The Photo of Teresa Halbach and the RAV4


The photos above of the RAV4 found at Avery Auto Salvage were taken by Wisconsin State Troopers after it had been taken into custody by the Calumet County Sheriff's Office.

Over the span of almost 2 1/2 years the RAV4 went from first being DARK GREEN (Halbachs-11/3/05) to being more BLUE than GREEN (Pam-11/5/05) to being DARK BLUE (Wiegert-11/5/05) to being GREENISH BLUISH (Wiegert-8/9/06) to being BLUE and certainly not GREEN (Kratz-3/15/07). DISPATCH: Do you know what she drives?

KAREN HALBACH: She drives a RAV4, Toyota. It's a dark green color, kind of.

DISPATCH: Did you say red or dark green?

KAREN HALBACH: Dark green.

Bob Lemieux Toyota in Green Bay confirmed that the RAV4 they sold Teresa Halbach was one-tone, dark green (six-minute mark in video below), like the one in the images above.

Wisconsin DOT generates a title and sends it to the owner, which was Teresa Halbach's financing company in Atlanta. So the original and actual title to Teresa's vehicle was held by Toyota Motor Credit Corp. The DOT would have a record/copy of the title.

There is a reason the registration and insurance were missing from the RAV. Nobody ever thought a second RAV was an option back then. Erie, Teresa's insurance company, would have her VIN in its records. Kathleen Zellner contacted Erie so she has a copy of Teresa's information.

The RAV4 at ASY and the WSCL is the wrong color. It’s blue (and two-tone), as all of the photos seem to confirm, and as it is also reported in the search warrant.

Teresa Halbach’s RAV4 is clearly described as “dark green” in the missing person flyer that was created by her family.


The blue RAV4 at ASY (and at the WSCL in Madison) isn't the green RAV4 that Lemieux Toyota in Green Bay sold to Teresa.

In addition to the front-end damage on the blue RAV4 found at ASY and processed at the WSCL, Ertl testified at Brendan Dassey's trial about a dent hidden behind the Rambler hood while the RAV4 was at ASY on 11/5, yet not one photo exists which illustrates this dent in the rear quarter panel (all cropped off right where it counts). Whose RAV4 did Dean Strang and Jerry Buting inspect?

Kratz was certainly coaching his witness to always use the term BLUE or BLUISH GREEN. This is strange considering that, again, not a single person said the RAV was BLUE or a BLUE GREEN color prior to Pam Sturm saying, "It looks more blue than green." [Source]











Rav4 Tyre Comparison is Very Telling. LE What Did You Do?

I was cleaning my car today, and as I was cleaning my tyres, I realised that in one photo of Teresa Halbach’s car the tyre looked clean compared to the others. So I had to come in and check out what I was thinking.

The photo PoG [Pam Sturm] took of the left hand side of the car when she found the Rav4 showed a fair bit of the tyre, and on enlarging that, I saw all the dirt embedded in the grooves of the tyre, but the flat part of the tyre [the sidewall] was actually quite black still. Not very dusty at all.

I tried to find a right hand photo of the Rav4, but there doesn’t seem to be many, but I found one; and after enlarging it, there doesn’t seem to be any dirt embedded in the tyre or much dirt at all.

So I’m thinking the Rav4 must have been driven, left hand side, partly through wet, muddy, damp water or something, and enough for it to be embedded and stay embedded and the right hand side of the vehicle must have been on dry, hard dirt or road.

This also made sense when I saw dirt splashes on the left hand side of the vehicle but not the right.

Photos from the crime lab, show this front left tyre is clean. No embedded dirt anywhere. The left hand back tyre seems to be the same as it was when found at ASY, but the front tyre is way different to that of the tyre where the Rav4 was found.

Note the position of the tire stems in the photo comparisons: the stems are almost in the exact same position in the crime lab photo but not in the Pearce photo. This cannot be due to a tire rotation because, had the tires been rotated, the rear tire on the driver's side would have been rotated to the front of the vehicle, yet the three wheel weights are at the same position on the rim of the rear tire in the photo taken by Pearce as they are in the photos taken at Avery Auto Salvage and at the Wisconsin crime lab (the weights are hard to see in the crime lab photos).

The images below are a comparison of the wheel/rim of the RAV4 in the photo taken by Peace of Teresa and her RAV4 and the wheel/rim and tire of the RAV4 at the salvage yard. They appear to match because in both photos there are three weights to balance the wheel in the exact same spot on the rim in relation to the tire. 






Also, in a photo of the RAV4 at the lab, the weights appear to be in the same location on the rear driver's side tire.



Kathleen Zellner in her motion for post-conviction relief filed on June 7, 2017:
Northwest of Mr. Avery's trailer, between the Avery property and the cul-de-sac at Kuss Road, there was a metal post protruding approximately 2 ½ feet from the ground (photo showing post, P-C Exhibit 51). When the killer attempted to plant Ms. Halbach's vehicle near Mr. Avery's trailer, he collided with this post, causing the damage to the front end of Ms. Halbach's RAV-4 and knocking out the driver's side parking light. He recognized the need to retrieve the parking light because leaving it, or any pieces of it, in the field would show the RAV-4 left the Avery property, contrary to Mr. Kratz theory that the RAV-4 never left the Avery property.


A rusted metal post (bottom center in the image above) could have caused the damage to Halbach's RAV4 (in close-ups of the RAV4, you can see red and pink marks in the damaged areas). The primary point of impact could have been the area on the bumper directly below the head light assembly. And as the vehicle moved forward from the primary point of impact, the rusted metal post scratched and dented the area to the right of the head light assembly. The secondary point of impact could have been the area below the blinker light assembly, which caused the blinker light to snap/break and pop out.
The RAV4 at Avery Auto Salvage was tarped almost immediately after it was discovered. Nobody mentioned any damage on the vehicle or having seen any blood on the inside or outside. After dark, the tarp was removed and the RAV4 was loaded onto an enclosed trailer. By 9:30 p.m. it was ready to be transported on the trailer to the state crime lab in Madison.











RAV4 damage:
  • Broken left front turn signal light was placed in the cargo hold after the accident.
  • Diagonal parallel creases in the left front bumper near the turn signal. Two small puncture marks at top of diagonal creases.
  • Puncture damage to left front bumper at corner of car. The puncture is flared out, perhaps because a chain or cable was used to pull on it, or perhaps due to an object being trapped under the bumper when the car was backed away from what it hit.
  • Front left wheel well liner was likely dislodged and removed as a result of the accident. Pins that hold it to the front of the wheel well were likely popped out. The wheel well liner would have created interference for the tire.
  • A strange object wadded up above the front left tire. It is perhaps the wheel well liner, wadded up, foam created by the AirUp tire sealer and inflator found under the front passenger seat, or wadded up duct tape holding something in place. There also appears to be a curved part in the wheel well that may be part of the liner or a foreign object.


What is the shapeless brown blob is in the wheel well of Teresa's RAV4 (photo above)?

There has been much speculation surrounding this shapeless mass. Some thought it might be a wasp's nest, others thought it might be a big ball of tape, and still others thought it might be a tow strap or even limestone caught up under there.



It could be tire sealant.

When the RAV4 was searched, they found a can of AirUp Tire Sealant.

Air up tire inflator and sealer, bearing property Tag-8073 was collected into evidence (CASO report, page 426).

If Teresa's tire had a substantial hole, the foam would shoot out and pile up until it compresses against the wheel well.

Note that the blob seems to be made up of a long, thick stream of foam. The foam did not adhere well to the dirty and possibly wet tire, but it did adhere to the freshly exposed wheel well. When the RAV4 was moved, the tire broke free but the foam blob remained in place.

Why is this significant?

Someone needed this flat fixed in a hurry. The fix had to have occurred after the wheel well liner was destroyed.

This tire, by the time it got to the State crime lab in Madison, was clean. It may be that the tire was properly plugged and reinflated on the extra long journey to the lab or it may be a different tire altogether.

Was the tire holed in the accident that created all the front left damage or was the tire damaged, thus creating the accident?

Could a chunk of tire foam left behind look like a charred foot?

Most of this could easily be investigated with access to the RAV4.

Why did Wiegert have the RAV4 spare tire cover in 2006 (which, after it was dusted at the crime lab, looked like it was covered with fingerprints)?

Was the spare tire checked? The condition of the spare is important. The RAV4 comes with a full size spare. The spare tire was stored on the back of the car.

The lug wrench was found in the RAV4 and was taken into evidence, but not the crank for the jack. Apparently the toolkit bag, which should have had two pieces (the lug wrench and crank), was not entered into evidence. Is the crank missing because it was the murder weapon?

The AirUp can was found under the front passenger seat. This is the seat where the car jack was supposed to be stored.

There was supposed to be a Toyota factory-provided car jack under the front passenger seat, where the AirUp inflator and tire sealer can was found, and there was supposed to be a factory toolkit in a storage location in the cargo compartment on the driver's side. This kit should have contained the Toyota factory-provided lug wrench and the crank handle for the factory-provided jack.

If so, did she use it? Did she keep it in the vehicle when she wasn't using it? Was it inventoried in the contents of the vehicle? Was it discarded with the bloody floor mat?

The photo above of Teresa Halbach was taken by Tom Pearce (day 1, page 198). In photos above and below, notice what looks like spots where the paint has been scrapped on the rear door (below the handle) and on the back panel of the driver's side. There also seems to be damage to the paint above the window on the rear door. However, these spots do not appear in photos of the RAV4 taken at the crime lab or at Avery Salvage Yard. It is possible that Teresa had the scraps repaired with touch up paint or there is another explanation altogether and the spots really may not be there at all.





There has been debate about the color of the RAV4. The RAV4 at Avery Auto Salvage and the Wisconsin State Crime Lab is mystic teal mica, not deep jewel green mica.



On the left in the image below is the RAV4 from the photo of Teresa taken by Pearce in broad daylight; on the right is the RAV4 inside the crime lab with artificial lighting. One appears blue-green and the other blue.





A decoy RAV4 could have come from Sheriff Hermann's car dealership/salvage yard, Cleveland Auto Sales and Salvage. A RAV4 was driven onto the Avery property on the evening of November 4, 2005 per Zellner's motion for post conviction testing. Avery's neighbor told a freelance reporter in April 2016 that he thinks he may have seen Teresa’s RAV4, followed by a white jeep, being driven into the back of Avery Auto Salvage via a road from Radandt's quarry before Pam Sturm found it the morning of November 5, 2005.









The RAV4 at the salvage yard had Uniroyal tires on it. It is difficult to read the brand of tires on the RAV4 at the crime lab because of the photo resolution. On the left in the image below is a photo from Avery Salvage Yard of the rear tire on the driver's side; on the right is the rear tire on the driver's side from the RAV4 in the crime lab.



To support the theory that there is a decoy RAV4, the blood smear on the cargo door handle (Item A23) can be seem on the RAV4 in the crime lab (right in the image below) but not on the RAV4 at the salvage yard (left in the image below). There also appears to be a light below the latch in the crime scene photo but not in the photo at the salvage yard. This could be due to angles and lighting.



Additionally, in the photo below, the vinyl of the spare tire cover on the RAV4 at the crime lab looks like it was scraped (and there appears to be handprints on top of the cover) This is not the case for the spare tire cover on the RAV4 at Avery Salvage Yard (other two photos below). However, the photo below is of the RAV4 at the crime lab, post fingerprint dusting (and possibly swabbing), which could explain the marks that look like someone was grasping or clawing for the spare tire cover, either on the way down or while on the ground.

The spare tire cover in the crime lab is misaligned, which wasn't the case at the salvage yard. Did someone remove the spare tire cover and then put it back on after it was photographed at the salvage yard and before it was photographed at the crime lab?









Finally, in the photo taken at Avery Salvage Yard on the morning of November 5th (image above), you can see what looks like a bullet hole or a dent to the left of the rear cargo door window. There appears to be a dent in the rear cargo area of the RAV4 at the crime lab, but it is in a different spot. This could be explained by debris on the vehicle that fell off during transport or angles and lighting, etc.



There also appears to be a bullet hole in the RAV4 that Zellner purchased: it is below the handle of the driver's door. Note that Zellner's RAV4 is the royal sapphire color and not mystic teal or deep jewel green.



To add to the confusion: 
  1. Dave Remiker testified that the VIN on the RAV4 at Avery Salvage Yard appeared to have been tampered with.
  2. A dashboard bolt and screw were missing from the RAV4 at the Madison crime lab.

This is just my opinion of course, but I will use some facts to arrive to this conclusion. I made a few comments in other threads, but I thought I should make a post out of it, so all can see.

I just want so bad for the State to let Zellner get her hands on the evidence RAV, so any discrepancies can be put to rest!!! The door Jamb will have a sticker with the correct VIN and Color Code, so Body Shops can paint match.

The VIN Number

I made a typo in my own VIN searches because when I copy-pasted from the Evidence list. I missed that it copied a "C" instead of "0", third to last value. And, in fact, JT3HP10V5X7113044 is a valid VIN, but for a 1999 RAV4. 

So they did have the VIN correct in their reports, and the DOT did as well. 

But I will keep my OP up, because I still think Police were wrong about it being a 1998 Model Year RAV4.



The Vehicle Color


I think the color controversy is because Teal is a very confusing color, depending on light you are viewing it in. It a color that is, in fact, a medium blue-green color. So I can see why some people think it's blue, and why some think it's green.

We have to explore the available colors for a 99 Toyota Rav 4.

As far as "Green" looking colors go, they offered Deep Jewel Green.

As far as "Blue" looking colors go, they offered Royal Sapphire Pearl.

And then, we have Mystic Teal Mica, Teal being "Blue-Green" color

After looking at those three colors, it's obvious the picture of Theresa by her vehicle clearly shows that her RAV4 was Mystic Teal Mica.

The evidence photos of the Vehicle in the Avery Yard clearly shows it is Mystic Teal Mica.

Her car was not BLUE or GREEN. It's TEAL. And it's a simple mistake, Mystic Teal Mica could appear Blue OR Green!

Why Item A is in fact a 1999 RAV4

Toyota didn't change much from the 1999 RAV4 compared to the 1998 model, but there are a few key changes that we can use to identify the difference:

Removed two-door hardtop from the American Lineup.

Additional new options include color-keyed mirrors and door handles and the alloy wheel option now features a full-size steel wheel spare and soft spare tire cover.

Three new exterior colors include Quicksilver, Venetian Red Pearl and Mystic Teal Mica. Discontinued colors include Alpine Silver, Prussian Red Pearl and Sedona Sunset Metallic.

Based on multiple photos, in different lighting situations, this car seized into evidence clearly looks like Mystic Teal Mica. And it has a full size spare with soft tire cover, so it leads me to believe this is in fact a 1999.

I know there is a lot of buzz about Colburn and what this person said and what time line is and so forth, but I have a problem with the entire RAV4 they found. There are many issues with it…
  1. 1999 RAV4 was the only year that Toyota made two colors that are very close, one is dark green and the other is green blue. Teresa’s vehicle was dark green yet the Crime Lab shows photo it is the greenish blue.
  2. A broken blinker light with a replacement blinker that is laying in RAV4 in the cargo hold, yet Teresa’s vehicle had no damage and according to the John, the propane dealer who saw it drive away, states it looked shiny new with no damage.
  3. The RAV4 they have found has been towed, which bent the frame.
  4. The latest pic of Teresa holding her keys in front of her vehicle, notice the missing paint on the top of the passenger door? Well, the crime lab photo of the RAV4 that they say is hers, is not missing paint in those places.
  5. Her real keys are missing, and now we have a valet key? Is it because the real key would not start the duplicate RAV4?
  6. Its known as a Salvage Yard Scam to switch VIN on two vehicles to sell a stole vehicle. Was a switch made on the Vehicles in order to hide the real murder scene and that explains where all the blood is?
  7. The battery cable was disconnected, it is standard to disconnect the negative battery cable to tow a vehicle. Why tow it if you can drive it, unless you can’t because its so damaged that it would draw unwanted traffic police attention.
  8. The blood in the back of the RAV4, there should have been much more unless her heart came to rest prior to being placed there. It would suggest this was post mortem.
  9. Her license plate was not attached to her vehicle and found crumpled up in the trunk of another vehicle. Is this because to transfer the plates on to the duplicate, would have made fresh metal scratches and drawn even more suspicion?
So now let me ask you this, who would have a means to….
  1. Incinerate a body at 1700 degrees to produce just bones
  2. Tow a vehicle with out showing records of such
  3. Crush Teresa’s real RAV4 to hide the actual murder scene
  4. Have access to planting Steven’s blood
  5. Have the know how and ability to switch VIN’s so easily
  6. Locate a replacement RAV4 on quick notice
  7. Have the inside knowledge of how to stage a crime scene
  8. Have a questionable past issue with the truth
  9. Have not one but three motives
I want you to look at the list.
  1. We know that Mark Fassbender investigated Avery’s incinerator, it was not used for months.

Who would have an incinerator, a tow truck, a crusher, replacement vehicle with no prints and no real evidence to link the real murderer, VIN switching knowledge, access to your own pick of vehicles and contacts in the auto business, high rank individual beyond questioning, Manitowoc County Sheriff.

Guess what, he is the President of Cleveland Auto Sales and Salvage. He was a deputy in 1985, he was the undersheriff in 2005, and he is now the Sheriff of Manitowoc County.

He and he alone fits all that would be needed to fulfill the requirements for this type of accident and he is the one saying, all over, that Netflix is taking things out of context and out of order, and says that’s how its done to keep every one confused. He is saying this in my opinion because He himself is the one that did this and so he knows how it works.

Just saying, don’t get distracted. Focus on what a killer would need to accomplish the tasks. That is how you find the real killer.

Hermann Career Highlights Interview

A small piece of the grill, coming from the suspect’s vehicle, had been found near the scene of the rural Manitowoc County accident and he remembers driving through area lots of car dealerships until he found a pick-up truck that matched the grill. His experience with cars helped give him and other law enforcement officers an idea of the kind of vehicle they were looking for, Hermann said.

The Manitowoc County Sheriff's Department, which has been accused of framing Steven Avery for a 1985 rape and planting numerous clues to convict Avery for the 2005 murder of Teresa Halbach, has also been dogged by allegations it mishandled the 1999 hit-and-run death of a 17-year-old boy, USA TODAY NETWORK-Wisconsin has learned.

The homicide of Ricky Hochstetler, who was struck by a vehicle while walking to his home along a frontage road, remains unsolved. The crime occurred at about 2:20 a.m. on Jan. 10, 1999 during a snowstorm.

On the morning of the fatality, Robert Jeffery of Newton found parts scattered in the snow at the seldom-used intersection of Center and Newton roads in rural Newton. If the fleeing driver had turned onto Center Road, the village of Cleveland was about five minutes away. Several sources who had ties to the investigation suspected that the hit-and-run driver was probably headed toward Cleveland. But this critical clue soon fell by the wayside under the direction of Lt. Mike Bushman, the road deputy put in charge of the homicide by then-Manitowoc County Sheriff Tom Kocourek. According to Bushman's report, the Newton resident “was unable to tell me which direction the suspect vehicle may have went after the pieces fell off.”

On the day of Hochstetler's funeral, multiple car parts were visible in the thawing snow at the far edge of the victim's driveway along Manitowoc County CR. The boy's body was found 50 yards up the road. "(The parts) were right up by the road," Manitowoc resident Sylvia (Hynek) Schmidt told USA TODAY NETWORK-Wisconsin. "I just remember I was thinking, 'This doesn't look like it had been weathered.'"

The parts appeared to be a section of headlight housing with letters and numbers stamped into it, Manitowoc sheriff's deputy Jason Jost reported at the time. "I also observed three other pieces of plastic lying just around the corner," Jost's Jan. 15, 1999 report stated. All four of the parts "appeared to be from a newer style car," Jost wrote. There had been no other recent collisions along the two-lane highway around the time of her son's death, said Debi Hochstetler, the victim's mother. Nevertheless, Bushman determined that these fresh car parts were not relevant to his investigation.

Within hours of the overnight crash, juvenile detention center Lt. Rob Hermann, now the county sheriff, assured Bushman that the hit-and-run vehicle was a 1985 to 1988 Chevy truck, Suburban or Blazer. Days later, Bushman speculated that the tiny pieces of broken grill found along the rural highway may also belong to a 1988 to 1991 full-size van. It seemed that every decision Hermann and Bushman made put Manitowoc County farther away from identifying Ricky Hochstetler's killer.

From the outset, Kocourek, who did not return a message from USA TODAY NETWORK-Wisconsin, didn't make it a top priority for his detectives or deputies to canvass local bars, bowling lanes or late-night diners for leads and suspects; conduct any round-the-clock surveillance near the crash site or near the rural intersection in Newton where signs of evidence were found; inspect the salvage yards near Cleveland and Sheboygan, even though there was a strong chance the hit-and-run driver would fix or destroy his damaged vehicle to avoid suspicion; and scour the rural roads and ditches for additional vehicle debris that may trace back to the hit-and-run driver.Kocourek also let several weeks pass before volunteer firefighters were summoned to the crime scene along County CR to melt down the snow and ice. The effort yielded 126 gray grill pieces, three black pieces, two small pieces of Chevrolet emblem, one gold glasses frame and one lens, reports show. "Most were very small and of no identifying quality at this point and time," Bushman stated.

Weeks after the boy's death, a number of sheriff's department employees began to suspect that an off-duty deputy — after a night of drinking — struck and killed the rural Manitowoc teenager. Even the traffic patrol lieutenant who was in charge of the investigation was aware of the allegations, indicate reports reviewed by USA TODAY NETWORK-Wisconsin. However, both Lt. Mike Bushman and then-Sheriff Tom Kocourek's administration declined to probe the activities of the two deputies who were being mentioned as possible suspects — Lt. Rob Hermann and his brother, Sgt. Todd Hermann. Rob Hermann is now the sheriff of Manitowoc County...

When reached on his work cellphone by USA TODAY NETWORK, Todd Hermann declined to comment. The 49-year-old Cleveland, Wis., resident directed all questions about the case to Rob Hermann. After his brother was elected sheriff, Todd Hermann was promoted to the Manitowoc County Sheriff's Department's deputy inspector of operations, the third-highest position in the department... Bushman, the night-shift patrol commander, heard about the hit-and-run pedestrian collision on his squad car radio while at the gas pumps about a mile away. He arrived on the scene at 2:28 a.m. Hochstetler's body was in the middle of the road. Bushman decided to preserve the death scene rather than chase after the fleeing driver, the Division of Criminal Investigation report stated.

Ken Petersen, undersheriff at the time, assured the Manitowoc Herald Times Reporter that the hit-and-run driver had not been drinking at the popular club. "I don't know if the person could have gotten up to a speed that would have caused that kind of injury to the victim or damage to the vehicle," Petersen told the newspaper. The front entrance to the Bil-Mar was close to a quarter-mile from the Hochstetler tragedy. Although the high-profile crime became the talk of the town, Kocourek decided not to seek help from the Wisconsin State Patrol's technical crash-scene reconstruction experts. And the Division of Criminal Investigation wasn't asked to help, either. Kocourek did not return a phone call seeking comment for this story. Before the autopsy — and prior to any daylight searches in ditches and along adjacent roads for more broken vehicle parts — Rob Hermann, Manitowoc County's juvenile jail administrator at the time, set a course that would later prove unsuccessful in finding the person who killed Hochstetler.

As the hit-and-run investigation floundered in 1999, Bushman continued to hear whispers suggesting Hochstetler's death was part of a sheriff's department cover-up. Bushman's investigative reports show he raised the issue of a cover-up during a face-to-face interview with Rick Wetenkamp, a rural Newton resident, who had been the hit-and-run victim's stepfather. By that point, the homicide had been unsolved for 11 months. "I decided to question him about a statement he made ... reference the opinion that the police may have been involved in the accident and are attempting to cover it up," Bushman wrote in  his report. "I wished to catch what type of reaction this would bring." It was evident from Bushman's report that he did not want the victim's stepfather believing that police corruption might be the root cause for the lack of an arrest.

Months later, in 2000, there was a changing of the guard. Kocourek retired and Petersen took over as sheriff. Petersen elevated Rob Hermann to under-sheriff/inspector. Bushman was promoted to third in command, supervising the road patrol division and the detectives bureau. That bureau included James Lenk, the same detective who was later accused of planting Avery's blood and a spare key during the 2005 Halbach murder case. Under Lenk's leadership, little progress was made in bringing Hochstetler's killer to justice, and Petersen's administration wasn't optimistic about an arrest. "What it's going to take to solve the thing would just be luck at this point," Petersen told The Associated Press in January 2002. "I doubt if that truck exists anymore, especially in any kind of evidentiary form."

But not everyone at the sheriff's department shared Petersen's pessimism about solving the high-profile homicide. A former sheriff's employee confirmed resigning from the department, disgusted by what the employee felt was a shoddy investigation. Sources with ties to the Hochstetler investigation told USA TODAY NETWORK-Wisconsin that it was evident Bushman and Rob Hermann had compromised critical evidence recovered at the scene of the crime, jeopardizing the prospects of a criminal prosecution...

After a Green Bay television station aired a 2004 story, a woman called Debi Hochstetler, asking "if she was the person who lost her son." The woman told Debi Hochstetler "that the person who killed her son was a cop and that she gave the last name of the person as (Hermann)," DCI reports from 2004 showed. "Hochstetler stated that the woman gave her a first name for (Hermann) as well, but that she could not remember it at this time."  According to the tipster, the hit-and-run vehicle ended up at the Cleveland Auto salvage shortly after the crash and was subsequently crushed. Cleveland Auto was the long-time family business in southern Manitowoc County along County XX operated by Bob Hermann and his family. The elder Hermann had worked as a traffic patrolman for Manitowoc County before retiring and two of his sons, Rob and Todd, followed in his footsteps and were hired into the sheriff's department by Kocourek during the 1980s. Years later, when Debi Hochstetler brought her information to Bushman in 2004, he dismissed it, telling her Rob Hermann wasn't involved in the crime.

In July 2009, the Division of Criminal Investigation reopened its investigation of Rob Hermann, the state agency's reports reflect. By then, Hermann was Manitowoc's sheriff. "The caller wanted to remain anonymous and would provide no information on the source of the allegations other than the individuals who provided the information were high school friends of the suspect that did not want to get involved in the investigation and did not know the caller was providing information to authorities," the late Division of Criminal Investigation Craig Klyve wrote in his report. According to Klyve's report, "the caller said that Robert Hermann had an early- to mid-1980s Chevy pickup truck that has not been seen since the time of the accident. The caller believes this vehicle was the one that struck and (killed) Ricky Hochstetler."

Dean Strang's former criminal investigator, Pete Baetz, told USA TODAY NETWORK-Wisconsin that he questions Hermann's rushed conclusion that the hit-and-run vehicle was a full-sized truck. The teen's body was found in the middle of the county highway more than 300 feet from impact. Based on his review of the autopsy findings, Baetz said the victim's injuries appeared consistent with someone being struck by a car. “It looks like a cover-up​, let's put it that way.” "Based on the breaks in the lower legs, I just did not believe it was a pickup truck," said Baetz, a retired Illinois police investigator. "I think he was scooped, and a pick-up truck isn't going to scoop him up. It's too high." Baetz said the crime scene evidence was mishandled by Rob Hermann, who was allowed to drive around with crime scene parts in his personal vehicle for several hours after the crash. Broken pieces from a radiator grill were found at the "The way they handled this case, they overreached beyond their capabilities, and they made these amateur guesses," Baetz said. "From a professional and technical standpoint, the investigation here was laughable. "It looks like a cover-up, let's put it that way."

Yet another was the 1999 vehicular death of Valders teacher Debra Cooper, who was hit by another vehicle. Hermann was off-duty and was called in to reconstruct the accident. The other vehicle, belonging to the suspect, contained a bag of $75,000 cash and evidence of drug activity, Hermann said.

A highlight of his career was attending the FBI Academy in Quantico, Va., in 1995, he said.

Hermann won the election in 2006 against two other candidates, Democrat Ryan Gilbert in the primary, and Republican Andrew Coborn in the general election. He ran unopposed for his second term and will be running unopposed again in fall for his third term, Hermann said.

Aside from the allegation that the law enforcement framed Avery for Halbach’s murder, there’s undeniable proof that certain members failed in their duties. For example, Sgt. This picture that Tom Pearce claims he took of Teresa and her RAV4 was staged to show Teresa as a photographer with a RAV4. They overdid it with the Hasselblad around her neck. It goes hand and hand with her "If I Die Video."

The RAV4 itself was photographed using a flash which reflects off all the shiny parts of the RAV4 body, yet there's no reflection or hot spots seen on the Hasselblad, or the Hasselblad's flash, or Teresa Halbach herself. With the photograph is in negative mode and adjusted for brightness to look for hot spots, you'll notice the cut out lines around Teresa herself became sharper, like as if she had been badly super-imposed on the RAV4 (image below). What if the copy of the Wisconsin DOT record entered into evidence for license plate SWH582 is fraudulent? 

On December 5, 2005, Kratz's office was the first to officially receive the "Certificate of Record Copy" from the Wisconsin DOT Division of Motor Vehicles, dated November 30th (image below).



Lynne Judd, Administrator for the Division of Motor Vehicles, wrote the following
I certify that the annexed photocopy of the described record [mage below] has been compared with the original on file with the division in the department [Wisconsin Department of Transportation] and the same is a true and correct copy of such original record.

The Wisconsin registration and proof of insurance were missing from the RAV4 at ASY.

CASO did not take into evidence important papers from Teresa Halbach's home, such as the "Confirmation of Ownership" for her RAV4 (the orignal title was held by Toyota Motor Credit Corporation because Teresa had a lien on her RAV4), insurance documents, Social Security card, birth certificate, passport, etc.

Wisconsin DOT generates a title and sends it to the owner, which was Teresa Halbach's financing company in Atlanta. So the original and actual title to Teresa's vehicle was held by Toyota Motor Credit Corp.

The Wisconsin DOT would have a record/copy of Teresa's RAV4 title.

Erie, Teresa's insurance company, would have her VIN in their records (Zellner has been in contact with Erie).

The Wisconsin DOT "vehicle record" below was created on April 21, 2016 for VIN JT3HP10V5X7113044 with licence plate SWH582. 

As of 2016, there was no longer a lien on the vehicle. 

For some reason, the registration for this RAV4 was still listed as valid as of 4-21-16; the Registration Renewal Number (RRN) for the 2016 record (below) is different than the RRN for the 2005 record (above).



When doing a license plate search at the Wisconsin DOT website on 12-6-19, the plate was no longer in their system (images below).





Starting at the 7:00 minute mark in the video above, Dolores Avery tells Steven that a man in Green Bay saw Teresa Halbach driving her green RAV4 in December 2005. He tried to follow her but got stuck in traffic. The man is positive it was Teresa and says "he would swear in court to that." Steven tells Rollie Johnson about this man in the video below.

Also in the video below, Rollie says at the 15:50 mark: "Where's the evidence that she even died?" Steven says at the 17:50 mark: "Somebody seen her (Teresa). It seems like they paid her off... Somebody's been hearing that she is out of the state, out of the country, Mexico or something... there's something fishy."

Steven says at the 19:45 mark: "Her dad (Teresa's uncle and stepdad) was supposed to have something to do with this county jail (Calumet County). Rollie replies: "I've heard rumors before that he works for the Sheriff's Department" (but he can't remember who told him that). And just before this conversation, Steven tells Rollie that a male relative of the Halbach family was taken into custody at the Calumet County jail on Monday, and Steven saw Teresa's sister out there when this family member was brought in, yelling and screaming.

    What I find interesting about the letter is that instead of taking a picture of it, like they did with the zander rd sign, they instead decided to scan it in on presumably what looks to be a prototype of the very first computer scanner ever produced. This all occurred in the 2005-2007 range, yet this image literally looks like an archived image you would find from a 1932 newspaper. The fuck? The same thing goes for the autotrader appointment exhibits. It is as if the quality was intentionally downgraded significantly so as to obscure things.

    Look at that image of this letter, and then remind yourself that this was made less than 10 years ago. The camera on the android phone I had in 2006-7 could take a picture 50x the quality of what we are seeing in that exhibit.

    They are the same vehicle, as I believe we've mostly accepted. The difference you are seeing in the photos with the bumper is because the day time photo by Pam is cut off at the bottom. You don't see the bumper because it's not in the picture.

    One of those frustrating things about this case. When it comes to pictures and the flyover video, there always seems to be something cropped or edited from the frame of view, making exact side by side comparisons nearly impossible.

    Think all of these were just bad luck or done by accident? Not likely.

    When thousands of extremely smart, (albeit not professional investigators), internet sleuths have an extremely hard time connecting the dots in the evidence photos, it kind of paints a picture for me that it's not by accident.

    Someone in LE or otherwise deliberately and meticulously scoured over all the evidence they had and edited, removed or "lost" certain things that they knew could possibly cast doubt on the story they wanted to tell.

    As JL said, there are photos no one has ever seen because they were not submitted into evidence. I think we know why. They went through the same routine we have been going through endlessly for 12 months.

    Think of it like this. Have you been caught in slow traffic on the way to work and thought you would be clever and take some "short cut" you know to avoid the traffic? Only once you start going that way, you find that the traffic is backed up there too because someone else already beat you to it.

    It's the same with these photos. They looked at everything and found out which things the defense could use to poke holes in the prosecution's case and went to great lengths to "avoid" those things.

    So as we go through these photos and think we stumbled across something, we say, "oh let me get the ASY photo of the same angle, only to find it doesn't exist.

    Just like Hos's picture of what appears to be blood near the lock on the back tail gate. Is it any surprise that POG's photo is cropped so close on the left? We are all left saying, "I wish there was a better picture of that so we could see more to the left of the lock". Well, i'm fairly convinced the original probably did show this.

    Rather than LE cropping both the night time and day time photo, they just cropped one. If that is blood by the lock, and we know from the report that the swab is unaccounted for, it is because they didn't want that looked at during the trial. If they crop both photos, it looks too obvious and plus the swab was already documented. So they crop the day time one just to prevent the side by side comparison.

    Then after all of the photo evidence is set, they hire the computer guy to come up with a fancing set of graphics depicting the entire Avery compound and basically after that, the photos become secondary and tactfully avoided by KK. A diversion.

    Again, anything we can come up with here, they already did and built a roadblock. That's why we keep coming up with these "darn it" moments. Granted they did not have the TTM Reddit users of 10 years into the future in mind when they did this, but the blog community wasn't zero in 2005 either.

    Wish I could recall where it was posted but someone posted... many months ago... the search data for internet searches on a RAV4 in that area during the time she was missing... it was striking because the search result for the period of time was remarkably high compared to the prior weeks. Now, of course I don't know who that person was or whether that data was legit... but...

    So, on a whim I decided to take a lookie-loo and randomly chose the Sunday edition of the Green Bay Press Gazette on Oct 14, 2005 to see if there were any RAV4's for sale. The Manitowoc Herald Times is not available for that year, but the Oshkosh, Sheboygan and Green Bay papers are.

    So, there are two RAV4's for sale - a 97 and a 2001. This could be like searching for a needle in a haystack, and I'm kind of off looking in other haystacks right now, but you can sign up for a free 7 day account with newspapers.com and take a peek for yourselves, it might be worth a look.

    Not all the photos are on skipptopp'ss site (stevenavery.org) due to the cost over $7 per photo, the cost so far for what we have with all the docs is around ten thousand dollars that was crowd funded.

    It's just down to the cost and the amount of photos taken, it's in the hundreds of photos. Skipp did look into getting more photos but because of the appeal they won't release any more photos or docs so we are stuck with just the ones we already have.

    This was mentioned in a thread a few months ago, i think it was when we had the big discussion about the rav4 colour so skipp tried to get the rest of the pics and got refused.

    We are only allowed to have photos put in evidence. We aren't allowed discovery materials or work product, even though we know as with this example that they exist. This is why I posted the OP about a Christmas present of getting all the photos via some other means than us paying for them (we can't; the state isn't required to share them) say via the discovery that KZ has.

    Almost all of the footage shot for MaM of the trial, news clips, police footage etc. was shot in 480p (SD) so no amount of up-scaling will get any more detailed pixel data from them. Even the photos and stills included in it would be constrained to 1080p since to my knowledge MaM was never available at 4k resolution. But you are right that the specific photo cited on StevenAveryCase.org site seems to just be a lower resolution cropped frame grab from the series, rather than one actually bought from the court which are scanned at higher resolution as most of them on the 'exhibit photo' page are... All of the original footage circa 2005-2007 appears to be at 480p as HD wasn't widely adapted until a bit later. They definitely shot 1080p interlude footage of Manitowoc etc. more recently (a lot of the aerial and street shots were probably shot in the past 3-6 years with HD equipment), as well as some of the interviews and such. The evidence photos and documents were also of high resolution, it's just the original footage including the news aerial of the salvage yard that were of low resolution.

    Here are the three photos online that I was looking at. The first, from the driver side (I'm pretty sure that is Pam on the passenger side looking in... at first I thought it was the top of the passenger car seat, but it is too large to be the seat). The second and third pictures are just random pics I also found online of different angles. At first, I thought the angles of the pictures was the reason for the perceived movement of the branch... but I personally think it was moved. I did not know there was mention of them moving the materials, my apologies.

    They had to have moved things when they put that tarp up and took it down. That tarp over the RAV was one of the more brilliant elements of this investigation. /s. Putting it up to keep rain off the vehicle, propping it on trees, then taking it down when it actually began to rain.....you have to wonder what they were thinking. If they really wanted to do it, why didn't they send for one of those funeral home tent frames and do it properly?

    Car trouble (flat tire or off the road) could also explain why the covers for the compartments that store the jack and lug wrench in the back of the vehicle are missing.

    Say she gets the tools out of the storage compartments, and leaves the covers laying in the back, then gets into an argument with the "good samaritan", while standing at the rear of the car, because he tore up her bumper.

    They argue, he hits her in the head with one of the tools that she got out, causing the spatter on the rear door. He thinks "oh no, now what do I do", and throws the storage compartment covers out of the car to clear some space to put her body because it's a very small cargo area.

    If she had a cargo cover (unclear if she did), it conceals her in the back while he relocates the vehicle to somewhere more secluded, and would have been discarded with the bloody floor mat later if it also got blood stains on it.

    This is purely speculation based on my recent questions about the missing covers from the rear storage compartments. ETA: I've been trying to find a reason that someone would have removed those covers.

    Was the left front tire later changed? This may be a key piece of corroboration. Look at this zoom-in on the photo of the RAV4 taken at the Wisconsin State Crime Lab (Link). There is mud thrown all over the side of the RAV4 behind the left front tire, but the tire itself is fairly clean. This is not true of the rear tire. Does this corroborate the stuck in a ditch theory?

It made sense TH had car trouble, someone stopped to help her out. She gathered the importance stuff, and took them with her. She got into their car. So this working theory of yours does have legs, anyway for our scenario.

    added thoughts upon initial reading:

    testimony of seeing her taking a picture of a cow. Could this be when she got stuck? Pulled over just a little too far and then couldn't get out?

    some have also pointed out the slight dent in the under carriage, but that's on the left side. There is an evidence photo looking straight on at the RAV within the wooden 'box', with fingerprint dust all over it, where you can see that dent.

    in that same photo you can see how accessible the hook loops are. No need to go through the bumper.

    There was a search for the missing 'tool'. I remember reading that, but don't ask me where. Speculation it may have been the murder weapon or at least used to subdue her, hence the blood on the inside of the cargo door - bonk in the head, toss her in the back.

    Someone had opportunity to sabotage TH's tire and to follow her after leaving ASY, but not necessarily in that order. I suspect the perp brought the car back that way to frame SA, and LE at most moved it a short distance.

    The best opportunity was at GZ's, as you said before. If the trip goes SS -> SA -> GZ, then there is an opportunity when TH leaves her car to sabotage the tire.

    If she's headed home from GZ's she would go 310 to US-10, and probably break down somewhere on that stretch.

    I put together the "hole possibly from a lug wrench" post up, and something else came to mind..because I began wondering if hiding that hole was to protect their story of Avery killing her, and a girl stuck on the side of the road with a flat...that doesn't put her on Avery's property for him to be raping and killing.

    So tell me how plausible this sounds. They hid the puncture, but what else did they hide?

    The 2:41 call. A minute and 20 seconds..of what we thought could be someone luring her to her demise. But...bear with me.

    Her Cingular contract showed she selected roadside assistance with it. That's in there, she selected to have that. They put the code that you TEXT....notice, no phone number to it. You TEXT #HELP. Well that's not enough information, so what would they have to do? Call you back. On the number you just texted from.

    So could it be possible, this 2:41 was them calling to get her location to send a wrecker out, and someone did the "good samaritan gone bad" thing to her?

    If KZ has her text records, she would know that. So it would be interesting to know if on her roadside assistance provider, if they received a text and sent a driver to her only to have her not there.

    Remember, she was driving around with a can of Fix O Flat, so she likely had gotten close to Whitelaw tower when it went flat while driving home, and it would concede the fact Avery's WAS the last place she went...but ran into trouble going home.

    The fix-o-flat was actually "AirUp" brand, and it could have been supplied by the perp. TH's friends might know. "AirUp" is a premium brand, I believe.

    I'm much happier with this theory. A hollow-point 22 LR bullet would likely have torn up the car much worse than the mark you called out. Even though it is small, it carries a lot of momentum, at least for 100 to 150 yards. Of course it could have been any gun, really, but the mark you are showing is what you might expect from a pellet or BB gun.

    We know the back of the car was a true crime scene, but no one has treated it like one!

    What's funny is also sad and by funny, I shall clarify and say sick sense of humor. You describe her photogaphy gig for a few xtra bucks and real gig as that of a studio photographer. Says who?     There was supposed to be a Toyota Factory provided car jack under the front passenger seat, where the AirUp inflator and tire sealer can was found, and there was supposed to be a factory toolkit in a storage location in the cargo compartment on the drivers side. This kit should have contained the Toyota factory provided lug wrench and the crank handle for the factory provided jack.

    we can't see the jack in the pics, but you can CLEARLY see the roadside tool kit where they store the lugwrench and crank. But Kucharski and Wendling are searching for a "tool"...and Hawkins photograph's a lug wrench taken from her car. So it sounds like the tool went missing, so could that be the murder weapon and possibly what caused the hole and dent in the Rav4 panel? I can't tell if the crank has a flat end on it anywhere, but if Hawkins listed the crank as the "lug wrench" in error..then it means that the search on the property was for the lug wrench itself.

    I think this makes sense for a few reasons. I think she did have a flat tire and asked a while back if anyone ever found any reports where they checked the spare tire to see if it was flat. Stahlke's blood analysis report states the blood inside the back cargo door was cast off from a blood bearing object. Now if Teresa was attacked while reaching in the back end then the person very well could have hit the vehicle with that object.

    I don't know what kind of tools were in that bag but many tire kits have a 2 piece shaft that fits together to crank the jack up and they usually have square or hexagon ends to crank them up with the ratchet portion.

    First I'll start with the report from Stahlke

    Now in the conclusion portion of his report he states,

    The distribution and orientation of the stain patterns observed in the rear storage area of the Rav4 are consistent with the presence of an individual with bloody hair in the rear of the vehicle.

    So in the conclusion portion he totally ignores the splatter on the back door and just talks about where we can assume TH's head was resting at one time. To me he intentionally leaves out the back door splatter that in his conclusion and should have stated someone appears to have been attacked in this area.

    Is this the investigators or prosecution influencing his report?

    Now looking at the cargo door pics, what would make this pattern and from where?

    If TH was murdered in the back then the cargo door would have had to be closed and the attacker would have to be in the back seat. I doubt there is room to swing an object hard enough in the tight spot back there. It couldn't have been a gunshot because there would have been a lot more and smaller blood patterns. A blood mist if you will and you would have had "blowback" where there would have been more blood spots and mist on the back of the seats and probably interior roof and sides.

    So this leads me to believe TH had to be attacked at the back of her vehicle with the cargo door open. I still don't think it's a gunshot wound because the blood "mist" still isn't present. This means it would have been from an object and it also means that more than likely she was hit more than once. Like Stahlke said "a blood-bearing" object. First hit the object is now bearing blood and the second swing and the blood flies off onto the interior of the cargo door.

    So lets put all of this into the prosecutions theory of what happened that day.

    First of all if Steven did this he took some huge chances. One it was during daylight, during the Salvage yard business hours, and while at least one of his nephews was at home, and according to Bobby she was parked out on the driveway. Second that would have been a nasty injury that if he took her into his trailer there would have been evidence of her bleeding on the floors, carpet, bedding, etc. Then we have to believe that Brendan (not used in SA's trial but his "confession") never noticed a really bad injury to Teresa's head. You can go on and on with events the State claims from here but everything so far in my opinion is extremely unlikely if not impossible.

    What is more likely is someone killed TH with a blood-bearing object, (the missing lug wrench?) and placed her immediately in the back of the Rav 4 and set out to hide her and the vehicle. You can take what events you believe happened after that however you want but I think this is most likely the case.

    Just curious but does anyone know if they ever checked out the spare tire? Was it fully aired up? Just wondering if there is a very good explanation why the lug wrench was missing.

  15. Happy New Year Magiclougie and I hope this is truly a happy New beginning for Brendan and Steven.
    I was reading something today that may tie in with the theory of the car being planted. I was looking at an article on TickTockManitowoc on Websleuths. The poster, u/not_a_sloppy_joe, had been reading the original Websleuths' article on Teresa Halbach's disappearance from 2005.
    I followed the link: http://www.websleuths.com/forums/showthread.php? 31696-WI-Teresa-Marie-Halbach-25-Mantiwoc-31-Oct-2005 and I read an article by Ed Culhane, written on November 6 2005 for the Post Crescent.
    The Headline reads:'Car of Missing Woman Found', The strapline reads '... Vehicle located in Gravel Pit.' Culhane goes on to say (in paragraph 2) that the car was found at Avery Salvage but in paragraph 1 he states the car of the missing woman was found at a 'rural Mantiwoc County gravel pit.'
    So my question is, why describe the place the car was found as a rural gravel pit if it was Avery Salvage? Is this a linguistic thing? I'm English so for me, Avery Salvage and the location of the car is not a gravel pit- my understanding is that the gravel pit and the salvage yard are two separate locations, close but not the same but in American English, would this be the same or a permissible synonym?
    I wondered if Ed had had a report of the car being found at the gravel pit initially, which was then altered to be Avery Salvage? Is Ed referring to two possible discoveries that have been conflated: Colborn's initially discovery Nov 3 at the gravel pit and then the official discovery, Nov 5 at Avery Salvage?

Culhane writes 'Law enforcement officials found the vehicle of a missing St John woman Saturday in a rural Mantiwoc County gravel pit, but were tight lipped about Teresa Halbach's fate.' It sounds to me like Culhane was told about the original discovery, before the decision that the car would be officially discovered on the 5th was made!

    All the revisited conversations and questions about whether there is more than one RAV? Is it same RAV from POG/ASY to LAB? Now whether or not anything was altered, that's another question.

    7 Months ago I added this photo to someone's post that shows at least small evidence leaning towards it being the same RAV from ASY to LAB.

    You can see some mud splashes that look like they add up in 3 different images.

    I really have to say that the odds of there being two RAVs is pretty slim.

    LeMieux Toyota is a fair sized dealership, but I just can't see how they could've traded out vehicles or repainted or ANYTHING because of dealership sticker that comes up in a big percentage of the photos.

    If there's a repaint, the sticker is gone. You can't tape them off and paint around them or sand around them. You sand the car and the sticker is gone. They just don't hand those things out. Finding another RAV from LeMieux (same year, same color, etc), pretty slim.

    I am fairly certain it's the same RAV.

  19. Please don't worry about checking comments, I know interest has died down now and I like the process of writing because it makes me organize my thoughts. There's really not much to go on at the moment and I don't want to be bothersome, so only respond if and when it's convenient. I like this site because there are no big egos vying for attention and I'll keep checking for insightful posts but I don't need replies unless I think I've found something important and then I might get a bit fraught but I'll let you know if that's the case!

    I remember a discussion a while back at reddit about the article by Ed Cuhane.

    I think people were confused about the quarries next to the Avery property and what were the boundaries. That is my guess because I was confused at the beginning about "the pit" versus "the burn pit" versus "the quarry" versus the "quarry pile" versus the "gravel mound," so maybe the reporter was confused as well.

    Here is my breakdown of the different areas:

    Avery's burn pit, which was a burn area behind his garage that became a pit when LE dug it out after finding a bone close to it on November 8th.

    Avery family members themselves referred to the salvage yard as "the pit" (or at least the area by the pond, which was dug out). A conveyor from Radandt's quarry crossed over that area of the salvage yard onto another area of Radandt's quarry.

    Michel's quarry, the small quarry to the right of Avery Road: a bone was found there I believe (maybe after being brought there from Radandt's quarry by an animal).

    The quarry pile at Radandt's quarry where charred bones were found. I'm still not sure if the gravel mound of debris searched by state troopers is the quarry pile or if it is a separate location in the quarry.

    Burn barrels collected into evidence from the deer camp at Radandt's quarry, from Barb's backyard, and from the field in front of Avery's trailer.

    Does that sound about right?

Fifteen months after Teresa Halbach went missing, Thomas Bruechert contacted MTSO to inform them he was told that ex-inmates of Steven Avery, after his 2003 release for the 1985 wrongful conviction, broke into the prison hospital, stole his vial of blood, and turned it over to inmate Roger Raduenz, who was about to be released. CASO detectives Gary Steier and Wendy Baldwin interviewed Bruechert on January 24, 2007 at his home in Manitowoc. The following is that report.

    On Wednesday, 01/24/07, at approximately 9:41a.m., I (Inv. STEIER), along with Inv. WENDY BALDWIN, both of the CALUMET COUNTY SHERIFF'S DEPARTMENT, interviewed THOMAS JON BRUECHERT.

    THOMAS BRUECHERT had reported to the MANITOWOC COUNTY SHERIFF'S DEPARTMENT that a ROGER R. RADUENZ had told him he was in prison with STEVEN AVERY. RADUENZ informed BRUECHERT that after STEVEN AVERY was released, some other inmates at the prison broke into the prison hospital, stole the vial of STEVEN AVERY's blood, and then tumed the blood over to RADUENZ, who was being released from prison.

    RADUENZ indicated he had befriended BRENDAN DASSEY and RADUENZ and DASSEY would watch STEVEN AVERY's whereabouts around the AVERY salvage property. BRUECHERT stated RADUENZ went on to tell him that RADUENZ had come upon TERESA HALBACH, who had run out of gas on I43. He had tried to have sex with her, she refused and he killed her. After this was completed, he placed TERESA HALBACH's vehicle at the AVERY'S SALVAGE YARD with AVERY'S blood, which he had stolen from prison, inside TERESA HALBACH's vehicle.

    Inv. BALDWIN and I met THOMAS BRUECHERT at the residence of 820 Redfin Court, Manitowoc, Manitowoc County. THOMAS BRUECHERT indicated he was waiting for investigators to speak with him about the incident.

    BRUECHERT stated he was given a ride by ROGER RADUENZ in ROGER RADUENZ's white van when RADUENZ informed BRUECHERT of the story he had told the MANITOWOC COUINTY SHERIFF'S DEPARTMENT.

    BRUECHERT stated he had met ROGER RADUENZ at the SALVATION ARMY in the City of Green Bay. RADUENZ took BRUECHERT for a ride in his van and while riding with RADUENZ in his van, told him the story that RADUENZ and STEVEN AVERY were in the same prison. BRUECHERT did not know which prison RADUENZ was referring to. BRUECHERT said RADUENZ stated the inmates at the prison were mad at STEVEN AVERY. BRUECHERT indicated the blood was stolen by the inmates and given to RADUENZ along with very small cameras. This was used to set up STEVEN AVERY for the murder of TERESA HALBACH.

    BRUECHERT was unclear how the miniature cameras were used in the setup of STEVEN AVERY, but indicated they make very small cameras, which were given, along with the blood, to ROGER RADUENZ when he left the prison.

    BRUECHERT contradicted himself by indicating that state inmates have a code. When asked further about the code, BRUECHERT stated RADUENZ, being a state inmate, would have a code like a code of silence and would not speak about this to anyone other than to other inmates about what had taken place. BRUECHERT stated, however, RADUENZ had confided in him inside RADUENZ's van.

    BRUECHERT was asked when the conversation had taken place inside the van between himself and RADUENZ. BRUECHERT estimated it to be a warrn day and told investigators he believed September, 2005. Inv. STEIER informed BREUCHERT that TERESA HALBACH had not been killed until later that year and was still alive in September,2005. BRUECHERT then indicated he thought it was in the fall or December of 2006.

    BRUECHERT indicated he was scared of RADUENZ who is always known to have a knife or gun on him. BRUECHERT indicated he was so scared to be in the van, he got out of the van and stayed at a VILLAGE INN.

    BRUECHERT indicated RADUENZ was a trucker. BRUECHERT stated he did not know the whereabouts of ROGER RADUENZ and was tryrng to locate where he was.

    BRUECHERT believed ROGER RADUENZ was related to the family who owned the RADANDT GRAVEL PIT south of the AVERY property.

    BRUECHERT indicated he had never been in prison but had spent some time in the WINNEBAGO RESOURCE CENTER approximately 20 years ago.

    The female subject who was present, who wished not to be identified, identified only by her first name of SANDRA, indicated she also knew ROGER RADUENZ. She indicated she contacted her son, TRAVIS LEMAY (ph), approximately 32 years of age, by cell phone and asked her son, TRAVIS, if he knew where RADUENZ was.

    According to SANDRA, TRAVIS told her over the phone that ROGER RADUENZ was trouble and THOMAS BRUECHERT should stay away from him. SANDRA also indicated TRAVIS said he had beaten up ROGER RADUENZ once and did not like him. SANDRA also indicated TRAVIS stated he has not seen ROGER RADUENZ since. SANDRA indicated ROGER RADUENZ was never a truck driver but drove a white panel van, which he drove with stolen goods in the back. SANDRA indicated ROGER RADUENZ would steal stuff and transport the stolen items in his van. She described it as a white moving truck like a U-haul type.

    The interview ended at approximately 10:00 am.

  23. Jane, the Bruechert interview is a great find!

    I believe Bruechert is telling the truth. The question is, was Raduenz telling the truth when he told the story to Bruechert? If so, then that could mean that Raduenz and others were informants to MTSO and were instructed to steal the vial and give it to Raduenz since he was getting out soon. Then Raduenz gave the vial to the framers at MTSO.

    Strang and Buting thought they got the blood from Avery's 1996 vial that was stored in the 1985 case file at the office of the clerk of the court. The blood vial was stored in Avery's 1985 case file (a cardboard box) because it was collected in 1996 as part of his motion for DNA testing to exclude both himself and Beernsten.

    Was there a vial of Avery's blood stored at the prison hospital from a different year? Is that what Zellner means by her tweet on December 4, 2016:

    "Experts experiments confirm SA's trial attorneys correct about blood being planted but incorrect about how it was done."

    Did the plan to frame Avery for a crime begin in 2003, before he left prison. Was Joshua Radandt a willing participant in this framing?

Hey Magiclougie thanks for your reply- I nearly didn't add the bit about Bruechert because it seemed a bit out there, but I did think there was something compelling about it, because as you show, it does fit in with the facts as we know them. I hadn't thought of the possibility that RR was actually part of a set up that was arranged before he was released but I think you are right to explore that - it fits! Like you, I'm wondering how Joshua Radandt fits in - what does he know? Also, the white van is interesting because didn't someone who lives by the quarry say he saw Teresa's car and a white van or Jeep enter Avery Salvage the night before the car was discovered. Wow! We need to find out the source/age of the blood but it does fit and its a working theory! I'm going to try and find out more about RR and thanks again I think this is an interesting thread. The weak link is if RR wasn't in fact in prison with SA but as you say, that isn't so critical if he was part of a grander plan, hatched by a person or persons more powerful...

    2. Yeah, Avery's neighbor did say he saw a white jeep following Teresa's vehicle from a back road into the salvage yard before the RAV4 was discovered on Nov 5th.

      But from the report on Bruechert's interview by CASO, Raduenz's van was actually more like a box truck/U-haul moving truck, not a regular van or jeep or SUV:

I-43 IS A HIGHWAY SO IT IS UNLIKELY THAT HE WOULD HAVE ASSAULTED HER THERE WITH THE HIGH LIKELIHOOD THAT THERE WOULD BE WITNESSES TO THE CRIME. HE DIDN'T ELABORATE ON THE DETAILS OF THIS ALLEGED ASSAULT. TERESA HAD ROADSIDE ASSISTANCE BY TEXTING #HELP ON HER CINGULAR CELLPHONE, SO WHY WOULD SHE SEEK ASSISTANCE FROM A STRANGER? DID RADUENZ ABDUCT HALBACH FROM THE SIDE OF THE ROAD, FORCE HER TO DRIVE HER RAV4 WITH HIM IN THE BACKSEAT WITH A GUN TO HER HEAD TO ANOTHER LOCATION, WHERE HE SEXUALLY ASSAULTED HER AND KILLED HER? BUT IF SHE WERE OUT OF GAS, THAT WOULDN'T HAVE BEEN POSSIBLE. HAD HER CAR BEEN ABANDONED ON I-43 BECAUSE SHE WAS OUT OF GAS, SOMEONE WOULD HAVE SEEN IT THERE, YET THERE ARE NO REPORTS OF THAT. IS RADUENZ MAKING UP THE I-43 ENCOUNTER OR ANY ENCOUNTER WITH HALBACH?

    Bruechert stated Raduenz went on to tell him that Raduenz had come upon Teresa Halbach, who had run out of gas on I43. He had tried to have sex with her, she refused and he killed her.     Bruechert indicated he had never been in prison but had spent some time in the Winnebago Resource Center approximately 20 years ago.

    BRUECHERT COULDN'T REMEMBER THE EXACT TIME RADUENZ TOLD HIM THIS STORY WHILE DRIVING IN HIS VAN, BUT THOUGHT IT WAS IN THE FALL OR DECEMBER OF 2006, A YEAR OR SO AFTER TERESA HALBACH DISAPPEARED.

    Bruechert was asked when the conversation had taken place inside the van between himself and Raduenz. Bruechert estimated it to be a warrn day and told investigators he believed September, 2005. Inv. Steier informed Bruechert that Teresa Halbach had not been killed until later that year and was still alive in September, 2005. Bruechert then indicated he thought it was in the fall or December of 2006.

    BRUECHERT STATED THAT RADUENZ WAS A TRUCKER, BUT BRUECHERT'S FRIEND, WHO WAS PRESENT DURING THE INTERVIEW, SAID RADUENZ WAS NOT A TRUCKER BUT DROVE A WHITE U-HAUL TYPE VAN, WHICH HE DROVE AROUND WITH STOLEN GOODS IN THE BACK.

    Bruechert indicated Raduenz was a trucker. Bruechert stated he did not know the whereabouts of Roger Raduenz and was trying to locate where he was.

    The female subject who was present, who wished not to be identified, identified only by her first name of Sandra, indicated she also knew Roger Raduenz.

    Sandra indicated Roger Raduenz was never a truck driver but drove a white panel van, which he drove with stolen goods in the back. Sandra indicated Roger Raduenz would steal stuff and transport the stolen items in his van. She described it as a white moving truck like a U-haul type.

    She indicated she contacted her son, Travis Lemay (ph), approximately 32 years of age, by cell phone and asked her son, Travis, if he knew where Raduenz was.

    According to Sandra, Travis told her over the phone that Roger Raduenz was trouble and Thomas Bruechert should stay away from him. Sandra also indicated Travis said he had beaten up Roger Raduenz once and did not like him. Sandra also indicated Travis stated he has not seen Roger Raduenz since.

    I found the tweet and related reddit post about Kathy Raduenz being Kratz's mother and Roger Raduenz being his uncle.

    After doing research online I can say for sure that Ken Kratz's mother is NOT Kathy. Kathy never married Ralph Kratz of Manitowoc. And Ralph is not KK's father.

    Kathy Raduenz would have been born in the 1940s or 1950s (her brother Roger was born in 1942). She was engaged to Ralph Kratz in 2003, which would make her at least 50-something at the time. Three years later, in Sept. 2006, Kathy's last name still was Raduenz (per her mother's obit), so she never married Ralph Kratz, who was her fiance in Sept. 2003 (per her stepfather's obit), or she never took his name. I can't find anything for a Ralph and Kathy Kratz in Wisconsin, so I think it's most likely she never married Ralph Kratz and still goes by the name Kathy Raduenz (and maybe never married).

    The stepfather's obit in 1984 lists Lorraine's two sons and six daughters; however, Lorraine's obit in 2006 only lists one son and five daughters. Rogene and Roger were not mentioned.

    Lorraine, Kathy and Roger's mother, died on September 25, 2006.

    Roger R. Raduenz died on October 16, 2007.

    There is a Kenneth R. Kratz from Wild Rose, WI (born 1934; died 2004 ) with possible relatives Nancy Lee Kratz (born 1936), who also at some point lived in Wild Rose, and Kenneth Ralph Kratz, age 55 (this would be KK).

    I think Kenneth R. Kratz (Sr.) and Nancy Lee Kratz are KK's parents.

Thanks Magiclougie I really enjoyed these comments - I thought the connection to KK was a long shot but the exchange of tweets was between someone from Zellner Law and I thought it was interesting - not least because Zellner Law were talking about it. There is a tape of the interview with with RR but it isn't available and I think this is because it being held as evidence - I read (didn't make note) a request for it to be released and it was rejected. It is recorded on Calmut County log under an incorrect name - RADOVENZ. (stevenaverycase.org) I read the CASO interview and I made a note of a few things:Radandt stated he wouldn't have been asked to help carry out blood from prison by inmates because he was friendly with the guards. How friendly ? He had privileges (he said they let him use tools).

    Raduenz stated he could not be sure if he had given her (TERESA) a ride because of the way women change their hair. Was he in the habit of picking up women he didn't know? Was he covering his tracks incase they actually inspected his van? He needn't have worried - a cursory look through the windows and job done! I think RR was a driver for Dedicated Systems. I didn't pick up the bit about befriending Brendan, that is chilling, the most vulnerable and as it transpires the most exploited of all the people close to Steven - it really is sinister. Very disappointed to hear RR is dead - I really hope someone is held to account - perhaps there's more?

      So there is a tape of Roger Raduenz's interview but no tape of Bruechert's interview? That's the one I really would like to hear.

      It's unfortunate (and perhaps "convenient" for LE) that RR died six months after Steven and Brendan were convicted.

      March 18, 2007: Avery is found guilty of intentional homicide and being a felon in possession of a firearm. He is acquitted of mutilating a corpse.

      April 25, 2007: Dassey is found guilty of sexual assault, party to a homicide, and mutilation of a corpse.

      October 16, 2007: Raduenz dies at the age of 65.

      I'd like to know exactly when Bruechert talked to MTSO. He told them the story but they didn't write a report, of course.

      It was more than a year after Teresa disappeared when Bruechert was interviewed by CASO.

      CASO wrote that "Thomas Bruechert indicated he was waiting for investigators to speak with him about the incident."

      If Bruechert took that van ride with RR in the fall or December of 2006, I wouldn't be surprised if he recounted the story to MTSO prior to January 2007, and yet they waited to inform CASO until near the start of Avery's trial in February 2007. Or maybe CASO took their time contacting Bruechert so that Avery's defense wouldn't have time to investigate the story.

      I haven't read Raduenz's interview with CASO. After I do, I'll be back to post my thoughts.

    On Friday, 01/26/07, I (lnv. STEIER), along with Inv. WENDY BALDWIN, both of the CALUMET COUNTY SHERIFF'S DEPARTMENT, did interview ROGER R. RADUENZ. M/W, DOB 11/09/42, at his apartment complex of 1325 N. 8th Street, Manitowoc, WI.

    Investigators identified themselves as from the CALUMET COLINTY SHERIFF'S DEPARTMENT and informed RADUENZ they were investigating the TERESA HALBACH murder. RADUENZ indicated he had nothing to say.

    Inv. STEIER informed RADUENZ an individual, who he had given a ride in his van, had told investigators a story. RADUENZ remembered the individual, describing him as the guy from Two Rivers. RADUENZ also indicated the guy was always in jail.

    RADUENZ was asked if he knew STEVEN AVERY. RADUENZ replied he only knew him from the junkyard.

    RADUENZ was asked if he was ever in prison with STEVEN AVERY. RADUENZ indicated he probably was in prison at the same time as STEVEN AVERY but never had contact with him.

    RADUENZ indicated no one had ever given him anything to take out of prison nor had anyone given him blood to take out of prison.

    RADUENZ indicated he was out of prison before anything like that had ever happened.

    RADUENZ stated he was familiar with the story Inv. STEIER began to explain to him (the story of prison inmates smuggling STEVEN AVERY's blood out of the prison).

    RADUENZ denied having any mutual acquaintances between himself and STEVEN AVERY while in prison.

    RADUENZ then informed investigators he was in MANITOWOC COUNTY JAIL with STEVEN AVERY the first time STEVEN AVERY was charged with a rape case in the 1980s. RADUENZ indicated he was in the same cellblock as STEVEN AVERY but did not speak with him nor was he in the same cell as STEVEN AVERY.

    RADUENZ said no other inmates would have been talking with STEVEN at the time because they were both in isolation. No other inmates were in the same cell as himself nor was anyone else in STEVEN AVERY's cell.

    RADUENZ denied ever being aware of any blood from STEVEN AVERY while he was in the MANITOWOC COUNTY JAIL or while STEVEN was in prison. RADUENZ indicated he was not aware about it and DNA was not even talked about back then.

    RADUENZ denied telling a story about STEVEN AVERY's blood to THOMAS BRUECHERT.

    RADUENZ also denied ever having met or having contact with TERESA HALBACH.

    RADUENZ indicated THOMAS BRUECHERT had probably told the story to get ROGER RADUENZ in trouble.

    RADUENZ did recall giving THOMAS BRUECHERT a ride in the winter of 2005.

  31. RADUENZ stated in the fall of 2005, he was a truck driver for DEDICATED SYSTEMS. RADUENZ indicated he was an over the road truck driver and was never in the area. He indicated his truck driving would take him to Texas, Florida, Louisiana and Atlanta. RADUENZ indicated when he did return from his truck driving routes, he was only in the area one or two days and he would be gone again with an over the road delivery. RADUENZ indicated he lived in his truck semi trailer at the time he worked for DEDICATED SYSTEMS. RADUENZ indicated he did not have a home address, only a P.O. Box at the time. RADUENZ indicated he did have all his log books to show where he was back in 2005. When Inv. STEIER asked to see his log books in his apartment, and asked if the log books were in his apartment, RADUENZ indicated he did not want to answer that because they would probably get stolen now.

    Inv. STEIER then showed RADUENZ his badge and produced for RADUENZ a photo ID of a CALUMET COUNTY SHERIFF'S DEPARTMENT employee as well as a WI Driver License. RADUENZ then indicated he was okay in believing I worked for law enforcement.

    RADUENZ was again asked if he had told the story to THOMAS BRUECHERT of how he smuggled STEVEN AVERY's blood out of prison. RADUENZ again denied the implication that he was involved in TERESA HALBACH's murder or framing STEVEN AVERY.

    RADUENZ indicated he would not have been asked by prison inmates to help carry blood out because he was friendly with the guards. RADUENZ indicated his being on the good side of the prison guards allowed him to work with tools and do maintenance. RADUENZ indicated he would never do anything like that to start with because it would break his trust with the guards and he would not have been allowed to use the tools in the maintenance position.

    RADUENZ indicated the story was a lie and THOMAS BRUECHERT was a liar. RADUENZ indicated BRUECHERT had asked him for $20.00 during the time he had given him a ride in the fall of 2005.

    RADUENZ indicated he did not know TERESA HALBACH and he had not killed TERESA HALBACH.

    RADUENZ indicated he had been at the AVERY'S SALVAGE YARD looking for parts prior to TERESA HALBACH's disappearance. RADUENZ stated he hung around with AL AVERY but did not hang around with nor was he friends with STEVEN AVERY or any of his brothers.

    RADUENZ indicated the only thing he had to do with the AVERYS was on a previous occasion he had gotten parts from the AVERY'S SALVAGE YARD. That was the only thing he had in common with STEVEN AVERY. RADUENZ indicated the last time he had been to the AVERY'S SALVAGE YARD, he had looked for a power steering pump for his van. He indicated the AVERY brothers were too busy to wait on him. He did find a van, however, he did not purchase the power steering pump from the AVERY'S SALVAGE YARD.

    RADUENZ indicated he believes the last time he had been at the AVERY'S SALVAGE YARD, which was to buy the power steering pump, would have been in September, 2005.

    RADUENZ was asked by investigators if he had ever helped a stranded motorist on I43.

    RADUENZ indicated he could recall helping a stranded Sheboygan motorist in a canteen truck.

  32. RADUENZ was asked if he had ever given TERESA HALBACH a ride. RADUENZ indicated not that he remembered. RADUENZ was asked if he knew what TERESA HALBACH looked like. RADUENZ indicated he had seen a picture of her in the paper. RADUENZ stated he still would not be sure if he had given her a ride because of the way women can change their hair.

    RADUENZ indicated there was a time when he worked out in Washington State for a MANPOWER COMPANY. RADUENZ indicated there were two girls that worked for MANPOWER with two different names. RADUENZ indicated they turned out to be the same individual. RADUENZ then indicated the woman had changed her name three times but was the same woman just using three different names. RADUENZ indicated he had gone to this place too many times and had noticed this female using multiple names. RADUENZ then indicated that if Inv. BALDWIN were to shave her head, he would not recognize her. RADUENZ indicated a lot of blacks do that now, they have their hair up and the next time you see them in the same spot they are bald.

    RADUENZ indicated he had never picked up a white female on I43 who was a stranded motorist or given assistance to a white female.

    RADUENZ indicated he did not kill TERESA HALBACH and there would not be any reason for him to do that. RADUENZ also denied taking TERESA HALBACH's body and placing it by STEVEN AVERY's trailer in an attempt to frame STEVEN AVERY. RADUENZ also indicated he did not take any of STEVEN AVERY's blood and place it on the AVERY compound in an attempt to frame STEVEN AVERY.

    RADUENZ theorized that someone with motive would have done the murder. RADUENZ lacked motive.

    RADUENZ indicated he did not need a business card from Inv. STEIER because he knew that he was a police officer and if he had any information, he could call the MANITOWOC COUNTY SHERIFF’S DEPARTMENT oR the CALUMET COUNTY SHERIFF'S DEPARTMENT.

    The interview ended at approximately 1:03 p.m. The ROGER RADUENZ interview was recorded. The recording CD was placed into evidence.

    As investigators were leaving the apartment complex, Inv. STEIER did notice a white van with WI registration of 626-JNP. A vehicle registration check of the van listed to a ROGER RADUENZ. Inv. STEIER and Inv. BALDWIN were able to look through the numerous van windows into the interior of the vehicle. Inv. STEIER and Inv. BALDWIN did not observe any dried bloodstains or any substance that would appear to be bloodlike.

      On Thursday, 01/25/07, I (Inv. STEIER) used Wilenet, a law enforcement website for the State of Wisconsin, to determine WI DEPARTMENT OF CORRECTIONS locations for STEVEN A. AVERY and ROGER R. RADUENZ. Both records from the DEPARTMENT OF CORRECTIONS were printed and are attached to this report.

      I compared the correction facilities where STEVEN AVERY and ROGER RADUENZ were located during their time of incarceration. In comparing the locations, ROGER RADUENZ and STEVEN AVERY were not incarcerated in the same facility at the same time.

      Information provided on the offender.doc.state.wi.us website shows ROGER R. RADUENZ was incarcerated from 09/01/81at WCI RECEPTION to 10/02/81 where he was incarcerated at WAUPUN PROPER. RADUENZ stayed at WAUPUN PROPER from 10/02/81 to 06/02/83 where he was transferred to FOX LAKE until 10/08/03. On 10/08/03 he was returned to WAUPUN PROPER for release on 07/24/84.

      RADUENZ was again incarcerated on 05/22/86 at DODGE RECEPTION until 07/17/86. He was moved to WAUPUN PROPER and released 8/11/87.

      On 04/18/91, RADUENZ was again at DODGE RECEPTION until 06/13/91 when he retumed to WAUPUN PROPER until 08/02/93. He was moved KETTLE MORAINE INSTITUTION until 12/15/98, at which time he was released.

  33. Hey Magiclougie I've just discovered something weird. RR's brother, Michael Raduenz, died the day before Roger, October 16 2007. He died in Casa Grande at RTA Hospice House, aged 58. I know this is definitely his brother because his parents are the same - Lester and Lorraine Raduenz. But here's an even weirder thing - the obituary says Michael was preceded in death by his parents, Lester and Lorraine and his brother ROGER RADUENZ. Why does this obituary say Roger is already dead if he actually died the day after his brother? The plot thickens...

  37. Hey Magiclougie, TJB is Thomas Jon Bruechert, the man who was initially interviewed regarding his encounter with Roger Raduenz. As he was convicted of First Degree Sexual Assault in Manitowoc in 1991, I wonder if he was in the same prison as Steven Avery? I don't know how RR died but the timing of the interviews and his death is significant I think. The report is tucked away at the end of CASO and coincides, I think, with the trial starting and the investigation closing. I read a post by Foghaze on Reddit in which he speculates that it is as if the police did not want the prosecution to have time to examine this properly. I'm going to keep digging. Did you know that Carmen B
    whose death coincided with Teresa's died of a methadone overdose but she did not have a prescription for methadone? I read an interview with Lt. Dave Remiker of the Manitowoc County Metro Drugs Unit on the subject of her death, another unsolved Manitowoc crime.

    Coaching testimony

    A major incentive for prosecutors to use cooperating witnesses is to support an uncertain but consistent version of the facts, rather than to confirm an inconsistent version of the facts that may represent more of the truth.

    By incorporating the day 2 coached testimony from Drumm, watching the flyover video and then comparing the 4:22 marker from the flyover video and the 0:34 marker of this NBC26 video (or image from same video), I've come to the conclusion that 0:34 - 4:21 of the video is from the Nov. 4th flyover and anything after the 4:21 marker was recorded between November 5th and November 8th.

    I think the tire was changed out before crime lab... I think we see a spare on her front end at the time PS took the photos... I believe Pam's image was intentionally blurred. I think her spare tire from the rear was switched around later...

    I think all of the staging done around the RAV was to prevent law enforcement from properly documenting its state of disrepair... with an hour and a half unaccounted for during the road trip over to crime lab, law enforcement had a lot of time to deal with some issues...

    That the agency that should not have been involved in the first place, had their hand in the following questionable pieces of events and evidence:

    Colborn lies about the day he makes a license plate call about the RAV4, and the call is actually an entire day later than testified to. If the call is an entire day later as shown by evidence audio and timelines, what is the real reason he is making that call, if not to verify information just given to him by Inv. Wiegert?

    Det. Jacobs records a voicemail from the Zipperer residence on 11/06/05, but never hands it over to Calumet County. In addition to breaking the chain of evidence, the voicemail, today is missing.

    MTSO Bushman stumbled upon a burial site near Kuss Road, a day before major pieces of evidence are found near Steven Avery's trailer. Colborn made his was over to the burial site that day as well.

    MTSO Deputy David Siders stumbles upon a barrel of burned electronics in front of Steven Avery's trailer, the same day a burn site is discovered near Kuss road.

    MTSO Deputy Jost notices what looks like a bone, about 8 feet south of Steven Avery's burn pit on November 8th, a day after the Kuss road burn site is discovered.

    MTSO Sergeant Colborn and MTSO Lenk discover a key on 11/08/05 that seems to defy gravity and logic. The explanation given at trial was the he was exasperated from collecting pornographic magazines and searching the 8x8 bedroom for over an hour and a half. He roughly handled the book case which also defies the before and after photos of the bookcase as told to the jury at trial (ex 208 and 210 respectively)

    MTSO Lenk and Colborn recommend that trunks of cars are re-searched and popped a day after firemen and volunteers went through all cars on the salvage yard. License plates are found later that day in the rear seat of a station wagon near the driveway leading up to Dassey/Avery trailers.

    Manitowoc County does not hand over dispatch recordings in discovery until Summer of 2006, which contains vital phone calls that show several things, such as Colborn making a license plate call which is later lied about under oath, and Calumet County giving their theory of the timeline before the RAV4 is found the morning of 11/5.

    I am not sure if I am missing any more oddities with Manitowoc County's involvement in this case.

  42. Events coming into focus for 11/04/2005: The Planting of the RAV4 (self.TickTockManitowoc)

    With the new affidavits from Kevin R. and Wilmer S. and the dispatch analysis putting the Colburn license plate call between 2:00 pm and 7:30 pm on 11/04/2005, the evidence showing the planting of the RAV4 on the Avery Salvage Yard is coming into focus.

    (1) Det. Remiker and Lt. Lenk visit Steven Avery's residence from 10:20 am to 10:38 am. This was an opportunity to get a bloody item from Steven's bathroom or laundry room. "Prior to leaving, we thanked STEVEN for his cooperation."

    (2) Kevin R. sees Colburn (in uniform on his day off) at Cenex and tells him about RAV4 at the old Mishicot dam turnabout. Colburn goes to investigate, but never reports finding it.

    (3) Colburn finds the RAV4 and calls dispatch to verify the RAV4 plates. The latest analysis puts this call between 2:00 pm and 7:30 pm. The most likely window for this event is 2:00 pm to 5:06 pm (dusk).

    (4) Colburn calls the MTSO posse together to decide what to do. If the keys are missing, perhaps the posse contacts Scott B. or Ryan H. to see if there is another key to move the RAV4. Was the lanyard sub-key at the house?

    (5) Sometime prior to dusk (5:06 pm), Wilmer S. sees the RAV4 and the white jeep with the hood stain move onto the Radandt Quarry property. Shortly afterward, he sees the jeep leave, alone.

    (6) Also sometime prior to dusk, the air search ends without finding the RAV4. The footage of the search is later edited to omit any clear pictures from the vicinity in which the RAV4 was found, perhaps because they show that the RAV4 was not there. Perhaps other footage shows the RAV4 at the turnabout.

    (7) The dog search team identified the back entrance to the salvage yard on the conveyor road as a key position, with three dogs alerting in this vicinity. Could this be where the RAV4 sat, as the planting team waited for darkness to come.

    (8) Once darkness sets in, around 7:20 pm to 7:40 pm, Chuck sees headlights near the quarry while leaving for Crivitz. Chuck calls Steven and tells him about it. Steve and Bobby drive part way into the "pit" to check for a car. The posse is planting the RAV4.

    (9) Ryan H. speaks to Law Enforcement 22 times this day, between 3:11 pm and 7:25 pm. Did Ryan H. and Mike H. bring the sub-key to Colburn at the turnabout and help him plant the RAV4? Did they bug out as soon as the RAV4 was planted?

    (10) Blood is planted in the RAV4 by the MTSO posse. Perhaps Lt. Lenk took advantage of his opportunity that morning to get blood from Steven Avery's residence. The blood may have been smeared onto the CD case and then applied to other surfaces using a forensic swab or q-tip, per KZ's expert.

    (11) Ryan H., Mike H. and the MTSO posse plan the Pam-of-God search to discover the RAV4 the next morning. Key phone numbers and a camera are selected to assist Pam in her mission.

    The Zellner investigation is closing in on the events of that day. What else may help prove that the RAV4 was planted that night?

  43. At some point between November 5th and before Groffy arrived to examine the vehicle at the crime on November 6th, Teresa's RAV4, Sam William Henry, was unlocked and entered.

    As provided in the Official 1999 Toyota RAV4 Owner's Manual (pgs169-170), the correct towing procedure for Sam William Henry, in order to avoid damaging any components of the AWD Automatic Transmission drivetrains, is to permit no turning of the wheels:

    However, and not recommended, an AWD vehicle can be towed on two or all four wheels for a short distance only if the automatic transmission is in neutral.

    If a wheel is disengaged from the transmission/engine, the transmission does not affect it (and vice versa) and the wheel can turn freely without causing any damage.

    After transporting Sam William Henry to the WSCL garage in Madison, consistent with his elaborate testimony that only the front wheels rolled, Mr Ertl added to his testimony that the rear wheels remained locked:

    From Steven Avery Trial Transcript, 19 February 2007 (Day 6), Page 33:

    Ertl: When we arrived in Madison, I called the local wrecker company to come and do the opposite of what the wrecker had done at the scene in Manitowoc, to lift up the back end, pull the vehicle out of the trailer, and then put it into the garage, because the back wheels were still locked.

    It in fact does not matter whether it was a driveshaft to the front or the back wheels that was disengaged at the Avery Salvage Yard: both the front and back wheels show evidence that they have both turned freely.

    It is also not necessary, in the event that all four wheels have turned freely, for all four wheels to demonstrate the exact same degree of rotation. The differentials for the front and back wheels are independent, and allow for the wheels to turn at different speeds/distances. Towing Sam William Henry from where it was located at the Avery Salvage Yard to where it was loaded into the enclosed trailer required at least one sweeping 90o turn and some manoeuvring; and some further manoeuvring was also required at the WSCL garage. If the rear wheels of Sam William Henry were lifted even once off the ground, at the Avery Salvage Yard or the WSCL garage, the front and back wheels then certainly covered different distances.

    Towing a vehicle with locked wheels, such as an Automatic Transmission in Park or with a brake applied, results in skull-dragging. Skull-dragging can apply torque backwards through the drivetrain by forcing a wheel to turn, leading to damage to the components of that drivetrain.     I would like to point out something very odd in the cross testimony by the defense.

    The defense insisted that 4 doors were locked.

    2 front doors

    2 rear doors.

    Over and over in testimony we are told about the 4 doors being locked.

    But there is actually a 5th door. That door being the cargo door.

    That door for some reason was a third rail. In particular Strang nor Buting approach and tackle the subject

    We learn from Nicole Sturm's testimony that that cargo door was never checked by neither herself or her mother Pam

    It begs the question:

    If they never checked to see if it was unlocked. Then was it locked at all?

    Law enforcement certainly never checked to see if it was unlocked. In fact they stayed as fr away from the vehicle as possible.

    It is logical to conclude that the cargo door out of all 5 doors to the RAV4 was most likely **UNLOCKED

    Everyone, including LE avoided the cargo door like the black plague.

    IMO when the RAV was planted on the ASY and locked to keep anyone from moving it or entering it to frame SA they didn't think ahead as to how they were going to move it to the lab, hence the idea to tarp the RAV to move it out of Park.

    I have no solid theory but I've thought many times that the interior panels might have been switched. Just sitting here now I don't have the link (sorry!) but there was a photo of the back interior tailgate panel that seemed like the plastic bolts or covers had seen some "wear" if you know what i mean. There was nothing in the low res image I could truly confirm this but it just had the impression that they all had been turned, removed, or something along those lines. Speculation on my part, it's just what it seemed at the time. Just bolstering your idea as I've had the same.

    Sorry trying to read this over at lunch but wanted to comment in hopes to hears others thoughts. First the glass marking isn't a sticker its a factory etching. So to replicate this is about impossible.

    Lastly one thing some haven't spoke about is Toyota offered me a "sticker/label" that goes on doors, trunks and..... Hoods just incase of being stolen a thief would try to remove the sticker and it etches a code number down to the steel. This number is registered and has a correlation to the correct VIN. Knowing how TH was with paper work I'm sure she had down this. The point being look at the under hood latch photo and this sticker is there. It looks like a wax paper covering a small label.

    The driver's fender well liner was particularly interesting, as to can now see better than ever before what appears to be the plastic fender was pushed up into the wheel well such that jammed up into the top of the wheel well and is in contact with the tire. I always wondered what that was in the other pictures, it almost looked like foam or something (it was mud on the plastic inner fender). We also have the best pictures to date of the damaged light. There is very little chance TH was driving that vehicle with the plastic fender jammed up in the wheel well. That would have caused a terrible racket going down the road.

    I'd like to bring up something I noticed when MaM first came out. The Rav4 is missing a wheel well cover or also known as a fender liner. It's a large piece of plastic that covers the entire underside of the fender. You should not be able to see the tire through the broken blinder assembly!.

    You should see the wheel well cover (fender liner), which is on the under side of the fender. It is a large plastic shield under the fender.

    Here is a video (go to 1:58 seconds) showing the underside of a RAV4, front driver's side. You can see the fender liner (and, because of the fender liner, not the blinker).

    Notice the black plastic liner throughout the entire underside of the fender? Well in the photo of the RAV4 with the missing blinker you can see the tire through the hole - you should not be able to see the tire because the fender liner should be there.

    The fender liner was damaged when the car hit something and damaged the front bumper. The damage meant the lining was hanging down and rubbing onto the tire.

    Did something pierce the signal light all the way through to the fender liner, bending the liner back so that that part of the liner was rubbing against the tire?

    How would the damage on the underside tie to the damaged fender liner? Had the RAV been in a ditch at some point? Stuck on a rock or ditch driving through the quarry to plant? Happened towing?

    When the RAV lost the blinder light, they got out and picked it up but didn't notice the liner was loose and drove/kept towing it?

    The liner is attached with retaining pins/moulding clips. On low impact crashes the liners come loose real easy.

    With a liner intact, you should not be able to see the tire!

    I had a body shop give me an estimated of all damages based off the picture - it's over $1400 in damages, in today's repairs (this car was only 5-6 years old at the time and the estimate would have been way higher).

    VIN: JT3HP10V5X7113044

    The 9th digit is a "check digit" used to check invalid VINs ("5" in the VIN above).

    The remaining digits are the serial number: X7113044

    The 10th character in a VIN tells you the model year.

    1. Teresa's RAV chassis (at least) was built at a plant in Japan, the plant number confirms this. Japanese cars of that period did not have a VIN number, they were built with a 12 digit chassis number.

      When the cars are then imported to another country there are digits added in front of the last 7 digits of the Chassis number to form a 17 digit VIN. Therefore what you see in the firewall photo is the chassis number prior to the rest of the vehicle being fully built and assigned a 17 digit VIN in another country.



      EDIT TO ADD: Only the last 6 digits (7 in Europe) are unique to a vehicle, it is the same as a serial number, therefore the last 6 digits of the chassis number and VIN number are exactly the same, meaning it is a MATCH. I did not write this post to disprove the two RAV theory, it was merely to establish why there was what looked like a shortened VIN in the firewall, however by establishing that it is a chassis code which then turns into the last 6 unique digits of a 17 digit VIN, it confirms that the photos at least are all of the same car.

  50. The firewall number was noticed straight away in the photos and I've already had a number of robust arguments with some well-meaning people about this.

    My understanding is the firewall number is a chassis number assigned before or during assembly, which was later incorporated within the VIN number once assembly was complete. The VIN number itself contains information which cannot exist until assembly of the vehicle is complete.

    For starters, the firewall number is not a 17-digit number so you know straight away it is not a VIN number.

    The 1996-2000 RAV4's were first generation or XA10 series vehicles. From 1998, some variants in the XA10 series were designated SXA11. The SXA11 is what the firewall number begins with - so that tells us that firewall or chassis part was produced to be part of a SXA11 vehicle. The last 6 digits of the firewall number (113044) are the production number, which are the same 6 digits seen in the VIN number (JT3HP10V5X7113044). This is the actual production number of the vehicle (it's own in-/out- house serial number if you like), which would have been assembled with major parts that should all include this same 6 digit number.

    Once assembly is complete, other information is added to the VIN such as engine specs, transmission, country/plant of assembly, year of assembly etc. These aspects of the vehicle can be variable and subject to change during assembly, and therefore the VIN cannot be assigned until after the vehicle is assembled. Numbers in hard to reach places (like the firewall) therefore cannot have the VIN pre-designated.

    As far as evidence supporting ONE RAV4 belonging to Teresa Halbach:

    (1) There is documentary evidence the number 'JT3HP10V5X7113044' is linked to Teresa Halbach by the DOT record. Unless the DOT record is fraudulent, that VIN number, and any vehicle it is found on, belongs to Teresa Halbach.

    (2) All available RAV photos, regardless of when they were apparently taken, are consistent with the expected features/extras as dictated by the manufacturers vehicle specifications.

    (3) All available RAV photos, regardless of when they were apparently taken, appear to consistently show the same vehicle with the same features/extras/damage.

    (4) All available RAV photos, regardless of when they were apparently taken, consistently show the 'JT3HP10V5X7113044' number (complete or partially) on the windshield, left and right sides of the engine bay, under the hood, and on door frames.

    CASO did not take into evidence important papers from Teresa Halbach's home, such as the copy of her RAV4 title, insurance documents, Social Security card, birth certificate, passport, etc.

    Wisconsin DMV generates a title and sends it to the owner, which was Teresa Halbach's financing company in Atlanta. So the original and actual title to Teresa's vehicle was held by Toyota Motor Credit Corp.

    The Wisconsin DMV would have a record/copy of TH's RAV4 title.

    Erie, Teresa's insurance company, would have her VIN in their records. Zellner has been in contact with Erie.

    The Wisconsin registration and proof of insurance were missing from the RAV4 at ASY.

      It's not the camera's that said the RAV 4 is GREEN......it's Karen Halbach who said it's GREEN, it's the missing poster that said it's GREEN, it's Teresa's friends who said it's GREEN, it's Tom Pearce that says it's GREEN. Witnesses who say they saw a jeep parked at STH 147 call it GREEN

      "An Attempt to Locate was issued for TERESA HALBACH and her vehicle, a 1999 Toyota RAV4, dark green" (pg 4 CASO)

      "Around 8:00 a.m. on Thursday,11/03/05, ROBERT FABIAN states he did observe a GREEN jeep backed all the way up at a parking area on STH 147 by the river. ROBERT described this area as a turnaround. ROBERT recalls seeing this jeep at 8:00 a.m. because he had seen a male subject talking on TV about a GREEN jeep being in the area." (pg 320)

      Yet hours later it suddenly is a GREEN car again when officers stand gard?

      "While standing guard over a GREEN Toyota RAV4, I could see the sky was getting very dark and there was a mist in the air. There was talk amongst several of the officers to put a tarp over the GREEN Toyota RAV4 to protect any possible evidence on the exterior of the vehicle. A tarp was produced and I did assist in getting objects from in back of other vehicles to help weigh down the tarp to prevent it from blowing away. Extreme care was used by the officers to prevent the tarp from touching the GREEN Toyota RAV4. Once the tarp was in place, Inv. STEIER notified me that my assistance was needed back at the command post. Deputy BASS did relieve me in protecting the GREEN Toyota RAV4.       Everybody who saw the pictures taken by Pam Sturm on the day she found the RAV sees a BLUE car..........everyone who saw the picture of Teresa in front of the RAV......sees a GREEN car

      And people keep talking about lightning?

      Really?

      Only if Pam Sturm and the rest of the world who sees a BLUE car on the property of Steven is color blind (which I am not) it would be fair to say.....maybe you don't see colors straight......but I bet 99,99% of people who see a BLUE car on the property of Steven is not color blind.....just like Pam Sturm isn't.

  52. Hello it's been a long time since someone has written a comment on here so I hope you get this, what was that by the left tire Wheels here is the answer? Fender liner damage, I wish I can show you the pictures I found but it's easy to look up, you look very close to one of the pictures that you have, you can see the opening where the left blinker light is the light is shining through from the Sun and then you can see the inner parts above where the fender liner should be. I have some other stuff so I'm going to leave you my number because I have no choice nobody else call me except him please πŸ™‚ 951-305-6888 this is a temporary free number I got from the app store.

    When it is cold, plastic parts can break very easily. Driving over packed snow or a high curb could cause damage to your fender liners. If you are driving in the rain with a damaged or missing fender liner, moisture could get inside the wheel well and corrode the headlight's wiring.

    Can you drive with a broken fender liner?
    No no and even more no! The fender liner is the one most crucial pieces of equipment on a vehicle. It's the centre point of all mechanical devices. The suspension will fall off if a fender liner is missing.

    Can I drive without a front fender liner?
    driving without front fender liner? It is fine to drive without the wheel well liner. It won'y hurt the tire. Only will send all the water and dirt from the road up into areas inside the fender.

  53. i have a couple questions and wanted to see if any could answer

    1) which way was the parked Rav4 facing on the ridge

    2) with the direction it was facing what would be the most likely route? if it is facing away that would suggest from inside Salvage yard, how did no witness seeing it driven? Not Barb, Nieces/Nephews Chuck, Earl, Parents, nobody. and if it never left the yard not only would it have to be driven past everyone, pushed/driven up the ridge with no one hearing, wiped of all finger prints but leave obvious blood, but also steven would have to walk all the way back with no witnesses.

    3) if it is on the ridge how easy would it be to be pushed/driven onto the ridge with its height or more likely came from Randant

    4) is their a fence or anything besides 2 foot medal rod blocking access to yard from Stevens?

    5) the state suggest Steven after murdering someone sometime after 230pm, mutilate/dismember body ,burn remains and her personal belongings all on Oct 31, but not get rid of vehicle for the next 5 days? also did not check burnpit and other areas to make sure all bones/property were completely destroyed prior to missing person call on Nov 3rd? Hes advanced enough to get rid of every single trace of dna in trailer and garage (besides bullet) but didnt think to verify bone property evidence was completely unretrievable.
