Shelter vital over winter

Homeless people seek comfort from the elements regardless of how low the mercury dips.
That was the case during Trail’s mild winter, because no matter the
temperature, an average of two people sought beds at the city’s
temporary shelter each night.
The La Nina Extreme Weather Emergency Shelter offered services to mostly
middle aged males who were homeless and needed a warm place to rest
their heads from November 1 to February 28.
The demographic evolves from those who are homeless to women seeking
shelter from domestic situations, and those travelling through the area
for medical appointments with no transportation back home. One constant
element since the shelter opened in the Trail United Church, is that
over the past three years, people use the six-bed service snow, rain or
shine.
“The usage for the shelter this year was steady in November and December
due to a few individuals waiting for available housing,” said Teresa Crockett of Career Development Services (CDS), the organization that runs the shelter.
January slowed down, however the shelter was utilized for some crisis
situations, she explained. “And individuals stranded and travelling
through town.”
She said one to two people accessed the shelter nightly, with the most being four in one shift.
“But we never had to turn anyone away,” Crockett added.
Extreme weather response shelter programs are funded through BC Housing
with a temporary purpose to provide spaces to individuals and families
who are homeless during winter months when sleeping outside could
threaten their health and safety.
Each year, CDS is required to apply for funding with a rationale as to
why the service is needed, said Crockett, adding that the shelter staffs
14 individuals during the season.
As a key element in the strategy to break the cycle of homelessness,
temporary shelters like La Nina and BETHS (Boundary Emergency and
Transitional Housing Society) in Grand Forks or drop-in centres such as
Nelson’s Stepping Stones for Success, are disbursed funding to help
connect the homeless to support and housing services within their
respective communities.
In Greater Trail, a joint venture between the Greater Trail Skills
Centre and CDS called Getting to Home, was launched two years ago with a
goal to end homelessness in region.
“The project well surpassed our ideas and what we had set forth to do,”
said CDS spokesperson Gail Pighin. “We hope to raise funds as well as
awareness that homelessness isn’t a problem that occurs in larger
cities,” she continued. “It is alive and happening right here in Trail
and the surrounding areas.”
The homelessness initiative began with 28 people on the roster in need
of assistance, but by the end of June, the program helped 163
individuals from Rossland through to Fruitvale find a place to call
home.
“This isn’t just about picking the person up and saying ‘Here is a house for you,'” said Pighin.
“It’s about looking at the dynamics and what has created this situation
and how we can help them be in a better place and get the support they
need.”
Single mothers, seniors on the verge of losing housing, youth
transitioning out of foster care, brain injury clients and people
struggling with mental health or drug and alcohol issues have all found
housing through “the homeless are here if you choose to look” project.
“It’s not the guy you see walking around or sleeping under the bridge and other nooks and crannies in Trail,” said Pighin.
“We thought we would just get those guys and get them off the street. But it has turned out to me so much more.”

March 2016. A photo of a lady had surfaced. Theresa St Jean-Crockett (TSJ) of Trail, BC, Canada.
TSJ has a photography business called Photography by Theresa. TSJ was being researched by a facebook group and a lady in the group named Danni. A guy named Kyle O in that group is from Ontario, Thunder Bay, where TSJ claims she was originally raised. Kyle O was also in Chad Keller's group: The Official Anyone Could Have Dunnit Theory Group, at this time.
According to Chad:
Kyle O expressed to me that this group he was in with Danni had basically investigated this lady. So, my own group was basically a re-visit/re-write that focused on debunking claims. When I initially re-wrote this theory I was one of the inclination of this theory having absolutely no merit.
Kyle O tells me, “We’ve already debunked her, don’t give me any credit for anything.”
So, I do some investigating of my own. I write an article, do some photoshopping of some comparisons. I post in my group. BAM! The entire thing blows up. 150 comments in 10 minutes. Yada, Yada, Yada.
Kyle O gets mad that I didn’t give him any credit. Runs to TSJ and tells her all this nonsense that I’m posting her kids etc., etc., etc...
Well, TSJ contacts me and says she has evidence that I’m theorizing she’s this person from a documentary.
I’m like, first of all, I run a theory group that debunks theories. So, she agrees to an interview.
Now, during this interview [it’s very cordial] I wasn’t necessarily looking for signs of life. I was trying to literally debunk it. So, we chat for a good hour or so.
The following day, Kyle O [with his little feelings still hurt] proceeds to contact TSJ and dox me, basically. Kyle O proceeded to give TSJ false information that I was a child molester. [I’ve never been charged with child molestation in my life; furthermore, I have no felonies on my record. No, I don’t register as a sex offender. Blah, blah, blah—Manipulate this however you want. This isn’t important.]
What TSJ DID, stemming from this, is important. Here was a lady that claimed she had never been to Wisconsin nor has she ever seen Making A Murderer. TSJ claimed she allegedly called the Wisconsin authorities on me. I have never been contacted by any Law Enforcement. There was absolutely no harassment.
This person contacted Wisconsin Law Enforcement when neither she nor I live in Wisconsin. That, in itself, was kind of odd.
But, the more I thought about it—a few things began to unfold.
TSJ had told 3,000 plus people she has never been to Wisconsin.
Then, I re-read our little chat that we had, and I discovered TSJ had lied to thousands of people.
Not only did TSJ lie about having never visited Wisconsin, but a lot of things weren’t adding up. There were a lot of inconsistencies.
DO THESE INCONSISTENCIES WARRANT DNA?
Here’s the rundown: Per a recent email left with Kathleen Zellner.
Are TSJ’s parallel connections coincidental or merely a pattern?
She has matching teeth, fingers, eyes, scars, moles, ears (including the lobes).
Very distinctive are both St. Jean-Crockett’s and Halbach’s chin and jawline; long and very protruding.
St. Jean-Crockett is an avid participator in shooting in boudoir photography.
She claims photography (of all types) is her fun job; just a hobby.
However, since 2008 she has had nearly $1 million in clients. In 2008,
she was charging $1900 for weddings. This price is not a hobby price.
FALLON WON’T GIVE ZELLNER BONES:
The State Crime Lab has possibly only labeled the bones and blood as being Teresa Halbach.
You have to recall in the transcript, DCI says they didn’t get involved until November 5th.
However, Dave Remiker called DCI on the night of November 3rd.
So, if Teresa Halbach is alive… and living in Trail, British Columbia:
1. You have to test TSJ’s DNA with Karen Halbach’s
2. Do NOT test this DNA with the file from the State Crime Lab
3. DO test the child’s DNA with Ryan Hillegas

If Halbach is alive:
AG Lautenschlager paid the Halbachs off.
AG Lautenschlager, privately and criminally, paid Teresa Halbach to disappear.

3. Lautenschlager arranged Mike Halbach’s Green Bay Packer career through Chris Kirby and Bob Eckberg
4. These careers were all pre-arranged before Halbach was even reported missing!
13 years later, The Halbach Family is reported to be worth $20
MILLION—that AG Lautenschlager arranged for, prior to Teresa Halbach’s
disappearance and alleged death.
What did Teresa Halbach want to do for a career?
Travel and be a photographer, right?
Is there a possibility Halbach is now in the most perfect place in the world, to do this? Trail, British Columbia?
TRUE FACTS:
At one of her jobs, St. Jean-Crockett is getting money washed by an ex boyfriend who went to college in LaCrosse, Wisconsin.
AG Lautenschlager gave this boyfriend $500,000 to start this business at a Law Enforcement Convention on October 14, 2005!
This is 17 days before Halbach is reported missing!
St. Jean-Crockett met her husband in Van, Mexico.
We know for a fact that Halbach traveled to Mexico.
Instead of going to Canada, the couple went to Brevard County, Florida.
This is the area where Halbach’s biological father died in the mid-80’s.
What are the odds St. Jean-Crockett ends up in the area where her
biological father died and becomes employed by Richard Halbach’s friends
for a year?
Now, while this is just a theory [worthy of any other theory] out there,
the bottom line: the circumstantial evidence here of alive is greater
than the circumstantial evidence used by the prosecution team to elicit
death.
None of you can debunk this theory without DNA from TSJ.
[She’s the one that stated in an interview she would give Zellner her DNA.]
The only problem with this, Zellner could not test this DNA with what is on file.
Zellner would have to test DNA with the Halbach Family.
There are so many coincidences surrounding TSJ that have not even been divulged yet.
However, I think DNA is warranted.
We are talking the freedom of 2 innocent men.
Like I told TSJ nearly three years ago: I apologize for whatever she’s been through, but 1,001 coincidences are no longer coincidental–they're a pattern.

There were multiple sightings of Teresa after 10/31/05 (sightings 11/1/05-11/8/05):
- Anna Knutsen of Valders says she saw Teresa taking pictures of cows on Madson Road, “literally kitty corner” to Trinity Lutheran Church at 11303 Wehausen Rd, Manitowoc, on the morning of November 1st, around 8:35 a.m.
- Barbara Linsmeyer says she saw Teresa in a white van with two men on the side of the road by the turnaround on highway 147 (around 23-minute mark in MTSO dispatch audio).
- Gary Ebert saw Teresa sitting next to a man, who was about 15 years older than her, on the ferry from Washington Island at 5 p.m. on November 4th (they didn't look like a likely couple to him, and she looked almost scared and appeared to be falling to sleep (around 29-minute mark in CASO dispatch audio).
- Leo Richmond of Kuss Road says Teresa knocked on his door at midnight on November 4th looking for a home in his area.
- A tip called in on November 7th from a teacher at Hilbert High School, who was told by a student that, when the McGlone family was distributing missing persons posters at a gas station in Sheboygan yesterday, November 6th, a person standing in line there said they had seen Teresa in Sheboygan the day before, November 5th.
- Two sightings of Teresa in Sheboygan with a black man on around midnight November 5-6th (one sighting in Walmart, another sighting in a white van at Taco Bell).
- Bill Crummel left a message on the police department's voicemail on November 8th saying he saw Teresa in a bar/restaurant (with a tree on its sign) on Lakeshore Drive and County Road Xx in Cleveland.
Two people from Sheboygan call CASO dispatch. The first caller at 6:30 p.m. on 11/5 says she saw Teresa with a black man following her into Sheboygan Walmart. The second caller at midnight says he saw Teresa at a Sheboygan Taco Bell, in a white van, with a black man next to her in the van.
Another potential witness, Barbara Linsmeyer, came forward, referencing a white van (at 16:27 and around 23-minute mark in MTSO dispatch audio). Barbara claims that she too physically witnessed Teresa. She stated that she saw Teresa on the shoulder side of the road, at the turnaround on highway 147, inside a white van/SUV with the hazard lights on. She said she could see her through the driver's side door, and was almost certain it was her. She also claims that Teresa was not alone and that there were two other occupants inside the vehicle with her (two men). Barbara contacted police and reported this information, but when she called she had only spoken with dispatch. She seemed sincere and concerned for this woman's safety, whoever it was, whether it was Teresa or not. Ryan may have seen Teresa on and after October 31st because he had her day planner page that should have been in her RAV4 (he turned it over to detectives on November 3rd).
Then there's the fact that everyone seemed to have advanced knowledge of her death (someone deleted some of Teresa's voicemail messages on November 2nd, before she was reported missing, and her missing persons poster was created on November 2nd). The Halbach family appointed Mike Halbach to be spokesperson. Therefore, anything he says is coming from the family. If not, they would categorically deny he speak for them. Thus, Mike is the Halbach family. They are smart and not saying anything. Why? Because they are in this deeper than people realize.
Zellner refers to the voicemails deleted from Teresa's cell phone, when she wrote in her motion: "...eleven voicemails were deleted before 7:12 a.m. on November 2, 2005." There was contention between Kratz and Buting over the accessing of Teresa's voicemail on November 2nd voicemail. Kratz argued: "Mr. Buting's position, if his theory of defense is that Teresa Halbach is alive on the 2nd of November, we're entitled to know that." Kratz argued that the information was irrelevant because it didn't answer the question of who killed her. Buting argued that the answer to the question was relevant to indicate that the cops did not investigate. Buting summarized: "Who was accessing Teresa Halbach's phone on November 2nd at 8 AM. Either she was alive and doing it herself or somebody who had the password to her voicemail was doing it. It's got to be one or the two." Judge Willis ruled for the prosecution and declared it irrelevant. So it never was determined who accessed Teresa Halbach's voicemail on November 2nd and deleted messages.
Wiegert: I did get a call last night, there was a Knutson, from Valders actually said she... she claims... she left she left me a voicemail which I haven't got, dispatch called me, she claimed, allegedly...she claims... she was on her way home and sees Teresa... and she sees Teresa pulled over taking a picture of a cow.
Remiker: Huh... she know Teresa?
Wiegert: No, just seen on the news... all this kind of crap. I'm going to get my ducks in a row and drive up to Valders, talk to her.

Upon arrival in the dispatch center, I noted Sheriff PAGEL had taken a phone call from a lady who was later identified as PAMELA A. STURM. PAMELA had indicated to Sheriff PAGEL that TERESA HALBACH's vehicle had possibly been located at the AVERY'S AUTO SALVAGE yard near Mishicot. Sheriff PAGEL handed me the phone and I spoke briefly with PAMELA.

On 11/05/05 at approximately 10:40 a.m., I (Inv. BALDWIN) began my shift and was requested by Inv. WIEGERT to follow-up on some information that had come in about the possible sighting of TERESA HALBACH.
At approximately 11:13 a.m., I did make contact with ANNA P. KXUTSON, DOB 01/10/74, who informed me that on possibly Tuesday morning, she had seen a female fitting the description of TERESA on the highway taking photographs of cows.
Shortly after my arrival, Inv. WIEGERT had informed me that they located TERESA's vehicle
on the AVERY property.
At approximately 11:42 a.m., I arrived at W3559 CTH B.

On November 5th, a resident named Leo Richmond, who lives at 4201 Kuss Road, called in a tip about seeing Teresa at his door the night before (11:30 p.m. on Friday, November 4th); she was looking for a home in his area. Wiegert dismissed the tip and said he would call back later.
Steven Speckman didn't show up for his 10/31/05 11 a.m. appointment with Teresa Halbach in Sheboygan (3:05 mark in 11/11/05 CASO dispatch calls, video below):
"She was talking to him on the phone. She left Sheboygan about like ten, quarter after 11, because he (my friend, Steven Speckman) didn’t show up for the appointment."
Speckman called Tereasas at 12:44 p.m. on 10/31/05, at which time Teresa asked him if he could meet her in Sheboygan within the next 30 minutes. Speckman told Teresa that he couldn't, and Teresa replied that she would call him later to setup an appointment for next Monday (per his 2017 affidavit).
This is confirmation that Teresa Halbach was in Sheboygan around 11 a.m. on 10/31/05 (and not at home, as the State presented).
Teresa was in Sheboygan per the Calumet Dispatch Calls
It's weird as a stand alone call. I know only because I have listened to the collection of calls around this time so I understood the context.
In context, Calumet had received a couple of calls from witnesses/workers who saw Teresa at Taco Bell and Walmart, in Sheboygan (that day/evening of the 5th?) with two other people in a white van.

In early 2007, Thomas Jon Bruechert reported to MTSO and then CASO that Roger Raduenz, who drove a white van, told him that he killed Teresa Halbach and framed Steven Avery. I absolutely think Raduenz is involved with her murder, either as an accomplice or as her only killer.
As a side note, the audio of the police interview with Raduenz was requested through a FOIA request sent to Calumet. Calumet refused to provide the audio, citing it's sealed as part of the current/ongoing case. That strikes me as incredibly odd being Calumet claimed this was all a big nothing during 2007, and Raduenz is dead.
Here's another interesting thing. Raduenz's address in the CASO investigative report matches the mother of a guy named John, who was apparently a resident of the home which used to be located on the end of /corner of Avery Rd and 147. That house was torn down but appears to have still been there during 2005 based on Google maps. The obituary for the mother of John says she lived at that Manitowoc address (matching Raduenz) for years - it was a 62+ disabled persons housing apartment building. So, if she was there during 2007 when Raduenz lived there, it seems possible Raduenz had more than just Brendan and Allen in common with the salvage yard. Raduenz would have lived on the same 1st floor of the apartment building with John's mom. I imagine John may have met Raduenz while there taking care of or visiting mom.
And, it seems a son or nephew of John, Christopher, also has multiple battery convictions. He appears to be Bobby's age or just a little older by a year or two. Others have drug and alcohol related charges.
There are other tie-ins to Raduenz too, as it appears he may also have lived in the Hilbert area.
His involvement with this case strikes me as being very possible, and Calumet keeping his recorded interview under seal, in my opinion, further validates this possibility.

Funeral services will be 10 a.m. Monday at St. Mark Catholic Church, Two Rivers. The Rev. Robert Sladek will officiate and burial will be in Holy Cross Cemetery,
Two Rivers.
Mr. Raduenz was born Dec. 1, 1913, at Manitowoc, son of the late Edward and Veronica Mrotek Raduenz. He attended St. Boniface Parochial School. Mr. Raduenz was employed at Kaufman Manufacturing Company form 1939 to 1947 and then at Hamilton Manufacturing Company until 1950, when he joined the Two Rivers Fire Department until retiring in 1975 as a Lieutenant.
He married Mabel Koch and she preceded him in death in 1945. He then married Lorraine Gilbert, Dec. 27, 1947, at Two Rivers.
Mr. Raduenz was a member of St. Mark Parish and served in the National Guard from 1932 to 1939.
Survivors include his wife; two sons and a daughter-in-law, Roger Raduenz of Two Rivers and Michael and Sandy Raduenz of Manitowoc; six daughters and five sons-in-law, Rogene and George Cronk of Manitowoc, Connie and James Kronforst of West Germany, Sue and Karl Kimmes, Ann and Edward Kubichek, Valerie and Scott Stevens, and Kathy, all of Two Rivers; a brother, Oliver of New Jersey; a sister, Mrs. Sylvia Mrotek of Manitowoc and 14 grandchildren. He was preceded in death by an infant daughter, Caroline.
Friends may call at Deja and Martin Funeral Chapels, Two Rivers, 5 p.m. to 8 p.m. Sunday, where a memorial service will be 6:30 p.m.

Roger's sister Kathy Raduenz would have been born in the 1940s or 1950s (Roger was born in 1942). She was engaged to Ralph Kratz in 2003, which would have made her at least 50-something at the time. Three years later, in September 2006, Kathy's last name still was Raduenz (per her mother's obit), so she never married Ralph Kratz, who was her fiance in September 2003 (per her stepfather's obit), or she never took his name. There aren't any records online for "Ralph and Kathy Kratz in Wisconsin," so most likely she never married Ralph Kratz and still goes by the name Kathy Raduenz (and maybe never married).

A. Correct.
Q. Maybe you would explain, then, for me, what you mean when you say, indirectly, the decision that Saturday morning was made by you?
A. I had been out of town the previous week. I was out in Seattle, Washington. And I arrived home probably 10:30, quarter to 11, Saturday morning. And that decision to transfer had already been made, I assume, by the inspector. I never inquired. I agreed with the way it was going, so I didn't interfere.
Q. Okay. I need to explore that just a little bit further to nail down timing. When you say you arrived home, do you mean physically at your home?
A. Yes.
Q. All right. You didn't go in to work immediately that Saturday morning?
A. No.
Q. Had you been in contact with the office during the course of that week in Seattle?
A. No.

A. The first I heard --

A. Yeah. The first I heard about the Halbach case was when a reporter called me Saturday after 11.

Theories that Teresa is alive have her living in Point Roberts, Washington, at some point in time after she disappeared.
The relative isolation and security checkpoint has bred a local brand of folklore: that the Point is teeming with people in the federal witness protection program.
Known as an exclave, Point Roberts is a bit of an oddity in that it’s not an island and yet it’s completely separated from the rest of the U.S. The only way to travel from Point Roberts to the rest of Washington and the U.S. is by passing through one international border crossing into Canada, driving 25 miles, and passing through another international border crossing into the U.S. Another 20 miles past the border at Blaine is Bellingham, Washington, the seat of Whatcom County, which oversees this unincorporated town in a strange bit of almost international bureaucracy.
Resident Kathryn Booth says the border tends to dominate outsiders’ perception of the town. As the operator of pointrobertstourism.com, she’s the self-appointed public relations face of Point Roberts, and she’s heard her share of incredulous visitors since moving here in 2009. “They’ll say ’Oh my god, how do people live here? It’s like a police state.’ And in some ways it kind of feels that way.”
“On the one hand, it’s been rated the safest community because it’s like having a really, really, really strict security guard gate,” Booth says.
Point Roberts is also a good place to get away—or to hide out. Thanks to Canada’s fairly strict border crossing rules, it’s difficult for people with criminal records to cross over, so even ex-felons who can move freely about in the U.S. wouldn’t easily be able to find their way into Point Roberts. This is part of the reason the town is, unofficially, home to about 50 people in the U.S. Marshals Service’s Witness Security Program, or Witness Protection. Other residents have come here seeking their own protection.
“That border works like a charm,” says Booth. “Restraining orders and things don’t hold up. But if they can’t get a passport, the border works real good.”

Farming operations run by the Wisconsin Department of Corrections date back to the 1800s. These days, inmates who work on the farms earn between 40 cents and $1.60 an hour. The prison farms produce enough milk and other dairy products to supply all prisons across the state. Last year, the state struck a deal with the Minnesota Department of Corrections to supply it with milk as well. Because of that agreement, Wisconsin sold 5 million half-pint cartons of milk to Minnesota last year. [Source]

Starting at the 7:00 minute mark in the video above, Dolores Avery tells Steven that a man in Green Bay saw Teresa Halbach driving her green RAV4 in December 2005. He tried to follow her but got stuck in traffic. The man is positive it was Teresa and says "he would swear in court to that." Steven tells Rollie Johnson about this man in the video below.
Also in the video below, Rollie 
says at the 15:50 mark: "Where's the evidence that she even died?" Steven says at the 17:50 mark: "Somebody seen her (Teresa). It seems like they paid her off... Somebody's been hearing that she is out of the state, out of the country, Mexico or something... there's something fishy."
Steven says at the 19:45 mark: "Her dad (Teresa's uncle and stepdad) was supposed to have something to do with this county jail (Calumet County). Rollie replies: "I've heard rumors before that he works for the Sheriff's Department" (but he can't remember who told him that). And just before this conversation, Steven tells Rollie that a male relative of the Halbach family was taken into custody at the Calumet County jail on Monday, and Steven saw Teresa's sister out there when this family member was brought in, yelling and screaming.

A very prominent change is an increase in the area of the eye sockets: they become wider and longer. The biggest changes occur in a person's 40s and 50s but can begin as early as the mid 30’s."

WAUPUN (WKOW) -- After living his whole life in Milwaukee, working with cows in the milking parlor of a dairy farm is the last place 42 year-old Orlando ever thought he would end up.
"When I first got here I was kind of shocked, like, wow they're so big," said Orlando.
It's similar story for 28-year-old Brandon, originally from Columbus, OH.
"I'm a city boy, we don't know nothing about dairies," said Brandon. "We just know the milk, that's it."
But for both men, dairy farming is now the biggest part of their lives.
That's because they're finishing up prison sentences with the Wisconsin Department of Corrections, which is why 27 News cannot share their last names.
Orlando and Brandon are two of about 80 inmates who work on one of the three DOC-owned dairy farms.
They have moved into the prison farm work program as the final step before transitioning back into society.
"It's a full blown dairy operation, with the three farms across the state and the full production dairy here in Waupun as well," said Wes Ray, DOC's Bureau of Correctional Enterprises Director.
The inmates grow crops to feed the cows, milk them, raise their calves, and ultimately process their products at the Waupun Dairy - also owned and operated by the DOC.
"So, our correctional farms produce those dairy products - milk, cream, ice cream, sherbet, to help feed the institution population," said Ray.
In other words, prisoners across the state eat and drink what the Waupun Dairy produces.
The Department of Corrections also sells the same products to the Minnesota prison system, while selling cream on the open market.
That means the cost to taxpayers is small, because much of the operation is paid for by what's produced.
Ray believes the biggest benefit is for the inmates.
"We're investing in them, giving them a chance to invest in themselves," said Ray, who likes to sum up the goal for the inmates in three words: work, learn, earn.
"I've learned a skill, so now if, say I get back to Milwaukee and there's no jobs available, now I have this option so maybe now I can go work on a farm because I've got the skills to maybe help me get a job that could help me support my family," said Orlando.
And it's not just farm work they are learning, because the DOC officials who run the Waupun Dairy say many of the inmates who work there go on to jobs in various liquid packaging operations in the private sector.
Brandon plans to move home to Ohio when he gets out later this year
"If it's butter, yogurt, milk, whatever it may be, I'm gonna have to explore that market and see how big it is actually down there and put it resumes and see where I can get in," said Brandon.
"Certainly if we can give more inmates the knowledge, skills and abilities to work on and be a productive contribution to Wisconsin dairy farms, that's great for the inmates and for their future employers," said Ray.
Along with the Waupun location - there are also operational state prison farms in Oregon and Fox Lake.
There is even a very local connection to Madison, as UW's Babcock Hall buys much of its raw products from the Waupun Dairy to make their famous ice cream.

Prison labour is a billion-dollar industry, with uncertain returns for inmates
ReplyDeletePrison labour is legally required in America. Most convicted inmates either work for nothing or for pennies at menial tasks that seem unlikely to boost their job prospects. At the federal level, the Bureau of Prisons operates a programme known as Federal Prison Industries that pays inmates roughly $0.90 an hour to produce everything from mattresses, spectacles,road signs and body armour for other government agencies, earning $500m in sales in fiscal 2016. Prisoners have produced official seals for the Department of Defence and Department of State, a bureau spokesman confirmed. In many prisons, the hourly wage is less than the cost of a chocolate bar at the commissary, yet the waiting list remains long—the programme still pays much more than the $0.12-0.40 earned for an hour of kitchen work.
Similar schemes exist at the state level as well, making the market of 61,000 captive labourers worth well over $1bn. California’s programme expects to generate $232m in sales this year, much of it from construction and textiles, though $10m is also expected from meat-cutting. In Idaho, prisoners roast potatoes. In Kentucky, they sell $1m worth of cattle.
Critics have spent years directing their anger towards private prisons, by pointing out the moral hazard created when profiting from punishment. Jeff Sessions, the attorney-general, caused a stir last month when he cancelled an Obama-era directive to phase out federal contracting with private prison companies, which expect bumper earnings under Donald Trump. The share price for CoreCivic, the rebranded name of the Corrections Corporation of America, shot up by 43% in a single day after Mr Trump was elected, in anticipation of lucrative contracts to run immigration detention centres.
But those who attack the new prison-industrial complex might be surprised to learn that America’s publicly run prisons have been providing labour for private companies since 1979. More than 5,000 inmates take part in the scheme, known as “Prison Industry Enhancement”. “Orange is the New Black”, a television show set in a women’s prison, recently lampooned a private-prison takeover, after which the inmates are forced to sew lingerie for $1 an hour. But this gets the history only half right. Female inmates did indeed make lingerie for brands like Victoria’s Secret in the 1990s—but only through a deal between South Carolina’s public prisons and a private manufacturer.
America’s prison-labour industry is wrapped in euphemism. Federal Prison Industries does business under the more palatable name of UNICOR, and government-run prison production schemes are called “correctional industries”. Some slogans are better than others; UNICOR has an unfortunate habit of calling its facilities “factories with fences” in reports.
Employment upon release is perhaps the best defence against recidivism. The chief justification for prison labour is that it both defeats idleness and gives inmates marketable skills. Whether it actually does so is unclear. “The vast majority of prison labour is not even cloaked in the idea of rehabilitation,” says Heather Thompson of the University of Michigan. Simple manufacturing jobs, like the ones done cheaply by most inmates, have already left the country. The study pushed by the Bureau of Prisons, showing drops in reoffending, was published in 1996. More recent comparison statistics often ignore bias in how those being studied are chosen. Rigorous academic work on the subject is almost non-existent.
Still, such programmes are undoubtedly legal. The Thirteenth Amendment to the constitution prohibits slavery and indentured servitude—“except as a punishment for crime”.

It’s Time to Stop Using Inmates for Free Labor

Last week, a Louisiana sheriff gave a press conference railing against a new prisoner release program because it cost him free labor from “some good [inmates] that we use every day to wash cars, to change oil in the cars, to cook in the kitchen.” Two days later, news broke that up to 40 percent of the firefighters battling California’s outbreak of forest fires are prison inmates working for $2 an hour. Practices like these are disturbingly common: Military gear, ground meat, Starbucks holiday products, and McDonald’s uniforms have all been made (or are still made) with low-wage prison labor.
Inmates are exempt from the Fair Labor Standards Act, which requires that workers are paid at least the federal minimum wage. That makes it completely legal for states to exploit inmates for free or cheap labor. More than half of the 1.5 million people in state and federal prisons work while incarcerated, and the vast majority only make a few cents per hour.
Most inmates work in their own prison facilities, in jobs such as maintenance or food service. These jobs pay an average of just 86 cents an hour, and are primarily designed to keep the prison running at a low cost. Others may be employed in so-called “correctional industries,” where inmates work for the Department of Corrections to produce goods that are sold to government entities and nonprofit organizations. The highest median wages for these jobs top out at less than $2 an hour, and they’ve dropped over time—an incarcerated worker is paid less today than they were in 2001. In Alabama, Arkansas, Florida, Georgia, and Texas, most inmates working in prison facilities aren’t paid at all.

Human rights organizations, as well as political and social ones, are condemning what they are calling a new form of inhumane exploitation in the United States, where they say a prison population of up to 2 million – mostly Black and Hispanic – are working for various industries for a pittance.
For the tycoons who have invested in the prison industry, it has been like finding a pot of gold. They don’t have to worry about strikes or paying unemployment insurance, vacations or comp time.
All of their workers are full-time, and never arrive late or are absent because of family problems; moreover, if they don’t like the pay of 25 cents an hour and refuse to work, they are locked up in isolation cells.
There are approximately 2 million inmates in state, federal and private prisons throughout the country. According to California Prison Focus, “no other society in human history has imprisoned so many of its own citizens.”
The figures show that the United States has locked up more people than any other country: a half million more than China, which has a population five times greater than the U.S. Statistics reveal that the United States holds 25% of the world’s prison population, but only 5% of the world’s people. From less than 300,000 inmates in 1972, the jail population grew to 2 million by the year 2000. In 1990 it was one million. Ten years ago there were only five private prisons in the country, with a population of 2,000 inmates; now, there are 100, with 62,000 inmates. It is expected that by the coming decade, the number will hit 360,000, according to reports.

Corporate stockholders who make money off prisoners’ work lobby for longer sentences, in order to expand their workforce. The system feeds itself,” says a study by the Progressive Labor Party, which accuses the prison industry of being “an imitation of Nazi Germany with respect to forced slave labor and concentration camps.”
The prison industry complex is one of the fastest-growing industries in the United States and its investors are on Wall Street. “This multimillion-dollar industry has its own trade exhibitions, conventions, websites, and mail-order/Internet catalogs. It also has direct advertising campaigns, architecture companies, construction companies, investment houses on Wall Street, plumbing supply companies, food supply companies, armed security, and padded cells in a large variety of colors.”
CRIME GOES DOWN, JAIL POPULATION GOES UP
According to reports by human rights organizations, these are the factors that increase the profit potential for those who invest in the prison industry complex:
Jailing persons convicted of non-violent crimes, and long prison sentences for possession of microscopic quantities of illegal drugs. Federal law stipulates five years’ imprisonment without possibility of parole for possession of 5 grams of crack or 3.5 ounces of heroin, and 10 years for possession of less than 2 ounces of rock-cocaine or crack. A sentence of 5 years for cocaine powder requires possession of 500 grams – 100 times more than the quantity of rock cocaine for the same sentence. Most of those who use cocaine powder are white, middle-class or rich people, while mostly Blacks and Latinos use rock cocaine. In Texas, a person may be sentenced for up to two years’ imprisonment for possessing 4 ounces of marijuana. Here in New York, the 1973 Nelson Rockefeller anti-drug law provides for a mandatory prison sentence of 15 years to life for possession of 4 ounces of any illegal drug.
The passage in 13 states of the “three strikes” laws (life in prison after being convicted of three felonies), made it necessary to build 20 new federal prisons. One of the most disturbing cases resulting from this measure was that of a prisoner who for stealing a car and two bicycles received three 25-year sentences.
Longer sentences.

I’ve been glued to this thread for years but have come to the conclusion that I have to start looking at this as 3 separate events. I preface this by saying I believe SA to be, again , innocent.
TH did go to ASY to photograph a car, and left ASY.
TH left there, perhaps went to GZ for the last appointment, but left and drove off to a more social engagement. We all know about the strange BC interaction and the well documented RH angle. I strongly believe this triangle should have been investigated first. For Gods sake, TH’s friends called into calumet pleading to check this angle out. Who better to know inside nuances to a 20 something’s life then her girlfriends.
But I digress, the atrocity that occurred happened in this triangle or as a random act of opportunity by a stranger.
The AC plate call flat out confirms the vehicle and original evidence were discovered well before the PS guided by angels discovery of the rav4 occurred. I strongly believe AC happened upon the rav as left by the perpetrator, then the frame job was spawned.
BJ, BoD and ST seem sketchy as hell to me. But I am convinced this went down as described above. SA from a motive and just flat out ability to execute all that was convicted of makes zero sense.

I truly believe she was alive and photographing cows when believed to be deceased. The call sounds so accurate and certain while matching perfectly with what TH portrayed in her short video bio.

ReplyDeleteI read your post because I absolutely think Raduenz is involved with her murder, either as an accomplice or as her only killer.
As a side note, the audio of the police interview with Raduenz was requested through a FOIA request sent to Calumet. Calumet refused to provide the audio, citing it's sealed as part of the current/ongoing case. That strikes me as incredibly odd being Calumet claimed this was all a big nothing during 2007, and Raduenz is dead.
Here's another interesting thing. Raduenz's address in the CASO investigative report matches the mother of a guy named John, who was apparently a resident of the home which used to be located on the end of /corner of Avery Rd and 147. That house was torn down but appears to have still been there during 2005 based on Google maps. The obituary for the mother of John says she lived at that Manitowoc address (matching Raduenz) for years - it was a 62+ disabled persons housing apartment building. So, if she was there during 2007 when Raduenz lived there, it seems possible Raduenz had more than just Brendan and Allen in common with the salvage yard. Raduenz would have lived on the same 1st floor of the apartment building with John's mom. I imagine John may have met Raduenz while there taking care of or visiting mom.
And, it seems a son or nephew of John, Christopher, also has multiple battery convictions. He appears to be Bobby's age or just a little older by a year or two. Others have drug and alcohol related charges.
There are other tie-ins to Raduenz too, as it appears he may also have lived in the Hilbert area.
His involvement with this case strikes me as being very possible, and Calumet keeping his recorded interview under seal, in my opinion, further validates this possibility.

What is this revelation that's not been thoroughly looked at, discussed, or properly investigated.
It starts in Sheboygan. Where a man saw a missing woman who at this time was still alive.
Teresa Halbach, who's been missing since Oct 31, is seen by a man who reports this information to MCSO. He claims to have physically seen Teresa with a couple guys with a white van/suv in downtown Sheboygan.
This man had contacted the police several times on multiple days asking to speak with a detective, not once ever speaking to anyone of them.
He told dispatch multiple times what he witnessed. He claims that he's positive it was her, and she was not alone. She was accompanied by two other men down by Taco Bell.
This witness was never followed up on. Even though this man had made several attempts to contact authorities.
Another potential witness came forward, referencing the same exact white van/suv. This time it comes from a witness most people never heard of by the name Barb Linsmeyer. Barb also claims that she too physically witnessed Teresa. She stated that she saw Teresa on the shoulder side of the road inside a white van/suv with the hazard lights on at the 147 turnaround. She said she could see her through the driver's side door and was almost certain it was her.
She also claims that Teresa was not alone and that there were two other occupants inside the vehicle with her. Two men. She couldn't tell if she was in any type of trouble, but with hazard lights blinking it places them in some type of troublesome situation.
Barb contacted police and reported this information. But when she called she had only spoken with dispatch. She seemed sincere and concerned for this woman's safety, whoever it was. Whether it was Teresa or not.
If Barb really did see Teresa that day and it truly was her., police really dropped the ball here. Police never contacted her back at all. Just as they've done with any other witness throughout the entire case.
They claim that an extensive investigation was done. Where & how? Because I honestly don't see that at all.
How can you just blatantly ignore potential lead's? How can you blatantly ignore potential witnesses when Teresa at the time was still considered a missing person? This is what you call an investigation?
Radandt also witnesses a vehicle fitting this description down at the quarry. He stated what he saw was a white suv with another vehicle.
Another witness claims to have gotten a visit by Teresa after she had disappeared, asking about directions. He said the woman was Teresa Halbach and was positive it was her.
7 witnesses and counting claim to have seen Teresa Halbach or her Rav4 down around by the 147 turnaround. This information is significant enough in that none of these people were followed up. As though they were all blatantly ignored.
Witnesses though still continue to keep coming forward with new information.
Obviously something was wrong to indicate or engage the hazard lights on a vehicle. Was Teresa trying to signal for help? Was she trying to get someone else's attention? Maybe it was to get a pedestrian to approach the vehicle? Who know's. What we do know though is police blatantly ignored damn near every single witness. All for what?
What this tells me is that police obviously didn't care what the witnesses had to say. They were never gonna follow up with them anyway. They had a target and nothing was gonna derail that mindset. (CBS) MISHICOT, WI
Police have set up a search perimeter in the Mishicot area in relation to the disappearance of Teresa Halbach. CBS 5's Jennifer Kolbusz was in Mishicot Saturday night where a 9 PM press conference was held, and reports that authorities closed off several roads in the area.
She also says that authorities have located Teresa Halbach's vehicle at Avery Auto Salvage near Mishicot. The vehicle has been transported to a crime lab in Madison to analyze evidence.
Authorities held another press conference Sunday afternoon, and Sheriff Jerry Pagel of the Calumet County Sheriff's Department told reporters they will be executing a lengthy search that will cover a 40 acre parcel of land and hundred's of vehicles.
Also, dive teams from the Winnebago County Sheriff's Department are being utilized. There is water adjacent to the area in question.
Sgt. Mark Wiegert of the Calumet County Sheriff's Department said Teresa Marie Halbach, a resident of the St. John area, was last seen about 1:30 p.m. Monday in Manitowoc.
She works as a freelance photographer for auto dealers and had been taking pictures of vehicles up for sale. Jennifer Kolbusz reports that Halbach was at Steven Avery's property, photographing a vehicle for Auto Trader magazine. However, Jennifer says that Halbach did continue on to another appointment before she disappeared.
The investigation "indicates it is out of character for her not to have contact with family or friends for this length of time," Wiegert said.
Calumet County Sheriff Jerry Pagel said her parents reported her missing Thursday, and his department and police in Manitowoc County immediately began investigating. Calumet County has been named the lead investigative agency in this case, and anyone with information relevant to this case are asked to call the Calumet County Sheriff's Office at 920-849-2335.
"This is behavior that is not normal for this young lady," Pagel said. "It's suspicious. Parents, friends, relatives, nobody has had any contact with her since the 31st (of October)."
Pagel said Halbach has no criminal, medical or mental history indicating she may have left on her own.
Steven Avery, a Wisconsin man who served 18 years in prison for a rape he did not commit, may have been the last person to see Halbach, a sheriff said Saturday.
Avery, the Two Rivers man who was released from prison in 2003 after DNA evidence exonerated him in the 1985 attack, told investigators Thursday evening that Halbach took pictures of a van that he wants to sell.
Avery and another man in the area are the last to have seen Halbach, but it's unclear who saw her last, said Calumet County Sheriff Jerry Pagel.
"I'm classifying it as coincidental at this particular time," Pagel said. "Just because it's Steven Avery, doesn't mean that he had anything to do with it."
Halbach is described as 5-foot-6 and 135 pounds, with light brown hair and brown eyes.
She was wearing blue jeans, a white button-down shirt and a summer jacket when she last seen, police said.
She was driving a dark green 1999 Toyota Rav4 with a Wisconsin license SWH582.

For researchers, I want to let you know that we have several hundred pages of investigative/police reports from Green Bay and which are related to Gregory Allen. The reports of are particular interest to a number of researchers. They are heavily redacted (by the police department) but still not sufficiently redacted to post here. Keep a watch out as a number of us will find appropriate ways to get these reports into the public domain. A few that will be of particular interest tie to the time period of the last post I created which provided links to four (4) 1996 Avery appeals documents that are available online via the Wisconsin Law Library.
Some interesting tidbits or odd connections within Allen's documents and Avery's CASO reports:
5 blood vials were taken from Gregory Allen sixty (60) days before blood was drawn from Steven Avery.
The hospital at which Gregory Allen's blood was drawn is St. Vincents.
Gregory Allen met with police to complain that his blood was drawn and was being used to switch blood with (name redacted by GB PD) for the purpose of making it look like he committed the crime.
If you refer to CASO, you will notice that Roger Raduenz was a person of interest in Avery's case.
The audio of Raduenz's interview with CASO is still sealed.
A witness, Thomas (page 1043,) said Raduenz had Avery's blood, killed Teresa and planted Avery's blood in Teresa's RAV4.
Avery's January 1996 blood was drawn by a nurse who worked part-time at Kettle Morraine Correctional Institute (page 1028).
Roger Raduenz was incarcerated there at the time when Avery's blood was drawn.

This certainly does not help bring in donations for the innocence project. Nobody wants to be called an idiot when they have supported these two case for years through researching, reading transcripts, etc. He really blew it with that comment. His PR people should be advising him on how to minimize the damage he has caused. Public support is extremely important when you don’t have an infinite budget.

I can't imagine what could bring more pain than listening to a prosecutor on television telling a story about your loved one being horrifically tortured, raped, traumatized, then murdered; when he knows that story is complete BS. Then that 'story' is repeated over and over, how many thousands of times, still to this day. Even in the BD hearings, attorneys and judges still talked about TH having been raped and shot.
There is absolutely no evidence she was handcuffed, raped, stabbed, and otherwise tortured, in fact; any the physically evidence refutes this story. I don't trust the evidence that suggests she was shot. The bullet nor that the skull fragments had bullet holes or a bullet hole, or whatever the story was.
What concerns me more than the point of being 'pissed off' is that a 16 year old child was convicted of 1st degree murder when there was NO.. NONE, ZERO physical evidence linking him to the crime... and in fact any physical evidence refutes the Mr. Kratz's story. Yet, he had no problem subjecting a mother to believing her daughter lived through that ordeal.
After that, I can't imagine a few "idiots" suggesting she is alive, when there is a lot of fishiness surrounding the ID of the remains found can even compare.
The parents who lost children in the recent shooting have bodies. We can't quantify people's grief, nor should we try. The question in the TH case is about the evidence,not the degree of anyone's pain.

First-time poster here, long-time follower!
Calling people "idiots", whose theory is one of many in this case, which supports the notion that the prosecution was incorrect, therefore supporting your client's innocence and the work you're doing, is pretty harsh. I gave some of my own money to him to support his work in freeing BD, who I believe is clearly innocent of the charges. I don't regret it, but come on. I do not think it's far-fetched to believe, at the very least, that TH did not die/was not murdered in the days she was said to have. Something fishy happened to land SA and BD in prison, and until the truth is definitively found and reported, all we have are our theories. It sucks that he lashed out like that, then stating he did it because he was affected by the Florida shootings. I don't even see the link between that and BD's case.
And the H family hasn't exactly proven they are deserving of any sympathy, as far as I'm concerned. MH was so convinced of BD's guilt that he refused to listen to or watch his testimony. And he made questionable statements on camera, and had questionable mannerisms on camera. He is in the H family, he is convinced your client is guilty--so, is he an "idiot" for believing a theory other than SD's defense? Or does he deserve sympathy because his sister possibly died many years ago? Which one is it, man?

To me, it didn't sound exactly like backpedaling. But definitely was an excuse for sort of exploding in his original tweet. I just don't see the connection between feeling for grieving parents whose children definitely died horrifically (video, audio evidence) to a family that might have grieved over the possible loss of a daughter that maybe happened, and if it happened it could have been in a horrific way (if you trust KK), or not.

I know and have known many people who do hold this theory.. and it is because they give a darn (I don't know if I can cuss, lol) about what happened to her.. and well, to be honest, to a lot of people, "burying' someone before it is even confirmed they are dead is a little odd. I don't know... her family and friends seemed eager to write her off... I think calling people who have legitimate doubts and have 'cared' enough to do a lot of research and looking into things a derogatory name.

I have to agree with you. While I believe Teresa is most likely dead, what the state presented just leaves me with more questions.
Chain of Custody was NOT followed or properly documented. It couldn't be given LIESenberg's and Culhane's testimony. I have trust issues with both, given what they did and what they testified to.
LIESenberg was forced to walk back her earlier testimony. That shows she was more than willing to mislead the jury.
Surehands left out her deviation from her final report that she turned in to the Court. UNSIGNED deviation. Tells me all I need to know about her character. She was over the top willing to mislead the court and the jury.
We recently also talked a bit about what the FBI reported that Buting was trying to discover, and Prick Fallon never really answered.
I know in complex cases there are always going to be a few lingering questions. But these two cases aren't like that. Every single aspect is under fire because of how terrible these cases were investigated and not documented. We didn't do that.
Personally, I fully believe this was done with intent. It's like NOT opening the Rav4 at the ASY, or not allowing the State required coroner on scene.

There are so many reasons to wonder if she died that it's completely reasonable to question it imo. I personally don't think she's alive but at the same time they have not shown us anything that proves she was killed either. I don't trust anyone who tries to stop the conversation from even happening by playing the old "respect for the family" line. This has nothing to do with respect for the Halbachs. It has everything to do with finding the truth. which in the end the family must want as well.

To bad the state dug her remains up with a skid loader if that was her remains there(not),and then dumped them in a dump truck and hauled them back and dumped them to sift thru them, now there’s an insault to her family(when has that ever happened before?) I see where people can have doubts about it. Now if drizin wants supporters, he shouldn’t call them idiots, those idiots may not support him anymore(just a thought for future comments). So how many teeth did they find how many bones ,were there? Her blood was on the bullet then is that what he is saying, this case is nuts 🥜.

Had ANY protocols been followed in regards to the bone find there wouldn't really be any of this talk. Although I think it's likely she is dead I don't really discount any possibilities. They bones just aren't conclusive for me. All I'm left w/ for certain is a small amount of blood in the back of the RAV and a bullet w/ no blood but possible DNA found well after the fact under questionable circumstances.
When a case is documented this poorly by investigators under such a huge conflict of interest is it really such a surprise that every thing under the sun is under question?

Pretty much paraphrasing exactly what I wrote! The fact is, there are issues with the ID of the remains, with the DNA evidence, and even if that was 100% trustworthy, we cannot know exactly what was tested, and where it came from, because based on the trial testimony, SC could not have gotten her tissue from the 'bone' she says she did in the photo, which LiEsenberg said was sent directly to the FBI.. who never reported receiving it! This is a HUGE problem!!!!!! Then there is a death certificate with "autopsy" checked before one was ever done... oh yeah.. and no report to be said re: said autopsy.. and ME removed for trial.., some might consider that medical fraud... and death certificate signed before any proof she was even dead...and the 'burial' before there it was proven she was dead.. they sent the 'tissue" or whatever they sent to the FBI, b/c they KNEW SC's results were not valid for solid ID.
Given all this, I think one would be an idiot not to speculate, and her being alive would be a natural theory to consider. I've considered it, how could one not, given how bizarre this case is! I don't think it's likely, b/c it would be hard, and Mz Zellner is looking for a killer, I think she would have know if there is an likelihood of TH being alive. I wouldn't say it is impossible though.
Hopefully someday there will be more clarity with regards to some of this evidence.

It may just be another chess move in a game to find the whole truth, including no real TH, no murder and a make believe crime and investigation to hide something from the distant past. The blood in her RAV4 indicating head trauma is undisputed
I would dispute the blood in the rav4. There were numerous people, some law enforcement, some civilian, that looked into the rav4 while it was at the salvage yard from the morning of November 5th until it wss moved that night. Every single person gave sworn testimony that they saw no blood in the RAV4. Some of these people were aided with flashlights and claimed they were able to read the name teresa written in the back of a memory card in the cargo hold. I tend to think if they could read the name written on a memory card, they should have been able to see the blood stains, if they were there.
Furthermore, if TH was in on the plan to frame Steven Avery, it provably wasn't to save some sorry ass little sheriff department. I would think the motivation would be to keep an investigation from going into the state crime lab. Thousands of prisoners wanted new DNA testing after Avery got exonerated. PB and who knows how many other women probably would have filed lawsuits if Avery was able to win his. The 36 million civil lawsuit was small fries compared to what the state stood to lose if the crime lab was exposed.

I don't know what made Drizin so mad that he felt the need to call anyone an idiot---maybe he is having a bad day. I personally don't know one way or another what happened to Teresa because of the problematic evidence in this case. All I know is that she disappeared. I don't know that the evidence testing done by the state in this case is trustworthy. I don't know if the conclusions drawn regarding blood and bones are valid. I don't know if the testimony of many of the witnesses is untainted. I think Brendan's 'confession' should be thrown out because it was coerced. Do these things, these questions, these doubts, make me an idiot? Or just a curious mind searching for solid proof of a murder and evidence that points to the responsible party/parties beyond a shadow of a doubt? Sure, the Halbach family deserves our respect and the right to mourn as they see fit and to get on with their lives in peace---all with the presumption of innocence that we all would want extended to ourselves and our loved ones and that was denied to SA and BD. But it is human nature to speculate and cogitate when riddles present themselves. It is natural for the human mind to wonder and ponder when things don't add up. This is the sign of an active mind and not the mind of an idiot.

You express the same conclusions that anyone with 2 functional neurons and a synapse who has delved into this case has come to.
I don't see any logic in linking examining a case where clearly miscarriages of justice took place and "harming/insulting" etc, anyone's family. In fact, cold as it sounds, I think the examination of facts/evidence must be objective, and therefore completely separated from the family or anyone's feelings. I don't like how the legal system, particularly prosecutors use family, and the guilt tripping of insulting a family or victim by questioning things to win cases.
Why is a crime more serious if the victim's family is 'grieving' more? I talked with an attorney who told me absolutely juries will give harsher sentences or look more negatively on the suspect if there are a lot of family and friends who talk about what a saint the victim was and how THEIR lives are devastated by the loss.
So, if you have the bad luck of not having been born into a "nice" family or were a good for nothing, lazy; SOB, and no one really misses you that much; :D :D :D, your murder won't be quite as 'horrible'.
IMO, the investigation of evidence has absolutely nothing to do with TH as a person or her family members. There is a place for honoring her and her family and that is their private business. Drawing emotions into things is what leads people away from being objective, sadly a strategy used our courtrooms too much. It is about who puts on the best "show", and clearly it was in this case. Nothing to do with the objective evidence. Nothing. There was NO objective evidence to convict Brendan Dassey. NONE. Yet he is spending life in prison for a murder. That upsets me a lot more than anyone's "feelings". I'm not going to fall into the guilt-trip trap for questioning things that don't make sense.
That issue too important to sweep under the rug to avoid "hurting' someone's feelings. And does he even know this? I wouldn't imagine as BD's lawyer he has conversations with the Halbach family about their "feelings".
I'm surprised.. no, actually I'm not.. at all the folks pandering to him on Twitter. It does sometimes feel like the attorneys in these cases get elevated to demi-gods and one if not a "supporter" to disagree with them about anything.

Why is he taking his time to tweet this when he clearly states in a later tweet that he doesn't have time this week as they are putting the finishing touches on the most important document of Brendan and THEIR lives... see sounds to me like this is more about him than it is BD. If TH were still alive(no proof either way), there goes SD's big chance to get his name on a landmark SCOTUS case.

Certainly anyone has a right to be pissed, and I don't know anything about billboards, however; I guess I have a problem with someone who is an attorney in a current case (well, I mean I guess there is no current case technically, but I believe he is still representing BD in hopes to get a SC hearing) telling the public what they can/can't believe and do. I don't think it is their place.
I don't know what you are referring to about billboards - they aren't about rewards, but the father of a young man killed by WI LE has billboards urging people to contact AG Schimel and ask him to get his case investigated. He also took out a full page ad in the Milw Journal Sentinel, and paid $65,000 to an ad in the WA Post. I say, more power to him, and it is sad that he has to PAY to try to get justice; and if he does, it will only be because he was able to pay for it. and because HE is urging people to contact the AG.
Getting off track, but it bothered me that Mr. Drizin (while I respect him as an attorney, I disagreed with him here) actually 'ordered' people not to contact AG Schimel re: the BD case. I honestly don't know why he would say anything. Again, not his place to tell the public what to do. In fact, as a resident of WI, the AG the Gov, and my Reps work for ME, and hell yes, I will contact them when there is an issue I am concerned about. Now, I got a lot of hate for disagreeing with SD, but I think it hurt the case. He isn't my attorney. IMO, it is the same thing as telling the public "please contact the AG about BD (my client). I think anyone would recognize that as unethical. I think telling them to do the opposite is no different. He should not be trying to influence the public's actions. There is so little awareness in WI about what is going on, and his own attorney doesn't want people bringing up the case? These public officials have social media accounts so people can contact them! That is their job!
Judges, of course are a different story, I think most people know it is not appropriate to contact judges (well I guess not everybody).
Anyway, SD does seem to be protective of the state. It seems kind of odd to me that he would be so emotional about some people having theories he thinks are "idiotic". Anyway, just my thoughts.

Hi. The billboard reference is in regards to a couple new electronic billboards in Manitowoc that is soliciting info in Teresa Halbach case. It is offering a 10,000 dollar reward. I have no factual knowledge on who is responsible. I assume it was someone who is either a supporter or the opposite.
I was not aware Drizin had told people what to do and what not to do. I think its been a long journey and there is still a battle to be won. Maybe he is frustrated. Not sure, but like I mentioned above... I would think he wouldn't react in such a way unless he was contacted directly.
I'm all for theory and speculation. Shit. I do it daily with these two cases. I just hope no one crossed a line, is all.

And, you are right, I don't know the impetus for his making the tweet, and you make a good point, maybe something happened I'm/we're not aware of to cause him to be upset; because people have been speculating about the TH alive theory since the doc came out, as far as I know.
I'm kind of thinking after reading your comment, maybe he is sending a "message" to a particular person or group of people... anyway, I guess since I have no clue I will stop speculating.
He certainly has a right to his opinion, I was just surprised he would make such a strong statement. It is a little different when a person is presenting themselves on social media as a "professional" or public figure, vs just a joe citizen, like me. I imagine sometimes it is hard to keep the 2 separate.

As we stand it was a fucked up one suspect investigation with made up proof that she perrished at this point. Don't blame it on the peeps who question If she passed. Exactly. I don’t agree with the theory but given the lack of forensic knowledge/skill (and proper photographs!) in the bone collecting, I can see why some people may believe that. Had they done the investigation properly and professionally, there would be no question about it.

Ooh, touche, I can't make the little accent thing.
It bothered me that he ordered 'supporters' to not contact the WI AG about this case.. when it is obvious the these cases are politically charged, and what gets addressed is what the public appears concerned about. Well, if no one in WI is concerned about how the BD case is being handled, the state will have no problem continuing on the current course of action. That is exactly what has happened.
Now, I am not a sheep and in no way feel compelled to listen to anyone tell me I cannot carry out what I feel is not only a right but a duty as a citizen of the state, and let my elected and appointed officials know exactly what I think (politely, of course :) ). Unfortunately, it seemed that so many seemed to follow this like it was some kind of holy command. That kind of blind allegiance is never a good thing. Encouraging people to be silent is never a good thing, and he should not be encouraging the public to act one way or another when he is involved in a current legal case.
Meanwhile, there is another case involving LE misconduct in WI, and the father of that victim has paid for billboards, and full page newspaper ads, spending well over $100,000 to urge people to contact the Brad Schimel (WI AG) to bring attention to his case. Because it is the pressure from the public that influences how politicians act. And the AG is a politician first.
I don't understand SD's motivation for that edict with his case. I just know that I am able to think for myself, thank you :)

I don't see or hear much pain out there. Why don't the family and friends get on here and state their feelings backed up with real impartial facts, continuity, history. The pathetic attempt at showing a family album, which looked like a ream of new blank paper in a new binder. There should be fingerprints and DNA, which don't change with age, all over Wisconsin to prove who she was. Oh but LE couldn't find any... What pisses me off is ignoring the obvious. Pap smear? Ha! Who handled that? Take off the do-gooder blinkers and join those with ears, eyes and a willingness to accept other possibilities.

Yeah I respected the guy until this tweet. There is a very serious lack of evidence that the remains were TH's and Drizin knows this which makes me think there must be some ulterior motive for him to attack people who are considering the possibility that TH is alive.

I'm seeing a few posts asking the question regarding the Halbach integrity in going along with LE in the framing of Steve.
Obviously, this would be deeply disturbing if an upstanding family knew Teresa died of suicide, accident, or even natural causes, and still helped frame an innocent man.

That's what I don't understand - why the lie(s) about hacking into her cell account?? I think it's completely understandable and admissible if a family member is missing and you're freaking out about it that you do whatever you can to find out where they are, and that includes illegally obtaining access to their phone. It's not like the Sweaty Dough Boy was going to prosecute a family member for illegally getting into her VM when she has been deemed "endagered and missing". But instead it's all sorts of [really bad] lies of how and why and when those VMs and call logs were accessed. Why the secrecy? Why so shady about it? Why wasn't that mentioned in the initial missing persons call from KH on 11/3 since the phone was accessed on 11/2? That would be one of the first things to tell LE, that she hasn't used her phone since monday afternoon and that's not like her. I generally don’t like this guy narrating. I have found him to be making a lot of assumptions about some of the subjects he’s discussing.
So I’m hesitant to agree with him just because there is a confirmation bias there for me.
I do find them a curious lot.
I accept that people can all process grief in different ways but to have all family members appearing to have such little concern strikes me as odd.
I’m not saying they don’t care if she were dead.
I’m not saying they had any part in her murder.
But something doesn’t add up.
Mike seems to give things away more so than his Mother. He’ll talk prematurely about grieving and notably in one of the clips says that he hopes they’ll find her vehicle.

Nothing was planted with exception to the key, the RAV4 and the bullet frag, Item FL. Those items were legitimately in a sense documented wholly as being found on the ASY.

Final specimen radiograph is designated AK. This consists of a fragment of skull bone measuring 6.3 x 3.8 cm. Also present are some possible coniferous needles or similar type of plant debris. There does appear to be some soft tissue adherent to this portion of bone. It appears consistent with occipital bone however for definitive anatomical designation, refer to the forensic anthropological report. Radiographic appearance of this is also variable dense and without definitive fragments of bullet.
The fact that keys, garnet zippers and clasps, along with a burned cell phone, were found in the Rudy burn pit.
It would be freaking amazing if we really did have it all completely wrong.
And this last gem from Eisenberg regarding the burn pit where bone fragments were located in the Rudy case:
"Given the shallow depth of the burn pile and the meager representation of adult human bone from that context, I believe that another (or other) dump/deposition location(s) may yield additional adult human bone/human remains. Now Eisenberg boldly stated that in Avery's case the bones were not moved from his pit, nor were they brought to his pit... Yet the bones allegedly found in Avery's pit were said to have been found in a pile on top of the crusted earth in plain view.... and that other cremains were found in two other locations... the gravel pit and Janda's burn barrel.

This quote by KK taken from the court transcript of the discussion you highlight in #2 above, has always bugged me---because it underscores the incompetence and/or corruption on the part of LE, the prosecution team and the judge. This is something that the prosecution should have investigated without 'suggestion' from Buting, as soon as it was known that her voicemail had been altered on Nov. 2, 2005---prior to the report of her missing. There are only three reasons that they did not:
They were utterly incompetent at the process of conducting investigation, or
They (LE, Prosecution, Judge) were utterly corrupt and ignored facts that pointed away from their chosen 'perpetrator,' in order to target SA alone, or
A combination of incompetence and corruption.
The judge's part in not using his authority to pursue this question raised by Defense is most troubling. What a disappointing failure.
Also, the following portion from MH, highlighted above, triggers my spidey-senses:

Maybe I am reading too much into his hesitations and pauses---but, something about this rings false to me. Didn't he later state under oath that he accessed her voicemail on Nov. 2 and yet he testifies that he first learned about TH missing on Nov. 3?
I believe the Halbachs have information that would add to a more truthful account of TH's death, but their misplaced allegiance to LE is keeping them silent. I hope I am wrong about this.

If the State truly thought Avery was guilty of Teresa's murder, Zellner wouldn't have to go through the courts like this. They would have immediately granted Zellner access to whatever evidence she wanted so they could watch her drain her resources conducting tests that would prove Avery's guilt, at which point the State would demand an evidentiary hearing that would be widely publicized so they could have an audience while they easily discredited Zellner's experts and claims.
If there was nothing wrong with giving those bones to the Halbachs why didn't the State pass along the report or directly inform Avery's counsel themselves of their actions? Why would the State give these bones to the family if they knew they would have to then turn around and hide reports and lie to lawyers and courts about their actions? It seems as though giving those bones to the Halbachs was such a sketchy move that it required an immediate and continuous cover up. Why take the risk in the first place? Why didn't they just leave the bones in evidence and avoid all these troubling questions?
When it comes to the lack of photo documentation regarding the quarry bones, such obvious investigative failures do not qualify as excusable neglect. This was intentional. And their intentions were nefarious - they were hoping to obscure the truth of what the quarry evidence would reveal, just as they were hoping to do with the burn pit evidence.
We all have discussed the State's failure to photograph the burn pit over and over, but truly their failure to photograph the remains in the quarry is just as egregious. There is not an innocent explanation for burned human bones with cut marks being found on county property during a murder investigation. Therefore, there is not an innocent explanation for investigators failing to photograph this evidence in situ. They are clearly trying to cover something up in regards to the bone evidence.

The defense was going to illustrate to the jury the lack of documentation of the evidence at the scene of Avery's pit and the fact that almost everyone involved in depositions in Steve's civil suit had a role in the Avery property searches and investigation, some turning up critical physical evidence, even though there was a COI mandated to keep Manitowoc LE from the Avery property.
Then there is Deb Kakatsch. By barring Deb from the scene, Law Enforcement had free reign to develop any kind of narrative they wanted to in regard to Steve's pit and the Janda burn barrel. It was all about perception. And LE wanted to control the perception, and they did for a long time. At trial, Willis bounced Kakatsch out of the courtroom on a flimsy argument. The jury was about to hear some truth but were denied.
They barred Deb Kakatsch from witnessing the shenanigans unfolding at the Avery property. They knew she wasn't going to be a team player in falsely claiming bones were in Steve's fire pit... so they took the unusual and quite risky route of simply excluding her from the " fake investigation." She did not play ball in Ricky's investigation: she witnessed what the Sheriff did that night and it sickened her. Now comes Avery's case. She knew something was afoot but was too spooked to do anything about it.
A crime scene willfully neglected and undocumented - the burn pit. The second most important crime scene next to the RAV4 isn't photographed or forensically excavated, but everyone testifies there were bones there, even LE who have had zero expertise in identifying any kind of human bone or cremain, Jost, who personally kicked of the burn pit narrative.

Then 4 months later they blasted Avery with Brendan's confession, which was so incredibly over the top that not one piece of forensic evidence would ever be found to reconcile it. To save themselves from embarrassment, Fassbender, Culhane and Newhouse generated the magic bullet to save the day.
The blatant misrepresentation and lies regarding the identification of Teresa Halbach's bones being 100% identified by both the Wisconsin State Crime Lab and the FBI were broadcast to the mass public BEFORE Dean Strang and Jerry Buting took the case. Talk about swimming upstream against the strong current of public perceptions.
Pagel was the first to spin the lie regarding the positive ID of TH. He grossly misrepresented the FBI finding to inflame the court of public opinion against SA. The public consumed and believed what they were being told by those in authority. Perceptions of SA's innocence quickly turned to those of guilt.
Mike Halbach furthered the bone identification inaccuracies by broadcasting Jerry Pagel's false information about the bones belonging to Teresa via statements he gave to news outlets during the same time period. Going so far as citing Teresa Halbach's death certificate as proof of what he claimed they already knew.
Pagel completely oversold the FBI mtDNA tests. They were, as FBI reported, not confirmative. They couldn’t exclude KH as a relative, but with a probability that is much, much lower than required by regular nuclear DNA tests. And unless he is a complete nincompoop, he of course did it on purpose.
Kratz knew this was a huge misrepresentation of the FBI's DNA findings. Yet he floated it publicly anyway. He admits later in an email to Sherry Culhane the weight given to the public perception angle of the falsely represented FBI findings by Pagel, when he knew that the FBI never positively identified Teresa Halbach's remains.
The Wisconsin public formally believed and accepted Ken Kratz's narrative that human bones were not only found in Steve Avery's burn pit, but that the FBI confirmed the bones as belonging to Teresa Halbach.
The FBI received bone fragments and a cutting, Q1, on November 23, 2005. The FBI stated that the bones were too far destroyed to extract a positive DNA identification of Teresa, that Q1 could not rule out Teresa as the contributor, but it certainly fell short for positive identification purposes.
DeleteWhatever specimens the FBI received, they didn’t even do nuclear DNA tests on it. They stated the material was too destroyed. So we don’t know what they got. It is peculiar that the State requested help from the FBI when SC apparently could do wonders and detect loci herself.
The FBI analysis of Item Q1 was more compatible with the Hispanic population than that of the Caucasian population by 39%. It begs the question, What the hell was submitted to the FBI for testing? Is the FBI analysis of item Q1 in exact alignment with BZ, the tissue Culhane analyzed? Did the sample the FBI received come from a Hispanic origin?
The question remains: Why did Sherry Culhane insist that she was the person responsible for packaging item BZ and sending it to the FBI for testing? And Eisenberg, on the contrary, making the same insistence. The FBI received something to analyze but the sequence of events don't pass the smell test.

I don't have a direct knowledge, otherwise, I would provide it. I only read it somewhere here. I am guessing it's plausible that she was forced to test truthfully if WIP was over her shoulder.
That actually brings up a question of how much her testing of the 2005 case was truthful. I am guessing no one was watching her anymore?

ReplyDeleteI don't have a theory. I have legitimate, fact-based doubts that TH reasonably has been proven dead. A partially successful MtDNA test (results only listed that bones could not be ruled out as a descendant of KH, which is not the sames as saying that the odds of the bones not being a descendant of KB is 1 in a billion) that has chain of custody and other issues is nowhere near a reasonable standard of proof of death.
So TH is missing. We have no official or credible report that she is alive. Likewise, we lack credible proof that TH is dead. So that leaves us with TH's status as unknown. We can't say for certainty that she is either alive or dead.
This is the exact opposite of what KK did, which was go with a theory that lacked sufficient support from the facts to be true. All evidence must be weighed for credibility. Everyone, and I mean everyone, accepts and rejects evidence every single day based upon perceived credibility of the evidence. The trick is to have as objective and rational standards of doing this as possible. KK's accepting and rejecting of evidence appears to be highly subjective using whatever "logic" to argue that advances towards his goal.
I just flat out don't know what happened to TH. I just want the truth and, using objective standards, there is considerable rational doubt that TH is dead, as the narrative the state has been pushing for over 13 years claims. She can be proven to be alive or dead, so long as it's credible and true, then it meets my objective.

DeleteWhat does a 100% mtDNA match mean? Well it means the two samples share a common maternal ancestor usually within the past 550 years or so. Which means literally thousands of people who don't know that they share an ancient common maternal ancestor could have the exact same mtDNA. So the bones could have been someone who died in 2005, 1950, 1803, or 1670 and be an exact match to KH's mtDNA.
Now the bones tested did not match KH's 100%. So not exactly the same confidence as 100%, but mutations do happen or we'd likely all share the same mtDNA or a very limited distribution. So it's possible that TH had a mutation in her mtDNA at one location - only one location didn't match.
The FBI's 0.17% is a statistical measurement, not a measurement of accuracy. And it assumes bones are of same race as KH. But the owner of the bones, if human, could have been black, hispanic, asian, native american, etc.
So the odds of it being TH based solely upon are extremely far from certain. How far? Well, we don't know, other than many thousands of people could have potentially matched as well.
So we really have no credible proof that the alleged bones are TH. We can't show that it wasn't TH if the FBI mtDNA was correct and a hole host of other things were correct, such as bones or whatever was tested was found in one of the 5 spots for bones reported, that human procedure was followed, that chain of custody is credible ( a huge if), etc., etc., etc.
Simply put, if the FBI mtDNA is correct - couldn't rule out the tested material from being TH - it certainly was a far cry from identifying the bones as belonging to TH. The bones could belong to thousands of people with a common maternal ancestor a few hundred years ago.

0.17% is a precise measurement for a very precise question. What is the likelyhood of there being a separate maternal line other than that of KH that matches the material tested for mtDNA where the person is caucasian? Based upon the FBI's limited data of less than 4,000 at the time of testing. Meaning that the single value that did not match doesn't add significantly to the number of people it could match as a search of KH's female ancestor that generated the mtDNA that KH would have passed on.
Now if we trace KH mtDNA back to where it likely came into being from a mutation, usually estimated as 7 to 8 generations. Then proceed forward with all that could have inherited the KH mtDNA gene from the common ancestor, we have a large group of people. We can't precisely measure that group because we don't have sufficient data to do so. Now if we did the genealogical research (if that's possible in KH's case) we would have a huge tree of names and data for a precise answer.
So the mtDNA narrowed the odds of the bone being TH from 1 in 8 billion or so down to 1 in x + x0.0017 + x0.0026 + x*0.0039 or 1 in 1.0082 x. Where x is an imprecise guess at the total number of people in a person's maternal lineage family tree.
Or as the following article explaining what mtDNA testing reveals:
Matching at the HVR1 level means that you have a 50% chance of sharing a common maternal ancestor within the last fifty-two generations. That is about 1,300 years.
Matching on HVR1 and HVR2 means that you have a 50% chance of sharing a common maternal ancestor within the last twenty-eight generations. That is about 700 years.
Matching exactly on the Mitochondrial DNA Full Sequence test brings your matches into more recent times. It means that you have a 50% chance of sharing a common maternal ancestor within the last 5 generations. That is about 125 years.

What totally sucks for SA... he saw a woman called TH leave the property alive, and then charged with her murder. If Steven Avery is Sam Jones, a worker at a Salvage yard, and TH had been to his work place to take a picture for AT on Oct 31... there would be zero evidence to get warrants ... for the entire Yard. PD would need to build a case on Sam Jones.
What immediately happens on Nov 5 2005, with a SUV found on the ASY.... every building, auto, and parcel of land is given a search warrant by a Judge. A DA / Special prosecutor from Calumet C shows up on scene like its scripted out.
Crimes are not solved the way the Avery/ Halbach case went down. Due process, and not Pam of Gods solve crimes... This was a set up from the day TH left the yard.
It's my belief BJ/T met ST thru BoD... she became involved with ST while married... ST lives almost directly across from ASY in 2005... both BoD and Scott T have permission to hunt the land ST RV is on..

After much debate with friends family etc....our consensus is the following:
we have ZERO information on TH such as her computer forensics information, her text messaging and email
ALL the current players in this game seem sketchy as hell but at the same time oblivious to the big picture BoD, ST etc
LE had several days at minimum to fabricate this crime and pin it on their #1 nemesis.
This leads to only one possible deduction....we know almost nothing about TH's last several days/months leading up to her disappearance....WHY? Is this the gentlemen's agreement forged between B&S and KK? Would having all of TH's correspondence amongst friends painted a different picture of her? We don't know do we? OR maybe we actually do!
It has come out over the course of reading transcripts etc that TH was not only a adult photographer but she did in fact have an affair with a married man....(going thru a divorce) was TH the reason? we don't know this either....
The key to this whole case is going to be getting TH's computer forensics analyzed again and her phone and texting history. Is it possible via some open records law to find if she ever had a second phone? (the one found where her car was seen)
The more we focus on the known the less chance of the unknown ever coming to light. BoD and ST are nothing more than idiots who got caught in some lies....
The REAL plot is going to focus on and revolve around her known friends and that circle....not anyone associated with the Avery's

This was shown in MaM part 1: KK jumped on Buting as soon as he tried to bring up the deleted voicemails. He even had the jury excused from the court room to prevent them “getting confused.” The judge agreed. KK distracted the judge by rambling on about how he couldn’t have the defense saying TH was still alive. And that was the end of the defense being allowed to bring up anything regarding TH’s voicemail.

So what do I think happened then? This begins a LONG time before Oct 31st and began only as surveillance of SA only to try and get him on SOMETHING before he sues the state.
I honestly believe that TH's father is the key to this whole thing. Personally I do not think he died in 1988 in Florida. It's impossible to prove but I believe he was an agent either FBI, DEA, etc and was working the underground drug scene as an undercover agent or informant. He was made to disappear just like TH did. She actually followed in her fathers footsteps.
I believe TH showed up, took her pictures and left. She put her vehicle in the Radant pits with the keys in it, and either the Federal agency she actually worked for picked her up, or a close family member also in on this case.
I think some PUNK basically STOLE her vehicle from the pits and left it where it was seen by more than one person. This and this alone is why this case turned into an absolute circus! This part was NOT PLANNED! Explains all the evidence like finger prints etc not being compared to anyone.
AC finds the car and is directed EXACTLY what to do with it either via KP or the DOJ.
The rest is pretty straight forward, LE's plan WAS to use old bones from a previous case who would match MTDNA which they knew up front. This could be ANY PERSON who died in the last several decades that shared a common female ancestor to TH. Insert whoever you want here....
Being that the vehicle was compromised they upped the ante against SA by moving bones from the Pits where they initially figured was close enough to get SA, but with the vehicle compromised figured they needed more. Enter the Bullet and Key.....the blood was already planted the night of the 4th. The vial was used and the FBI knew that certain spectrums of light could destroy EDTA so it was never an issue.
To me....this is the most streamlined easy to grasp theory, that matches what we know. TH I believe to be dead now, as a result of a terminal condition she knew she had so played along with the state and lived her last years travelling abroad...its the only thing that makes any sense at all about this case.

"Charred tissue" from bone fragment (item BZ, with partial DNA) and another piece of "charred tissue" from the same bone fragment(?) were sent to the FBI for mtDNA (items Q1 and Q2?). Both charred tissues fragments (if there really were multiple miracle-survived tissues) have very interesting results: partial Teresa Halbach DNA and full mtDNA match to Karen Halbach.

They sent all the bone fragments to the FBI but they were too badly degraded to do tests. The FBI did the mtDNA test from mysterious “tissue” that supposedly came from the tibia. (Shin). But this was not used during trial. Mainly because mtDNA tests are a joke. What they used at trial was Sherry’s partial DNA match. Which was just as much of a joke as the mtDNA test. It too should have been inadmissible for several reasons including it only matched 7 of 15 alleles. It was also discovered and tested under very sketchy circumstances with no chain of custody. It is not known exactly where and when it was found. Eisenberg claims she had it when Sherry had it. Sherry claims she is the one who sent it to the FBI also.
Her profile was never entered into any database nor has anyone ran her supposed DNA through any database. The only place the profile exists is in Sherry’s reports.

Yes it was returned by FBI. They returned everything that was sent to them. It should not have been destroyed. Also note all of Teresa’s remains were given to her family in 2012. I’d assume they gave the tissue back as well but I’m not so sure now because I don’t recall seeing it listed with the fragments. This tissue would have to been stored in a refrigerator and the items they gave back to them were not from a fridge. Just boxes and zip locks bags. No mention of how this tissue was stored. Come to think of it this would be something to look into.

Thank you, I knew somebody like you would be able to give the OP a better answer than I did. I knew the Halbach's had been given the majority of the bones back, I just wasn't sure about any that had been used for testing. I presume KZ not inquiring about the shin bone, or the tissue from it, means she is happy it was Teresa's, even though the work done on the identification was pretty shocking and not what most people would call conclusive at all. Or maybe it means it is just something KZ knows she can't make a successful argument against.

I'll even go so far as to say the 85 case was a set up as well...... After doing some digging, there wasn't even a rape that took place...... Just an assault. Yet, they charged him with rape among other things....... If you think about it, the 85 case was too convienent too, given the whole incident of SA running cousin off the road...... The TH case was probably dreamt up before SA even got exonerated of the 85 case.... Once the state realized SA was going to get out, that he had solid proof he was innocent (DNA evidence became a thing) I think the state went to work straight away concocting a second plan to frame him and make sure he lands back in jail. SA didn't have a prayer.

One theory I have definitely tossed around is her actually being undercover. Maybe she was an agent of some kind from GB. Her college degrees and whatnot could've been made up and TP couldve known or maybe not. So with the rest of the theory I think if this were the case the bones are the girl that overdosed, cant think of her name. Thats why they are so charred. Another reason this could make sense is the job at AT. Their relationship seems weird and the whole thing does really. I think a lot of things make sense this way.

I have to look back on Kratz's STIP list, but was Mike Osmunsen on that STIP list?
If not it looks like another case of the defense blowing yet another red light.
If you read Strangs cross of Bobby Dassey it is completely confusing to read. Strang jumps back and forth from one topic to the next, in and out of timelines without really getting much of value out of Bobby Dassey.
Strang does this a lot with the witnesses. His cross is difficult and quite confusing to read.
Now imagine if you were a Juror listening to that?
Now imagine not being allowed to have access to any transcript like the Jury wanted in Bobby's case and were told to "rely on your memory" ...as Willis instructed the Jury they'd have to do.

Notice how he basically drawls only yes or no answers from his witnesses. Notice how his questions are direct, simple and flow forward and dont jump from one timeframe to the next.

The Knights of Columbus is a fraternal group founded by the Catholic Church and modeled after Freemasonry. In Catholic regions, the Knights are well-represented in city government, law enforcement, and the courts.

I share your suspicions. It's distinctly possible he was tangentially involved in the commission of the murder - a support role in a larger operation.
It's my theory is that he and Tadych were involved in surveillance of Avery - initiated by police (hypothetically) following the $36 million lawsuit.
Bobby Dassey told CASO (p. 32) that Avery would lie to "stab ya in the back" and indicated that he had done this to him in the past. On 3-19-2007, the day after Avery's conviction, Tadych said: “What happened yesterday is the best thing in the world,” adding, “He got what he got comin’ to him.”
Tadych's family is part of the local "elite."

Scott Tadych and his brother (William Tadych) had previously been represented by Mark Rohrer, who was part of Fox's private law firm (Winter, Fox & Stangl and renamed Olson Winter & Fox).
Rohrer was later District Attorney of Manitowoc County (2003-2013) at the time of the Halbach Case. It was he who brought the Calumet County D.A. (Kratz) into the case.
Rohrer had also been deposed in Avery's lawsuit little more than a month earlier. He appeared extremely nervous.
I predict that if the convictions are vacated they'll try to blame most if not all of the planting on Dassey and Tadych as well. There were several of us who predicted that 'backup' patsies had been set up in advance.

There is virtually no biographical information available with regard to her father Richard Urban Halbach, who died at the age of 31 in Florida under circumstances that remain undisclosed.

I think if one considers that this whole thing is a psyop/framing of SA, and that TH didn't die, the weird RAV 4 photo with her and the camera, and the ridiculous video would have been part of it.

Exactly lol. It’s so blatant when you really step back and put the pieces together. The thing is, their is no way little old manny had the brains or the capabilities to not only dream this whole plan up, but execute it as well. I 100% believe the FBI interviened and set everything in motion. They were on the hook too for shoddy DNA tests with inaccurate results. Most forensic analysts (like SC) are trained by the FBI......so these analysts end up using these techniques for DNA testing in the county medical examiners/morgues across the country, the techniques the FBI taught them.
What do you think would have happened had SA brought this little to but of information regarding the faulty DNA testing techniques developed by the FBI to the public eye? There would be outrage, and most likely court orders to re-test hundreds of thousands of DNA tests, possibly millions, effectively making the FBI look like an embarrassment.
I mean, these are supposed to be the highest of the highest, brightest of the brightest, and highly advanced of law enforcement in the country, and they were about to be exposed for knowingly teaching, promoting, and using flawed DNA testing. SA was going to clean house lol. Nobody wanted that. Especially the FBI.
So I 100% believe they were involved, if not the masterminds behind the whole “operation”. I mean, the FBI has everything needed to pull something like this off as far as resources. It’s also why MC LE felt so secure - because they had the FBI looking out for them.

I believe it was organized at a very high level and, of course, the Halbachs would have participated. That would explain why they all acted so oddly while she was alleged to have been missing, as well as at the trial. What other explanation is there?
It would also explain why we have no documentation of the discovery of her remains -- the only evidence proving she was murdered on that property. That just would not happen. But if not for MAM, no one would have placed this case under a microscope.
There was probably a lot of coercion, bribery and blackmail.
I don't believe we will ever know what really happened in this case, and people will argue about it forever. The truth will never come out.
I really wish SA's attorneys would not have accepted that TH's remains were found on the property. I believe that was his only hope for freedom. But as it stands, no one has ever contested that in court, and for that reason, it is unlikely he will ever be cleared.
There was just too much money at stake. It would have devastated the county, and they had new businesses starting up there. Orion had just received federal money intended to revitalize the country. This lawsuit would have probably destroyed that plan. Obama talked about it when he visited Manitowoc in 2011.

Teresa's friends could and probably do have information that would be helpful to the defence.
I WAS in contact with one of Teresa's circle of friends for a while who believed that Avery was innocent and something fishy could have possibly went on - she also believed that it was possible Teresa might still be alive.
But in asking her if there was anything unusual she had heard when talking with Teresa's other close friends that stuck out in her head - she told me no - that she couldn't talk to her other friends about it because whenever she brought up that she thought Steven Avery might be innocent they would get mad at her and stop talking to her - and she said there was no one she could talk to about it.
When I asked her if she thought they could be hiding something, she said she didn't know but did think it was odd that they wouldn't look at any other possibilities of what might have happened to their friend.
What might they know?

If they, once again, changed their theory of defense, then, once again, we'd like to know that... Obviously I believe something is very wrong with this case and that the Halbach family might have a piece of the puzzle, but that does not mean I’m advocating for any position other than “I don’t believe we’ve been told the truth.” I did not mean for this post to come off as an attack. I am simply asking a few questions. Here a few thoughts:
The many theories surrounding the family can be broken up into two categories:
The Halbachs had a motive to cover up Teresa’s death and so they helped out and shut up. Or Teresa is alive due to some interested party approaching Teresa with an opportunity to fake her death. Either way in this case the Halbachs framed Avery and Dassey, men they knew to be innocent. As Mike says, “It’s the hand that’s kind of forced upon the prosecution team.”
In the alternative perhaps Teresa was murdered and LE manipulated the Halbachs into believing Avery guilty and persuaded them to help out / stay silent to ensure they ”killed the lawsuit” “got the right man.”

There are so many things that are so wrong in this case. One thing that makes me furious is the blue code of silence. Every law enforcement officer around the world knows how utterly incompetently this whole case was handled, but none of them will call the bad apples out and stand up for what is right. I hope that LE realize that when the truth finally is exposed, people will then realize that the whole LE profession sat by for over a decade and did nothing to call out their own. On Oct. 5, 1926, Officer Leo Rocque of the Manitowoc PD was shot to death after answering the doorbell at the combined police and fire station. The case was never solved. "The entire investigative file went missing back in the 1930s, so there was a whole cloud of suspicion surrounding that investigation," said Two Rivers Police Chief Joe Collins. "That was back in the day of Prohibition and it was suspected that he may have been working on an alcohol case of some sort."
On June 15, 1970, Emma Fick, 76, was killed when an unknown assailant repeatedly bashed her head into a tombstone in St. Mary Catholic Cemetery in Manitowoc. Her purse was found at the scene and nothing appeared to have been taken. She was not sexually assaulted.
On New Years Day, 1971, Jeffrey Csida, 18, an honor roll student and recent graduate of Reedsville High School, was found beaten to death "along a road near Cato" in Manitowoc County. The Waukesha Daily Freeman reported on 1-8-1971 (p. 11) that Dennis Saber was arrested at a manufacturing plant in Two Rivers and charged with the murder. On Sept. 17, 2016, however, USA Today published an article about memorials for the deaths of Rocque and Csida, stating that to date "no one has been charged in the homicide."
On July 10, 1972, Mary Glander, 83, was beaten to death in her apartment after which several things are purportedly stolen and two fires set inside. Randall Rohl - likely a relative of Rick Rohl (see "Ricky Hochstetler") - is charged with the murder based on the testimony of Sue Nelson, 13, despite 8 alibi witnesses and the state failing to present any of the the supposedly stolen items.
Debra Sukowaty, a cousin of Carmen Boutwell (who is also on this list), disappeared on September 24, 1977, a day after the Fall Equinox. Her body was later found in a gravel pit owned by the Radant family. A local, Ronald Fencl, was later arrested. He maintains his innocence to this day.
The Radandt family wields powerful influence in Manitowoc. They have served as directors of various community associations and of the county bank. Members of the family have also belonged to the Knights of Columbus. One member of the family is married to the only granddaughter of a top officer of the Manitowoc County Sheriff's Office.
DeleteThe Radandts owned a "hunting cabin" situated directly behind the Avery property, and also several 'gravel pits' and 'quarries' where police found flesh, blood and charred bones. Josh Radandt was the first person to report a "bonfire" on the Avery property, which every member of the family denied until after repeated police interviews.
On Jan. 22, 1980, the body of Irene Roedig, 43, had been found naked and bound by rope after officers responded to a suspicious fire at her residence. Roedig was mentally challenged and had worked for the Holiday House, a workshop for people with mental disabilities. Nothing had been stolen and no motive nor suspects were ever established. Roedig had been speaking to her mother when the doorbell rang, approximately two hours before the fire. Her mother asked if she should hang on and Roedig told her not to, as she knew who was at the door. Forensic tests confirmed she had sexual intercourse within 48 hours of her death.
On Jan. 24, 1983, Mary J. Ziegelbauer, a student at Marquette, was brutally raped and murdered in Manitowoc County - allegedly by a juvenile who had been released from police custody less than 24 hours earlier. Her father, Robert, was the Manitowoc County Executive in 2005 and one of the top officials who issued direct orders inexplicably banning the county coroner from the Avery property during the Halbach murder investigation.
On May 13, 1984, tax auditor Thomas Dresser died in Manitowoc County - after drinking cyanide-laced Coca Cola. The investigation was presided over by Sheriff Thomas Kocourek and District Attorney Denis Vogel, the key figures in the cover-up of the 1985 sexual assault of PB. Days later, Vogel announced that their investigation had concluded that the victim "committed suicide."
On Nov. 30, 1984, the eve of the Greater Feast, Louise Frank, 64, disappeared without a trace and has never be found.
On Oct. 1, 1988, Cheryl Spaeth-Duvall, 38, disappeared without a trace and has never been found.
DeleteOn November 15, 1988, Mary Ann Dehne, a friend and employee of Dave Begotka, was found in her bed covered in blood. Her boyfriend was initially arrested, though the police later changed the story and, bizarrely, deemed it a 'heart attack.' Begotka claims that Dehne was being harassed by members of the occult-based 'sex club' he claims existed in Manitowoc and that she was sleeping with a gun because she was in fear of them. When he suggested that they contact the police, she replied: "They are the police."
On November 2, 1990 - All Souls Day - the body of Nathan Terens, 2, was found floating in Manitowoc River. The father was arrested and convicted, but strong evidence later emerged showing he was railroaded and that his wife and her paramour may have killed the baby. The truth remains unclear.
On Sept. 13, 1993 (around the Fall Equinox), Pamela Claflin was brutally raped and murdered after leaving a bar in Manitowoc. The man who was arrested and convicted, Randall Mataya, maintains his innocence to this day. It later emerged that one of the State's witnesses, a convict, received a sentence reduction and, beyond that, money for his testimony. It also later emerged that a reputedly corrupt police officer with scars on his face had been pulled over while off-duty and had the victim's personal affects in his glove compartment. One significant revelation was that the rape kit tests were actually negative for Mataya - not positive, as Deputy Sheriff Gene Kusche, who played a key role in framing Steven Avery for the 1985 rape, falsely represented them in perjured testimony during the trial. Kusche served with the U.S. Army Security Agency in Vietnam and may well have participated in the Phoenix Program.
On September 23, 1998 (the Autumn Equinox), Officer Dale Ten Haken of the Manitowoc PD was killed execution-style, with shots to the head and abdomen. Two teenagers were arrested and convicted on the testimony of their girlfriends, who escaped possible charges by turning State's evidence. They had been captured with the assistance of Julie Cramer, who later resurfaced in the Halbach investigation. Both young men were represented by public defender Len Kachinsky, the Army Intelligence asset who worked hand-in-hand with the State to deliberately sabotage Brendan Dassey's defense. True to form, Kachinsky began airing to the press that his clients' story was "hard to believe." One of the alleged killers now practices witchcraft in prison.
Ricky Hochstetter was killed in a hit-and-run in 1999 that was investigated by many of the same police personnel later involved in the cover-up of the 2005 murder of Teresa Halbach. There were persistent reports that a police officer had killed him - purportedly 'accidentally,' while driving drunk. Among the early suspects were Sheriff Thomas Kocourek and Rob Hermann, who is now the Sheriff. Another was Rick Rohl, who knew Steven Avery and to whom Avery had placed a forty-second phone call to on Halloween, 2005, when Halbach disappeared. The circumstances surrounding this call have never been established.

None of the other parties are given such provisions, and the cousins will soon find the car in a forty acre labyrinth of vehicles in 15-30 minutes, one of them later testifying that "God showed us the way." Avery is immediately logged as a suspect and police begin a seven-day search of the property - one of the longest searches in the State's history. Sgt. Andrew Colborn, who had ignored a 1995 report from the Brown County Sheriff's Office that Allen was responsible for the rape of Penny Beernsten, and Lt. James Lenk, his direct superior, both of whom were deposed only weeks earlier in Avery's lawsuit against the county. Both Sgt. Colborn and Lt. Lenk will find or be present for the discovery of virtually all evidence that will later be used against Avery, even after previous searches of the same areas produced nothing. Also during the search, the roommate, the boyfriend, and Josh Radandt, a prominent businessman from one of Manitowoc's most powerful families whose "hunting cabin" was behind the property, were inexplicably allowed behind police lines. The boyfriend inexplicably used a false name when 'logging in.' Cremains are discovered in a 'burn pit' on the Avery property, though despite false testimony by the Wisconsin State Crime Lab, the FBI was unable to positively link the material to Halbach. Avery is arrested days before the scheduled depositions of Sheriff Kocourek and District Attorney Vogel, which are soon canceled. Lt. Mark Wiegert of the Calumet County Sheriff's Office and Tom Fassbender of the Wisconsin Department of Criminal Investigation induce Brendan Dassey to make false statements attributing the crime to he and Avery. His first lawyer - a cousin of Halbach - and second lawyer, Len Kachinsky, who is flown in from Army Intelligence, both tell the court and press that Avery and Dassey are guilty and attempt to coerce Dassey into testifying against his uncle. Both are convicted after widely-televised, surreal show trials and are now fighting for their freedom.
Carmen Boutwell dies of a reported 'drug overdose' under strange circumstances in Manitowoc on November 3, 2005, the day Teresa Halbach is reported missing. Strangely there were no needle marks on her body, and the family remains convinced she was strangled to death. Her mother had seen her earlier and described her as being in good spirits. Boutwell bore a striking resemblance to Halbach, and when police discovered her body they initially believed they had found Halbach's remains. In another bizarre 'coincidence,' Halbach and Boutwell were related through marriage. The investigating officer, Lt. Dave Remiker, was a cousin of Sheriff Thomas Kocourek (who played a key role in framing Avery for rape in 1985) and was also on scene at the Avery Salvage Yard. He declared that the case would likely 'never be solved.' In the days before, she and her boyfriend, a violent criminal who was mysteriously released during this period despite pending charges and a long criminal record, were being processed through the courts for drug offenses. He was arrested shortly after the release of "Making a Murderer" and is currently serving prison time. There were later indications Boutwell may have been supplied drugs by a prominent pharmacist who had been protected by police. It would later emerge that Boutwell was under scrutiny by federal agencies, and that the DEA had driven her to a remote location for an intimidating and undocumented 'interview' in Oct. 2001. Boutwell was cremated at a funeral home owned by the spouse of Lt. Mike Bushman, who was one of the officers who arrested Avery in 1985 and who later participated in the search of the area in and around Avery Auto Salvage. In a series of highly unusual moves, the police took control of the cremation and delayed the funeral until the day the cremains publicly linked (but never matched) to Halbach were discovered.

He claimed he was being 'harassed' by police, and it was shortly afterward was found dead. Grimm, who had served in the Navy from 1974 through 1977 and was well-regarded in the community, had been arrested earlier in the year after breaking into a school while high on drugs. He reportedly "thought he was a knight."

I agree. Especially nowadays everyone has a phone that can do everything.
It's a tough market for sure. I know a few people who were trying to run a business (they are quite talented tbh - very nice photos they showed me) but eventually had to get a salaried job. But this was just a couple years ago which means the cell phone has invaded the photo market.
My real question is why would she choose that path? MH was working as an assistant with GB Packers even at the same time of her disappearance. She graduated in 2002 which means she would have had more experiences and she probably had better grades. Couldn't she see how tough the market would be? Why couldn't she get a better off gig (like MH's) that would have brought in more money so she could afford a better place to live in GB and to travel?
If the reason was because she really loved photography, I would want to see how really talented she was if I can see a few of her work.
I do think it's still possible there's nothing more to what she chose to do. But I am trying to see if it's also possible that there was something suspicious. You have to bring up the theory to go further. Either to debunk or the strengthen it. If the theory doesn't hold water, it will die itself.

On 11/06/05, I (Deputy cw of the CALUMET COUNTY SHERIFF'S DEPARTMENT) was called by Inv. MW who asked if I would be able to go over to TH's residence to collect evidence. Inv. W wanted me to pick up evidence that would contain TH's DNA in case it would be needed for further identification. I informed Inv. WIEGERT I would go en route and collect some evidence. lnv. WIEG told me a toothbrush, lip ChapStick and possibly a vibrator that was located in her dresser would be good items to collect.
I then asked SB if he could bring me to T's bedroom, which is located on the first floor in the southwest corner of the residence. Once inside the room, I did locate the center compartment cabinet doors on the dresser and inside there was a cardboard box containing a reddish maroon case with a zipper. once I opened up that case, I did locate a vibrator or a sexual device. I rezipped the case, placed it into a plastic bag and sealed it. That item was collected at approximately 0803 hours.
o Property TagNo. 7096, a toothbrush and ChapStick.
o Propefiy Tag No. 7097, lip moisturizer and hairbrush.
o Property Tag No. 7098, a maroon case containing a vibrator sexual device.

Brushes are also excellent sources of DNA because the scalp also sheds a LOT of cells, that is more valuable than the hairs.
Hairs without a root can be used for mtDNA, you need the root intact for STR testing (the type the WI State Crime Lab did).
Usually a well used brush will contain good epithelial cells.
And a toothbrush.. spit is right up there with blood as far as good DNA sources, & chapstick... ooh that goo is a cellular trap!
I think they could have gotten a standard of hers if they wanted from her personal items, but I assume the pap smears had more legal cred. (?)

DeleteI just want to clarify that pap smears do not necessarily mean a partial profile was obtained.
Unfortunately, there is confusion because of SC's inconsistent language in her lab report. Since the pap smear was used to ID the full profile of blood stain A1 as belonging to TH, we have to assume a full profile from EF (pap smear) was obtained. In a report dated 3/2006, a full profile is shown.
Now, whether you believe those results, is another story.
The thesis paper that OP presented shows that getting full profiles from pap smears is difficult, and that there are issues that could confound the validity of the profile, however; it is not impossible.
Right now, we can only speculate, however, these are questions that should be asked... ideally during the trial; but better now than never :)

Maybe they took TH's pap slides so no one else would have a source of reference if in the future they tried to compare it the "evidence" in the Rav4, on the magic bullet, etc. In fact, maybe all the items they took from TH's house was so no one would later be able to obtain them for a basis for comparison.

Could it be that she only had a partial profile on the PAP slide because the retrieval methods are so fast or so easy. Could she have skipped some steps and messed this test up?
The fact that they used NOTHING from her home that they collected has always bothered me. There was a big gap of time from her missing to obtaining Pap slides. Why were they comparing everything off of the Pepsi can when they had other things w/ her DNA to compare it to?

DeleteMethods of DNA retrieval from Pap smear are NOT easy and NOT fast. According to document, these methods were debatable among forensic study groups in regards which method was better. Why such complexity? Because Pap smear has been already used for other medical purpose. These slides went thru with certain chemical treatment. Plus, slides itself has ‘coverslip’. It’s not fresh taken tissue from vagina for DNA purpose.
Every forensically based criminal case must have ‘reference’ DNA sample. It’s absolutely MUST.
‘Reference’ DNA sample must contain full victim’s profile (preferable!!!) for reliable victim’s identification.
Pepsi can cannot be used as ‘reference’ sample because ANYONE could drink from this can. Only if you have reliable proof that ONLY TH was drinking from this can (you or LE have eyewitness of such drinking event) then such evidence can be used as ‘reference’ sample.
Yes, it’s very very strange that:
nothing forensically has been found at TH house which could be used for her identification;
TH hair brush and TH panties from hamper (meaning, used dirty panties) and TH vibrator didn’t produce any TH DNA!!!!!

SC reported DNA was extracted from toothbrush but no profile obtained. (from it D1, and B2 a blood stain; however later a profile did show up for B2). So who knows.
There are no reports of DNA tests done on panties or vibrator. We can only assume no report = no tests.
If they wanted to get a DNA standard from her they could have. 3 or 4 items could have been used to verify.

So they got a partial match to the bones from a partial profile of a Pap smear they obtained. They have no full match standard to TH it seems anywhere but what about all those other items they took? Why not develop a standard from even the cigarette butt it would have yielded a full profile. They could have compared that to the partial profile developed from the Pap. I get they wanted something legit from medical records to compare her to but when what they are comparing doesn’t yield a full profile why did they just keep using it and nothing else?

You got it! Partial profile in ‘reference’ sample (and we need to know how many loci such ‘partial’ holds!) could NOT be reliable for TH identification! This where is the problem. So far I see absolutely no reliable proof of TH identification. I have no idea which blood is in cargo, to whom it belongs? I only know this is female blood. And if DNA from Pap smear wasn’t properly retrieved by SC in 2005 then we have zero proof of TH identification. Item A1 (blood from cargo) could be belong to ANY female.
The same with bones partial identification! The same with MtDNA from Q1. These bones could belong to any person on KH maternity line (going many years backward in time).
IMO, as of today, I see no proof of TH reliable identification.

Bones would go to coroner to be evaluated. Since the coroner was banned, it went to state-hired consultant Eisenberg. She didn't get #7926 until Nov 15. Yet SC says she did her hacking on Nov 11. What SC identified with 7 loci, which the FBI could NOT replicate, means that what SC got and the FBI got are two different things. The FBI's mtDNA testing was on Nov 23.

When SC was questioned during the trial about when she received BZ, she replied: "Item BZ was taken into the lab on Nov 11, 2005" " Was taken into" - this is interesting language, distancing herself vs just answering the question: "I received BZ..." The FBI testing was NOT done on the same material that SC says she tested (item BZ), for which she didn't report results until Dec 5.

They represented BZ as being 7926. Why would they not take a photo before cutting it at crime lab - that makes me think even more that SC got her "tissue" or bone/tissue "on the sly" i.e. not through the normal chain of command/protocol - which would've been from Eisenberg. How would Fassbender know there was "tissue" on bones that Eisenberg hadn't received yet and that she didn't herself send to the crime lab? I think SC got that tissue "directly" from Fassbender (or Holmes)... and he knew where it was from.
DCI Holmes reportedly set off to take 7926 to the lab first. But why not take it into custody at CASO and record in the CASO ledger that it was with Holmes overnight and then hand it over to crime lab the next day?
It's suspicious that 7926 was driven toward the lab early evening on the 10th but wasn't taken into the lab until the 11th, with a missing chain of storage custody, and that Eisenberg was working late at the morgue next door that evening (pretrial testimony). Did Eisenberg handle them that evening?
The testimony where Eisenberg and Fallon seem to be talking as if they're still on 8318, rather than changed to 7926, was deliberately misleading (again, is it to cover for them being been 'dumped' into a tarp, not straight into that box, or to cover for something else). Did Culhane's CA (some DNA but not typable) become Q2, and why did the FBI never mention Q2 in anything disclosed).
DeleteI don't think there was much consistency in the terminology that was used for the "remains" evidence - bones, charred remains, charred bones... who knows... SC say she used tissue that was attached to bone, which could have been cartilage, tendon, maybe muscle? Supposedly this 'bone" was found outside of the Avery pit, at one of those red flags a reporter was standing on in a news cast. Although there is no photo of the 'bone' there.
The profile was not complete enough to make an official ID, however they used the press "leak" of the FBI results, knowing the public would not understand the difference between mtDNA, FBI/state lab, etc. and assume that Culhane's results were this "confirmation". Especially when Mike H is so thankful to the state lab for identifying his sister. When the trial comes... all they need to do is put Sherry's results on a PPT slide and, with some vague language, imply that body is ID'd. No mention of the FBI report at all. The results page says DNA was taken from item BZ. Kratz put together the PowerPoint!
Did Culhane lie about cutting anything from a bone? A piece of unidentifiable material with a partial DNA match is completely different then a partial match cut from a bone. The dna that was 'matched' or 'consistent with' didn't come from item BZ because BZ wasn't the tissue item: BZ was charred remains. Even more interesting is that the bone shown in the PowerPoint is also exhibit 385, which she received in January 2006 and eventually photographed and sent to the FBI in November 2006, not 2005. What DrE sent to the FBI in 2006 was tag 7964, not 7926! The FBI said the specimens sent in 2006 were to charred for DNA testing.

The FBI received the "remains" that they were able to get a mtDNA result from on Nov 23, 2005. Sherry got DNA results from her item BZ weeks later, on Dec 5th, although she testified that it was received in the lab on Nov 11th. Sherry says she took tissue that was near the bone (probably muscle), but the FBI... read question starting on line 25 first page. He asks if she sent it to crime lab. Eisenburg says no. This exact same "mistake" on questioning happens in Dassey trial. Maybe a bone was handed over to SC, maybe even sprinkled with DNA, but it was not exh 385. A bone found in the quarry, the only day (11/10/05) Mike Klaeser was on the premises, the day he mysteriously made a death certificate with proncounced time 16:10. NOTE: That bone had to be from CB's body, which was cremated on 11/8/05 by Mike Bushman's wife's family's funeral home.
DeleteIt's possible BZ could be 7926, but I don't see it. The date of 11/15 (three days after Christine Rudy was murdered) is when Eisenberg received it - it's what she wrote in her own 'bone log.' I don't think she'd have a reason to change it to a later date. If anything, she'd want to move it up so it looked like it came from the SA pit, and that she had it before SC. That's how she would fudge the records! This one was actually legit, I think.
Any bone should have to go to Eisenberg first. And this wasn't a situation where there was so much tissue you couldn't see the bone; in fact, the opposite - if you look at that photo of a supposed bone with tissue... it doesn't look any different than the other stuff. The "tissue" would be a very tiny layer, not like a chunk of meat. Eisenberg would need to look at the evidence unaltered... it should not go to SC first... not following protocol, that would be highly unorthodox.
As far as photos... In an ideal world, SC would have taken a photo of her 'evidence' before and after she cut it. But she didn't. I don't know... the whole scenario is so odd... If BZ is 7926, then why wouldn't they just be up front about it? It actually would be a good thing for them. Why wouldn't SC just say BZ came from the morgue? Why would Eisenberg fudge the date of receiving it to later? That makes no sense... she would do the opposite. I don't think they hatched the plan to make it look like it was the same bone until trial time because by trial they couldn't fudge the date to earlier for Eisenberg having received it (her lab notes had been turned over to the defense and, hense, couldn't be altered).

Not constantly...I did live a life along the way, but I never forgot it and ran through various scenarios because the one we, the public, were told just had too many holes and I caught MTSO in lies...directly to my face. Also, they put the fear of god in anyone who lived in WI to not ask questions or go digging around and it would have stayed that way had MaM never been released.
I would like to say that I am happy that so many Americans are now waking up and are concerned with the justice system and how it is being bastardized. It is very difficult to be an amateur sleuth because you cannot look at files, or pieces of evidence or interview people and so forth. So, my theories change with new developments or findings that point in a different direction.
I've had this theory before and I feel myself thinking it over more and more recently. I am not sure there ever was a murder. Also, think of the title of the documentary. I was living there when all this went down and the behavior of the police and the press was more than bizarre. Even the behavior of the locals was very odd...nobody wanted to talk about it. Nobody questioned if other women in the area felt unsafe. The police did not give any tips for women traveling alone, living alone, etc. It's hard to describe, but the whole atmosphere was strange. So little is known about TH. What was she doing in Australia, Mexico or was it Spain...anyway, it was never said. Did she go there for photography jobs? Where are samples of her work? Why would she be working for Auto Trader when they said she only made less than $10 per shot.
I think evidence was planted, but I doubt she died. I know the cops will fabricate a crime. They did it to me in WI with a dog crate. I had never known that having a dog crate was a criminal act. And the dog who was in the crate is alive and well, was given to a woman near Green Bay and I know who and have seen photos of my dog. She was a pup when they stole her, I bred her myself and took care of her from the moment she was born. She was not sick, not injured, not hungry or thirsty, nothing was wrong with her. I even had her to the vet the day before with blood tests, all was normal. She never even had a flea.
So yes, this is America and the cops are in place to do the "dirty work" of whoever is giving orders and if they want to take you down, they give the order and it is done...similar to a hitman. It's the mafia police. Your verdict is fixed like destiny before you even get to a courtroom.
I can't say that it how it is everywhere because I had never been a target before and am just an unknown person that nobody would have a reason to target...except in WI because of my big mouth asking questions and looking up records in the Avery/Dassey case.
Anyway, I looked on youtube and typed in TH and one of the first videos was this one and I can get on the same page as this guy. I know everybody here watched the doc. All I can say is I was right there a few miles down the road days after it happened, actually moving in the day they found that car and I had spoken with the MTSO on more than one occasion while living there and something was NOT right.
That place was so creepy, if I had had more money, I would have just left and never moved there. The lawyers and filmmakers already know the ending to the story is my guess.

DeleteI'm afraid I have had to move that remote possibility up into my top few too. It does sound crazy, but we simply have no real proof and too many questions. I could accept one or maybe two "lucky" breaks for LE but there are too many in total for me to swallow.
The idea of a drugs is the only other reason I can come up for taking the bones so far you lose the chance to ID someone. That, or they couldn't control that process any more than that, say by using a crematorium.
The idea of CB overdosing being tied to TH more than just the remains of a distant family member and CB being a "poor person" (RIP CB) that no one would ask much about had never crossed my suspicious mind before. It is a thought. Remember too, CB was the FIRST methadone OD there and we know who said they probably would never know how she got it. Sure...
I also believe that any county that has any major drugs moving (all of them, ha ?) You will always be told by those that know, that the sheriff's department is making money on it too. One way or another.
I also can't forget about Dave Begotka on one of his earlier videos on YT talking about hearing from locals that think she is alive and living in Calumet county. They were saying that she had a tooth replaced and minor plastic surgery. Sounded crazy then, still does...but I am not closing the door on this yet.
And didn't a few people here earlier this year and now figure out that 2:41 call may have been her dentist? Then nothing after that...very strange if true.
Dave has also pointed out in his videos that when something of importance happens there, you don't call the cops, you call one of "big people" first. One of the ones that kept the coroner out was one of the people he was shown in photos years ago. I believe Dave, I know others don't. That's fine.
If she's not alive and LE is involved in one way or another, I think someone started this in motion on Monday, since that was when AT was called. I always had my eye on S.T., since he would know from T.J. and hated/hates Steven. Didn't S.T. and Steven get into in the yard that week and A.A. had to break it up?
I'd like to know who cancelled the Schmidt/Sippel shoot on Saturday. TH or one of them? If it was them, not her, and Steven had filled out the AT form on Saturday, but then didn't call it in until Monday.....well it gets me thinking. That stop not being what is presented is one simple lie and a quick statement and testimony. Zipperer involves much more lying and very drunk people.
I just can't buy the idea of her still being alive or around with all this now though. My mind can't make me go for that. I'm so confused! :)

As comprehensive as it was, I think she missed something big - a request for re-testing of tissue sample BZ which was allegedly used to identify TH's body. There is a clear discrepancy in the collection of the tissue alleged to be the only tissue that survived the fire. Eisenberg said she shipped it directly to the FBI upon examination. Culhane testified at trial that she picked a section off that bone for her (questionable) DNA testing in which only 7 alleles "matched" --- which by the way was an improper test and should have been described as inconclusive.
This is critical because there was absolutely ZERO chain of custody of the alleged remains. We are still working on the assumption that everything involving the bones was above board and I think this was a huge opportunity to determine if in fact TH's remains were even on that property.
This would have been the appropriate time to request this testing. FBI supposedly still has the specimen (BZ).
It could potentially expose the biggest fraud of all in this case.

DeleteI wonder if this might be something better addressed in an eventual appeal, if one is proven necessary. Perhaps there has not been any advancement in the science of testing charred remains since the trial. If that is the case, KZ can't simply request a re-test, is my understanding - i.e. There's no legal argument she can make in this type of motion to justify re-testing a sample on the grounds she believes Culhane simply got it wrong. The legal burden she has to clear is proving there is new testing methods available. The questions around chain of custody of the bones and charred remains, cannot be raised in a motion to re-test evidence. Such an argument would have to be presented to the court via a different route......and in this case, the legal hurdle KZ will have to clear to raise that issue is pretty high, since the issues were raised to some degree in the trial. I agree with you re: the fraud around the bones....I have a feeling KZ does as well.....she could not raise the concern in this motion, imo, because of the restrictions around when you can and cannot request re-testing.

The justification for retesting is the fact that the specimen couldn't have been in two places at once.

I believe she is still alive. The death was staged... the family profited by going along with it, believing they were putting a "bad guy" away. There were NO bones found on that site. There were no bones planted on that site. They merely needed to take some photos of a box of random bones to convince a jury that bones were found. A fake, staged story. I think people miss the fact that nobody had to die. A body was not required. They didn't have a body. We don't know what they had. We only saw a picture of some random bones. I believe they had nothing. They staged TH's death to put SA away for good and paid her to disappear. That is the most logical scenario.
I fail to understand the CB connection. If they really had her body/bones/tissue to submit for testing, surely they would have been able to deliver something more than that pathetic looking shin bone presented at trial - purportedly tested simultaneously by Culhane and the FBI.

On November 3rd 2005, the day TH was reported missing, Gregory Allen was being transferred from Waupun Correctional Institution to Stanley Correctional Institution (the prison from which Steven Avery was released on September 11th 2003).
Why would you transfer Allen during that specific time period, on that specific day? Maybe you wouldn’t want Allen and Avery at the same prison. Maybe you already knew that Avery was going to be convicted and wanted to preemptively transfer Allen. Couldn't have known “all of that" preemptively on November 3rd 2005. By then, Avery was merely a suspect. Right? A week later, he was awaiting trial in jail, not
prison. Right!
In a 2005 interview with Dateline, Allen denied assaulting PB. "Allen confessed to investigators (Brown County) that he had committed a rape in Manitowoc, in which an innocent man was sitting in prison for." This would have to be a false statement, or completely fabricated, if Allen also had been framed for the PB rape. Allen takes the fall. Avery is paraded as a hero with a bill in his name, and PL will gift LE with no wrongdoings. We’ll give Avery enough so he won’t sue us since he was already going to prison for the 1984 SM case. And we will all live happily ever after!
But Avery is 18 years stubborner, justly unhappy, and wants those who have wronged him to face justice. As SG says in the 1st episode of Making a Murderer Part 1, "The one thing we didn't tell him is that you have to be careful when you bring a lawsuit against a Sheriff's Department ... because you could end up getting charged with murder."
Did the plan backfire when Avery sued the hell out of ‘em? Hell yeah, but Allen was already planted. They just may have wagged the dog too hard ;) Now they just had to wag the dog the other way… and convict Avery of murder so nobody would ever talk about the civil suit ever again. And for that, they planted Brendan.
I've re-watched GK's interview, and I do think that behind his smug face he was really trying to tell them something: don't trust the DNA; don't trust the newspapers.
If Allen was immediately setup to take the fall after SA's release this would finally make sense of AC filing his report that next day, regarding a call from several years earlier from a conveniently unnamed Brown County officer stating Allen confessed. Makes sense that his report was also omitted from the DOJ investigation. They didn't want anyone from the DOJ calling Brown County to track down the officer since the call never happened.
I also believe GA was transferred in Nov 2005 to keep him away from seeing the local media coverage because maybe he would contact a reporter to set the record straight. And the reason the DOJ will not allow KZ to retest the SUV blood is because both Steve's and Teresa's blood are bogus.

We know that SA was not at Kettle Morraine, especially at the time frame in question, 1996. We don’t know for certain whose blood they sent. I suspect they sent GA’s blood.

The trial transcripts show a concerted effort by KK to establish that they didn't realize TH was missing until 11/3. MH, KH and TP are all asked to confirm this narrative. Someone close to TH had to get her to buy in...TP with the help of now deceased Mr Kushe? It's possible TP was TH's handler as a CI. TP was only one to mention harassing.
ReplyDeleteI don't doubt she was a real photographer. Whether or not her business (or Pearce's business) were utilized for other purposes at some point is another question. Pearce himself had a background in the military.
Teresa was either brought in to save everyone in Manitowoc by the MTSO business roundtable or she was already a Fed working for the DEA undercover in Green Bay and Tom P was her cover story. The Fed strikes me more as a valid scenario because of the faux EDTA test. One agency could ask another to HELP if an agents safety depended on it, never needing to say a name.

We have been looking at an entire team of experts who worked together to shape the case in a manner that pointed to Avery as the murderer. And piece by piece, we have been able to debunk claim after claim. So I suspect the misrepresentations go well beyond Eisenberg, with regard to identification of Teresa's body at the burn site.
ReplyDeleteBecause of the proximity in time and the involvement of many of the same people, that the Rudy case was an opportunity to practice the very tactics that were then used against Steven Avery only months later. First Shawn Rudy was the boogie man, then Steven Avery was next, and finally, it was Steven Avery's nephew, Brendan. Brendan Dassey had a functional age of nine, no criminal record whatsoever, and he was a harmless virgin who didn't even comprehend what investigators were talking about.
The bones that were identified as human and female were the pelvis that was found in the quarry (not a location consistent with the crime scene as argued by the prosecution), and were deemed "suspected human" or "non-human" in SA's trial (which the prosecution contends proves it to be irrelevant and of no evidentiary value to the case). The tissue was not skull tissue. It was a fragment of tissue supposedly still attached to a completely charred bone that somehow survived a fire that turned the rest of the skeleton to ashes/shards; and there was conveniently only enough of it for a shoddy technician to test once (and contaminate in the process).

Wake up Wisconsin. Put the sabbatical on hold. Issue a ruling on KZ's motions. Then we can either have a new trial or let the appeal process continue. Nobody (except for the malicious framers) wants to see 2 innocent men in prison.
ReplyDeleteNo credible evidence exists to show Avery murdered TH. In fact, no credible evidence exists to show TH was murdered by anyone or that TH is even dead. This does not prove TH is alive, rather that a prerequisite of any murder conviction is proof beyond a reasonable doubt that the alleged victim is deceased. The state never came anywhere close to providing this. Any other evidence is moot lacking evidence to show a crime was committed.
Quite simply, if they grant a re-trial Zellner will rip the case to shreds and they know that . So all they can basically do right now is stall as long as possible !
The focus should have been more on disputing the evidence with out implicating LE as much as they did. Presenting the evidence as supporters and KZ are doing now would be more effective in convincing a jury to see the obvious themselves without being told it was a setup. The amount of time the defense spent on disputing a lot of the evidence to me was minimal, and they seemed to have missed so much that has been very obvious after the trial. It was the Defense Team that created the doubt that we all look at further, many years later, that has led to the situation as it is today. It just would have worked better for SA if they had done what everyone is doing now because, regardless, Reasonable Doubt has been established.
The prosecution didn’t play fair. There’s a couple instances of Brady violation which might be the undoing of the prosecution in federal court. Brady violations are severe enough to get your whole case overturned. Then you have the Denny standard and the judge that blocked them at crucial intervals. Just because you have evidence, doesn’t mean you are allowed to present it.
There's literally not one thing was was both found in a timely fashion AND documented properly. These buffons had every reason to conduct this investigation as close to perfectly as possible and they did the exact opposite.
Wag The Dog. Make a case with fabrication, then destroy the false evidence to bury the conspiracy. Build a false case. Bury all the evidence to hide the conspiracy. SA should walk, but clearing his name will be tough. Avery getting out on a technicality will give the sheriffs & state a way out of their corruption while hiding the truth.

So the FBI gets involved in missing persons cases for ID and lab work, but nothing more. So then why was the FBI questioning Wilmer Siebert about sightings of Teresa, and why were their suburbans parked on Kuss Road, in early November 2005?
The Federal government is not allowed to police normal crimes. They can only step in if a crime occurs on federal property, affects federal employees, or has some impact across multiple states. The states, then, have generally followed the same model, letting their sub governments police themselves. Though state agencies are generally available to help out for big cases.

My mind races about possible explanations and theories but there seems to be one limiting factor;
TH's cellphone went offline shortly after leaving SA.
I believe this fact limits the possibilities greatly;
*TH was killed by someone shortly after leaving ASY. Halbach, Ryan Hillegas and Scott Bloedorn were manipulated, knew TH was dead, helped LE get SA. Never asking any hard questions. 'We love the police'.
*TH had a deadly accident. Her car wreck was seized on 11/03. Body burnt in smelter. Possibly another RAV4 was planted. Halbachs, RH and SB were manipulated or paid off and helped LE get SA.
*TH died (OD?) the weekend before and RH, SB, MH were facing charges and therefore were forced to help LE use TH's death to frame SA. A TH stand-in (Carmen Boutwell?) went to ASY on 10/31.
*TH was part of the frame job. She shut her phone down.The plan was put in motion. Her predecessor was a DOJ special agent.

If TH was murdered on October 31st, what possible reason would anyone have for accessing her voice mails until Nov. 2 at 8 AM and erasing them? How would messages sent to Teresa possibly implicate the killer?
The only logical explanation is that Teresa, who had left town, was getting updates as to how the whole ploy was going down. And of course, she would erase them.
If I was the key player in the plot to implicate the "evil" Steven Avery and send him back to prison where he belongs, I would certainly want to know how things were progressing.

I have a feeling Kratz also thought someone had accessed her voicemail on the 2nd, but was going to do everything possible to make sure that didn't surface.
Unless the telecom company had some technical information to show one way or another if her voicemail had been accessed, I don't think it's possible from the records we have seen to know either way really.

While determining who it was that accessed the voicemail and deleted entries is interesting and would point to another person being suspect (which is what JB was alluding to and quite eloquently so), it's actually secondary to the point.
The point is that the voicemail was accessed on Nov. 2nd. The state claims TH was dead by then. If she was dead, who accessed them? If she was alive, the state's theory is wrong and she wasn't dead on the 31st. Unless SA had her password, it wasn't him which means it's automatically someone else.
Judge Willis "failed to see the relevance of it at [that] point in the trial" and Kratz kept trying to say that it was third party liability which the defense wasn't allowed to demonstrate directly. I thought it was a pretty good way, without pointing the finger directly at someone specific, that it was very likely that someone else was involved.

If anyone wants to read the entire discussion it is on Day 11 under the cross examination of Laurie Shadrie. Of course, since her phone was allegedly destroyed in the burn barrel, her voice mails were accessed via a land line requiring the password. It seems to me that the only person who would have accessed TH's voice mails on November 2nd via that process was TH.

The guilters always say that "So many things would have had to happen for him to have been framed" -- but that's not actually true. I believe the corruption in this case is very high level, so most of the cops wouldn't have had to know what was going on.
The biggest red flag (and I've been saying this from the start) is that there is NO PROOF there were any remains found on the property. No remains -- no solid ID it was TH = no evidence TH died there.
All of the witness statements evolved to fit the police theory -- to include the bonfire (which I believe did not even occur that night based on first interviews)
What else is there? Her key? That lone key --it is ridiculous to believe TH would have used a single key! Where's her purse? Where's her key ring?!
The blood in the RAV -- I will always be suspicious that Sherry Culhane processed the vehicle, swabbed it for blood. Typically the investigators do that, not the crime lab workers. I have never before heard of that. And remember that Fassbender was comfortable enough with her to tell her to "place the victim in the trailer." Lots of corrupt people, that is clear.
Finally, there will always be people who 100% trust LE and prosecutors and can't fathom that they could be crooked. After reviewing several cases I know what they're capable of.

There is no evidence either that Teresa or the RAV4 were ever in the garage.
If Avery did murder her, it would have had to have taken place in the driveway and he would have used the RAV4 to quickly move both off his property.
But then other things don't make sense.
Why lock and disable the RAV4 in the salvage yard?
Why hold on to the key after disabling the vehicle?
Why hide her purse, keys and garage door opener, but throw her camera, camera and PDA into his own burn barrel? And along the same vein, why burn her body, clothes, rags, sheets in the burn pit but the electronics in the burn barrel?
I cannot believe a body was cremated to "the most destructive category level 5" [Eisenberg] with just a few tires and a van seat. And worse than a house fire, vehicle fire or aviation fuel [Dr. Simley].
The copper jacketed bullet found under the compressor has what appears to be years of tarnish on it, and the exposed lead on the bullet which is impacted in the crack has years of white oxide corrosion on it. If the photographs are an accurate depiction of the two bullets then there is no way they were fired four months earlier.
But the worst example of planted evidence is Brendan's coerced false confession which just throws the entire investigation into question.
Easy explanation of how it could have happened, but not for the evidence found afterwards. The prosecution's case makes no sense.

It's strange that no DNA of Teresa's as far I know has been found anywhere. The blood found in the RAV and and the pap smear results is all there is I think.
The police are planting bones ,blood,DNA ,a car,but why haven't they planted some of Teresa's DNA ,it wouldn't have been hard to gather some of her hair from her house or car,or take something like some dirty underwear or socks and put some DNA on some items at Steven's trailer/garage.
I've suggested that if police had found or killed Teresa then not planting any DNA would be a good way of not being accused. But after thinking about this I think that if they killed Teresa they would have planted her DNA all over the place. And the same if they had found her in a condition that they could have planted her blood or DNA they sure as well would have.
So this got me thinking about why they didn't plant her DNA that they could defiantly get there hands on ,like hair ,or DNA from items in her house that she touched a lot ,or some dirty laundry.
I'm not sure but I don't think they matched Teresa's DNA found in the RAV to any of the things they could have used from her house,like a pair of shoes she wore a lot . The only DNA the blood found in the RAV was matched with is probably the can that was found in the RAV.
Could it be that the blood and the DNA on the can from the RAV are not Teresa's. That could be why they never planted any of Teresa's DNA ,because it wouldn't match the DNA in the Rav. This would explain why the people who are planting anything they can can't plant so much as a hair of the victim.
They said they used a pap smear to confirm Teresa's DNA but what if the pap smear was not hers .what if they used Karen's pap smear and planted her blood and it's her DNA on the the can to. They could have confirmed Teresa's DNA from her vibrator and a pair of her shoes ,then compared them to her mother.
The bullet that was found in the garage could also have had some of Karen's DNA on it. The sample was destroyed and there is no way to retest .the only way to check the blood in the RAV is Teresa's is by the pap test, but is there one ,and who does it belong to.
I would imagine a vibrator would be a rich source of DNA ,so why did the framers not extract some and plant it all over the bullet .they could also have wiped a bit on Steven's bed or something.
The DNA on the bullet was not blood or skin cells ,so there is a good chance it was saliva and was taken from a swab ,for some reason they aren't planting Teresa's DNA so why would they put some on the bullet.

DeleteThey did a very good job of taking (obtaining) every single item that may have had Teresa’s dna on it. And of these items they tested NONE of it, they just collected it. Even the cigarette buts from the studio those were taken, never tested tho. I will say that NONE of the victim in this case remains. There is literally nothing left.
If you were really going to fake a crime and fake a death, you would never ever use the actual dna of the victim and you would make certain that no items remained that could have DNA of the proposed victim.
CASO gave TH's personal items to Karen Halbach on 5/21/2007 (eyeglasses, hair and hairbrush, toothbrush, lip moisturizer, chapstick, vibrator, laptop and journal) so that they can't be tested to compare DNA.
Teresa's DNA was never tested by any of Steven's lawyer's and probably never will be. Culhane couldn't get a full profile from the pap smear. She was like a couple of alles short. So allegedly she compared to the Pepsi can and obtained the missing alles from there to combine with the rest of the partial profile from the pap smear.
They could have built up her profile and confirmed it but don't seem to have taken a sample from a guaranteed source from her house. They have matched the DNA from the car to a pap smear and I think her mum. Why when they had her vibe did they need to use a partial result from a smear test?
Shoes would have been a good source ,and if they used a few different items could easily have built up and verified her profile. They could have got Teresa's DNA from Lot's of different sources to plant ,they had months to get some of her DNA to put on the bullet but there was hardly any on it.
What happened to the shoes that Pagel gave to the scent dog handler? They were not taken into custody.
They could have got her DNA from lots of things but didn't, in sole's, hair, vibe, her bedroom would have been covered, the door handle. Steven is supposed to have touched the latch once and look at the amount he left lol. Nothing Teresa came into contact with was tested to compare DNA from the RAV.
Her DNA should have been all over the RAV but they never found so much as a single hair of hers in the RAV. Or any where else, even her house.

I mostly think she is likely dead, but I DO wonder, I will admit that. Sometimes I feel certain she is dead and other times I’m not so certain at all. Kind of a strange thing for me to say considering I have been day in and out with this case for 3 years straight now.
All that said, as far as DNA I only this: IF she is possibly alive then I think that none of the DNA used in this case would be hers. It would be far too big of a chance to use her DNA when it could show up somewhere else later in life and ruin their evil conviction.
I DO believe that If this WAS planned then leaving her alive would be a HUGE liability.
While I think that alive would be a liability, I DO believe that the further up the chain this conspiracy goes the more and more likely they let the girl next door poster child LIVE and the disposable druggie girl from the broken home NOT live.

Maybe because Manitowoc County Sheriff's Department, supposedly uninvolved, was very involved. SA was practically the poster child for false convictions. I'm sure Kratz and the state thought that might have an impact.
The inconsistencies in what he did, if guilty, are blatant or the whole theory is wrong. He cleaned his house and garage so no trace of TH was present, no blood, no DNA. But left the key in his bedroom and the RAV, with his blood in it! -- on his family's property? It's possible he may have thought they'd never search a burn barrel or a burn pit, but he did spend 18 years in prison; you'd think he'd have heard all the LE stories. Also, they didn't find a bullet until they "needed" a bullet, even though, according to Remiker, they searched the garage "thoroughly".
Also, since they asked so many about a fire on Oct 31, wouldn't you think one of the first sites they'd search after getting a warrant on 11/5 would be the site of the fire? And yet they don't search it until 11/8 and then only because a Manitowoc officer, while feeding the dog Bear, "feels" the area should be searched for some "type of evidence." He tells a Calumet officer, Sippel, and together they reportedly find a bone -- which was not isolated, photographed, collected, tagged and examined. Then state agent Sturdivant wanders over, moves the bone with a stick, and sees what he says are more bones, and then skull pieces. Skull pieces?! Lying on top of the crusted burn pit? Really? Was he qualified to identify skull pieces? Or even bones? Maybe, maybe not, but it prompts the digging up of the burn pit, the ash sifted through a screen, leaving fingernail sized burned bones which are put into a box. No idea how those bones lay in that burn pit before digging because it was not gridded and excavated according to protocol. Just dug up.
Two days later Pevytoe, a certified arson investigator, finds what he thinks at first are bones, too, lying in the area above the burn pit and entwined in tire wire. He's honest enough to say that what he saw on the ground was insulation from jumper cables, dragged around by the dog's chain. He collected the tire wire but it was not brought to court and there were no photos and no testimony that what he saw in it was, in fact, bone.
I think what Jost and/or Sippel and/or Sturdivant saw was what Pevytoe saw: insulation. Which is probably why there are no photographs and these first "bones" were never collected.
As a reason for not examining the area earlier, Bear the dog is no excuse. Have the dog removed to a kennel; it was a simple matter, yet not done. Why?
The burn pit is just one example of why this investigation is considered flawed and questionable.

Theory - TH family found out their daughter was targeted by the “club” . Their offensive counter, was to create missing person, etc. and initiate a new identity.....timing was perfect. The “club” used this tactic to frame avery, hence, the 2 door RAV4 planted in the salvage yard....few missteps, change the narrative to 4 door....pussbender confiscates TH’s underwear and stuff to have DNA on hand...The H family is under duress and figures they have to play the game or else! They never presented pics of TH’s RAV4 to verify color, the boy did his best at acting to play along. The pressure was either the daughter or family member take the hit or play along and let avery take the hit. And avery was the prize! Rid any more suspicion of police corruption. Stop the 36 million dollar lawsuit, perhaps the1980’s picnic pics from becoming public And. This fits why no blood of TH found nor planted, she was already gone! As far her car? Ditch it, shoot bullets at it, make it look like something really bad happened and that she must be dead, hopefully be convincing to end the “club” hunt. Also very possible there is a link to all this from the 1985 penny Bernstein case where she was attacked on the lake beach. An eyewitness states that several people were in the woods watching along. Was she a planned target? Maybe simply didn’t give a cop a free breakfast? Who knows, but somebody does!

Bembenek suffered a seemingly endless campaign of abuse and harassment during her police training, she writes. Infractions for which white men got a pass, black and female recruits were punished severely. “Sexist, vulgar remarks” were standard.
ReplyDeleteGraduating from the 21-week police academy training in the summer of 1980, Bembenek was assigned to the South Side Second District – riddled, she wrote, with “brutal, lazy, apathetic and corrupt” cops. But in a month, she was fired.
While still in training, Bembenek had been investigated on an anonymous charge that she was seen smoking marijuana at a party. She denied the allegation. In her book, Bembenek blamed the charge on the wife of a police officer who had accosted her at a party with complaints about how she was dressed and insinuated she might be trying to lead her husband on.
The charge against Bembenek was never substantiated. Later, however, a fellow officer and friend, Judy Zess, was arrested at a concert for smoking marijuana and was fired. Zess accused Bembenek of doing so as well – a charge she denied – and Bembenek lost her job, too. As in grade school, Bembenek decided to fight the injustice.
Some pictures of a party sponsored by The Tracks Tavern on Locust Street fell into Bembenek’s hands: They showed police officers, both men and women, dancing naked and seminaked in public. Bembenek brought the pictures to the Milwaukee office of the Equal Employment Opportunity Commission. She argued that while her alleged infraction was minor and not even proven, the pictures showed much more serious and documentable violations of department rules that went unpunished. EEOC investigators told her she had a likely discrimination case. At the federal agency’s behest, she turned copies of the pictures over to the police department’s internal affairs division.
But she also spiraled into a depression: jobless except for a baby-sitting job, unable to find work at other area police departments or even as a security guard. “My life seemed to be falling apart,” she wrote. “I tried to pick up the pieces, to stabilize, but I couldn’t.”
DeleteEnter Elfred Schultz. Schultz, a Milwaukee Police detective, knew the woman for whom Bembenek was baby-sitting. He was also one of the people in The Tracks pictures – preening naked before drunken partygoers.
Schultz, who had just divorced from his wife, Christine, in November 1980, took Bembenek to the Municipal Court Christmas party that year. “I was drawn in by his overwhelming personality,” Bembenek wrote. “He was manipulative and consuming, but he was also the life of any party he went to. … He allowed me to forget my depression, for a while.”
Bembenek and Schultz went to Stevens Point and visited with her friend JoAnne, who was finishing college and living with her boyfriend and future husband, Doug Evica.
“I thought Laurie was an attention-getter,” JoAnne Evica says, “but Fred was over the top. He was the spotlight when he walked in the room.”
One word sums him up for her: “Loud. The way he acted, the way he dressed, the way he fixed his hair. Everything.” He was quite “a jokester,” she adds.
Within minutes, JoAnne pulled Laurie into the bathroom. “Where the hell did you get this squirrel?” she asked. She didn’t approve of Schultz.
She knew this upset Bembenek, so she sought to temper that, saying something along the lines of, “Whatever makes you happy. I’m not here to judge.”
Barely two months after they began dating, Schultz and Bembenek married on Jan. 30, 1981. The marriage was a quick civil ceremony over the state line in Waukegan, Ill. – more than three months earlier than would have been permitted under Wisconsin law, which requires a divorced person to wait six months before remarrying.
But the marriage quickly soured. Bembenek was working part time as a health club trainer, and she and Schultz shared an apartment with Judy Zess – the woman whose testimony about drug use had gotten Bembenek fired. When Zess, who had helped offset the rent costs, moved out, money got tight. Schultz was also paying the monthly mortgage of $383 for the house in which ex-wife Christine still lived, along with $365 a month in child support.
On May 28, 1981, shortly after 2 a.m., an intruder at Christine Schultz’s house on West Ramsey Avenue bound her, gagged her, shot her once in the back, then fled. Not quite a month later, on June 24, Bembenek was charged with killing her.
DeleteDespite Bembenek’s steadfast claims of innocence, she was convicted on March 9, 1982, after jurors deliberated for four days. The Milwaukee County district attorney’s office alleged she’d killed Christine in order to end the financial strain that paying for her home mortgage and child support had placed on Bembenek and Fred Schultz. Testimony at the trial linked the murder to Fred Schultz’s off-duty gun, to which Bembenek would have had access the night of the killing. (Fred Schultz had an alibi: He was on duty that night and had a partner who vouched for him.)
At her sentencing, Judge Michael Skierawski noted the evidence was almost entirely circumstantial. For him, however, the ballistics evidence clinched the verdict.
Since then, virtually all that evidence has been called into question or even contradicted. But in 1982, the verdict against Bembenek was simple: Guilty.
Sentenced to life at the Taycheedah women’s prison, Bembenek helped start an inmate newspaper and earned a bachelor’s degree. She also divorced Fred Schultz. But appeals of her murder conviction were repeatedly denied. Bembenek decided she had nothing to lose. So on July 15, 1990, eight years, four months and five days into her life sentence, she escaped, sneaking out a laundry room window and clambering over a fence topped with barbed wire.
She was aided by Dominic Gugliatto, a Milwaukee factory worker whose sister was an inmate at the prison. He had fallen in love with Bembenek. The two fled to Thunder Bay, Ontario, where they hid out for three months. The media helped galvanize huge public sympathy for her, but also aided in her capture: Someone in Thunder Bay called police after recognizing her face on the TV show “America’s Most Wanted.”
Bembenek and her Canadian attorneys argued to a Canadian immigration judge that corrupt police in Milwaukee had framed her for murder. The judge released her on bail pending the resolution of her immigration petition, but a day later, she was sent back to jail there as formal extradition proceedings began. After 21 months, she was returned to prison at Taycheedah in April 1992 and placed in solitary confinement – where her autobiography ends.
In August, after a secret John Doe investigation, Milwaukee County Circuit Judge William Haese issued a report denying Bembenek’s claim of a conspiracy to frame her. Notwithstanding that setback, her new attorney, Sheldon Zenner of Chicago, petitioned for a new trial for Bembenek on the grounds of holes in the case exposed by the John Doe investigation.
The Milwaukee County DA’s office made an offer: In return for a no-contest plea to a lesser charge of second-degree murder, Bembenek would be released on parole. Bembenek, who had spent seven months in solitary after her return to Taycheedah, took the deal.
When Bembenek accepted the no-contest plea, notes her current lawyer, Mary Woehrer, she and her legal counsel believed there was still a ballistics test that tied the murder bullet to Elfred Schultz’s off-duty gun – the one she had access to. Overcoming that evidence seemed an insurmountable challenge.

She took the photos to the EEOC and became MPD enemy #1. A federal investigation was initiated against the chief of police for discrimination and misuse of affirmative action funds. As part of the investigation the photographer who shot the pics was interviewed; this was in February of 1981.

Christine Schultz had been killed by a single .38 caliber pistol shot fired point-blank into her back and through her heart. Aging changes in body shape
ReplyDeleteYour body shape changes naturally as you age. You cannot avoid some of these changes, but your lifestyle choices may slow or speed the process.
The human body is made up of fat, lean tissue (muscles and organs), bones, and water. After age 30, people tend to lose lean tissue. Your muscles, liver, kidney, and other organs may lose some of their cells. This process of muscle loss is called atrophy. Bones may lose some of their minerals and become less dense (a condition called osteopenia in the early stages and osteoporosis in the later stages). Tissue loss reduces the amount of water in your body.
The amount of body fat goes up steadily after age 30. Older people may have almost one third more fat compared to when they were younger. Fat tissue builds up toward the center of the body, including around the internal organs. However, the layer of fat under the skin gets smaller.
The tendency to become shorter occurs among all races and both sexes. Height loss is related to aging changes in the bones, muscles, and joints. People typically lose almost one-half inch (about 1 centimeter) every 10 years after age 40. Height loss is even more rapid after age 70. You may lose a total of 1 to 3 inches (2.5 to 7.5 centimeters) in height as you age. You can help prevent height loss by following a healthy diet, staying physically active, and preventing and treating bone loss.
Less leg muscles and stiffer joints can make moving around harder. Excess body fat and changes in body shape can affect your balance. These body changes can make falls more likely.
Changes in total body weight vary for men and woman. Men often gain weight until about age 55, and then begin to lose weight later in life. This may be related to a drop in the male sex hormone testosterone. Women usually gain weight until age 65, and then begin to lose weight. Weight loss later in life occurs partly because fat replaces lean muscle tissue, and fat weighs less than muscle. Diet and exercise habits can play a large role in a person's weight changes over their lifetime.
Your lifestyle choices affect how quickly the aging process takes place. Some things you can do to reduce age-related body changes are:
Get regular exercise.
Eat a healthy diet that includes fruits and vegetables, whole grains, and the right amounts of healthy fats.
Limit your alcohol use.
Avoid tobacco products and illicit drugs.

If an independent inspection ruled the RAV in evidence was not Teresa'a than it would guarantee an evidentiary hearing, it would actually go further and guarantee a retrial given how all other evidence followed the RAV being found at ASY. Given Adnan Syed's recent ruling, not even the WI courts could escape the media attention of a faked crime scene (the RAV).
So ask yourself, given KZ has to raise evidence with the courts as soon as is possible, given she has had the case since 2016 and has not yet achieved an evidentiary hearing (despite compelling evidence she should have one) and given it would be the quickest route to a retrial; why has Kathleen Zellner never raised the issue of 2 RAV's in any court filing?

The reason this master frame job from State agents seems so sloppy even though it was planned in extreme detail for 18 months prior to Stevens Arrest is because of Recorded phone calls.
The scumbags that set this thing up could not control what was out of their control. Steven Avery was supposed to be framed at Zander RD. They probably had a beautiful crime scene set up with lots of DNA evidence and other bs, however Steven kept talking to his gf Jodi while she was in the county jail. Phone call after phone call all recorded.
This is why this case seems like such a cluster. The State agents had to spend 3 to 5 days coming up with a brand new plan on how to spin this new story hence "restage kuss rd".
The random Zander rd sign in Steves trailer with TH's phone number on it was totally planted. There has never been an explanation for it and its not Stevens hand writing. They goofed on that one! I'm sure KZ knows this, this is one of her Aces up the Sleeves she is holding.
The blazer being set on fire a year prior on Zander rd. that they tried really hard to pin on Steven was a total set up. They kept this fantasy of Steven being a pyro alive. Steve is no pyro, he feared fire, its why he had BD using a stick to move stuff around in the fire.
The interview of the farmer that claimed he heard a big WHOOSH and smelled burning and it scared his cows. Who knows what happened but sounds like Steven couldn't have been where they were planning on saying he was.
After months and months of planning the perfect frame job they frantically had to come up with an absolutely outrageous version of events that anyone with an IQ higher than 70 would call bs.

The state couldn't afford a battle with Steve after the PB case settlement of + or minus $36 million. Attorneys would be standing in line for his civil suit cases. They had all the proof they needed for the win.

I'm of the belief that this was in the works probably as soon as those DNA results came back and they knew Avery was gonna be released...certainly once he filed the lawsuit at the latest.
There's no doubt they were monitoring him and were listening in on his phone calls, and once they had the opportunity, they took it.
Another reason why I can't put the Theresa was part of it theory to rest...it would make perfect sense if they set it all up, and we do know the previous autotrader girl was an agent. We also know that a large insurance policy for Theresa was paid for and then collected on...an unusually large one at that.
Still pieces to the puzzle missing, but some of us can see what was going on...

the previous AT woman was an agent and Avery was still balls deep in a court battle against the state... Its not like the State would just leave him alone all of a sudden. To me it makes since that TH was also an agent, she was the chosen one for this mission. Most can't wrap their head around this being a possibility but it makes a hell of a lot more sense than Avery wanting to go back to prison when hes been fighting this whole time to prove his innocence.

The fact that SA was linked irrefutably to ASY and it took three days of searching before any evidence was discovered there is suspicious to say the least.
What I am beginning to believe is that KZs first priority is getting SA released from prison. I think the criminal and civil cases are going to be two totally different things. We may not know what honestly occurred to TH and at Zander Road and Kuss road until after he is freed and she is deposing all the players involved.
JMO but I think that some things have to be kept out of the criminal part simply because of how outrageous they are,. It doesn't help the effort in getting SA released. It causes reactions from people who can't comprehend how corrupt some of these individuals are. These people were, in the moment this went down, feeling a lot of pressure and were desperate.

Exactly - KZ's first (and currently ONLY) priority is to get SA a new trial or exonerated. Everything else will come later. That's how she works. She HAS spun a web that Kratz has been thrashing around in for years, but she's going to let him rot there awhile.

No matter the truth of what really occurred with TH-,if it hurts SAs chances of being released perhaps it's best for me to know but not say. The Zander Road for sale sign is one of those things. She really hasn't discussed it IIRC and I know she has to be at least curious about it. B and S even mention it -as does the legal stain. Something either did or was going to be made to appear to have happened there involving TH and SA. I think that's part of KKs luring narrative. It doesn't help SA yet but I think when the civil suit depos start a lot of questions we have will be answered. JMO

No, Zander Road is where MTSO tried to frame SA for a stolen car fire in 2004. They visited a farmer there on 10/31 so to get him to say he smelled a fire with a burning body nearby, but then CASO edited the report and changed the date and details after the RAV was planted on ASY.

Let's all be Honest How would you feel if your Murdered Child Bones are Questionable when the state Returns them to you. What Would you do? I realize everyone Grieves differently. God forbid if I had a Murdered Child Bones in Question I would do anything I can to confirm this is my Flesh and Blood.I would need peace and comfort. The Halbachs claimed they are Faithful Catholics and attend Church. How in the Hell can this mother go about her routine Daily Business and not screaming about bones given to them may be chicken bones or even somebody else's. I as a Mother be pounding on doors. The state would not get rid of me. Do you find Halbachs' behavior odd?

None of the "evidence" either could be independently examined, or has had the opportunity to be examined.
The "evidence" i found most suspect, is the blood, bones, and vehicle. And of course the testimony of all prosecution witnesses.
The defence narrative is negligible.
Guilders keep saying " why hasn't the defence raised the possibility that TH is alive? " Obviously there is no benefit to them to do this, as they can't disprove the blood/bone evidence as the state was the only one able to test it, and there only ever was enough surviving DNA for 1 test. My understanding is, the test conducted could have shown it belonged to anything, as the DNA had been replicated so many times.
If she were dead by any other means, then LE and family colluded to frame SA. Why not use more of her remains as evidence, also the timing then becomes coincidental.
I find that highly unlikely, and still doesn't explain the family's reaction given her death still happened in the same time frame. And how does RH become so involved with family, LE and the investigation? Particularly when up until the car is found, logic would suggest he and the room-mate would be considered suspects.
I suspect RH became involved for this incident to manage the family and TH both prior, during and post 'crime".
