explanation is usually the correct one (Occam’s Razor). It is also much easier for me to accept one, rather than multiple planters of evidence for the same reason. A facile explanation would be that all of law enforcement in the area was corrupt, and to leave it at that without providing further detail, but if we implicate Kratz, a person who probably didn’t even know either Lenk or Colborn, we are forced to explain why one or the other would have risked involving the other in highly risky, nefarious deeds. Kratz is the seeker of glory here. He is the one who had the most to gain by successfully prosecuting Steven Avery. Kratz is the one with the chequered past, and a string of highly questionable deeds. Both Lenk and Colborn have always struck me as milquetoasts, Mayberry-esque kind of. That impression could well be wrong, but no one has ever come forward to ever describe them as doing anything remotely like the sort of stuff we know Kratz has done and continues to do. And I would return to this: if Kratz had all of the evidence in his possession, and he had unrestricted access to it, and he had as much time with it alone as he desired, why is it necessary to involve Colborn and Lenk? I’m not saying that I’m right, but I think about this matter a lot, and this is the only scenario that I’m satisfied with. It is the only one that allows me to put all of the pieces together. I have scratched my head about all of this for a long time, and it’s only when I put Kratz squarely in the center of it as the grand puppet master does it fall into place. I think the reason people have trouble seeing it, including myself, owes to the sheer audacity of it all. But speaking even to this point, Kratz’s behavior continues to be audacious. He is an audacious man who does audacious things.

Evans and the kitchen connection, plus a history of lies

One of the biggest red flags in Evans' meandering narrative--and there are plenty--comes as he attempts to describe the physical areas that Teresa, Avery and Brendan apparently wound up amidst the supposed torture, murder and cover-up.

While there are obvious questions about his description of the burn pit (requiring Avery to drive Teresa to it from the garage and then drive the soiled rags to it from his own vehicle despite it being just feet away), I'd like to focus on the kitchen aspect which comes up quite a few times in his story (even if it is obviously just another "insignificant nitpick" according to JWE truthers). Divided sequentially from the order he told them, which also happens to be from least to most absurd.

Bonus at the end relating to his history of lying as documented in court.

Inviting Teresa to the Kitchen

Evan first writes that Teresa voluntarily went into the trailer where "they sat at the TABLE IN THE KITCHEN talking."

Taking this statement at face value, they would had to have walked past the living room (where Avery's desk and AutoTrader records were kept), through the dining room and into Avery's small kitchen. It seems physically implausible for there to be a table in that kitchen, unless Avery enjoyed climbing over it every time he needed to get to anything.

The kitchen has an estimated four feet of walking space edge-to-edge between the entrance and the sink counter (which consumes about two feet of space). Lengthwise, the stove and counter occupy two feet on one side while a living room closet eats up the kitchen space on the opposite side.

Fassbender estimated the entire trailer to be 12-14 feet wide and 40-50 feet long. Austin's "forensic mapping" presentation, which he claims was based on 4,100 measurements, never once lists the trailer or room size dimensions and omits most of the furnishings from the rooms. The kitchen, excluding the stove area and closet area, is about 13-15% the length of the trailer. Measuring via satellite imagery and cross-checking with some of Austin's other on-screen yard measurements gives me a high estimate of perhaps 13x57 for the trailer size.

The closest table to what is described by Evan that I'm aware of would be a corner table in the dining room, opposite the kitchen entrance.

Below are some images of Avery's kitchen to put the size of it into perspective.
Inviting Dassey to the Kitchen

Of note, the criminal complaints against both Avery and Dassey describe how, upon first arriving at Avery's house, "Steven Avery invited [Brendan] into the kitchen area of the residence," where Avery began discussing the rape. The complaints also describe Avery using a kitchen knife to torture Teresa.

If someone were an outsider trying to concoct a believable story based on only the resources available and their creativity, but had no actual concept of the physical layout and arrangement of Avery's trailer, it may seem logical to work the kitchen into the narrative. We have Brendan speaking of it multiple times in his various confessions, it shows up in the criminal complaint, the search warrants speak of seizing many knives from the kitchen including one from a drawer (none of which had Teresa's DNA)...

Brendan showed up at Avery's door and Avery invited him straight into the kitchen. Per Evans, Teresa likewise showed up at Avery's door and Avery invited her straight into the kitchen.
Grabbing the Knife

Let's assume Evan (er, "Avery") meant the dining room table, which is not unheard of. He states that Avery and Teresa were at the table talking when Avery "got up to go to the kitchen counter, that's when he grabbed a kitchen knife out of the draw[er] and then grabbed Teresa by the back of her hair."

If they were seated at the dining room table (the only table I'm aware of), Avery would had needed to get up, walk across the dining room to the kitchen, then across the kitchen to a cabinet drawer to retrieve a knife. He would've had to then walk back to Teresa in the dining room in order to grab her hair. Still not unrealistic, sure, but certainly more involved while allowing greater time to react than if both of them were crammed into the kitchen as implied.

Brendan references the kitchen knife in the kitchen drawer multiple times (at least once also saying Avery went back to get the knife after Teresa was already tied up in the bedroom). Here's an excerpt from the 3/1 interview:

    FASSBENDER: An what did he use to stab her?

    DASSEY: A knife.

    FASSBENDER: Where did he get the knife from?

    DASSEY: From the kitchen.

    FASSBENDER: And what, how big was the knife, show us.

    DASSEY: 'bout like that.

    FASSBENDER: About that big and he got it out of the kitchen. When he went in there, did he threaten her with the knife, did he just go right and do it, what did he do?

    BRENDAN: That he threatened her.
    ...

    WIEGERT: Wh-What about the knife, where is the knife, be honest with me, where's the knife? It's OK, we need to get that OK? Help us out, where's the knife?

    BRENDAN: Probably in the drawer.

    WIEGERT: In which drawer?

    BRENDAN: His knife drawer.

    WIEGERT: And where's that?

    BRENDAN: In the kitchen.

    WIEGERT: Is it probably in there, or do you know it's in there.

    BRENDAN: That's where I think it is.

    WIEGERT: Why do you think it's in there?

    BRENDAN: Cuz he wouldn't let that knife so.

    WIEGERT: Cuz he wouldn't let the knife go. How do you know that?

    BRENDAN: Cuz it was a pretty nice knife.

    WIEGERT: Did he tell you that? (Brendan nods "yes")

    WIEGERT: Did he wash it off or anything or wipe it off or what did he do with the knife?

    BRENDAN: He wiped it off.

    WIEGERT: What did he use to do that with?

    BRENDAN: paper towel.

    WIEGERT: What happened to the paper towel?

    BRENDAN: He burnt it.

As an aside, wouldn't it had been easier for Avery to just take the giant knife hanging on the cupboard than fussing around inside of a drawer?

    Hanging Kitchen Knives

Back to the Kitchen for some Duct Tape and Rope

In the midst of Brendan raping Teresa, which occurred well after Teresa had already died from the previous 90 minutes of rape, asphyxiation and punches to the head, Avery decided to walk back across his trailer into the kitchen to retrieve duct tape and rope. Since Brendan was still raping Teresa, Avery kindly stood outside the bedroom just waiting for him to finish up.

To reiterate: Avery ran to the kitchen and back in order to tape Teresa's mouth shut long after she had already died, rather than taping her mouth shut at any point while she was still living. That doesn't seem like a plot hole at all.

In Dassey's confession, he flip-flops between them using ropes, handcuffs, leg irons and chains at different points and across different days. The original story was that Avery had tied Teresa with ropes in the back of the RAV4. Future versions have them tying her with handcuffs but then removing them and retying her with ropes afterward.

Taking Teresa back to the Kitchen

After all of the raping, choking, punching and slashing of the throat had commenced and Teresa was dead and then bound with rope and tape, they carried her body through the bedroom, down the hallway, across the living room, past the dining room and into the kitchen. It is unclear where they place her in the kitchen, but Brendan was left alone with her as Avery ran out and pulled her RAV4 up "closer to his house by the door."

There are three doors on Avery's trailer. Two of them exit off to the deck from the living room. The third is right next to Avery's bedroom where Teresa was before they hauled her all the way out to the kitchen, and is in closest proximity to the garage. In any case, after Avery got the RAV4 near a door they had to pick Teresa back up and carry her through the dining room and back into the living room to get her out any of the doors, or perhaps down the hallway again to get her out the only door that didn't require them trampling over a deck.

JWE Truthers have reasoned that it makes sense for Avery to have driven her RAV4 to the back of his trailer and thrown Teresa's body off that way to load into the RAV4, so that nobody would see anything suspicious. In any case, Avery then backed the RAV4 up to the front of the garage, leaving it fully exposed as they unloaded Teresa, shot her five times and then loaded her back in and drove around the garage to burn her.

Cleaning Up the House

After everything, they gathered a few cleaning supplies and "cleaned up all of the DNA evidence and blood of Teresa's that was inside of his house in the bedroom and kitchen area of his home."

This statement, and most of the others from Evan pertaining to the kitchen, would make a hell of a lot more sense if describing a trailer home arrangement where the kitchen was right next to a bedroom and between an exit point. But in Avery's arrangement, the bedroom and kitchen are at opposite ends of the unit and the kitchen is two full rooms removed from any exit point.

In an effort to get Teresa back outside after killing her, based on Evans' narrative, Teresa's body had to pass through the bedroom, hallway, living room, dining room and kitchen. Then back through the dining room and living room, possibly back down the hallway and out onto the steps or deck. Yet, Evans specifically remarks that Avery cleaned up "in the bedroom and kitchen area of his home" to wipe away all blood and DNA evidence, while seemingly not being too concerned with the rest of potentially contaminated areas. Then again, we also learn through Evans' work that Avery very quickly called it a night and just went to sleep in the midst of burning a body.

Trailer Home Familiarity

Just a small footnote, Evans himself lived in a higher class Marinette trailer park prior to his arrest and incarceration. The average trailer property in that park is assessed at $50-75k; a far cry from Avery's humble red-painted trailer. It does not seem like much a stretch to conclude that he based his description of Avery's trailer, bedroom and kitchen arrangements on what his own trailer looked like. It seems other trailers in that court do have expansive kitchens more closely arranged near an entrance door.

A History of Lies

Evans has a history of lying and had even made his own family supply false police statements in the past to better himself. (Source 1 | Source 2 | Source 3)

    Evans also admitted to having his daughter and her boyfriend give false police statements. He said had he received three traffic citations he would have lost his commercial driving license needed for his job as an over-the-road trucker.

    He also admitted to destroying Dina's personal belongings and to lying to officers about a traffic accident.

    Evans testified on his own behalf and Wambach felt that benefited the prosecution. "It definitely helped the state's case," he said. "We were in a position to uncover other lies that weren't already documented through testimony."

    In their closing arguments Thursday morning, attorneys for both sides painted Joseph W. Evans Jr. as a hot-headed, possessive loudmouth.

    He said Evans had no problem lying to police - he testified he lied about a car accident so he wouldn't lose his commercial driving license - so there's no reason he wouldn't lie now.
...
    The prosecutor told the jury that Evans' response to damaging testimony against him - including an ex-girlfriend who claimed abuse - is to say they lied. He said Evans also lied about how he lost a finger - he claimed it was in a rifle accident, while his younger brother Michael, in a police interview, said he shot himself because of the former girlfriend.

    He also said Evans gave conflicting stories shortly after the shooting - first saying he was examining the gun when Dina arrived and then saying he was cleaning it. Wambach asked how Evans could have been "startled" when Dina entered his trailer when he clearly should have heard her drive up.

    "The defendant is a cold-blooded murderer," he said. "He's dishonest, selfish, abusive and regularly uses violence to control people and help himself."
...
    Duket said Evans' behavior has not changed in jail - he's got a new girlfriend and threatened to punch anyone who interferes with that relationship; he wrote a letter to his teenage daughter saying he would knock her flat if she touched his belongings in his trailer; and he wanted Dina's body exhumed from her Oconto grave and reburied in Marinette as a final act of control. "Joseph Evans has the character of the lowest order," Duket said.

"You went from selfish and greedy to crazy and psycho. You deserve the worst life ever." -Joseph Evans' daughter.

I'm still in awe that some are trying their damnedest to believe in this fantastical tale spun by Evans that defies all logic, evidence and reason. I now understand why tabloid rags, gossip sites and clickbait stories are such a big business. There apparently exists a certain percentage of the population that eat it all up. This is taking "grasping at straws" to a whole dumber level.

The SAIG crew have endlessly berated Avery and used his "prior acts" of domestic abuse against him at every opportunity, however unproven. Yet, these same people have become sort of cheerleaders for Evans, excusing all of his documented lies and massively checkered, violent and conniving past all because their hatred of Avery transcends all else. Evans' own history of domestic violence seems to far eclipse anything in Avery's world with an endless stream of actual restraining orders, threats of killing women who cheat or disobey, threats to his own daughter, and all kinds of horrendous events aside from the murder itself (one of which included dating an eighth grader for 18 months and allegedly grabbing her hair and smashing her head into his car door during one of his violent bouts).

But above all else, the most sickening part of this ordeal is that Teresa Halbach's family ONCE AGAIN gets to learn even more heinous claims of what else supposedly "happened" to their loved one in the moments before her death. It wasn't gruesome enough to be told with no supporting evidence by law enforcement and the media that she was kidnapped, stripped, chained up, repeatedly sodomized, stabbed, slashed across the throat, hair sliced off, punched, choked, left laying to die for awhile as her murderers watched TV and finally shot a bunch of times before being thrown into a fire and chopped up. It wasn't morbid enough to reenact the most extreme and unsubstantiated version of Teresa's death based on an overturned conviction, play-by-play on a nationally televised murder porn tabloid show. Nope, now it's time to let Teresa's family know that her daughter was actually strangled repeatedly over the course of a 90+ minute rape and then Avery and Dassey continued having sex with her long after she was dead! Yet, it was Making a Murderer that really defiled Teresa's legacy and hurt the family, right?

On Thursday, 03/09/06, at approximately 12:50 p.m., I (Inv. GARY STEIER of the CALUMET COLTNTY SHERIFF'S DEPARTMENT) spoke with RONALD F. RIECKHOFF telephonically. RONALD provided a telephone number of 715-213-2524. RIECKHOFF wanted to contact the CALUMET COUNTY SHERIFF'S DEPARTMENT to speak with Inv. WIEGERT reference the AVERY case.

RIECKHOFF indicated he had seen the news in which inmates had been telling the police that AVERY had shown them a torture chamber on a piece of paper. RIECKHOFF indicated he was in prison with STEVEN AVERY in STANLEY PRISON in the Wausau area and had spoken to STEVEN approximately 20 times. RIECKHOFF indicated he was in Unit 3 and AVERY was in Unit 2, but he would talk to STEVEN AVERY in the recreation field and in the prison library. RIECKHOFF indicated STEVEN hated all women and would resort to the saying about women, find them, feel them, fuck them, forget them.

RIECKHOFF provided his correction inmate number of 008456-4 and stated he was a car hauler and would be willing to talk to STEVEN AVERY's brothers reference the incident to get some information for the police. RIECKHOFF indicated he had been in prison with STEVEN AVERY in what he believed the year 2002. RIECKHOFF was unsure of the date when he had been released.

RIECKHOFF also stated he had been in contact with District Attorney KENNETH KRATZ and was now attempting to speak with Inv. MARK WIEGERT reference the investigation. I took RIECKHOFF's information and stated I would be in contact with Inv. WIEGERT reference his information.

At approximately 3:30 p.m., I (Inv. STEIER) again had telephonic contact with RONALD RIECKHOFF. RONALD stated he had been in prison with STEVEN AVERY since 2001 and had spoken with STEVEN approximately 20 times while he was in prison.

RIECKHOFF stated he was a paralegal and from time to time AVERY would ask him questions. RIECKHOFF stated STEVEN AVERY had told him he wanted to kill that young bitch that had set him up for the rape when he got out. RIECKHOFF again stated he would talk to STEVEN AVERY in the recreation field or in the prison library. RIECKHOFF again indicated in RIECKHOFF's words, he hated all bitches, he hated all women. RIECKHOFF again reiterated STEVEN's comment to him, I'll find them, feel them, fuck them, forget them. RIECKHOFF believed that STEVEN would threaten people indicating he (STEVEN) thought he was the mafia. RIECKHOFF, however, never received any threats from STEVEN AVERY while in prison. RIECKHOFF reasoned that this was because he was 6'3" and STEVEN AVERY was a little guy.

RIECKHOFF stated, I don't like STEVE AVERY, and also commented on how rowdy his brothers were. They came to see him in prison. RIECKHOFF reiterated the investigators should contact the adult conduct report for when STEVEN AVERY was in prison and check the security file, document nos. 30B or 920's. He did not think the information coming from inmates provided to investigators was accurate because he did not believe the prison guards would not confiscate a drawing. He indicated the prison guards checked their cells three times a week.

RIECKHOFF also indicated he was familiar with the JEFFREY DAHMER case and had smelled something bad in the yard behind DAHMER's apartment. He also told police officers, whom he was friends with, about the bad smell around the area where DAHMER lived. Inv. STEIER, at this time, ended the conversation with RONALD RIECKHOFF.

Both Sides Confident - My One Worry

Both sides tweet and give interviews claiming they aren't worried by the other side; this is natural as no side is going to admit they're worried or are struggling to maintain their stance.

However given that most of the planters/participants in the cover up have stuck around (apart from Lenk, who is sticking close to the border!) and have even started to push the guilty story again in the media, I am a little worried they are not faking confidence and it is more that they remain confident SA will stay behind bars.

What would lead them to that continued confidence? It can only be the evidence. They had years until MAM came out and months and months after it came out to see what evidence would further be questioned other than the evidence JB & DS picked out during the trial.

They could well have switched swabs and manufactured other evidence for the trial, they could have an unknown or unconfirmed amount of sources of SA's blood, assuming SA is right about his blood being taken several times over the years, and there only being one vial present in the taped evidence box. Access to several bloody rags as well.

So the evidence after trial is supposed to be held 'securely' and access documented, but at the end of the day the evidence is still held in the state of Wisconsin. So if the cover up and framing goes as high as Peg Lautenschlager then can we believe that any evidence that has been handed over for testing is actually what was originally tested at trial? They have had time and opportunity to re-manufacturer evidence/samples so that KZ may never get to test the most important samples that would prove SA's innocence. Perhaps KZ is faking confidence when really it's a war she can never win because it's not a fair fight.

In his amazingly detailed (and bogus) snitch letter, JWE provides enough detail for a treasure hunt! Who can find the state’s stash first? If we don’t find it first, the state will no doubt produce it.
Steve had went on to tell me that he had taken some more items such as clothing of his, two rings of Teresa's that she was wearing at the time that he had killed her and a necklace that she was wearing as well that he had taken off of her, and also the kitchen knife and the shovel that he had used up to the Crivitz, WI area, which I believed he stated and said that it was in the high falls area, in the town of Stevenson. Steve said that after he had gotten rid of the items at some camp up there, that he was on his way back home to Manitowoc, he had been pulled over by a Marinette County Shriff deputy…
So the location clues we have are:

    Crivitz
    High Falls
    Town of Stephenson (corrected spelling)
    Marinette County
    some camp up there

This can only be one place. That is Twin Bridges Park Campground. Described as follows: Twin Bridges Park provides a 62-site campground on High Falls Flowage of the Peshtigo River in western Marinette County.

Not too long ago, I created a post about a fantasy treasure hunt assuming that LE might just be dumb enough to actually plant those things that JWE alluded to in his very detailed snitch letter.

Well it appears that Kratz and the other planter team members (who have a lot to lose) may actually be going through with this! Today, on Crime Watch Daily, Kratz is asked about the snitch letter. Here’s what he has to say:

Host: Could this letter in some way affect Brendan Dassey's appeal?

Kratz: Probably not the appeal. Unless there is a piece of physical evidence. His appeal is going to rise or fall on whether or not that confession is going to be upheld by the federal court.

Host: Is it possible that there is some new information in this inmate informant letter that's been made public?

Kratz: Absolutely. We didn't find a knife or any other cutting instrument that at least Brendan said was involved. I've got a sneaky suspicion though that law enforcement will be looking into the new allegations that are made in that letter.

There is just a little too much foreshadowing by Kratz going on here. Back to the Treasure Hunt. JWE listed what we should be on the lookout for:

Let’s start with the jewellery: two rings and a necklace. It’s common knowledge that TH did NOT wear any jewellery. Have a look at these photos:

There isn’t an earring, a necklace, a bracelet nor any rings to be seen. Does it make any sense that TH would suddenly feel the need to don at least three pieces of jewellery to take some pictures of old cars? Obviously not, but it would be easy to grab some of her jewellery from her home.

Now how about that shovel. Wouldn’t it be great if it came complete with SA fingerprints? The shovel taken as evidence is clearly on display in this photograph of the burn pit:

So now we just need one of Steven’s Flannel shirts (taken from his trailer’s bedroom) and a (knife taken from his trailer’s kitchen) to show up along with the shovel and the jewellery.

Are these guys really dumb enough to think they can pull this off?

    Ken Kratz is a piece o’shit who used his authority to pressure crime victims into having sex with him, hey, maybe he killed Teresa Halbach. After all, he wasn’t goofing around either. Incidentally, does he have an alibi for the night of October 31, 2005? See how that works?


    If Kratz was happy enough to conjure up the harrowing torture, rape, massacre story to the media, her family and in essence the public being told every fibre of unsubstantiated lies then naturally he will have went to town with LE to make sure if they threw enough mud then some would stick. We know the type of guy Kratz was, we learn it at the end of the doc: a determined predator who cares not for what physical evidence presents rather what his disturbed mind can create. Pagel, it seems, was a sock puppet happy to be part of the horror show. I don't know how anyone can be comfortable with this investigation knowing what the documents and transcripts show.


    Kratz wrote the State's narrative on how Teresa was murdered. He sent investigators to coerce specific answers to specific questions from witnesses. Kratz wrote the script for the trial. He thoroughly coached every witness and rehearsed their answers to his questions. If he had to, he got them to abandon their original statements. He directed them with subtle signals while they testified. Read his opening statement and closing argument. It was his story that was told at Avery's trial. "The narrative Kratz made up on how Teresa was murdered was his very own perversion!" Which leads to the question, Is Kratz capable of murder?

    It's a crazy case about keeping a mentally ill child in a dog cage. It drew the attention of Chicago, if not a greater audience. MR defended the parents and later left the defense ranks to become a district attorney in Manitowoc County.

    How close do opposing counsels get during a high profile law suit? Would MR look to KK to help him learn the ropes of prosecuting? Was KK tightly tied to the Manitowoc cadre, facing $36M in judgement and lost reputations? Was KK already a member of the good old boys club?

    Does anyone else have evidence tying KK to MTSO or the Manitowoc indicted prior to November, 2005? Sleuthing minds would like to know!

    Dave Begotka said he saw Avery on Halloween 2005 (Monday), but he may be mistaken. It could have been the day before if that was when kids went trick-or-treating in Two Rivers (Sunday). Avery would have been driving his truck that day because he used it to tow a snowmobile on a trailer from the family cabin in Crivitz to the Avery property in Manitowoc County. Dave said he saw Steven at Patsy’s Hwy 42 Mobile Mart in Two Rivers. "He’s driving a dark colored larger Ford truck. He’s wearing a red and white jacket. He seems to be filling gas cans (the red plastic type). There also appears to be a blonde female with him."

    Blaine was with Steven that Sunday. He is blond and small in stature and had longish hair at the time, so maybe Dave thought Blaine was a women.

  6. Why My Theory About Kratz Is Not As Absurd As You Think (Excerpt)

    Though it is commonly believed that that evidence was planted, I’ve never heard the theory that it was Ken Kratz who was directly involved.

    So, for those on either side willing to hear me out, I would like to explain why it is not as far fetched as it might seem, and I would like to begin by taking a deep dive into what we all must acknowledge to be true about the character of Ken Kratz..

    Ken Kratz has passed that critical threshold of evil by creating two distinct identities, and the masks that correspond to each. It is really this which I find most disturbing about him, and why I think he’s capable of deeds far more wicked than is commonly supposed even though, as it stands, people sense that he exudes evil.

    Now, I should make it very clear from the outset that I do not think Ken Kratz is a murderer. I do not think that he harmed Teresa Halbach or anyone else, necessarily, in any way.

    But I do think he is very manipulative, very intelligent, and therefore very dangerous. People who study predators know that they are always looking for weaknesses, ways they can carry out their deeds among a vulnerable population outside the glare of scrutiny. It helps if they are able to take on the outward appearance of a figure to whom an individual in society would readily offer trust: a coach, doctor, priest, have all been used to great success in the past by sexual predators.

    Kratz achieved this in the less common role, for a sexual predator, as a prosecutor, but he chose well because there are no laws in Wisconsin that prohibit a prosecutor from trading his office’s willingness to move forward with a case for a coerced sexual act. After the downfall of Kratz, there probably still aren’t any laws which address this, although there should be Too bad politicians in so many places are trying to figure out ways to make life more difficult for the poor, or concerning themselves with bathroom door signage, instead of this trying to figure out ways to prevent this sort of thing. I digress.

    A distinction is called for here. There are men of low character who are willing to use leverage to get sex from women. The casting couch is the classic example, but an unethical casting director isn’t being paid by society to protect women who have become the objects of domestic abuse. Not getting a role for a part if one refuses such solicitations does not impinge upon one’s welfare and safety the same way that not receiving adequate and due recognition from a prosecutor when physical abuse has occurred and remedy is sought. One can be a major disappointment, but life goes on. But in the case of abuse, sometimes life does not go on.

    Kratz made it clear to his victims that he would withhold the protection that his office had to offer if he did not receive the sexual gratification he sought. This means one important thing: despite his mask of concern, in reality he was callous to their welfare and safety. The victims who came to him for help were just vulnerable individuals who Kratz used to re-victimize.

    If it ended there it would be bad enough, but Kratz went one diabolical step further by involving himself in victim advocacy that he hoped would outwardly make him appear to be the ultimate protector of victims. In this role, he actually became the lead chair at Wisconsin’s chapter of Crime Victims United, and in the United States, to be the lead chair in such a group gives you a very high-profile. The reason this is so is because crime victims have a lot of self-advocacy which they have been able to successfully roll up into political clout.

In the minds of people who take on the responsibility of guarding the hen house in order to devour the chickens, the thrill is derived from the risk, the pleasure from the power to manipulate and fool others by their superior wyles.

    Is a man who has gone to the trouble of becoming the lead chair for a victim’s advocacy group so he can secretly derive more pleasure from sexually preying on helpless victims of abuse, the very same kind of man who would derive a similar sort of pleasure by prosecuting a man who he had planted evidence to frame? If we know he did the first, why should it be so difficult to believe he did the second?

    When the sexual misadventures of Ken Kratz finally did come out, and when he finally stood to face the consequences for his abuses of power, he made it a point to remind everyone of all that he had done for victims. It appears that he had deluded himself into thinking that his position in that group would extend the obfuscation which existed over the nature of his character.

    When I tell people that I think it was Kratz who came up with the idea of planting evidence; that the evidence against Steven Avery was being held in Calumet County, and that Kratz had unrestricted access to the evidence room as the person in highest authority in the Calumet County’s DA office; when I try to carefully explain those things which I’ve explained here which cannot be denied, I am met with ridicule and disbelief.

    Even after all that has happened, Kratz is still wearing the mask, and people are still having trouble seeing through it. Sociopaths are charmers, and they’re secutive. There’s a reason they’re effective.

    I do not have a video of Kratz planting evidence, obviously. I wish I did though, because if the truth is that he did plant, I don’t expect many people to believe that. It’s too far-fetched. The idea that there is an evil mastermind pulling the puppet strings also seems fantastical, so I know there is an uphill battle. But the evidence of Kratz’s character does exist, and it cannot be denied by anyone. To interpret the aftermath of what happened in Manitowoc County on October 31st, 2005 demands that we acknowledge who Kratz is, and what he is truly capable of.

    One in particular starts on page 15. The time period was between Thanksgiving and Christmas 2009. The victim first met Ken Kratz five years earlier when she got in trouble for shoplifting and Ken Kratz was the DA on the case. He charged her out, and she didn't have any contact with him until he called her out of the blue five years later. She had no idea how he got her phone number. Ken Kratz told her that he and his wife were getting a divorce and he wanted to talk to her about things. She gave Ken Kratz her address and he came to her apartment. While he was in her apartment, he ate cheese and crackers and drank four or five beers from her refrigerator.

    I want to know what every one thinks about TK and DV, how deep do you think they are in to framing these guys?

    I believe the are up past their eyeball's. While we didn't really get much information about DV, we do know that in 1988 or 89, he suddenly resigned is position as DA in Manitowoc, moved into a private practice with a few other Attorney's IIRC.

    TK is a different story. He hated Avery. In fact it was suggested that TK was furious over the towing contracts the county had with ASY in the 80's. There were other competitors to consider, one that was employed by the department..

    After the Civil Suit was filed I personally believe Avery was watched. I don't mean like ninja's creeping around, but I believe MTSO kept close tabs on him. AC was a regular visitor as he was good friends of CA/EA.

    When the depositions began, TK tried to take steps to protect himself financially. He tried to get his homeowners insurance company to agree to protect him financially. They filed several motions pointing out their policy did not cover civil liability.

    TK also tried to get the Judge to limit or shield him from certain questions in his upcoming deposition. That motion was denied:

    So his insurance company said, NOPE, your policy doesn't cover your "on the job" fuck up. A Federal Judge said, NOPE, you WILL answer all questions asked during your deposition. What's a good ol boy former Sheriff to do? His ass was in a ringer and he knew it.

    Thanks to the allegations of the shenanigans Avery had claimed, Peg L the Attorney General at the time sent in her troops. They asked all kinds of questions that became public record. Of course Peg said, oh everything's fine, you all are doing a great job. But that public record came back to bite them in the ass.

    MR, GK, and others really spilled the beans. Bottom line, those depositions exposed several lies. TK's was scheduled for Nov 10th ,2005 and DV's Nov 15th 2005 IIRC.

    Luckily for them, Avery wasn't gonna let that happen, right? He decides to go full on horror flick character, except of course not leaving one bit of dna in his trailer or garage. But he is a master criminal, leaving only his and JS's dna. This is one smart criminal. /S

    No way TK was going to sit across the table from Avery and answer questions. Wasn't going to happen. Up past their fucking eyes, like I said.

    Oh, and just one more thing about those depositions. Lenk and Colburn weren't named in the lawsuit at the time, but Colburn was concerned he would be added. At trail, day 7, page 163. Strang is questioning AC:

    These odd questions are exactly the reason I've always believed they found the vehicle off the Avery property a day or two earlier. They find the vehicle, but no body, somewhere nearby (quarry?) and decide to move it to the salvage yard because they believe SA did something AND they believe they will find the body and/or the crime scene there if they can just get a warrant to search it. Planting the RAV gets them their warrant.

    To their surprise, they don't find a body or the crime scene, but a day or two into it they find the cremains a short distance from where the RAV originally was - this was possibly the 6 hours (!!) of investigation on a possible grave site by Lenk and Colborn that turned out to be a "rotting stump" or "bag of peat".

    Now they're in a sticky situation because they've already moved the RAV to the salvage yard. They decide they're going to have to move the cremains (and burnt devices) also so they can create a coherent storyline. The spare key gets thrown in so they have a direct link to SA in his personal space and to make sure no one looks too closely at the odd circumstances around the vehicle discovery and the collection/documentation of the cremains.

    Apologies for rambling on a bit but those two questions have always made me suspect that the RAV was planted for the sole purpose of getting onto Avery property to find the body and the crime scene, which turned out to not exist there.

    If all the CASO reports were copied into one big Word document, what would have prevented someone from editing this file to change one or more of the reports?

    Shouldn't the CASO reports have the date the reports were written, like the DCI reports?

    I agree. I think all the deputies/detectives/investigators with CASO were told to copy their reports onto CD so that they could be given to Kratz in electronic format. Then Kratz copied and pasted the reports into a Word file and edited them to fit his narrative. Who was going to stop him? He had prosecutorial immunity. He had free rein.

    11/8 is an important date because of the amount of evidence gathered that day. But, 11/7 is when most of the plotting and planting happened that led to the flurry of evidence finding on 11/8 (The exceptions being the Rav4 2 days before and the key the day after).

    Let's look at the timeline of 11/7. I'll point out where plotting/planting is likely to have occured. This is a work-in-progress so please feel free to add, amend, correct the record. (All information is sourced to Crime Scene logs and CASO report.)

    7:16 AM Tyson/Lenk/Colburn check in and begin searching the trunks of cars not already opened the day before. Starting at Avery's trailer, they worked their way down past the Janda trailer through the fenced in area and into the Blue building. This includes everything in between SA's and Blue Metal Building. This is the exact area the license plates were found the next day.

    COLBURN/LENK PLOT TO PLANT LICENSE PLATES

    9:30 AM The 1995 Monte Carlo was located in the Big Blue metal building and searched by Tyson, Lenk, and Colburn. Colburn used a screwdriver and crowbar to make entry to the vehicle. (We know he is carrying around a crowbar and screwdriver).

    9:58 AM Immediately after searching the Monte Carlo in the big blue metal building, they went into SA's trailer to retrieve the serial number from SA's computer (at Weigert's request). They were in SA's for 10 minutes.


    PLOT TO PLANT SIGN AT AVERY's. (If this is indeed necessary, this is when they could have done it. They plant it the next day with Colburn photographing and Lenk planting?)

    10:07 AM Colburn/Lenk/Tyson left SA's and went to Janda trailer to collect weapons.

    10:35 AM Dedering receives call from Weigart about suspicious area at the end of Kuss Rd.

    10:45 AM Dedering arrives at Kuss Rd. and speaks with retired deputy Bushman who was leading a search group in the area when they found the disturbed soil.

    10:58 AM Colburn/Lenk/Tyson were called to Kuss Rd. (presumably by Dedering or Wiegart).

    11:06 AM Colburn/Lenk/Tyson leave Avery property heading to Kuss Rd.

    11:20 AM Fauske, K-9 and Reimer begin search. This eventually leads to a strong track to Kuss Rd from red house trailer (sometime between now and 5:29pm when she leaves)

    12:46 PM Colburn/Lenk/Tyson return to Avery Property according to crime scene logs.

    12:50 PM Dedering, Faasbender, and Bushman return to Avery’s from Kuss Rd. site. Bushman is a retired Manitowoc cop and civilian searching for Halbach, he found the Kuss Rd. excavation site and called it in. At this point, all the main LE suspects have arrived and are near one another.

Colburn and Lenk helped load these barrels the day before 11/6. Mutzsak unloads Barrel #4 at Avery's and collects the Cell Phone barrel in front of SA's trailer.

    3:39 PM Baldwin is relieved of her post at cell phone barrel after Matuszak collects it.

    3:51 PM Fauske, K9 and Riemer leave Avery property

    I woke up from a dead sleep with this thought burning in my brain.

    He wouldn’t have put her in her own car. This is the last thing he would do. If anything, he would be careful not to place evidence of her being hurt or dead into her own vehicle. He would not have used a large vehicle to move her a few feet to a fire pit. He would have not used a large vehicle to transport her from the garage across the yard to a fire pit (murder theory 2.0). He would not have used her vehicle to move her to a location a few feet from his own front door, and then deposit her there, hoping the busy traffic of a Halloween afternoon would not result in his discovery.

    All the facts that screamed evidence of the true story, were manipulated, jammed and contorted, until they were nearly haphazardly rearranged into the prosecution’s narrative.

    There are facts in this case that we know with certainty. Kratz is a liar. Kratz is unethical. These facts we know. We know that the prosecution narrative was constructed by an unethical liar, who may or may not have been high on opioids when he was in a position of authority, which gave him free rein to go completely off the rails. I think that’s what he did.

    We also know that the sheriff department employees despised Avery. Avery was suing them for millions, and they were completely guilty and without a defense, so they certainly felt trapped.

    People within that department had allowed Avery to sit in jail for nearly twenty years, when they knew he was innocent. They knew all about Gregory Allen. They rebuffed efforts by others to bring evidence of Avery’s innocence and Allen’s guilt to their attention.

    The sheriff stowed a letter in a safe, like his “get out of jail free” card, if he ever needed it.

    The dubious people in this case have all been on one side—the prosecution.

    Why would he put her in the back of her own car?

    He wouldn’t.

    That was my very next thought when I first woke up. The vehicle might have been used back at that turnaround, where witnesses spotted the Rav4. It makes much more sense. The purpose of placing her in the vehicle was related to the circumstances, that there was no other way to conceal her. Like at a turnaround off the road.

    You know how your mind does housekeeping while you sleep? Things that are puzzling you when you go to sleep are sorted and reorganized. It's part of the healing process of sleep.

    So, no surprise, this was what my brain was trying to reorganize or explain. It is possibly one of the most disconcerting aspects of the prosecution's narrative. It truly makes no sense (because it didn't happen).

    I've always focused on the evidence, because I'm familiar with this kind of analysis. It's actually more the case in accounting than in law. In accounting, you start out with a pile of seemingly unrelated papers. You reorganize the pile, typically for hours. Then when you're done, you've got a magnificent set of financials that tells the entire story. I love this kind of work.

    Sometimes. I'm a bit of a nerd when it comes to truth. When someone lies it puts my brain on tilt. I keep going back at it, like "you said this, but I see that. Wait—there's also this, that and the other." And so on, until the facts work for me (which they don't in this case).

    This is super long. I'm sorry, but I think I've picked up on something accidentally while writing this.

    It is right below the ****** if you scroll down, I'm not trying to bury it. Skip ahead if you want.

    First I wanted to write about how daring Steven would have had to be in order to pull this off.

    October 31, 2005. Halloween day. He would have woken up, putzed around the salvage yard doing whatever. Supposedly he had the day off. How do you have the day off when you live at work? The salvage yard wasn't closed that day which means at any given time there could be any number of unknown customers driving in, walking in and hanging around the shop, the office and the cars. This is something that he had no control over.

    Barb's van, the one being photographed by Teresa, was sitting out in plain sight. It was not hidden behind a building, inside of a building or parked in the back of the property, far away from the entrance and possibly out of view from customers. No. It was on the dirt road, out in plain view.

    They said that Steven tried to hide his identity by using Barb's name for the listing, as if he was luring Teresa to an unknown place. The question then is, if he was trying to hide his identity, then why did he call Autotrader, as himself and specially ask for Teresa to be sent. Not exactly a real covert attempt at anonymity there is it?

    She gets there eventually to take the picture. He was no way of knowing when she'll get there, just an approximate window which would make planning anything nefarious pretty difficult. So she gets there and this is where the story goes off into the abyss.

    Bobby claims he saw her taking the picture and apparently walked toward Steven's trailer. He took a shower, came out and the RAV4 was still there, but Teresa was not. He left to go hunting and that was the end of his observation.

    So, what happened next? There is a gap here in Kratz's story isn't there? In Avery's trial, Kratz successfully had the judge remove Brendan from the story, but in Brendan's trial, Kratz jumps from what Bobby saw to suddenly Brendan is coming down the driveway from getting off the school bus and he hears Teresa screaming. Kratz says Brendan approaches Steven's trailer and is greeted at the door by a sweaty Steven who ushers Brendan into the trailer and invites him to take part in raping and stabbing Teresa in the bedroom where she is tied up.

    1. Let's pause there for a second. Think about this scenario. Kratz would have us believe that Teresa is completely naked, handcuffed to the bed by her ankles and wrists, and she is screaming for help.

      Now, a question. How do you suppose that in less than an hour of Teresa arriving, about 2:45pm to Brendan arriving about 3:30pm, Steven is able to strip Teresa down naked, then handcuff her two wrists and two ankles to his bed, go back outside and hide her RAV4 somewhere, come back in the trailer, rape her without once ever thinking to gag her so she can't yell?

      If she was screaming when Brendan got there, then she was likely still screaming when Steven would have been outside hiding the RAV4, after he handcuffed her to the bed.

      Again, let's remember, the salvage yard is open for business and people are coming and going. There are customers, the delivery guy and of course members of Steven's family that could pop in unexpectedly at any giving time. Brendan is out of the equation in Steven's trial, so what does Kratz suppose Steven would have done if someone else heard her screaming and came in? "Hey, who's that tied up to your bed". "Oh, that? That's nothing".

      Now, lets get back to the point where Bobby claims he left and the RAV4 was still there, without Teresa. If Steven got Teresa into such a compromising situation, exactly how did Kratz suppose Steven did that? There wasn't any testimony that connected the time Bobby left and the killing. It was just glazed over.

      In fact, in Kratz's opening statement to the jury on day one of the trial, he says this:

      "You are going to hear from Bobby that when he left 15 minutes later, Teresa's SUV was there, but Teresa was nowhere to be found. You are going to hear that Bobby Dassey was the last person, the last citizen that will have seen Teresa Halbach alive" (this might be the only truthfull thing Kratz has ever said).

      Kratz gives his opening statement as if it's just a summary of what he's going to eventually talk about, but really he presented his entire case that morning and took so long doing it, (deliberately) that it was lunch time by time he finished.

      He never really revisited a step by step scenario about Steven tying Teresa up, stripping her naked, handcuffing her to the bed, raping her, stabbing her, shooting her, burning her.       Something just struck me funny just as I was typing this.

      A couple of years ago, I first made a post about Scott Bloedorn when he was questioned by Wiegert. In the report, Scott was asked about when he last saw Teresa. Scott made the comment that he remembered on that Tuesday, (November 2nd), Teresa's car was "nowhere to be found".

      To me, the phrase "nowhere to be found" sounds like he searched all over for her car. It wasn't like he simply said, "Yeah, now that you mention it, I noticed Tuesday that her car wasn't outside" or "It wasn't in the driveway". Using the phrase "nowhere to be found" sounds like a actual effort was made to locate her vehicle. It sounds like he actively searched for it in many places and came up empty. I think this shows that he already knew she was missing perhaps and so I questioned, whey did it take another day before someone said anything, supposedly.

      A lot of people agreed with me, but others disagreed that the phrasing was important. They said it was perhaps just Wiegert's interpretation of of Scott's statement. Maybe those were not Scott's words, but were just Wiegerts words, paraphrasing what Scott said. OK, maybe that's true.

      However, I just noticed a line from Kratz's opening statement, which I pasted above. In talking about Bobby Dassey and when Bobby was leaving to go hunting that afternoon when Teresa was taking the picture of the van. Kratz said:

      "You are going to hear from Bobby that when he left 15 minutes later, Teresa's SUV was there, but Teresa was nowhere to be found."

      Sorry folks, but this made my skin crawl. That is not a common phrase to say. Using that phrase in the context of Bobby Dassey, on his way out of his house to go hunting, does not make sense. It implies to me that Bobby actively looked around for Teresa as if he was worried about why he only saw her car and not her. This would show some characteristic of awareness or concern on Bobby's apart that he was suspicious of Teresa's absence. Clearly, based on his need to go hunting, he wasn't that concerned about her well being. He left the property after all.

      So, what do we have here? Do we have an example of proof that Kratz in fact the orchestrated this entire framing? We know that none of the LE were really good at writing reports until days later. Maybe it was not laziness, maybe it's simply to avoid tripping over their lies. Maybe Wiegert went out to interview Scott Bloedorn that day, Scott said he didn't see Teresa or her car. Wiegert reports back to Kratz and Kratz says to him, "Mark, write it like this. Say that Scott noticed on Tuesday that her car was 'nowhere to be found'. This sounds more serious. This says Scott, her roomate, is "positive" he didn't see Teresa's car. This helps make Teresa being missing more powerful to the jury."

      Kratz then uses the same tactic at trial. By Bobby saying "Teresa was nowhere to be found", it removes doubt. It makes it seem like Bobby took notice of the entire scene outside of his house and he's 100% certain Teresa was not out there. Otherwise, if we have Bobby simply saying, "I didn't see her when I left", it doesn't sound as dire. It could be that maybe she was behind the van, or was kneeling down and tying her shoe. There are a million explanations of where she could have been at that moment, but none of them necessarily dangerous to her well being. "Nowhere to be found" is used deliberately by Kratz, because it evokes an image to the jury that Teresa was in danger.
