Ryan Hillegas is the Prime Suspect in the Murder of Teresa Halbach, According to Steven Avery's Post-conviction Counsel



Teresa Halbach and Ryan Hillegas: the two dated  "for five years or so," stretching through the end of high school and part of college (Teresa and Ryan were both born in March 1980; however, Teresa graduated in May 2002 from the University of Wisconsin-Green Bay, and Ryan graduated three years later, in 2005, from the University of Wisconsin-Oshkosh).


In HDTV it looks like Ryan has a black and blue bruise just below his hat, between his left eye and ear (click on image for video); it could be a bite mark.

Ryan Hillegas' Cross Examination (Excerpt):
Q. Okay. Now, did the investigators ask you any questions about the nature of your relationship with Teresa?

A. Yeah.

Q. And they learned that you were a former boyfriend, stayed good friends with her?

A. Well, I believe I just said that I was a friend of hers. I don’t think I mentioned that I was an ex-boyfriend.

Q. Okay. And they didn’t pursue that and ask if you had ever had anything more than a friendship, is that what you are saying?

A. I believe so. It came out eventually, I just didn’t feel that it mattered.

(Court reporter coughing, asked him to repeat.)

Q. Let me try again.

A. Ask it again, please.

Q. Did the police ever probe further and ask if you had — the nature of your relationship with her beyond whether there was ever anything more than friendship?

A. I don’t think they really probed into that. I mean, I don’t remember when it came out or who was the one that mentioned that we used to date.

Q. Okay. But it wasn’t talked about that night?

A. I don’t believe so.

Q. When they were trying to find out what was happening — or what had happened to this missing person, right?

A. Yeah.


November 9, 2005, Greenbay Press Gazette:

"Hillegas..... works closely with Police. He meets with them daily. They tell him the areas to search, what would be helpful and what would be 'getting in the way.' And he stays in touch with them by cell phone."

August 6, 2006, The Post Crescent:

"Calumet County Sgt. Mark Weigert and Ryan Hillegas, a friend of Halbach's who coordinated the volunteer searchers, testified that police did not direct the search or give any instructions to searchers."





In a rare interview with TheLipTV (video below) in February 2016 (other than social media, Zellner has been tight-lipped with press), she explained what compelled her to take the case, saying that she “intends to prove” who killed Teresa Halbach, and that it’s “fairly obvious” who did it if you review the evidence in the criminal case. “It’s the evidence,” she asserted to TheLipTV. “In having had a number of these cases, it has the signature of a wrongful conviction case. They only focused on Steven Avery. They did not look at a lot of other suspects, certainly some very key people they should have been looking at. There was a very poor investigation done of the victim’s background, who she was involved with, the circumstances of her life. It had all of the hallmarks of a wrongful conviction case.”



Steven Avery's attorney, Kathleen Zellner, wrote in her motion for post-conviction relief that the correct explanation of the blood spatter on the rear cargo door of Teresa Halbach's RAV-4 would have provided a completely different scenario of the attack upon her than the one presented by Ken Kratz.

Zellner's expert, Stuart H. James, says that the blood spatter on the inside of the rear cargo door was the result of Teresa being struck with an object consistent with a hammer or mallet while she was lying on her back on the ground behind the vehicle after the rear cargo door was opened.

The following is from Zellner's June 7th motion for post-conviction relief (not in the exact order as it appears in the petition).

A blood spatter expert has refuted the testimony of the State's expert, Nick Stahlke, that the blood spatter on the rear cargo door was created when Ms. Halbach was thrown into the rear cargo area of the RAV-4.

Stuart H. James, a forensic scientist and bloodstain pattern analyst with James and Associates Forensic Consultants, Inc. in Fort Lauderdale, Florida, opines that Mr. Stahlke mistakenly described the blood on the rear cargo door as having been projected from Ms. Halbach's bloodied hair after she had been shot and as she was thrown into the cargo area of the vehicle.

Mr. James, by overseeing a series of experiments, opines that the State's description of the cause of the blood spatter on the rear cargo door, resulting from Ms. Halbach being thrown into the cargo area and blood being projected from her bloodied hair on the cargo door, is demonstrably false. The erroneous blood spatter testimony of the State's expert Mr. Stahlke resulted in the State presenting a false narrative to the jury about the sequence of events surrounding the attack on Ms. Halbach. The State presented a scenario where Ms. Halbach was already fatally injured in Mr. Avery's garage prior to being thrown in the back of the RAV-4.

Mr. James will demonstrate that Ms. Halbach was behind her car and the cargo door was open when she was attacked. The experiments overseen by Mr. James demonstrate that Ms. Halbach was struck on the head after she opened the rear cargo door. She fell to the ground next to the rear bumper on the driver's side where she was struck repeatedly by an object similar to a mallet or hammer.

Ryan Hillegas has no alibi for October 31, 2005, the date Ms. Halbach was murdered, or the subsequent days when her body was burned and bones planted. Mr. Hillegas was never asked by law enforcement to provide an alibi for October 31, 2005. Trial defense counsel failed to conduct any substantive investigation of Mr. Hillegas, choosing to name him as a potential suspect at one point but failing to meet the requirements of Denny.

Mr. Hillegas' cell phone records show significant gaps during time periods in question. On October 31, 2005, there was a six hour gap -- a time frame in which there were neither incoming nor outgoing calls -- from 9:41 a. m. to 3:48 p.m. It is most likely that, during this time frame, Ms. Halbach departed the Avery property, departed the Zipperer property, and was killed after she arrived home at approximately 3:40-3:50 p.m. Ms. Halbach's day planner indicated that she wanted to "get Sarah's stuff from mom" at about 3 p.m. and "do biz paperwork" at approximately 4:30 p.m. Also on October 31, there was an over two-hour gap in Mr. Hillegas' phone records from 3:50 p.m. to 6:01 p.m. 

Mr. Hillegas' phone records have an over 17-hour gap from 7:47 p.m. on October 31, 2005, to 1:31 p.m. on November 1, 2005, during the time where Ms. Halbach's body was transported and burned. Subsequently, Mr. Hillegas had more suspicious gaps in calls. There was a six-hour gap in phone activity on November 2, 2005, from 10:06 a.m. to 4:12 p.m., and a gap on November 3, 2005, from 7:31 p.m. to 8:10 p.m, the time when Mr. Avery reported seeing headlights taillights on his property. His last call on November 3, 2005, was at 10:44 p.m.; Mr. Hillegas did not make another call until 7:52 a. m. the next morning. On November 4, from 4:15-7:25 p.m., Mr. Hillegas received 21 calls from an unidentified, hidden phone number. It is reasonable to conclude that the calling party intentionally hid its phone number and may have been law enforcement.





Knowing that he was likely to be a prime suspect due to his prior romantic relationship with Ms. Halbach, the killer, who was highly organized, devised a plan to burn the body and plant evidence which would focus law enforcement on someone else.

Because the killer found appointment details in the paperwork in the RAV-4, he knew Ms. Halbach had an appointment with Mr. Avery earlier that afternoon. The killer formulated a plan to move the body and the vehicle near the Avery property, with the intent of planting the RAV-4 on the Avery property and Ms. Halbach's bones and electronic components as soon as the body and electronic components were burned in the adjacent gravel pit [the Radandt Pit owned by Badgerlands Aggregate, formerly Fred Radandt & Sons].





The killer was familiar with the Radandt and Manitowoc County pit [images above]. He devised a plan to bring the RAV-4 to the Avery property. His chief objective was to plant the vehicle on the Avery property.

The killer would have been familiar with Mr. Avery and his fame as a wrongfully convicted exoneree who was suing Manitowoc County.

The killer was organized and methodical, and likely had a background in science. He knew that he needed to put something with the DNA of Mr. Avery in the RAV-4.

On November 3, the killer learned vital information from law enforcement during his police interview. He quickly realized that law enforcement was focused on Mr. Avery and not on him.

At approximately 7:30 p.m. [on Thursday, November 3rd], Mr. Avery was exiting the Avery property onto Highway 147 when he observed taillights of a vehicle close to the front of his trailer. Mr. Avery contends that the only way the vehicle could enter his property from the direction it was pointed was if it was driven by way of Kuss Road and then across the field to the front of his trailer. Mr. Avery believes the vehicle's taillights were similar to those of the RAV-4 and not a squad car. Mr. Avery instructed his brother Chuck to turn around and drive back to the trailer, but by the time they drove back to Mr. Avery's trailer, the vehicle had departed into the darkness. (Mr. Avery and Chuck went to Menards and the county jail to drop off money for Mr. Avery's girlfriend. Mr. Avery arrived home at approximately 10:00-10:30 p.m. Mr. Avery did not enter the bathroom and went straight to bed.)



The metal post that the killer hit with Teresa's RAV-4 around 7:30 PM on November 3rd as he was attempting to plant it near Avery's trailer after driving it from the cul-de-sac at Kuss Road and across the field road bordering the Avery property

Northwest of Mr. Avery's trailer, between the Avery property and the cul-de-sac at Kuss Road, there was a metal post protruding approximately 2 ½ feet from the ground. When the killer attempted to plant Ms. Halbach's vehicle near Mr. Avery's trailer, he collided with this post, causing the damage to the front end of Ms. Halbach's RAV-4 and knocking out the driver's side parking light. He recognized the need to retrieve the parking light because leaving it, or any pieces of it, in the field would show the RAV-4 left the Avery property, contrary to Mr. Kratz's theory that the RAV-4 never left the Avery property. (Evidence from the scent and cadaver dogs supports the conclusion that the killer drove the RAV-4 onto the Avery property from Kuss Road, across a field to the vicinity of Mr. Avery's trailer.)

Once Mr. Avery departed, the killer began to drive the RAV-4 onto the Avery property. When Mr. Avery spotted the RAV-4's taillights and turned around and drove back to check it out, the killer retreated to Kuss Road. Once Mr. Avery left again, the killer drove back to the trailer. The south door on the east side of Mr. Avery's trailer was unlocked, and the killer entered the trailer, intent on finding an item of Mr. Avery's with his DNA that he could use to plant DNA in the RAV-4 to connect Mr. Avery to Ms. Halbach's murder. In the small trailer, the killer noticed fresh blood in the bathroom sink.

The killer recognized from his scientific background that if this blood was in Ms. Halbach's RAV-4, Mr. Avery would immediately become the only suspect. The killer quickly collected the blood from the sink in Mr. Avery's bathroom and deposited the blood in several spots throughout the RAV-4. The killer recognized that the blood had to be planted quickly, within 15-28 minutes and before it coagulated. He then hid the RAV-4 in the vicinity of the Kuss Road cul-de-sac.

Only someone who committed the murder and/or was involved in the effort to plant the vehicle on the Avery property would know the significance of the broken parking light and that it had been placed in the RAV-4 to conceal the fact that the vehicle was moved onto Mr. Avery's property from elsewhere.

When Mr. Hillegas volunteered false information about when the parking light damage occurred, it raised red flags about his involvement in the murder and the effort to frame Mr. Avery.

Mr. Hillegas intentionally diverted investigators by reporting that the damage to the driver's side bumper and parking light of Ms. Halbach's RAV-4 occurred months before her disappearance and that she had filed an insurance claim for the damage. Current post-conviction counsel, through its investigator, has confirmed that Ms. Halbach never filed an insurance claim for this damage to her vehicle, and further contends that the damage to Ms. Halbach's vehicle occurred after she left the Avery property on October 31, 2005.

The most reasonable explanation for Mr. Hillegas' intentional misleading of law enforcement regarding the damage to Ms. Halbach's parking light is that Mr. Hillegas wanted to divert attention from the parking light that was tossed in the rear cargo area of the RAV-4 by the killer when he was trying to plant the car on Mr. Avery's property and inadvertently hit a post on Radandt's property. Mr. Hillegas would not want the searchers looking for other pieces of the parking light on the Radandt property because, if those pieces were found, it would destroy the State's narrative that, after the murder, the RAV-4 never left the Avery property. If the narrative implicating Mr. Avery was refuted, the investigators might begin looking at more likely suspects such as Mr. Hillegas himself.

Certainly, Mr. Hillegas had no motive to frame Mr. Avery unless he himself murdered Ms. Halbach. It is difficult to imagine a much more compelling motive to frame Mr. Avery than the one possessed by the murderer of Ms. Halbach. The alleged motive, presented by trial defense counsel, that MCSD investigators were trying to derail Mr. Avery's civil rights lawsuit against them, pales in comparison to the killer's motive to frame Mr. Avery.

Mr. Hillegas was aware of Sheriff Pagel's intention to conduct aerial surveillance of the Avery property and surrounding properties on November 4, 2005, to search for Ms. Halbach's vehicle.

On November 4, the killer decided to make another attempt to plant the vehicle.




I was told by DOJ agents that they believed Teresa Halbach's vehicle was driven to the Kuss Road cul-de-sac by driving west through an empty field, then south down the gravel road past the hunting camp until reaching an intersection with a gravel road that ran northeast into the Avery property. They told me that they believed Halbach's vehicle turned northeast onto the gravel road and entered the Avery property at its southwest corner. It is my understanding that this theory was based on the work of scent tracking dogs. [Excerpt from Joshua Radandt's 2017 affidavit]

After the flyover ended around 6:00 p.m. on November 4, the killer drove Ms. Halbach's vehicle to the southeast corner of the Avery property.

The killer parked the RAV-4 in the southeast corner of the Avery property on a ridge overlooking a pond. The killer parked the RAV-4 facing west, although the vehicles surrounding the RAV-4 all faced east, and tried to conceal the RAV-4 using tree branches, cardboard boxes, and a rusty car hood as an explanation for why the car was not seen in the flyover video. (Mr. Kratz admitted that the RAV-4 was not visible in footage taken during the November 4, 2005 aerial surveillance.)

The killer, who drove the RAV-4 into the Radandt Pit in the late afternoon of November 4, was aided by an accomplice who drove another vehicle into the Radandt Pit to give the killer a ride out after the killer planted Ms. Halbach's vehicle on the Avery property.


Google Maps captured an image in September 2009 of a 1999 Isuzu Rodeo in Andy Colborn's driveway. In 2005, in was not uncommon for Wisconsinites to refer to SUVs as "jeeps" or "trucks." 

A new witness describes seeing a vehicle similar to Ms. Halbach's RAV-4, followed by a white jeep, enter the Radandt Pit from Jambo Creek Road using an access road immediately south of his house. Only the white jeep returned.

Wilmer Siebert, ("Mr. Siebert") observed a vehicle similar in color, size, and style to Ms. Halbach's RAV-4 enter the Radandt Pit using an access road immediately south of his house. Mr. Siebert's house is immediately north of the east entrance to the Radandt Pit off of Jambo Creek Road. After observing the vehicle enter the Radandt Pit, Mr. Siebert saw pictures of Ms. Halbach's vehicle on the news. Mr. Siebert remembers the vehicle he saw driving into the Radant Radandt Pit had the same spare wheel and wheel cover on the rear cargo door as Ms. Halbach's RAV-4. Mr. Siebert observed a white Jeep accompanying the other vehicle into the Radandt Pit. Mr. Siebert remembers the paint was chipping off of the hood of the white Jeep. Mr. Siebert remembers the two vehicles were traveling at a high rate of speed when they drove down Jambo Creek Road and turned east onto the gravel road that leads into the gravel pits. Shortly after the two vehicles entered the Radandt Pit, Mr. Siebert observed the Jeep, unaccompanied by the other vehicle, exit using the same gravel road immediately south of Mr. Siebert's house. Mr. Siebert's daughter, Vicki Siebert ("Ms. Siebert"), called Manitowoc County dispatch to report the activity observed by Mr. Siebert. Suspiciously, the recording of this call was not turned over to trial defense counsel.

The killer returned to the Avery property with Sgt. Colborn in the evening on November 4, 2005, under the pretense of helping Sgt. Colborn search for Ms. Halbach's vehicle [Sgt. Colborn's scheduled days off were November 4-6, but he worked overtime those days to help with the Teresa Halbach missing persons' case].
Colborn testified that he was not scheduled to work on November 4th-6th, 2005: that these were the three days he was scheduled to be off  ("he worked a six day on, three day off rotation," noon to 8:00 PM shift, and he was scheduled to be off November 4-6th). 
On January 11th, 2007, Colborn was interviewed by CASO's Steier, who asked Colborn if he could recall what he had done on Friday, November 4th, one of his scheduled days off. Colborn told Steier he could not recall what he had done on the 4th. 
Colborn feigned ignorance about what he did on November 4th because he didn't want it to be public record that he worked overtime on November 4th to assist with the Teresa Halbach missing person's case, just as he worked overtime on Saturday, November 5th and Sunday, November 6th..
The following is part of Colborn's testimony at Avery's trial: 
Q. Sergeant, you hold the rank of sergeant?
A. Yes, sir.
Q. And in early November of 2005, did you hold that same rank?
A. Yes, sir.
Q. What were your duties back in early November of  '05?
A. Essentially the same duties that I hold today. I was a patrol supervisor on -- I work a six day on, three day off rotation. So on the days that the lieutenant that's assigned to the shift is off, I would be the shift commander.
Q. So you have supervisory responsibilities as well?
A. Yes, sir.
Q. I'm going to direct your attention to November 3rd of 2005, ask if you were employed on that evening?
A. Yes, sir.
Q. Do you recall what your duties were on November 3rd?
A. I was the shift commander for the noon to 8 shift, that's the shift I'm assigned to.
Q. Sometime during that shift, Sergeant Colborn, were you informed of a Calumet County missing persons investigation that was ongoing?
A. Yes, sir.
Q. And being involved in that -- or excuse me, being aware of that investigation, were you asked to assist in any way?
A. Yes, sir.

Q. Did you do anything on the 3rd of November to further investigate Mr. Avery?
A. On November 3rd?
Q. Yes.
A. No, sir.
Q. Did you ever go back onto his property on the 3rd?
A. No, sir.
[...]
Q. After going to the Zipperers with Detective -- I think it was Remiker and Dedering, what did you do after that?
A. After we were done, completed at the Zipperers?
Q. Yes.
A. I went home. I was done with -- you know, I was already on overtime. I checked out and went home.
Q. Do you know about what time that was?
A. 10:30, 11:00 at night, maybe.
Q. All right.  Do you remember what you did the rest of that evening?
A. Just probably fell asleep on the couch.  I went to bed and, you know, fell asleep.
Q. The next day, on the forth of November, were you working that day?
A. No, sir, I was off that day.
Q. It's a Friday; is that right?
A. Yes, sir.
Q. Do you remember what you did on the 4th? We'll get back to that, but do you recall, generally, your day on the 4th of November?
A. Yes, sir.
Q. Move your attention one day further, on the 5th, Saturday, the 5th of November; do you recall what you were doing that day or that morning?
A. That was also a regularly scheduled day off for me. Yes, I recall what I did on that day.
Q. We'll get into the morning, but let me just jump right to this investigation.Were you contacted at all by any supervisors or superiors that day and asked to participate in this case?
A. I was contacted by the noon to 8 shift commander for that day, and he did ask me to come into work and pick up a patrol vehicle and respond out to the Avery Salvage Yard.
Q. Did you do that?
A. Yes.
Q. In a marked vehicle?
A. Yes, I did take a marked vehicle out there.
Q. And about what time was it that you arrived at the Avery scene itself; do you recall?
A. I know I left my house between 4:00 and 4:30. I probably got out to the Avery Salvage Yard between 5:15, 5:30 maybe.
Q. To your best recollection?
A. Yes.
[...]
Q. The next day, that is, on the 6th of November, were you asked to come back to the scene?
A. Yes, sir.
Q. And what were you asked to do on the 6th?
A. On the 6th, when I came out there, again, with Detective Remiker and Lieutenant Lenk and I believe just -- this time just Lieutenant Lenk went into the Command Post to make contact with who we would be working with with Cal County that day. And Detective Remiker and I just kind of waited until he came back out. And we were introduced to Deputy Kucharski. And then Deputy Kucharski informed us what our assignment would be for that day.
Mr. Avery's brother Chuck told police that on November 4 he saw unidentified headlights in the salvage yard that evening.  At 7:20 p.m. on November 3, 2005 November 4, 2005, Chuck called Mr. Avery about seeing headlights in the area where Ms. Halbach's vehicle was found. By the time Mr. Avery went to check out this sighting, the headlights were off. Mr. Avery called Chuck back at 7:25 p.m. to report that he could not see the headlights.

The headlights were from Sgt. Colborn's personal vehicle, and he had a friend of Ms. Halbach with him to search the Avery property without a search warrant because he did not have probable cause to be on the Avery property at that point in time.

Sgt. Colborn, without probable cause for a search warrant for the Avery property, unwittingly relied upon the killer, a civilian, to find Ms. Halbach's vehicle on the Avery property.

On November 4, 2005, Sgt. Colborn discovered Ms. Halbach's vehicle and called dispatch, on a personal line, to confirm Ms. Halbach's license plate number. Audible in a recording of Sgt. Colborn's call to Manitowoc dispatch regarding the victim's plate number, a third party states, "it's hers."



The killer led law enforcement to Ms. Halbach's vehicle later in the evening on November 4. The killer represented to law enforcement that he would be willing to search the Avery property, something that the police could only do with a warrant based on probable cause, which they did not have on November 4. The killer, accompanied by law enforcement, went to the Avery property, and the killer proceeded to Ms. Halbach's vehicle in the southeast corner of the salvage yard. When the killer looked into Ms. Halbach's vehicle, he called out," it's hers," because he recognized her personal items in the vehicle, in addition to her vehicle itself.

The individual who helped Sgt. Colborn to the RAV-4 on the Avery property was most likely the killer because he was able to enter the Avery property and quickly locate the vehicle in the dark or with limited lighting. His words, "it's hers," shouted out when he looked in the vehicle and clearly recognized her personal effects, established that he was a close friend of Ms. Halbach. Sgt. Colborn called MCSD dispatch to confirm Ms. Halbach's license plate number. The dispatcher who answered Sgt. Colborn's call usually worked from 2:00-10:00 p.m.

Sgt. Colborn confirmed the identity of Ms. Halbach's vehicle by calling MCSD dispatch on his cell phone around 7:30 p.m. on November 4. Sgt. Colborn was with Mr. Hillegas, who led him to Ms. Halbach's vehicle, which had been previously planted by Mr. Hillegas on the afternoon of November 4, 2005, after a failed attempt to plant it closer to Mr. Avery's residence on November 3, 2005. Realizing such a call would be recorded, Sgt. Colborn removed the license plates from Ms. Halbach's vehicle to conceal that he had actually located the vehicle at the point in time, when he made the call about the license plate.

Sgt. Colborn's dispatch call was produced to trial defense counsel among other calls recorded by Manitowoc County Sheriff's Department on a CD. The recordings, which are labeled "Track 1" through "Track 30," give no outward indication of when they were left. However, based upon a review of the content of the recordings, it is apparent that the recordings are organized chronologically on the CD.

Sgt. Colborn's dispatch call was titled "Track 3." The preceding recording, "Track 2," is a call to Manitowoc Dispatch from an unnamed officer regarding George Zipperer. The officer requested a criminal records check of George Zipperer from the dispatcher. It is reasonable to conclude that this call was placed by one of the MCSD officers who was with CCSD Det. Dedering before they proceeded to the Zipperers on November 3, 2005 [around 9:30 p.m.]. Therefore, it follows that Sgt. Colborn's call to dispatch occurred after he responded to the Avery property to make contact with Mr. Avery and after he drove back to the MCSD. Further, based upon the order with which Inv. Dedering organized his report, Sgt. Colborn's call to dispatch occurred after he (Sgt. Colborn) informed the officers assembled at the MCSD about his contact with Mr. Avery.

On the afternoon and evening of November 4, 2005 [from 4:15-7:25 p.m.], Mr. Hillegas received twenty-two phone calls from a number or numbers with no identifiers. It is reasonable to conclude that law enforcement officers were calling Mr. Hillegas in connection with conducting an illegal search of the Avery Salvage Yard, using Mr. Hillegas to access the property.

It is during this time period that Sgt. Colborn called dispatch to confirm the license plate on Ms. Halbach's car.

In his pre-trial hearing testimony, Mr. Hillegas stated that although he was not sure how many times he talked with Sheriff Pagel on November 4, 2005, they spoke at least once. Mr. Hillegas did not recall whether he had contact with Inv. Wiegert on November 4, 2005. [According to Wiegert, he first interviewed Hillegas at 10:08 a.m. on November 4.]

On November 5, 2005, with information obtained from law enforcement in twenty-two unrecorded calls on November 4, 2005, Mr. Hillegas directed Pam to search Avery's Auto Salvage. While Mr. Hillegas provided only maps and missing person posters to other citizen searchers, Mr. Hillegas provided Pam and her daughter Nikole, the only searchers allowed access to the Avery Salvage Yard, with a digital camera and Calumet County Sheriff Pagel's direct line.

Clearly, Mr. Hillegas knew that Pam would discover Ms. Halbach's vehicle. Pam located Ms. Halbach's vehicle on the Avery salvage yard -- among 4000 other vehicles on the forty acres of uneven topography -- within thirty minutes of her arrival, a true statistical improbability. It is clear that Pam was provided information pertaining to the location of Ms. Halbach's vehicle by Mr. Hillegas.




Once the vehicle was found on the Avery property, the investigation of any other potential suspects halted, and, just as the killer planned, the whole case was focused on Mr. Avery. The killer duped law enforcement into focusing exclusively on Mr. Avery and helped them justify planting additional evidence to frame Mr. Avery.

In addition to maintaining control over Ms. Halbach's home and possessions, Mr. Hillegas personally searched property surrounding the Avery Salvage Yard and entered the salvage yard on multiple occasions. Even after November 5, 2005, the police allowed Mr. Hillegas through checkpoints to come and search the area. On November 7, 2005, Mr. Hillegas accessed the Avery property from 9:03 a.m. to 9:53 a.m. Mr. Hillegas made a second entry to the Avery properly on November 7, 2005, exiting the property at 4:28 p.m. Suspiciously, Mr. Hillegas never logged into the property when he entered the second time, meaning there is no way to know when he arrived or how long he had access to the property. (On at least one occasion, Mr. Hillegas also accessed the Avery and surrounding properties using a fake name.)



This access to the salvage yard would give Mr. Hillegas opportunity to plant the bones of Mr. Halbach, and her electronic devices, on November 6 and 7, now that the investigation was already focused on Mr. Avery. This would also explain why, despite previous searches of the Avery and Janda burn barrels, bones were not discovered until November 8, 2005.



Ms. Halbach was at a higher risk for being a victim of violence because of her involvement in nude photography and her affair with a married man and with her ex-boyfriend's best friend.

Ms. Halbach's ex-boyfriend was verbally and physically abusive to her during their relationship;

Ms. Halbach's ex-boyfriend had sustained visible injuries to his hands, from fingernail scratches, around the time of her disappearance.

Ms. Halbach's ex-boyfriend initially gave the police a false name, minimized his relationship with her, lied about crime scene evidence, controlled and led the searchers to Ms. Halbach's vehicle, had unrestricted access to the Avery property to plant evidence, assisted law enforcement in locating her car, and was living in her house after her murder in complete control of the evidence, disseminated to law enforcement, from her personal papers and effects.

At first, Mr. Hillegas told law enforcement that he was just a friend of Ms. Halbach's. Despite authorities eventually learning that Mr. Hillegas was Ms. Halbach's ex-boyfriend, he testified that he was never treated like a suspect in any way.

Mr. Hillegas was trained as a nurse but was unemployed in October and November 2005. He had no alibi for October 31, 2005.

Mr. Hillegas was not asked to provide an alibi. When asked by police about his last interactions with Ms. Halbach, Mr. Hillegas testified that on October 30, 2005, he dropped something off for Ms. Halbach at her house. Suspiciously, Mr. Hillegas does not recall what he delivered to Ms. Halbach nor can he remember anything about what time of day it was when he went to Ms. Halbach's residence even though this was supposedly the last time when he saw Ms. Halbach alive.

He was not asked to explain his past relationship with Ms. Halbach or to provide an alibi for the afternoon and evening of October 31. He was not asked about the scratches on his left hand or why he knew Ms. Halbach's voicemail password.

The killer was not treated like a suspect. Mr. Avery would immediately become the only suspect.

Failure of Law Enforcement to Investigate Ms. Halbach's Background to Realize That She Was at an Elevated Risk of Becoming a Victim of Violence

[Ms.] Halbach, the victim in this case, could be considered to be at an elevated risk for becoming the victim of violence due to her prior abusive relationship with her ex- boyfriend, [Mr.] Hillegas, and her business, which involved nude photography. Third party advertisers began advertising Ms. Halbach's business as providing "adult entertainment services." Although there is no proof that Ms. Halbach herself chose to advertise her business as providing "adult entertainment services," her nude photography business led others to advertise her business as providing "adult entertainment services."

Failure of Law Enforcement to Identify Prior Abuse in Ms. Halbach's Romantic Relationships to Correctly Assess the Motive for Her Murder

Based upon violent crime statistics, the killer most likely knew Ms. Halbach and may have been involved, at some point in time, in a romantic relationship with her.

The relationship was characterized by verbal and physical abuse by the killer towards Ms. Halbach. Even after Ms. Halbach ended their relationship, the killer continued to attempt to exert control over her by living nearby and coming to her home frequently.

Before Ms. Halbach's murder, the killer most likely became aware that she was sexually involved with a married man [Brad Czech] and a second male [Scott Bloedorn], who was a very close friend of the killer's.

The Killer's Post-Mortem Activities to Conceal Evidence and Frame Mr. Avery

The killer wanted as much time as possible before the people close to Ms. Halbach realized she was gone. As she received more and more phone calls, her voice mailbox became full, something uncharacteristic of Ms. Halbach. The killer, who knew the password to her voice mailbox, deleted several of Ms. Halbach's voice messages to buy himself time before Teresa's family and friends realized that she was missing and began searching for her.

Before her death, Ms. Halbach was known to regularly check and respond to her voicemails. If family and friends were to call Ms. Halbach and receive a message that Ms. Halbach's voicemail was full, it can be assumed that they would have been alarmed. When Ms. Halbach's voicemail was discovered to be full on November 3, 2005, it triggered her friends and family to notify law enforcement that she was missing.

The killer deleted voice messages from Ms. Halbach's voicemail in order to prolong the window of time before Ms. Halbach was reported missing, thereby increasing the amount of time the killer had to dispose of Ms. Halbach's body and personal effects.

The method of deletion, in order to leave no record in Ms. Halbach's cell phone records, could only be accomplished in one way: her voicemail had to be accessed from another phone by using Ms. Halbach's voicemail password.

Ms. Halbach's phone records do not indicate that her voicemail was accessed using her own phone after 2:12 p.m. on October 31, 2005. This indisputable fact means the person who accessed Ms. Halbach's voicemail, prior to the authorities realizing she was missing on November 3, 2005, had to be the killer, who knew Ms. Halbach's password, which would be required to delete voicemails recorded to her phone.

The killer knew Ms. Halbach very well in order to know her password. Clearly this person was not Mr. Avery.

The killer wanted to control the investigation and direct it towards the single goal of framing Mr. Avery for the murder. To accomplish that goal, he volunteered to take control of the citizen search as a means of both staying informed and controlling the focus of the investigation.

In his initial contact with law enforcement, the killer immediately attempted to misdirect their investigation by not telling them about his relationship with Ms. Halbach or her relationship with other men.

The killer participated in the discovery of major pieces of evidence, even going as far as leading searchers to the vehicle that he planted.

The Killer, and Not Law Enforcement, Planted Mr. Avery's Blood in the RAV-4

Current post-conviction counsel's blood spatter expert has demonstrated that Mr. Avery's blood was planted in Ms. Halbach's RAV-4. The only parties who may have had motive to plant evidence inculpating Mr. Avery were the killer and law enforcement, namely MCSD, in light of Mr. Avery's pending civil action against Manitowoc County.

Zellner Names Ryan Hillegas as Prime Suspect and Says Jealousy was His Motive

Zellner told USA TODAY NETWORK on June 12, 2017 she is not obligated by the criminal justice system "to prove Ryan Hillegas murdered Teresa Halbach" to get Steven Avery's conviction vacated.
"Rather, we are trying to show Hillegas had motive, opportunity and a connection to the crime that meets the Denny (third-party suspect) standard. The jury should have been presented with this evidence. It may have created a reasonable doubt about Steven's guilt."

Zellner said her legal team attempted to interview Hillegas, who lives in the Milwaukee area, over the past 18 months, but had no success.
"Our investigators contacted Mr. Hillegas to interview him. He was told that we wanted to rule him out as a potential suspect, but we needed answers to certain questions related to his alibi, abusive relationship with Teresa Halbach, knowledge of her password, injuries to his left hand, interaction with law enforcement from November 3 (2005) onward, damage to Teresa Halbach's parking light, access to Avery property November 7. Mr. Hillegas never responded."
Earlier in an interview, Zellner said that they had narrowed the suspect list down to two or three intimate friends, most likely Ryan Hillegas, Scott Bloedorn, and Bradley Czech. Law enforcement didn't investigate any of these people, and Zellner had to limit her arguments to the one that could get past all three requirements of the Denny (third-party suspect) standard.

The Denny Rule is unique to the State of Wisconsin, and stems from a 1984 Wisconsin Supreme Court ruling in the case of State v. Denny. Under Denny, the defendant has to show motive, opportunity, and some evidence to directly connect a third person to the crime. 


"I am pretty annoyed at the roommate. The guy is a pig and I can't stand to be around him most days. Luckily, we don't see much of each other. The man situation is pretty lame. Nothing much going on there. Although Ryan stopped by last night because he and Scott were going out and he was checking me out (oh, I know when he's checking me out, but I didn't mention it to him). Anyway, it gets me thinking how was it that this guy held my interest for so long and I allowed myself to love him so much and nothing else had come up since? It's strange but that's my life. Not like I'm wanting to get back together with him, but I would like to feel that way about someone again."

The following about the Denny Standard comes from Zellner's June 7, 2017 motion.

Prior post-conviction counsel never had an investigator develop evidence about third party suspects that would meet the Denny standard, and they never hired experts in blood spatter, DNA, ballistics, forensic fire, trace, forensic pathology, police procedure and investigation, brain fingerprinting, or prosecutorial misconduct, or a competent forensic anthropologist, or investigator. Current post conviction counsel has retained 10 experts and 2 investigators who have developed strong evidence that undermines confidence in Mr. Avery' s verdict. 

Trial defense counsel failed to thoroughly investigate other suspects and instead chose a scattergun approach of simply naming individuals without meeting the requirements of State v. Denny, 357 N.W .2d 12, 120 Wis. 2d 614 (Wis. Ct. App. 1984).

Only One Person Meets the Requirements of Denny as a Third Party Suspect With Motive, Opportunity and a Connection to the Crime 

Abusive History
  1. Mr. Hillegas was Ms. Halbach's ex-boyfriend. Mr. Hillegas and Ms. Halbach knew each other since they were freshmen in high school, and dated on and off for five years. (TT:2/13: 156, 173). Although Ms. Halbach and Mr. Hillegas were romantically involved during their high school and college years, they were no longer together in 2005, although Ms. Halbach reported to friends that Mr. Hillegas continued to check her out despite being broken up for years. (Email from Ms. Halbach, attached and incorporated herein as P-C Exhibit 53, STATE 4030).
  2. According to Mr. Pearce, a friend and colleague of Ms. Halbach, Ms. Halbach had been in a verbally and physically abusive relationship prior to or during her internship with Mr. Pearce. Ms. Halbach interned with Mr. Pearce in 2003 during her senior year of college when she was still involved with Mr. Hillegas. (Affidavit of Thomas Pearce, P-C Exhibit 44).
Jealousy Was The Motive
  1. While Mr. Hillegas maintained an interest in Ms. Halbach, she was no longer romantically interested in him. (Email from Ms. Halbach, P-C Exhibit 53). Ms. Halbach became sexually involved with her housemate, Mr. Bloedorn, in the months preceding her disappearance. (Bradley Czech Interview, P-C Exhibit 43, STATE 2523-24). Reportedly, Mr. Bloedorn was also Mr. Hillegas' best friend. (TT:2/13:175). Mr. Hillegas committed perjury at trial when he described Ms. Halbach's relationship with Mr. Bloedorn as platonic and never romantic or sexual in nature. (TT:2/13: 157). Current post-conviction counsel's investigator Mr. Steven Kirby attempted to interview Mr. Bloedorn about false statements he had made to the police in 2005. Mr. Bloedorn refused to sit for an interview with Mr. Steven Kirby, but when he was told that current post-conviction counsel planned to name a suspect in Ms. Halbach's murder, Mr. Bloedorn immediately blurted out, "You mean Ryan Hillegas." (Affidavit of Steven Kirby, attached and incorporated herein as P-C Exhibit 83). Another point of jealousy for Mr. Hillegas might have been the fact that Ms. Halbach, as part of her business, took nude photographs of men and women, and this activity led her to become sexually involved with one of her clients, Mr. Czech. Mr. Czech was married to someone else at the time. Ms. Halbach kept the nude photographs that she had taken of Mr. Czech and his then-wife in the bedroom of her residence (11/4/05 CCSD Interview of Jolene Bain, "11/4/05 Jolene Bain Interview," attached and incorporated herein as P-C Exhibit 54, STATE 2511), a home that Mr. Hillegas frequented and moved into after Ms. Halbach's death. (11/14/05 CCSD Report by Sgt. Tyson, attached and incorporated herein as P-C Exhibit 55, STATE 1466; Correspondence Regarding Nude Photography, attached and incorporated herein as P-C Group Exhibit 56, STATE 3898, 3849; Affidavit of Thomas Pearce, P-C Exhibit 44).
  2. Mr. Czech left a text message for Ms. Halbach at 12:45 p.m. on October 31, 2005. Mr. Czech was completely forthcoming in his interview with law enforcement on November 4, 2005 that he had texted Ms. Halbach. He was not asked the content of the message nor to show the message to law enforcement during his interview. At no point did law enforcement attempt to obtain the text message from Mr. Czech. (11/4/05 CCSD Interview of Bradley Czech, P-C Exhibit 43). Although Mr. Czech did not have an alibi for October 31, and another witness had described that Ms. Halbach had broken off her relationship with Mr. Czech but he continued to call her, Mr. Czech did not meet the Denny requirements. (11/4/05 CCSD Interview of Jolene Bain, P-C Exhibit 54).
  3. Mr. Hillegas was never asked by law enforcement to provide an alibi for October 31, 2005. (TT:2/13: 194). Trial defense counsel failed to conduct any substantive investigation of Mr. Hillegas, choosing to name him as a potential suspect at one point but failing to meet the requirements of Denny.
  4. For some unknown reason, Mr. Hillegas called Mr. Czech on November 3, 2005. According to their phone records, this was the first time Mr. Hillegas talked to Mr. Czech on the phone. (Ryan Hillegas Phone Records, attached and incorporated herein as P-C Exhibit 57; Bradley Czech Interview to verify Bradley Czech's phone number, P-C Exhibit 43).
Scott Bloedorn, Ryan Hillegas' friend and Teresa's roommate (Scott and Teresa had sex several times, which Teresa later regretted, according to Bradley Czech), told CASO investigators "he was aware that on Saturday night (October 29th) Teresa had been at a Halloween party in Green Bay," which was confirmed by Teresa's brother, Mike Halbach, during his testimony.
Bradley went on to indicate he and Teresa were involved in a sexual relationship "a long time ago." He stated that Teresa advised him that she had "nothing going on in that department" during her recent conversation with him. Bradley did indicate that Teresa mentioned to him that she had slept with her roommate, Scott, several times and that she had regretted it, but had gotten over the awkwardness of being involved with him. [CASO, page 44]
Mike Halbach's Cross Examination:
Q.   Okay.  The gathering at -- was at grandpa's house on Sunday, October 30?

A.   That's correct.

Q.   For his -- for his birthday?

A.   Correct.

Q.   And then, I think -- Were there, if you know, did she -- had she had plans to go to a Halloween party the Saturday night right before that?

A.   I believe so.  Earlier in the evening she was helping me with a wedding, shooting a wedding video.  After that I think she would have went to a Halloween party.  I believe that's correct.

Q.   Okay.  Saturday night, October 29?

A.   Right.  Yeah, it would have been later on in the night.
Apparently, neither Scott nor Ryan were invited to this party. Teresa's friend Aubrey Wygralak was at the Halloween party with Teresa on Saturday, October 29th. Aubrey who told the Herald Times on November 9, 2005 that Teresa was dressed as a cowgirl (the article misreported the date of the Halloween party as October 21st).

Perhaps Scott and Ryan became aware of the party through Mike Halbach, who had been working at a wedding in Green Bay with Teresa earlier during the afternoon of Saturday, October 29th.

In April 2006, Ryan told Milwaukee Magazine that Teresa she was dressed as a cowgirl for Halloween the last time he saw her:
On the Sunday before she disappeared, Hillegas ran into Teresa at a friend’s house. Halbach told him she planned to join her family at a bar in Appleton for a Halloween party. She was dressed as a cowgirl. On Tuesday, Hillegas called to ask Halbach about the party. Her voicemail box was full. "Which was weird for someone with a business," he says. "She’s not the kind of person who would just take off and not call." By Thursday, he knew something was wrong. With the help of a friend, he went to Teresa’s house, fired up her computer and printed out a list of names and phone numbers of everyone she knew. The search was on."
During Ryan's testimony at Avery's trial, Buting asked him about seeing Teresa on Saturday or Sunday, and he said: 
"On Sunday we just talked, and she had mentioned that she had a cowgirl hat and she was going to dress up like a cowgirl. And that was pretty much the extent of it." 
However, the party she attended on Sunday afternoon was a family gathering for her grandfather's birthday: it was not a Halloween party.

Ryan Hillegas' Cross Examination:
Q. Now, the night before, Saturday night, was sort of Halloween weekend; there would be parties, bar parties, house parties, whatever. Did you chit chat at all, talk about that?

A. On Sunday we just talked and she had mentioned that she had a cowgirl hat and she was going to dress up like a cowgirl. And that was pretty much the extent of it.

Q. This was, I’m sorry, Saturday or Sunday?

A. Sunday.

Q. Okay. Did she talk about having gone out the night before, Saturday night at all?

A. No.

Q. Do you know from any other information whether she did go Saturday night?

A. I don’t know.

Q. Or Sunday night?

A. I don’t know that either.
Ryan said he last had contact with Teresa on October 30th. He said she was at her computer when he dropped off items for Scott. Under cross examination, he couldn’t remember anything about the items that he dropped off, nor could he remember what time of day he was there.

Scott said the last time he talked to Teresa was around 2 p.m. on Sunday, October 30th, implying that either he or Teresa left the home at this time. 

The Cingular report entered into evidence indicates that on October 30th the first activity on Teresa's cell phone was at 4:41 p.m., an incoming call. At 5:05 p.m., she received another incoming call. The first time Teresa made a call was to check her voicemail at 5:27 p.m. According to the Cingular report, at 5:40 she made at outgoing call; however, this call is not listed on the report generated by AT&T in 2017.

These were the only calls on October 30th, and the Cingular report indicates that the calls were serviced by Teresa's home tower.

There may have been text messaging, but Teresa's text history was not part of discovery materials (which means text records were not entered into evidence).

Therefore, if the Cingular report is correct, and if it was not altered before being entered into evidence, Teresa was at her home, or her parents' home next door, no later than 4:41 p.m. on Sunday, October 30th.

Teresa's mother, Karen Halbach, testified at Avery's trial (trial testimony, day 13, page 106) that Teresa would come over on Sunday night to watch TV with her sisters:
"It kind of became a tradition, Teresa would come over Sunday after -- Sunday night, and three of her favorite TV shows were on that night, and they (she and her two sisters) would watch it together and laugh and have a good time." 
Kratz didn't follow up at Avery's trial with the question, "Did Teresa come by on the Sunday night, October 30th, to watch her favorite TV shows with her sisters," but Karen testified at Dassey's trial (day 1, page 108) that Teresa was at her parents' home from 7 p.m. to 10 p.m. on October 30th:
Q. Could you tell the jury what you remember about Sunday, the 30th of October?

A. Um, my dad's birthday is October 31, Halloween, so the day before, my whole family got together at his house and we just celebrated his birthday during the day.

Q. Was Teresa in attendance at that party?

A. Yes, she was.

Q. Were the rest of, uh, the siblings there as well?

A Yes, they were.

Q. What happened that night if you recall?

A. That night, um, we milked cows, and then Teresa came home from -- about seven, because Extreme Makeover Home Edition was coming on and she wanted to watch it with the girls.

Q. She was at your house?

A. Right. At our house.

Q. All right. Do you know about what time Teresa left your home on the 30th?

A. I would say it was after ten.
Ryan is the only one who mentioned Teresa wearing a costume on October 30th.

Teresa was not dressed as a cowgirl on Sunday, October 30th. Teresa did not celebrate Halloween at her grandfather's birthday party. 

Teresa left home around 2 p.m. to attend her grandfather's birthday party at his home (if the report about Scott last seeing Teresa at 2 p.m. is accurate and not falsified). She came home from the party around 4:30 p.m. (if the Cingular report is accurate and not falsified) and then went to her parents' home at 7 p.m. She returned home after 10 p.m. and printed her day planner at 10:29 p.m.

We know that Teresa was at home at 10:29 p.m. on October 30th because this is the timestamp on the page of her day planner that she printed.

At the 42-minute mark in episode 5 of Making A Murderer, Ryan testifies that he ran into Teresa at her house, but doesn't remember if it was day or night.

Ryan stated that he saw Teresa the day before she disappeared yet he cannot give any specific details about the visit. He knew nothing of a major Halbach family gathering planned for that afternoon, nor did he provide an alibi for the time period from October 30th through November 3rd.

The following is from Overthrow.us:

CASO Investigator Dedering reported that Bradley Czech sent Teresa Halbach a text message at 12:45 p.m., the day that Teresa went missing on October 31th, 2005.  Maybe Teresa arrived back at her house a few hours later, and maybe Ryan was waiting for her when she did. Maybe Ryan checked her messages when Teresa left the room to use the bathroom?  May this was the last straw that broke the camel’s back? 

This is what Dedering wrote about his interview with Bradley Czech:
He stated he had last seen TERESA at MAX & ERMA’s at BAY PARK SQUARE approximately two weeks ago and they had had lunch together. He stated that he had text messaged TERESA at 1245 hrs. on 10/31/05 and he had gotten no response. He stated he called her at 2117 hrs. on 11/03/05 and he found her voice mail to be fuIl. He stated that after a couple rings, the phone transferred to an automated voice mail, not TERESA’s personal greeting.
Is it possible that this text may have caused a jealous (former) lover to fly into a rage, especially if that former lover happened to know that the sender of the text had once been, and for all he knew, still was the object of Teresa's desire. 

From Zellner's June 7, 2017 motion:

Mr. Hillegas called Mr. Czech at 9:34 PM on November 3, 2005. According to their phone records, this was the first time Mr. Hillegas talked to Mr. Czech on the phone. (Ryan Hillegas Phone Records, attached and incorporated herein as P-C Exhibit 57; Bradley Czech Interview to verify Bradley Czech’s phone number, P-C Exhibit 43).





Just off the field road leading to Kuss Road, and close to the tree line and berm separating Radandt's quarry from the Avery property, there was a red or rusted metal post sticking out of the ground about 2 ½ feet (see image above). In her June 7, 2017 motion for post-conviction relief, Zellner claims this post caused the front-end damage to Teresa's RAV-4 as the killer attempted to drive it into Avery Salvage Yard on the evening of November 3rd (Avery saw taillights near his trailer as he and his brother were leaving the yard, but the vehicle had disappeared into the darkness by the time they drove to his trailer to check it out).
Northwest of Mr. Avery's trailer, between the Avery property and the cul-de-sac at Kuss Road, there was a metal post protruding approximately 2 ½ feet from the ground. (Photo showing post, P-C Exhibit 51). When the killer attempted to plant Ms. Halbach's vehicle near Mr. Avery's trailer, he collided with this post, causing the damage to the front end of Ms. Halbach's RAV-4 and knocking out the driver's side parking light. He recognized the need to retrieve the parking light because leaving it, or any pieces of it, in the field would show the RAV-4 left the Avery property, contrary to Mr. Kratz theory that the RAV-4 never left the Avery property. (TT:3/15:77-78).



AVERY: See me and my brother, we went and got some wood. That was Thursday night. Well, I seen lights down by me. So I told him, I said "why don't you turn around? Let's go check that out."

O’NEILL: Ok. Thursday night, you and your brother—your brother is?

AVERY: Chuck.

O’NEILL: Chuck. Went to Menards, got some wood.

AVERY: Yeah.

O’NEILL: You're on your way back to your house.

AVERY: No, this was when we left.

O’NEILL: Ok. When you're leaving to go to Menards.

AVERY: Yeah.

O’NEILL: What time's that, about? We're talking Thursday night, right?

AVERY: Yeah, yeah. That was around, I don't know, eight o'clock somewhere in there. Because we went up the road that's a little ways in.

O’NEILL: Which vehicle?

AVERY: The flatbed.

O’NEILL: And then you guys saw lights at that time?

AVERY: Yeah.

O’NEILL: Where'd, where'd you see lights at?

AVERY: Back by me. Somebody turned around.

O’NEILL: What kind of lights did you see?

AVERY: Taillights. They were kind of bright. I spotted them right away. But then they went off. That's why I told Chuckie, I said "why don't you turn around? Turn around."

O’NEILL: Where were you at, on the road here, when you saw the taillights?

AVERY: Well, I think we were some place in here. Because I think we got on 147.

O’NEILL: Ok. So you're here and you see the lights, where do you see the lights at?

AVERY: Back in here, some place. It seemed like it was right behind me. You know, you got a gravel pit here. Then you got the edge here. And, I don't know.

O’NEILL: So you tell Chuck, "turn around, let's go back."

AVERY: Yeah.

O’NEILL: You go back, what happens?

AVERY: Then we pulled up. I got the flashlight. And, uh, I walked around the trailer, shined it and there was nothing there. Then I walked up a little past the trees there and I looked. I didn't see nothing, so then I came back.

O’NEILL: Where'd Chuck stay?

AVERY: Chuck stayed in the truck.

O’NEILL: Then what'd you guys do?

AVERY: Then we left again. Went to Menards.

AVERY: Well, Thursday night we got to go get, uh, lumber.

SKORLINSKI: Ok. All right.

AVERY: Because we were leaving out the driveway and I seen lights by my place.

SKORLINSKI: Ok. And when you say you seen lights by your place —

AVERY: I seen taillights.

SKORLINSKI: Going away from your place.

AVERY: No, going by it.

SKORLINSKI: Ok. On what road?

AVERY: This is on the long way, I've seen it. Because we were going by the, almost by the stop sign —

SKORLINSKI: Ok.

AVERY: And I looked, and I spotted the lights.


Excerpt from Zellner's Post-conviction Petition: She Says Colborn Arrived at the Manitowoc County Sheriff's Department and Met with Dedering, Etc. at 8 PM on Thursday, November 3rd

Current post-conviction counsel has determined that MCSD officers did not have time to plant Mr. Avery's blood in the RAV-4 on November 3, 2005. After Sgt. Colborn came to the Avery properly on November 3 to speak with Mr. Avery around 7:00 p.m., he attended a meeting at the MCSD at 8:00 p.m. 
NOTE: According to Wiegert, sometime between 6 and 6:30 p.m. he called Colborn and then Dedering from Teresa's house. According to Dedering's report, he met with Colborn at 7 p.m., after Colborn had gone to the Avery property to interview Steven. Therefore, Colborn was at the Avery property sometime around 6:30 p.m., staying less than five minutes before heading to MCSD. 
Sgt. Colborn's presence at the MCSD was corroborated by Inv. Dedering. For Sgt. Colborn to arrive at the MCSD, an approximately 23-minute drive from the Avery property, by 8:00 p.m., he must have departed the Avery property by 7:37 p.m. Therefore, Sgt. Colborn would have had a short window of opportunity to obtain a spare key to Ms. Halbach's RAV-4, locate Ms. Halbach's RAV-4, drive Ms. Halbach's RAV-4 from Kuss Road to Mr. Avery's trailer through the field, drive back to a hiding place after being detected, return to the trailer a second time, collect Mr. Avery's blood from his bathroom sink, and plant Mr. Avery's blood in Ms. Halbach's RAV-4.
  • If Mr. Avery left at 7:15 p.m., Sgt. Colborn would have had 22 minutes to accomplish all of those tasks.
  • If Mr. Avery left at 7:20 p.m., Sgt. Colborn would have had 17 minutes to accomplish all of those tasks.
  • If Mr. Avery left at 7:25 p.m., Sgt. Colborn would have had 12 minutes to accomplish all of those tasks.
  • If Mr. Avery left at 7:30 p.m., Sgt. Colborn would have had 7 minutes to accomplish all of those tasks.
It is therefore extremely improbable that Sgt. Colborn planted Mr. Avery's blood in Ms. Halbach's vehicle on November 3, 2005. Further, Sgt. Colborn was driving a squad car when he met with Mr. Avery. Mr. Avery believes that the taillights that he saw on his properly were more similar to a RAV-4 than a squad car.
According to CASO Reports, Colborn Arrived at the Manitowoc County Sheriff's Department and Met with Dedering and Others at 7 PM, After He Had Visited the Avery Property

However, the CASO reports below are disputed by the CASO dispatch log. Detective Dedering is DISPATCHED and EN ROUTE to MTSO at 7:25 PM and ARRIVES at MTSO at 8 PM, ONE HOUR after his report says he arrived (he claims he arrived at 7 PM).

[On Thursday, 11/03/05] At approximately 1800 hours [6 p.m.] I [Wiegert] did make phone contact with STEVEN P. SCHMITZ. STEVEN states he and CRAIG have a car they own together and were selling through the AUTO TRADER magazine. According to STEVEN, he received a phone call from TERESA HALBACH at approximately 1:10 p.m. on Monday, 10/31/05. STEVEN told me TERESA arrived at his residence at N253 CTH A, New Holstein, between the hours of 1:30 p.m. and 1 :45 p.m. on Monday, 10/31/05.

Cpl. LEMIEUX and I then responded to TERESA's residence at the address of W3637 CTH B. Upon arrival, we were let into the residence, which SCOTT and TERESA rent.

I contacted the MANITOWOC COUNTY SHERIFF'S DEPARTMENT and spoke with Sgt. ANDREW COLBORN. I informed Sgt. COLBORN we were investigating a missing person's complaint. I also informed Sgt. COLBORN that we had two residences we would like to have checked, one being the STEVEN AVERY property and the second one being the GEORGE ZIPPERER property. Sgt. COLBORN indicated to me he would go over and attempt contact with Mr. AVERY.

I also received a phone call from Manitowoc County Lt. JIM LENK. I informed him of the situation. Lt. LENK informed me he would call some people in and assist us in the investigation.

I did contact Inv. DEDERING, who went to MANITOWOC COUNTY SHERIFF'S DEPARTMENT and then eventually met with GEORGE ZIPPERER.

I did receive a phone call back from Sgt. COLBORN indicating he, in fact, had spoken with STEVEN AVERY. Sgt. COLBORN informed me STEVEN had told him TERESA had shown up on Monday afternoon and took some pictures of his van that was for sale. He also informed me STEVEN was not sure on what day it was and did not know what time TERESA had shown up at his residence. Sgt. COLBORN also informed me the B. JANDA information would be STEVEN's sister, BARBARA JANDA, and she would live right next door to STEVEN.

That was the end of my conversation with Sgt. COLBORN. I left TERESA's residence and went back to the sheriff's department.

On Thursday, 11/03/05 at 1730 hrs. [5:30 p.m.], I (DEDERING) was alerted by Inv. WIEGERT of a missing person who is a resident of Calumet County. WIEGERT indicated that TERESA HALBACH had last been seen on Monday, 10/31/05, and that her parents had recently reported her missing.

On Thursday, 11/03/05 at approximately 1900 hrs. [7 p.m.], I (DEDERING) did arrive at MANITOWOC CO. SHERIFF's DEPT. There I met with Det. DENNIS JACOBS, Lt. JAMES LENK, Det. DAVID REMIKER, and Sgt. ANDREW COLBORN regarding this matter.

I learned that Sgt. COLBORN had been to the address of THOMAS JANDA (12930 Avery Rd., Two Rivers) and had spoken with an individual known to him as STEVEN AVERY. Apparently COLBORN leamed that AVERY's sister, BARBARA, is married to Mr. JANDA. COLBORN learned that AVERY was attempting to assist his sister, BARBARA JANDA, in selling a vehicle of some soft, and that AVERY was going to advertise this vehicle in the "AUTO TRADER" magazine that Ms. HALBACH works for.

AVERY had indicated to Sgt. COLBORN that the individual who had been scheduled to take the photographs had done so, but AVERY could not recall whether the photographer had gotten there in the late morning or the afternoon. COLBORN learned that, according to AVERY, the photographer had left the Avery Rd. address and had gone on, possibly to another area.

At 2115 hrs. [9:15 p.m.], while at the MANITOWOC CO. SHERIFF's DEPT., I received a telephone call from Inv. WIEGERT indicating that he had spoken with a representative from AUTO TRADER and that the AUTO TRADER had spoken with GEORGE ZIPPERER and it was determined further that TERESA HALBACH had been at the ZIPPERER residence.

Chuck Avery's Statements on November 5th Put Colborn at Avery Salvage Yard Around 6:30 PM on November 3rd (an Hour and a Half Before Colborn Meets with Dedering, Lenk, Remiker and Jacobs at MTSO)

Chuck Avery's statements on November 5th, from a report by Sgt. Michael Sievert, dated November 7th:
"On Thursday Steve and I went to the Menards in Manitowoc and we picked up trusses and insulation and a few odds and ends at 6:30 p.m. We got back about 9:30-10:00 pm. Steve and I both went home. I left for the cabin at 7:20 pm. on Friday. That’s when I saw the headlights behind me and called Steve on his cell 920-323-4038. My nephew Brendan rode up north with me. We took the flatbed wrecker to haul up the trusses and insulation. On Friday when I left Steve was at home, my mom was home because they were coming up in the morning. I don’t know if my sister was home.

"On Thursday 11/03/05 around 6:30 p.m. Steven and I were going to Menards and Steven saw taillights by the trailer that he is staying in. I turned around on Jambo Creek Road. We went back and pulled into my sister’s driveway. I did not see the taillights. Steven checked around by his trailer but didn’t find anything. I stayed by my sister’s house. If there was a vehicle back there the only road out was past my sister Barbara's house. A vehicle could get out by driving across the field. On Friday 11/04/05 when I was leaving to come up to the cabin in Marinette County I saw headlights behind my house on Avery Road, I called Steven and asked him to check it out. Steven called me back and said he didn’t find anything."
Blaine Dassey's statements on November 5th, from a November 13th DCI report by Debra Strauss, have Chuck and Steven leaving for Menards by 7 p.m. on Thursday, November 3rd:
"On Monday, November 7, 2005, at approximately 10:11 a.m., S/A Debra Strauss and S/A Lisa Wilson interviewed Blaine... Blaine was then asked if her could recall what happened on the evening of Thursday, 11/03/2005. S/A Strauss advised Blaine that, to help his recollection, that was the night that Steve and Chuck went to Menard's. Blaine stated that sometime after dinner, between 6:00 and 7:00 p.m., he, Steve and Chuck were outside. Steve and Chuck told Blaine they were going to got to Menard's to get trusses for a shed they were going to build up north. Blaine said he spoke with Chuck and Steven before they left for Menards. Chuck and Steve asked Blaine if he wanted to go. Blaine said he did not go with Chuck and Steve because he had other things to do. Blaine said they took the flatbed truck when they left. Blaine was asked if he could remember Steve and Chuck come home, and Blaine said he did not..."
Blaine also told DCI agents that he left home the next evening, November 4th, by 7 p.m.:
"On Friday night, 11/04/2005, Mike Kornely picked up Blaine at approximately 6:30 or 7:00 p.m."
However, the DCI agents returned on November 11th to question Blaine again, and Blaine changed his original statement about Chuck and Steve going to Menards on Thursday, November 3rd around 7 p.m. From the same DCI report dated November 13th by Debra Strauss:
"On Monday, November 11, 2005, at approximately 2:15 p.m., S/A Debra Strauss and S/A Lisa Wilson went back to re-interview Blaine to verify the activities of Wednesday, 11/02/2005 and Thursday, 11/03/2005... Blaine also said he is sure that Chuck and Steve went to Menard's on Friday night instead of Thursday night. Blaine said he can recall going into his garage with Bobby looking for duct tape or tie downs for the dryer vents. While out there, Blaine saw Chuck in his flatbed smoking a cigarette and Steve run into his house to get something. Blaine estimated Steve was in his house for approximately 3 to 5 minutes. Blaine said he did not talk to Chuck or Steve at all. Blaine saw Steve come out of his house, get in the passenger seat of the flatbed, and they left the area. The Special Agents asked Blaine why he had previously stated that Chuck and Steve went to Menard's, they asked Blaine if he wanted to go along. However, Blaine had declined because he had something else to do. Blaine said this was an error because he was confusing it with a separate incident he had with Chuck and Steve."
Chuck Avery left for Crivitz with Brendan on Friday, November 4th, just before 7:20 p.m., per his phone records (when he left, he saw headlights behind him and called Steven to go check it out), so he couldn't also have left at 6:30 p.m. on Friday to go to Menard's in Manitowoc with Steven.

Why do investigators want Chuck and Steven in the flatbed going to Menard's around 6:30 p.m. on Friday rather than 6:30 p.m. on Thursday, November 3rd?

Because law enforcement needs the taillights by Steven's trailer on November 3rd not to be Andy Colborn. Therefore, they persuade, manipulate, intimidate Blaine into stating that Chuck and Steven went to Menard's on Friday, not Thursday.

However, just because Colborn had opportunity to be driving around ASY and the surrounding properties on November 3rd, doesn't mean the taillights Avery saw by his trailer that evening were from Colborn's squad car.

Steven Avery Told O'Neill It Was About 7:30 PM When He Saw Taillights by His Trailer as He and Chuck Were Leaving for Menards on Thursday, November 3rd (After Colborn Stopped By the Salvage Yard)

From Kathleen Zellner's post-conviction petition:

Mr. Johnson, a family friend of the Avery's and owner of Mr. Avery's trailer, remembers observing the cut on Mr. Avery's finger at least one week prior to October 31, 2005. [This was the original cut that was broke open when he unhitched the trailer on November 3rd.]

In his affidavit attached to Zellner's post-conviction petition, Steven says he left his the trailer at approximately 7:30 p.m. on November 3rd to go to Menards with his brother Chuck. Menards in Manitowoc was an approximately 23-minute drive from the Avery property. Steven and Chuck checked out at Menards at 8:06 p.m. (Menards Surveillance Video, attached as P-C Exhibit 5).

On the evening of November 3, 2005, Mr. Avery was having dinner at his mother's residence, and when he walked outside her residence, a uniformed officer pulled up in a MCSD squad car and asked if he could speak with him. Later, Mr. Avery learned that this individual's name was Sgt. Colborn. Sgt. Colborn asked Mr. Avery if a female from AutoTrader Magazine had come to the property on Monday to take pictures of a vehicle they were selling. Mr. Avery told Sgt. Colborn that a female from AutoTrader had come to the property at approximately 2:30 p.m. and had photographed a van his sister was selling. Mr. Avery contended that she was on the property for less than five minutes. Mr. Avery told Sgt. Colborn that he noticed her photographing the van and he exited his trailer to pay her. Mr. Avery observed Ms. Halbach leave the property and turn left on Highway 147. Sgt. Colborn misrepresented, in a report written months later, that Mr. Avery said 3:00 p.m., not 2:30 p.m. Mr. Avery's affidavit is consistent with all of his prior statements to police that Ms. Halbach was on the Avery property sometime between 2:00 p.m. and 2:30 p.m.

Mr. Avery then drove his Pontiac Grand Am from his parents' residence to its usual parking spot in front of his garage. Mr. Avery then walked next door to his sister's trailer, where he attempted to unhitch the trailer. In so doing, Mr. Avery broke open the cut on the middle finger of his right hand. 

His finger was dripping blood as he walked back to his car to retrieve his cell phone charger. While in his car, Mr. Avery dripped blood from his finger onto the seats and the gear shift. 

From his car, Mr. Avery walked to his trailer, entering through the door at the south end. Mr. Avery dripped blood on the floor as he entered the bathroom to find a piece of tape to put on the cut. Mr. Avery dripped blood onto the rim and basin of the sink and the bathroom floor. He did not wash away or wipe up the floor or sink because his brother Charles Avery ("Chuck") was waiting for him to go to Menards in Manitowoc with him.

He hastily wrapped his finger in masking tape and exited the trailer through the front door. Mr. Avery forgot to lock the south door on the front of the trailer.

He did not clean the blood out of his sink prior to leaving the trailer at approximately 7:30 p.m. to go to Menards with his brother Chuck. Menards in Manitowoc was an approximately 23-minute drive from the Avery property. Mr. Avery and Chuck checked out at Menards at 8:06 p.m. (Menards Surveillance Video, attached as P-C Exhibit 5).

Blood stains were noted on the molding (Item AA) and the inside living room door (Item CQ) of Mr. Avery's trailer. Mr. Avery's Pontiac was unlocked and visible blood was on the gear shift. Anyone who examined the interior of his trailer or vehicle would have recognized that the locations of the various blood stains indicated Mr. Avery had a cut on his hand.

At approximately 7:30 p.m., Mr. Avery was exiting the Avery property onto Highway 147 when he observed taillights of a vehicle close to the front of his trailer. Mr. Avery contends that the only way the vehicle could enter his property from the direction it was pointed was if it was driven by way of Kuss Road and then across the field to the front of his trailer. Mr. Avery believes the vehicle's taillights were similar to those of the RAV-4 and not a squad car. Mr. Avery instructed his brother Chuck to turn around and drive back to the trailer, but by the time they drove back to Mr. Avery's trailer, the vehicle had departed into the darkness. Mr. Avery and Chuck went to Menards and the county jail to drop off money for Mr. Avery's girlfriend. Mr. Avery arrived home at approximately 10:00-10:30 p.m.  Mr. Avery did not enter the bathroom and went straight to bed.

On November 4, 2005, Mr. Avery awoke at his normal time of 6:00 a. m. When he entered the bathroom of his trailer to take a shower, he observed that most of the blood in and around his sink had been removed.

Mr. Avery consistently expressed his belief to his attorneys and the media that the blood of his found in Ms. Halbach's vehicle was planted and that it came from his trailer. In one interview, he said he dripped blood from his finger into his bathroom sink. (Video Clips from 11/9/05 NBC-26 WFRV interview and 11/18/05 WBAY interview, attached as P-C Group Exhibit 8).

At 10:30 a.m. on November 4, 2005, Lt. Lenk and Det. Remiker arrived at the Avery property to interview Mr. Avery. In the early evening, Mr. Avery smelled cigarette smoke when he entered his bedroom to retrieve a cable for his mother's television. Neither Mr. Avery nor his girlfriend smoked. Mr. Avery believes his trailer was entered unlawfully a second time.

On November 5, 2005, when Mr. Avery was preparing to leave for a trip to the family properly in Crivitz, he noticed the south front door of his trailer had been pried open. Specifically, Mr. Avery observed pry marks on the south door of his trailer. He remembered locking this door after Lt. Lenk and Det. Remiker left on the morning of November 4, 2005.

As Mr. Avery's brother Chuck left for Crivitz, he observed headlights in the area where Ms. Halbach's vehicle was discovered by the pond. Chuck called Mr. Avery at 7:20 pm. to check on the headlights, but by the time Mr. Avery arrived by Chuck's trailer, the lights were gone.

Colborn Arrived at Avery Salvage Yard No Later Than 7 PM on Thursday, November 3rd

Around 7:00 p.m. Colborn visited Avery Auto Salvage, spoke with Steven, left the property, and contacted Schetter and Wiegert.

The following is a timeline estimate on when Colborn arrived at Avery Salvage Yard and when Chuck and Steven actually left for Menards on Thursday, November 3rd.

6:00 - 6:30 p.m. - Sometime between 6 and 6:30 p.m., Wiegert contacts Colborn about missing person Teresa Halbach because AutoTrader told him that Teresa had appointments with two residents of Manitowoc County on the day she went missing: B Janda on Avery Road and George Zipperer.

6:30 - 7:00 p.m. - Sometime after 6:30 p.m., but before 7 p.m., Colborn arrives at Avery Salvage Yard and talks to Steven for five minutes or less.

7:00 p.m. - Sometime around 7 p.m. Dedering arrives for a meeting a MCSO, where he met with Colborn, among others. Colborn already had been to the Avery property and met with Steven, who confirmed that Teresa come to take pictures on 10/31.

7:15 p.m. - Steven drives his Grand Am from his mom's to his driveway and parks (2 minutes).

7:17 p.m. - Steven walks over to Barb's and unhitches trailer, reopening the cut to his finger (5 minutes).

7:22 p.m. - Steven walks to his Grand Am to get his cell phone charger, dripping blood into the vehicle (2 minutes).

7:24 p.m. - Steven walks to his trailer, goes into the bathroom, wraps his bleeding finger with masking tape, and walks back outside and gets in the flatbed with Chuck (3 minutes).

7:27 p.m. - Steven and Chuck drive the flatbed down the long shared driveway, turn left onto Avery Road, and, as they near highway 147, Steven notices taillights by his trailer (3 minutes).

7:30 p.m. - Steven and Chuck turn around and got back to Steven's trailer to check it out. Steven gets a flashlight from the flatbed and walks around his trailer, but the taillights are gone (5 minutes).

7:35 p.m. - Steven gets back into the flatbed, and they leave again for Menards (25 minutes).

8:00 p.m. - Steven and Chuck buy trusses (5 minutes).

8:06 p.m. - Steven and Chuck check out at Menards per Menards surveillance video.

The following is an excerpt from Steven Avery's November 5th interview with O'Neill about seeing taillights around 8 p.m. on November 3rd from a vehicle turning around by his place.

AVERY: See me and my brother, we went and got some wood. That was Thursday night. Well, I seen lights down by me. So I told him, I said "why don't you turn around? Let's go check that out."
O’NEILL: Ok. Thursday night, you and your brother—your brother is?
AVERY: Chuck.
O’NEILL: Chuck. Went to Menards, got some wood.
AVERY: Yeah.
O’NEILL: You're on your way back to your house.
AVERY: No, this was when we left.
O’NEILL: Ok. When you're leaving to go to Menards.
AVERY: Yeah.
O’NEILL: What time's that, about? We're talking Thursday night, right?

As we all know, it is commonly accepted as such that Ryan Hillegas did on November 3rd, 2005 what Ryan Hillegas testified to doing… Got a call from Scott, went over to Scott’s house, printed off records, and started calling friends and stayed there pretty much all night until about midnight or 1am. Let’s really drill down to the meat of the issue regarding his “truthful” testimony and see if it's really up to snuff...

We can attest that since all of the DCI reports that have recently been released in motions and filings, that the timeline of Ryan Hillegas for November 3rd, 2005 can be put together a little more clearly than it was at the trial.

Let's begin.

There are a few important points to remember regarding who called who and what time on November 3rd, when processing this post and this information:

Based on the information above and based on SCOTT CALLING RYAN at 4:06PM. We can safely say that RYAN arrives at SCOTT and TERESA’s house sometime AFTER 4:06PM.

We can also say that since RYAN is calling KELLY at 4:10PM and KELLY calling RYAN back at 4:12PM and speaking for 5 minutes, she is not yet at Teresa’s house. Kelly calls Ryan at 5:16 and speaks for 2 minutes, and gave an interview to Fassbender in January of ’06 that she and Lisa left to go to Teresa’s house between 4:30 and 5PM. When they arrived at Teresa's house, RYAN and SCOTT were there. It is safe to assume that Kelly arrived right after the 5:16PM call to Ryan where they spoke for two minutes.

The most important reason for establishing this, is that at some point, RYAN leaves TERESA's house prior to Law enforcement arriving around 6:20 TO 6:30PM. This is based on a 15-20 minute drive from Calumet County Sheriff to Teresa's House.

In summary, it is safe to say that Ryan arrived at Teresa's house sometime BETWEEN 4:06PM (after speaking with Scott) and 5:15PM (Before Kelly and Lisa arrived), and left sometime PRIOR to 6:15PM.

There are also important points to remember regarding activity that the people above had with Cingular wireless on November 3rd:

The communication with Cingular came in two forms:

RYAN CALLS CINGULAR a total of three times on November 3rd: Once at 5:15PM, 5:17PM, and 5:18PM. The 5:18PM phone call, Ryan was on the phone for 10 minutes. 


Teresa’s online Cingular account was accessed TWO times on November 3rd: 5:48PM and 7:18PM.

There was a Reddit post in December 2015 (now deleted) which claimed Ryan had told a coworker at the hospital that he didn’t guess the password, but he actually spoke with Cingular and tricked an employee to giving out the password illegally. The above 3 calls to Cingular wireless prior to printing out the records a half hour later, corroborate this deleted reddit posting.

QUESTIONS THAT NEED ANSWERING:

After Teresa’s friends gave Wiegert the 5:49PM printout, why was the online account accessed a second time at 7:18PM? And from where if Teresa's computer had already been seized by Wiegert and Lemieux?

Why did Ryan leave Teresa’s house prior to police arriving sometime around 6:20PM?

Why does the second login to Teresa’s online account at 7:18PM coincide with Ryan calling Kelly at that same time? Was there a password exchange?

Why, if Ryan was present on 11/3 when Wiegert and Lemieux arrived, was he only first talked to on the morning of 11/4?

Did Ryan lie at testimony about guessing the password, when in reality it was obtained illegally from Cingular wireless? If we think about the "full voicemail" issue that was brought up over the summer, is this another case of Ryan's big mouth revealing facts unintentionally?

When you have important events happening during the initial moments of a missing person case, it is even more important to make sure those happenings are presented factually and clearly, so everyone can break down the events in question with their own minds, and make up their minds as to whether it stinks or whether it's peachy.

Dispatch logs fill in the blanks for a lot of the ambiguous time frames that were presented in the CASO/MTSO police reports and at trial, under oath. Law enforcement, of all people, are trained on how to properly testify.

What does that mean?

It means if you don't remember, or can't recall, then you aren't lying. (Cough, cough, Colborn)

Let's belly flop right into this one...

LET'S TAKE A LOOK AT THE CASO DISPATCH LOGS

Please note that they have been redacted and marked up for easier reading.

What does the information above tell us?

Leslie Lemieux is dispatched to TERESAS address but for some reason she goes to TERESAS PARENTS house address and arrives around at 5:03PM.

We know this because from Leslie's own reports, she speaks to Karen and Tom Halbach, but speaks to SCOTT by PHONE. 


Why is this important? Because we know that just down the street, at 5:18PM, RYAN is on the phone with Cingular, illegally obtaining access to Teresa's Cingular account.

Leslie Lemieux LEAVES Teresa's PARENTS house at (presumed) 5:36PM (not clear in logs) and arrives at CASO before 6PM.

PLEASE NOTE that Lemieux leaves at 5:36PM, this is 12 minutes before first access is gained into Teresa's account and 13 minutes before the call records are printed out.

LEMIEUX and WIEGERT both respond to Teresa's house and arrive at 6:21PM.

WIEGERT AND LEMIEUX are at Teresa's house until they BOTH LEAVE at 7:25PM.

During their visit, they were given the cell phone printout from 5:49PM.

During their visit, they were present when the Cingular online account was accessed a second time at 7:18PM.

Please note that BOTH the 5:48PM and the 7:18PM logins to Teresa's online Cingular account were obtained illegally.

During their visit, they seized TERESA'S LAPTOP.

Detective Dedering is DISPATCHED and EN ROUTE to MTSO at 7:25PM and ARRIVES at MTSO at 8PM, ONE HOUR after his report says he arrived. 


This Call (TRACK 2) happened between the arrival of Dedering at MTSO (8PM) and the following item in his report after the Zipperer call (8:25PM)

You remember that the license plate call that Colborn testified to making to verify information from Wiegert, was TRACK 3.

I mentioned to Zellner a long time ago that the Order of the calls on the audio CD were in chronological order. She has since filed this in one of her briefs. We know Track 3 comes AFTER track 2 because of Math.

COLBORN wouldn't need to verify any information if he was with Officer Dedering until 10:30PM, until they finished visiting Zipperer.

LYNN, the dispatch operator who answered the call, worked the 2PM-10PM shift. There is no way she would be answering the call until the following day (11/4), starting until AT LEAST 2PM. 


It is safe to conclude that COLBORN'S call didn't happen until AT LEAST 2PM on 11/4.

THIS CORRELATES with the Affidavit of Mr Rahmlow when he mentions TELLING AN MTSO OFFICER about the car on November 4th.

If not, where was it accessed from? Does Ryan's 7:18 Call to Kelly and the simultaneous account access have any correlation?

WHERE WAS RYAN?

Remember he Left Prior Law enforcement arriving, as first contact with him is not until 11/4 in reports.

WHY DID COLBORN LIE ON THE STAND ABOUT THE PHONE CALL?

UNDISPUTED chronological order of the MTSO Dispatch CD puts his phone call After his Criminal history check on George Zipperer (That call happened between 8:00 - 8:30 PM).

No reason to "verify" info CASO gave him, if he's with a CASO officer until 10:30PM on 11/3.

His lies on the stand regarding this phone call is enough to impeach his entire testimony, and the fact that he lies about this makes it more likely that he also lied about the bookcase shaking.



The Cingular account had already been accessed. Then Kelly calls Ryan and the account is accessed a second time. Perhaps Ryan was at the house during the first access but he left before the police arrived. So Kelly had to call Ryan to get the login info before she could show the police where they got the call list.



Did Dedering Jump the Gun??

For those of you who have read the CASO report or other case documents, I think that you will agree that Dedering writes methodical and detailed reports. At least to me, he seems to have given some thought to what he has written. Up until today I assumed his reports were accurate.

In his report of his activity on 11/03/05, he writes that he "was alerted" by Wiegart of a MISSING person, Teresa Halbach of Calument County. The time he notes is 17:30, or 5:30 p.m.

The first thing that is wrong with that entry is that Weigart (according to his report) was receiving the call from LeMieux about Teresa being a POSSIBLE missing person at the exact same time.

The second thing that is wrong with the statement is that at 5:30 p.m. Teresa was not yet considered a missing person.

Between the time Weigart gets the call from Lemieux at 5:30 until he "alerts" Dedering, he does the following:
 -Requests Le Mieux to come to CA CO Sheriff's Office (consider travel time from TH's --15 minutes, maybe?}

 -Talks to C.S. at 5:55 p.m.

 -Talks to S.S. at 6:00 p.m. 

 -Goes with Le Mieux to TH's residence (another 15 minutes--this puts us at roughly 6:20.)

 -Talks to SB

 -Talks to KH and TH

 -Searches Teresa's bedroom

 -Gathers items for potential clues/evidence

 -Tags evidence

 -Calls Colburn

 -Talks to Lenk

 -Travels back to CA CO Sheriff's Office

I figure the very earliest Weigert could have called Dedering was roughly 7:00 p.m.

So, was 5:30 the agreed-upon time that this s*itball was to be set in motion, rolling towards Steven Avery? Was that time so ingrained in Dedering's head that he listed that time on his report? OOPS!! It seems the investigation continued before it was even supposed to start.

I need to stop reading the CASO Report. Doing so is not good for my mental health or my high blood pressure.

The CASO report is the result of a pre-trial conference with MTSO on June 26, 2006 (MTSO report, page 16). 

In other words, the CASO reports are prepped, so I don't bother with them much.

Colborn wrote his 11/3/2005 report of activity on 6/29/2006, after the pre-trial conference with CASO.

The contents of the George Zipperer voicemail were reported in the MTSO reports on 11/3/2005, long before the CASO revision as result of the pre-trial conference on 6/29/06, which resulted in a different version in CASO.

The police seemed to have changed their “narrative” as result of the 6/29/06 pre-trial meeting (MTSO Summary Report, page 16 of 17, paragraph 17). 

It was reported on 11/03/05 that the message Teresa left at Zipperer’s was seeking directions (page 4 of 17, paragraph 6). On 11/5/05 the detectives discussed amongst themselves that Teresa went from Steven Schmitz's to Steven Avery's (audio at 2:05). Yet, in the CASO report, which seems to have been created as result of the pre-trial meeting, a different message detail was reported (page 18 paragraph 5). Additionally, it was reported that the 2:27 call was the last phone activity when in reality it was the 2:41 call (page 3 paragraph 2). It was reported that the call with Schmitz was at approximately 1:10 when in reality it was ten to one or 12:51 (page 6 paragraph 3). Andy Colborn seemed to slip with his “2:00 or 2:30” (TT D7/P76/L18-20): I suspect he meant to say “3:00” to match his 6/29/06 reporting of his 11/3/05 activity (page 17 of 17 paragraph 1). “Between 2:00 and 2:30” matches the 11/5/05 discussion (audio at 2:10).

The MTSO Investigative Report, MTSO Global Subject Report, and MTSO dispatch log (audio) show raw data time stamped by a system of record that can't be changed by officers.

It shows:

11/03/2005 18:35 - Avery was entered as the suspect of "HOMICIDE NON-NEGLIGENT."

11/03/2005 18:37 - Teresa Halbach is reported missing to the MTSO's Dispatch.

11/03/2005 18:51 - Dispatch alerts all units of Teresa Halbach being a missing person.

On 11/03/2005, when Teresa was only reported missing, only her murderer would/should have known it was a "HOMICIDE."

Those systems should have been subpoenaed long ago, since a "system of record" logs whoever made the entry, and that person has a lot of explaining to do, especially since the evidence points to one person in LE.

    Why are some incoming calls on the report and some missing? I assume the missing ones went to voicemail and the two identified ones she answered.

    the 414 number is close to the Auto Trader number, and is in the same area code. AT office number from their job sheet is 414 425 8675. Dedering could not get internet info on that number. It could be in a group of incoming numbers to Auto Trader that are not published and were reserved for outgoing calls only for the business.

    He didn't do the smart thing -- calling the number or the in-coming numbers to see who would answer.

    11/03 Sheriff Pagel's first report

    He reports he was called at home about the missing person (by Wiegert); no time given

    He scanned a PHOTO of Teresa and emailed it and her personal details to the TV stations. Where did he get this Photo? Presumably from Wiegert, but he doesn't report that.

    he arrives at the MANITOWOC Sheriff's dept at 7pm. Jacobs, Lenk, Remiker, Colborn. Is he the liaison for Wiegert to MTSO???

    More 'chinese whispers' - This time COLBORN says Avery didn't know if TH was there late morning or afternoon. That doesn't match ANYTHING Colborn has in his reports. I think he makes up his name most of the time. Has anyone run an ID check on Colborn?

    Voicemail box was full But was it? This is important. And has been misleading all of us. The phone diverted to voicemail NOT because it was full, but because it was NOT on the Network. No calls from at least 4.35 on 10/31. Here's his exact words: > It was determined that the voice mail box for TERESA HALBACH's cellular phone was apparently full, as the phone rang directly to voice mail.

    That makes no sense. If it went to voicemail and NOT a Voicemail Full message, then the voicemail box was NOT full.

    at 8.25pm, call to TH "went directly to voicemail". So even then, they knew the voicemail was NOT full.

    Zipperer had a "domestic violence situation in 2002". It was "an arrest incident". This matches JoEllen's fearful behaviour when the sheriff's finally got them to open the door.

    2nd hand from Wiegert in Dedering's report; no ID as to who from AutoTrader Wiegert spoke with: first mention of the Two Rivers person coming to the door in only a towel. NO mention that it is Steve Avery. Fax was received from TH early morning hours, usually sent at the end of the day. Group of friends in Green Bay, but no boyfriend.

    The fax the night before could be because she was not going home after she finished her shoot that day and wouldn't be back home to send it. BUT it also would not have included her shoots from Monday. The fax could also have been sent to tell the office of her weekend cancels.

    More discussion about the Ameritech phone number that was no longer in service. 920-435-1367: the number of the FAX machine. Mystery solved. That number would have been programmed in from when she lived in Green Bay, which explains why it was disconnected.

    Wiegert called Dedering that Autotrader had made contact with the Zipperers and that TH had been at their place.

    This is probably a good place to stop in this post. The next will be back to Wiegert interviewing Angela Schuster, which should match what is above from Dedering's report. BUT since this is directly from Wiegert should be more reliable than the 2nd hand Dedering report.

    Someone was wondering where the Ameritech Security number came from. It wasn't the landline in the house (that's listed at the top of the missing person report). Ameritech Security is first mentioned in the CASO report as coming from Detective Jacobs. It's not mentioned in the MTSO report at all. So the source of that number and the name of the company was a mystery. I just compared it to Teresa's fax and there it is. Same number.

He was arrested for 'Criminal Damage to Property' & 'Contribute to Delinquency of a Child'; the latter charge was dropped by the prosecution when the matters went to court (see Manitowoc County Case Number 2005CM000883). Speculation: was JoEllen changing her story about TH's arrival and departure times, the price to be paid for dropping the second charge?

    No. The way fax machines work is you have to manually enter the info that will appear in that marking. She used to use it in Green Bay at that number. Or she bought it second hand and that number was manually put in it. It wasn't changed when she moved to Hilbert and the new landline. She probably didn't even think about it and no one paid any attention to ask about it. It's on all her faxes. They have her handwritten notes on them.

    Yes, exactly. In that report he says both exist at the same time, when in reality, they would not and could not. If you are invited to leave a message, either by the system or a personalised message, the VM is not full. And in fact, I read that Cingular said it would be highly unlikely with so few messages for her voicemail to be full.

    The coincidence is that nobody reported a fire on 31 Oct until after the bones had been found and it had been reported on the local news. Multiple witnesses said there was a fire either Tuesday or Wednesday, but Monday wasn't mentioned until after new information had been released.

  5. If Ryan Hillegas murdered Teresa Halbach, does Teresa’s mother know? She and Teresa were close according to everyone. It’s likely that Teresa and her mother talked about everything. Teresa’s mother would have been well familiar with Ryan and the intensity of his passion for her daughter.

    To add the next link in the chain of logic, we are now obliged to wade into territory that is murkier still. If Teresa’s family knows Ryan Hillegas to be Teresa’s murderer, why are they satisfied that the wrong men are serving life sentences for it? To put it as plainly as possible, why are they protecting Ryan Hillegas?

    There is only one explanation that I can think of that makes sense and one, even, that seems to fit with the facts as we currently know them. It would also explain why the Halbach family has behaved so strangely since the release of Making A Murderer. Ryan figured out some way of involving Teresa’s younger brother, Mike Halbach, in either Teresa’s murder, the cover up that took place immediately after her murder, or both.

    There is no doubt that Ryan Hillegas had his hooks into the Halbach family, and it is clear that he put a lot of effort into orchestrating ways to get close to Teresa even if she wanted to get away from him. All of the evidence points to this. Ryan moved into Teresa’s house after she was murdered. Probably slept in her bed, went through her personal belongings, reminisced about the happy by gone days when they were lovers. He initiated and lead the search for her body, and who, but her brother Mike, was by his side all the while?

    The idea here is that though Ryan’s efforts to convince Teresa to be with him after she decided to move on were unsuccessful, he tried to go around her by currying favor with her family members who he hoped to influence, and he hoped that influence would translate pressure felt by Teresa. Ryan groomed Teresa’s brother, Mike, in this effort as well, and we can only guess at what extent he involved himself in the younger man’s life. What on the surface was a guy who wished to gain a reputation for being helpful and generally terrific, was underneath the covers a diabolical schemer. His goal was to recruit everyone who knew Teresa to impress upon her his sterling virtues. I can’t say for sure, but I’m guessing that Teresa saw right through these crude manipulations and counted them prominently as her reason for rejecting Ryan.

    However crude Ryan’s efforts may have been, they did take some cunning, and some planning. How bitterly disappointed he must have been to invest all this effort for so long a period of time only for all of it to be ignored by its sole object. And not just ignored, but for all of it to blow up in the most spectacular form imaginable. It is shown in the CASO report that Teresa was sexually active with one of Ryan’s best friends (and Teresa’s roommate) Scott Bloedorn. Some best friend, huh? In Ryan’s possessive mind this had to have been an insult akin to cuckoldry. Is this the sort of thing which sometimes leads to murder? Well, yes it is! And it wasn’t just Scott. There was also Brad, and others too.

    Imagine Ryan’s humiliation. All of those schemes come to naught. All of those schemes, so carefully planned and executed so patiently over months and even years blowing up right in his face. This is the stuff of murder, people. This is the stuff of murder.

    Did Ryan have access to all of Teresa’s electronic communications? There is every reason to believe he did (he was the one, after all, who “guessed” the username and password to her Cingular account). If so, he would have had a front row seat to her love life. Imagine what THAT would do to a jealous mind.

    We can only interpret what we know happened, and speculate the rest. We know he was never really vetted, never asked for an alibi surrounding the timeframe in question. He didn’t declare his and Teresa’s past romantic relationship. Her family DIDN’T either and that is VERY odd.

    Ryan contacted AT&T multiple times on Nov 3rd. Why would he do that, he had a different cell provider?

    Ryan and Teresa stopped daily phone calls around Oct 25th. Why? They talked almost daily before that. What happened?

    Ryan entered the ASY under a false name at least once. Why? Why would he even be ALLOWED on the property.

    Ryan moved into Teresa’s house. Maybe. I’m not convinced he wasn’t already living there.
    Ryan organized an impressive grid search for Teresa, but didn’t send anyone to the Avery’s. WHo the fbomb believes this horse crap? He knew Teresa went there.

    And the two biggest questions of all. How did Ryan get into Teresa’s AT&T account? He sure as fbomb didn’t guess his way into it.Why did the cops call him 20+ times on Nov 4th?

    I don’t know the depth of Ryan’s involvement is in Teresa’s disappearance. But he IS involved in some aspects.

    Other questions remain about other people in her life. With the exception of Teresa’s new friend that told Pagel about the affair with BC and the gf from the recent Dateline episode, we have heard nothing from her so called friends. I find that remarkable for such a loved young lady. And a damn shame.

    Everyone in that community is afraid to talk. The party line is that Avery did it. To state otherwise is to risk social ostracism or worse. I witnessed this firsthand when I went there.

    I’m no fan of RH (I find him a bit creepy), but I just cannot believe the Halbach’s are “in on it,” unless of course, she’s not really dead which would take this fraud to a whole other level. The only thing I’m certain of after over a year of looking at this is Steven Avery and Brendan Dassey’s innocence and the corruption in law enforcement in Manitowoc County. Apparently, there’s more to that story too and may soon be released by author Chad Keller, Beyond Avery Road: Buting and the Beast. Let’s see if it makes it to release. Very serious allegations on the relationship between Jerry Buting and Peg Lautenschlager. I couldn’t understand why, oh why, certain things were not investigated more thoroughly by Avery’s defence counsel, like the phone records? Nevertheless, I still can’t believe they found Avery guilty on the so-called “evidence” that was presented which made absolutely no sense what-so-ever. But, they did! Now, I actually believe Avery will never get out. I wish Zellner the best but the corruption in WI permeates the entire system and unless key figures are turfed to the curb and honest individuals elected, nothing will change. Sad, but true. Yet, I cling to a thread of hope that she can prove me wrong for Steven and Brendan’s sake. And not just for them, but for all those that have been unjustly imprisoned by corrupt LE, otherwise, all hope is lost.

    His testimony of talking to Teresa about her cowgirl costume for the Halloween party she was going to (Saturday) and insistence that he saw her on Sunday and not Saturday are conflicting. Sunday night was her grandpa's birthday party. In my opinion, he is trying to hide something that happened Saturday night, possibly into the wee hours of Sunday morning (hence why he could say Sunday and not perjure himself, yet didn't want to give the time).

    His being at the house also gave him access to her extra key on the lanyard. There really is nothing to affirm that she had that key on her person on the day of her disappearance. In some photos she has a group of keys, presumably to her house, the car, her garage and the photog studio (testimony of her partner). So if you're wondering how the cops got the valet key, how the RAV was driven around after she was dead, look no further.

    The #1 suspect in any murder typically turns out to be the current companion or ex.

    If Ryan had been murdered, the natural order of suscpicion would be "Teresa" then everyone else.

    The reason for so much suspicion is the fact that Ryan was not questioned as a suspect, he was not asked for an alibi and to this day...we STILL don't know where he was on Oct. 31st.

    Then the day of the search, he is showing up with what look like fresh and recent claw marks on the top of his hands and not a single one of Teresa's friends or family question him about them?...he and Mike do interviews where they act sketchy.

    Then the kicker..to me...Her roommate Scott gives a statement saying he last saw Teresa on Sunday Oct. 30th, at about 2pm. Ryan's last time...he went to drop something off for Scott, and she was at her computer. But couldn't remember what time??? Scott has deducted the hours of 2pm-midnight with his statement...so 10 hours...gone. He doesn't remember if it was 9am? noon? 5 in the morning? I just don't buy that.

    If Scott wants to remove any suspicion from himself, he should give the press his alibi for that night, with witnesses who will vouch he wasn't anywhere near Teresa. Otherwise, the witchhunt seems likely to continue.

    Myself, I am thinking it was someone else, but originally suspected Ryan..because he doesn't have an alibi and his actions, so I see the ones suspecting him as having a great reason to.

    Who were the friends at TH's house on 11/3? Did her investigators interview them about what time RH first arrived at TH's house on 11/3 and whether or not he left and returned? If so, how many times and at what times, if any, did RH leave and return? Was he even there at all on 11/3?

    One of the questions in KZ’s "The Steven Avery Proof of Guilt Challenge" is:

    Why did RH claim to be with KP at Ms. Halbach's house on November 3 all afternoon until midnight or 1 a.m. when KP called him at 5:16 p.m. and Ryan called KP at 7:18 p.m.?

    Nobody ever asked RH what time he arrived at TH's house on 11/3. And there aren't any statements from SB or other friends that corroborate RH's testimony that he was there (RH could have been there at some point, perhaps around 5 PM, and then left and returned later that night).

    Wiegert wrote in his activity report for 11/3 that "Scott and several of Teresa's friends had also arrived at the scene at that time," but Wiegert didn't identify any of these friends by name.

    RH testified that KP arrived a few hours after he arrived, and he testified that she arrived between 6 and 7 PM (regarding what time KP arrived on 11/3, Buting answered his own question during cross examination, and RH agreed):

    Q. How soon did Kelly arrive? How long were you and Scott there together before she arrived?

    A. I’m going to estimate and say between —

    Q. Six, something like that?

    A. What’s that?

    Q. She arrived like 6 or 7, something like that?

    A. Yeah, she was there a few hours after I got there, I believe. She was one of the first people —

    Q. Okay.

    RH called KP at 7:18 PM on 11/3. If KP arrived at TH's house at, or before, 7 PM, then RH was not at TH's house at 7:18 PM, when he called KP.

    According to KZ's PC petition, around 7:30 PM on 11/3, the killer was on, or near, Kuss Road, attempting to plant TH's RAV-4 near Avery's trailer.

    I watched the opening of the ten o’clock news on WBAY-TV in Green Bay on 11/3/05. Presumably, the WFRV and WGBY 10 o’clock newscasts, and the WLUK 9 o’clock newscast opened the same way, with TH’s missing person report at or near the top of the program, as breaking news.

    The WBAY story indicates the police went public at about 8PM, and includes graphics that feature photos of TH and a green RAV-4, with the photos presumably supplied by police.

    I have long thought that police were informed by family, friends and employer of TH’s disappearance, and of her last appointment being with SA, much sooner than they have ever indicated to the public.

    It’s not impossible, but it seems odd to me that police had a full media package ready by 8PM on 11/3, if the Halbach investigation didn’t begin until 5PM that day. Wouldn’t it have taken almost that long just to interview the family, get some idea as to her character and the unlikelihood that she had just taken off, and get an idea of who else to interview?

    The WBAY report says that TH’s last known whereabouts were in Manitowoc, likely at the home of the client there whose vehicle she photographed. It wasn’t until 11/4 that LE said they had learned that TH’s last appointment was with SA.

    TH's employer would have been the more likely early source for information on her appointments, especially considering that the employer and TH’s mother say they talked before TH was reported missing.

    If it is the employer who provided the information about the Manitowoc client, so why would the employer not have provided information about the appointment at the Avery yard, outside of Mishicot?

    If the Manitowoc client could be quickly reached for confirmation, why couldn’t the employer, who had expressed concerns about TH’s whereabouts (and who would presumably make himself readily available for a call from the police), tell the police about the BJ visit on Avery Road, and possibly have even told TH’s mother about the appointment before she contacted the police?

Wiegert wrote in his report for 11/3 that he contacted Colborn [Wiegert doesn't say, but it was sometime after 6 PM] and asked him to check out both the George Zipperer property [the Manitowoc client] and the Steven Avery property; and Colborn told him he would go over and attempt contact with Avery.

    Why would Colborn be told about the Avery place on 11/3 if police still thought TH had last been seen in Manitowoc?

    It seems more likely to me that the police knew of the SA appointment much earlier than they led the media to believe--which, in the early going, makes sense: If they thought at that time that SA was holding her or had killed her, why effectively alert him that it’s time to kill his still-living captive, or time to hide evidence before the police can get to the property, yet alone get a search warrant?

    But keeping quiet about the SA appointment, especially if police learned about it at about the same time they learned of TH’s disappearance, would do no good, unless police also kept quiet about TH’s disappearance until they got at least minimal indication that she wasn’t being held alive by SA.

    With no idea as to where TH was, going immediately to the media makes sense.

    With the idea that she might be on the Avery property, going immediately to the media makes no sense at all: it could be what gets her killed, or what gets crucially important evidence destroyed. It would make sense to take at least 24 hours to search quietly for her and for evidence--especially that not requiring warrants--before going public.

    Once sure TH was dead (which would be the case if bone fragments were found in the quarry early on), it would also make sense for police to quietly keep an eye on SA and the property for a day or so, while letting SA think that police were a day or so behind where they actually were in the investigation. Perfect opportunity to catch a suspect tripping himself up. And warrants could always be obtained and ready for use at a moment’s notice, if it looked like significant evidence were about to be destroyed.

    On a more sinister level, concealing when police knew about the disappearance and the SA connection would also allow police to make it look less like they were gunning for SA, would help conceal any early warrantless searches, and possibly conceal added lead time for planting, moving and tampering with evidence.

    Even if only some things happened a few hours sooner, or were known by just one family member sooner, more things make sense: Why MH is talking of grieving so soon and why RH, Pam Sturm, and the police don't talk about the possibility of finding a body during the volunteer search or in the car.

  11. Concerning Weigart's report of his activity on 11/3/2005, a few things become immediately apparent:

    Assuming all times are accurate, a lot of activity went on between 5PM on 11/3, when the missing person investigation began, and 8PM, when the media were notified that TH was missing.

    It looks like family and friends of TH "knew" TH's last stop was at Avery property as early as the evening of 11/3.

    Contrary to what police reported to media, police "knew" by 8PM that TH's last stop had not been in Manitowoc but at the Avery property near Mishicot. They knew this as early as shortly after 5PM, when Auto Trader would have provided an Avery Road address, and no later than some time around 6 or 7 PM, when Wiegert asked Colborn to check out not Barb Janda, whose car had been photographed, but SA.

    The complete lack of focus on anyone in the Janda/Dassey household is interesting, though, given that the Auto Trader had brought the Janda name to police attention.

    Puzzling that police presence during at least some of the accessing of phone information is downplayed by RH and MH. Supposedly the police were present when RH printed phone records, so some explanation might be needed for why police had records faxed on 11/4. Maybe there's a logical answer, but the question remains, nonetheless.

    Police may have been present when at least some of the phone record accessing took place, and perhaps accessing of voicemail.

    Nothing here indicates any communication with police prior to 11/3, but, again, a lot of activity seems to take place in three short hours, holding back on contacts and media contact for 24-48 hours would seem to be sensible, and there was a hesitance to let media know that the last appointment was at Avery property.

    NOTE: The reverse look-up would have shown the number as Barb Janda's, and actually have made no mention of SA. This suggests that the disappearance and a connection to SA was being looked at before these look-ups were run. I still entertain the thought that everything that didn't involve contact outside of police and the people who gathered at TH's apartment actually happened 24 hours earlier than we have been told. There are things in Weigart's 11/3 report that could not yet have been known by the end of 11/3 or by the time Colborn is said to have been contacted, unless Calumet began looking into all of this much sooner than 5PM on 11/3.

    As more documents come available, evidence of an earlier report to police is not emerging, but it's clear that police began to focus on SA at least a day earlier than they led the media to believe. Wiegerts' initial report shows attention turning toward SA fairly quickly, though it's not clear when the family and friends became aware of SA as a possible suspect. I'm guessing shortly before the media learned about the SA connection, since MH said that police had been good about telling the family things before they told the media.

    REPORTING OFFICER: Inv. Mark Wiegert

    On 11/03/05 at approximately 1730 hours [5:30 p.m.], I (Inv. MARK WIEGERT of the CALUMET COUNTY SHERIFF'S DEPARTMENT) received a phone call from Cpl. LEMIEUX of the CALUMET COUNTY SHERIFF'S DEPARTMENT. Cpl. LEMIEUX was requesting my assistance in locating a missing person by the name of TERESA HALBACH. I requested that Cpl. LEMIEUX respond to my office so I could speak with her reference this incident. When Cpl. LEMIEUX arrived, she informed me that TERESA HALBACH had been reported as missing by her mother, KAREN. Cpl. LEMIEUX also informed me she had already spoken with ANGELA SCHUSTER from the AUTO TRADER magazine who gave her three names of appointments that TERESA was supposed to be at on Monday. Cpl. LEMIEUX gave me the names of CRAIG SIPPEL, B. JANDA and GEORGE ZIPPERER as people that TERESA was to meet with on Monday.

    At approximately 1755 hours [5:55 p.m.], I did make contact with CRAIG SIPPEL. CRAIG stated they, in fact, had contacted AUTO TRADER magazine to take pictures of a car he and his friend, STEVEN SCHMITZ, had for sale. CRAIG states the vehicle, which was for sale, was located at STEVEN's residence in the Village of St. Anna. CRAIG said he did not talk with the photographer or see the photographer that day and gave me the name of STEVEN SCHMITZ and told me I should contact STEVEN. That was the end of my conversation with CRAIG.

    At approximately 1800 hours [6 p.m.], I did make phone contact with STEVEN P. SCHMITZ. STEVEN states he and CRAIG have a car they own together and were selling through the AUTO TRADER magazine. According to STEVEN, he received a phone call from TERESA HALBACH at approximately 1:10 p.m. on Monday, 10/31/05. STEVEN told me TERESA arrived at his residence at N253 CTH A, New Holstein, between the hours of 1:30 p.m. and 1 :45 p.m. on Monday, 10/31/05. STEVEN told me she was driving a blue SUV possibly something like a Pathfinder. He told me the vehicle looked very new. I asked STEVEN what the photographer, TERESA, would have been wearing. He stated she was wearing blue jeans, a white button down shirt with a summer jacket, unknown color. STEVEN states TERESA took pictures of the vehicle that he and CRAIG had for sale and he wrote her out a check. STEVEN states TERESA got back in her vehicle and the last time he saw her she was headed north on CTH A. I asked STEVEN if there was anything unusual about TERESA when he spoke with her. He stated there was not and she had just taken the pictures and had left. That was the end of my contact with STEVEN.

  13. Cpl. LEMIEUX and I then responded to TERESA's residence at the address of W3637 CTH B. Upon arrival, we were let into the residence, which SCOTT and TERESA rent. SCOTT states he had talked to TERESA last on Sunday afternoon, 10/30/05, at about 2:00 p.m. I asked him what they had talked about, to which SCOTT stated they talked about the Halloween parties they had both attended over the weekend. I asked SCOTT if she had talked about what she was going to be doing on Halloween, the 31st, to which SCOTT stated she did not mention anything to him. SCOTT states they are just roommates and they do not check in with each other and only talk if they happen to meet each other in the house. He states they basically both live their own lives out of that house.

    I asked SCOTT if TERESA had a boyfriend to which SCOTT stated she did not. SCOTT has lived with TERESA for approximately eight or nine months. He did state to me he does not remember TERESA ever being gone overright; and her not being there since Monday is very out of character for her. He also stated he noticed on Tuesday TERESA's truck was also not anywhere to be found at the house. I asked SCOTT what he thinks might have happened, to which SCOTT states he really does not know, he just knows that this is out of character. He was thinking that maybe she had met a guy when she was out over the weekend; however, she did not mention that when he last spoke with her. SCOTT did tell me that he was aware that on Saturday night, TERESA had been at a Halloween party in Green Bay. He also stated TERESA hangs out in Green Bay a lot and has a lot of friends from Green Bay.

    I asked SCOTT if TERESA was on any medications that he was aware of, to which he stated he did not believe so. He also stated TERESA was always in good spirits and this would be very out of character for her to be gone this long and not notify somebody. He also told me TERESA is very tight with her family.

    I then briefly met with TERESA's parents, KAREN and THOMAS HALBACH. Both KAREN and THOMAS also informed me this was very out of character for TERESA to be gone this long without notifying somebody. KAREN stated TERESA is very family oriented and she also coaches volleyball for SACRED HEART CATHOLIC SCHOOL. Both the parents, THOMAS and KAREN, gave us permission to go in and search TERESA's bedroom for any clues as to where she might have gone at that time.

    It should be noted SCOTT and several of TERESA's friends had also arrived at the scene at that time. They did print us a copy of TERESA's cell phone activity from TERESA's computer. It should be noted TERESA would use CINGULAR WIRELESS as her cellular phone provider. TERESA's phone number for her cell phone would be 920-737-4731.

  14. The last phone call listed on TERESA's account would have been on 10/31/05 at 2:27 p.m. It indicates it is an incoming phone call from 414-425-8772. In doing a reverse directory on that phone number, it came back to AUTO TRADER magazine.

    A second last phone call on 10/31/05 would have been at 2:13 p.m. and was to voice mail at the number 414-534-0037.

    The third last phone call on 10/31/05 would have been to a Manitowoc number, 920-682-5719. In doing a reverse directory, it came back to a GEORGE ZIPPERER.

    The fourth last phone call on 10/31/05 would have been at 12:51 p.m. to a Kiel phone number of 920-894-3972, which would come back to a STEVEN SCHMITZ.

    The fifth last phone call at 12:44 p.m. would be an incoming from the phone number 920-254-6635, unknown at that time whose phone number that would have been.

    The sixth last phone number would have been aL 12:39 p.m. on 10/31/05 to 414-534-0037, which indicates it was to voice mail.

    The next previous phone call would have been on 10/31105 at 11:43 a.m. to 920-755-8715, which lists to a STEVEN AVERY.

    We were allowed to take several items from TERESA's residence by her roommate, SCOTT, and TERESA's parents. We did take a current photograph, several credit card and banking statements and a personal journal belonging to TERESA. The final item, which we had taken, was hair from a hairbrush, which SCOTT had stated to us was TERESA's hairbrush. The hair would have been taken into custody and placed under Property Tag No. 7826. The personal journal, which we had collected, was placed under Property Tag No. 7824. The financial records were placed under Property Tag No. 1825.

    At that time, I contacted the MANITOWOC COUNTY SHERIFF'S DEPARTMENT and spoke with Sgt. ANDREW COLBORN. I informed Sgt. COLBORN we were investigating a missing person's complaint. I also informed Sgt. COLBORN that we had two residences we would like to have checked, one being the STEVEN AVERY property and the second one being the GEORGE ZIPPERER property. Sgt. COLBORN indicated to me he would go over and attempt contact with Mr. AVERY.

  15. I also received a phone call from Manitowoc County Lt. JIM LENK. I informed him of the situation. Lt. LENK informed me he would call some people in and assist us in the investigation.

    At that time, I did contact Inv. DEDERING, who went to MANITOWOC COUNTY SHERIFF'S DEPARTMENT and then eventually met with GEORGE ZIPPERER. For more information on that, please see Inv. DEDERING's report.

    I did receive a phone call back from Sgt. COLBORN indicating he, in fact, had spoken with STEVEN AVERY. Sgt. COLBORN informed me STEVEN had told him TERESA had shown up on Monday afternoon and took some pictures of his van that was for sale. He also informed me STEVEN was not sure on what day it was and did not know what time TERESA had shown up at his residence. Sgt. COLBORN also informed me the B. JANDA information would be STEVEN's sister, BARBARA JANDA, and she would live right next door to STEVEN.

    That was the end of my conversation with Sgt. COLBORN. I left TERESA's residence and went back to the sheriff's department.

    Zellner told the Inquisitr that new witnesses have come forward, leading to ”significant discoveries” since she filed a 1,200-page petition for post-conviction relief on June 7.

    She did not name the individuals but said they were hesitant to tell the truth during the initial investigation.

    Details about new direct evidence has also not been released, but will be included in an amended motion.

    She’s not just after a new trial based on isolated violations. She plans to prove Avery’s innocence.

    “We are as fully invested in vacating Steven Avery’s conviction as we have ever been,” Zellner said.

    “However, the big difference now is the new witnesses who are stepping out of the shadows and telling us what they know.”

    There will be more forensic testing, too, she said, findings that will supplement the results and expert testimony she included in the June brief.

    “We have informed the Wisconsin Attorney General of our intent to amend the petition with this new information,” Zellner said.

    Zellner claims Halbach was not killed anywhere near the Avery Auto Salvage, but clubbed to death–not shot–likely at her home in Hilbert, Wisconsin, about 30 miles away. Zellner says her latest findings back that up, while those who believe in Avery’s innocence have pointed to a number other findings, including Halbach’s cell phone records and surrounding tower data from October 31, 2005.

    “We strongly believe this [new] information combined with the flawed forensic evidence used to convict Steven Avery will free him, once again,” Zellner said.

    My theory on this is RH did it and SB has known all along, this is my best guess anyway.

    RH controlled the crime scene (TH's house - which was never processed by investigators) and he controlled what possessions they were able to take from the house, he had plenty of time to get rid of incriminating evidence.

    I think something happened the night/day RH "dropped off" something for SB that enraged RH and was the motive for killing TH and I believe SB was involved in the cover up (maybe RH threatened to implicate him if he didn't go along with the plan). I think SB has now come forward.

    Of course, I could be totally off base but all I know for sure is this kind of scenario rings true to me on so many levels whereas the story of how SA and BD murdered her is beyond ludicrous. I keep thinking of the footage of SB talking about TH before her remains were found and he was the only one who struck me as being genuinely upset and his reaction made me think that he already knew she was dead and not just missing.

  17. Why would Ryan want to kill Teresa? Well unlike Steven, Ryan had a long history with Teresa. There could be a number of reasons why he could and I believe did kill her. Unrequited love is always a prime reason for murder.

    He also had access to her, with being able to drop by her house when he wanted. At least one person testified that he saw the RAV-4 leaving the Avery place. If Teresa was driving, and she made it home where she met a violent end, then it would better explain why she was not reported missing immediately.

    I find it very odd that in light of the release of “Making a Murder” both Ryan and his sister decided to place photographs of Teresa on their Facebook pages. But neither did similar acts on their accounts previously. Was this an act of defiance against the underlying tone of the innocence of Steven Avery, or an attempt to deflect the public eye looking critically at Ryan?
    Perhaps it just seems odd that during the time after Teresa was reported missing, you didn’t see the worried mother or the concerned sisters in front of the camera, and you more than likely found Ryan.

  18. I believe that after Teresa Halbach left the Zipperer residence she needed to relax on her way back home. She had a long day and with her grandfather’s party the night before, and the Halloween party the day before that she was likely very tired. Teresa got home and Scott Bloedorn wasn’t home, but Ryan Hillegas was there. He wanted to go out with Teresa on Halloween, he couldn’t get over her. She said no but he wouldn’t take no for an answer. They got into a fight, and she was killed. Ryan doesn’t panic. But he knows he has to get her gone. He moves her body into the RAV4 and hides the vehicle. Ryan grew up there and he is an avid outdoorsman, he knows where people wouldn’t look. He is also a RN, he knows how to clean up blood and other bodily fluids.

    Ryan also stated during his examination (at Avery's trial) that he and Scott Bloedurn were interviewed in the same room by the police. But no records of their interview were presented during the documentary, nor do I really expect a record to have been made.

    Ryan Hillegas is a student in the UW Oshkosh Accelerated RN Program and according to his Facebook page is an avid fisherman, and more into the sport of kite surfing. Why does this matter? Because the RN program often involves a large amount of cooperation with local law enforcement and may be a way he was able to know Lenk and Colburn and allow their frame job to occur.

    His actions during the investigation were very much into the realm of forcibly inserting himself into the limelight. This is often a sign from a killer that wants to relive the murder again. During the road grid search for Teresa, he was not forward about putting the bulk of the people involved in the search towards the Avery complex instead choosing to focus on points south of Teresa’s home. Yet the very next day he had the civilian searchers near the Avery yard, because that was the last place she was supposed to have been. The difference is astounding.

    There was one moment that shown on “Making a Murderer” that showed an emotion that Ryan Hillegas wasn’t keen on showing, that being anger

    During episode 2 “Turning the Tables” at mark 45 minutes 29 seconds appears to be a media question time following a search with Ryan Hillegas leader of the civilian search party and Michael Halbach. There is unfortunately no indication of when the footage was taken from, we can assume from what was said during the interview that it was sometime between November 5th the day when Teresa’s RAV4 was found and November 11th when Ken Kratz announced he would charge Steven Avery for Teresa’s murder.

    The first question that was shown was directed to Ryan and was relatively straight forward, “did they find anything while you were out searching?”

    Now there were a few ways he could have answered this question that wouldn’t have raised suspicion. Among them were no, I don’t know, yes, I can’t comment, and I won’t comment. He started down this path at first when he stated “I’m not really gonna comment on that,” and then he couldn’t stop talking and it was the moment that I lost faith that Ryan wasn’t involved.

    “But if anything was found you know, we had proper authority and had professionals take a look at it as needed.”

    In that moment, he couldn’t help himself and had to say something. That was yes they had found something, and that someone had cleared them being there and that someone in law enforcement was made aware of the fact that they had found something.

    If not then why did he feel the need to include the second part of the statement? I can see no reason other than to include it unless there was a need to state again that the search party was legally there.

    So the question that comes from this is why did they find? If it was so important that he wanted to talk about it, why wouldn’t it be spoken about during the investigation or trial?

  20. The second question really seemed to put Ryan on his heels “How many times were you on the site? You were there Saturday when they found the car, but how many other times were you on the site?”

    During the question the appearance of Ryan changed, his jaw became clinched and he seemed to lose the bluster in his attitude. But also Michael Halbach seemed to change, the look on his face was not one of concern or frustration over his missing sister, it was one of general interest in what Ryan was going to say.

    “I, I wasn’t , I wasn’t on the site.” Well it is rather obvious that the question was able to hit a nerve with him. To stutter not once but twice on the same question; which is really a give me question that should have been easy to answer, is something that needs to be questioned. Why is it so hard for him to answer something as simple as how many times were you on the site?

    The follow up question was expected given his reaction “You were never on the site?”

    He became defensive now and said “That’s not true at all. “ What a bizarre response to that question! You can even hear the change in his voice; he has clearly become very defensive at that thought. It is an illogical comment to become so upset over. Either you were at the site or you weren’t.

    The question that came next is rather odd, and has been a central point to a lot of thoughts of some intrigue between Michael Halbach and Ryan Hillegas, when a reporter deflected the situation to Michael and asked him about being on the site. Michael seemed to take over the situation and defused what was looking like a powder keg for Ryan.

    In that moment Michael appeared to fall back on some previous discussion and was very clear about the answer he gave. Although he too didn’t give all of the information he knew by referring to Pamela Sturm as a member of the search team, and not as his and Teresa’s cousin.

    Ryan however managed to interject into this attempt by the report to diffuse the situation by forcing the issue that Pamela and her daughter had permission to be on the site and that the site was taped off and secured.

    The secured comment was a little bold to make considering he is not law enforcement and beyond Ryan’s knowledge level.

    I am curious as to why the reporters did not follow up on Ryan’s statement that he was never on the site. With access to the video of the Avery Salvage yard from November 5th to November 11th when Ken Kratz stated he would charge Steven Avery then it should be easy to confirm his account that he was never there. If he is proven to be lying to the reporter then what else could he have lied about?

    There is some very disturbing content in here. I have put in bold those sections that seem to give me the most cause for concern. I believe that some of the reporting in this article shows the need for the police to have ruled out Hillegas in the murder of Teresa, instead of not treating him as a person of interest due to his relationship with her.

    Whenever he needed to talk, Teresa Halbach was always there, her friend Ryan Hillegas remembered Saturday.

    So now, Hillegas said Saturday, there seems nowhere to turn.

    Halbach, 25, who disappeared on Halloween, is gone forever. Steven Avery, 43, is expected to be charged with her murder this week.

    And those who cared deeply for her as a friend, a sister, a daughter, are struggling to come to grips with the idea of never hearing her voice again.

    “She always seemed to be one of those people who knew what to tell you,” Hillegas remembered. “I’m going to miss most just being able to sit down with her and talk. She was the person I’d go to for relationship advice. She provided my girl perspective’ on things.”

    In fact, in the close-knit group of young people whom Halbach socialized with, she was pretty much the one everybody sought counsel from when they were having problems.

    Hillegas spoke of Halbach on Saturday morning from her rented Calumet County farmhouse, where he and another friend are staying to keep an eye on things. It was some comfort, he said, to be surrounded by his good friend’s belongings, her photographs and her cat, Mila.

  22. Many of Halbach’s friends, in fact, have been gathering in the evenings at the old farmhouse to share memories and to be among the things that Teresa cared for. Such evenings together would surely have been directed by Halbach in trying times, said Kelly Pitzen, a friend from childhood.

    “She was always the organizer,” Pitzen remembered, “always the one bringing people together.”

    From these friends and others, from her artful photography and from the details of her life, comes a portrait of a caring and creative young woman gone long before her time.

    From her childhood on the family dairy farm near St. John to her years in college at UW-Green Bay and her successful career as a freelance photographer, Halbach touched many in her 25 years.

    Her friends all described her as being nearly always cheerful with a face built for smiling and laughter, adventurous and unafraid, and very serious about the responsibilities of friendship and family.

    Several of her friends spoke of Halbach’s talent as a photographer and said the images she captured said as much about her as about her subjects.

    She called her business “Photography by Teresa” and she photographed weddings, children, families and graduates. On her Web site, she described her goal of capturing emotion in her photographs. On the page are tender, joyous images of a baby’s tiny feet, a young couples’ clasped hands, a brother and sister embracing.

    Hillegas and Pitzen said they cannot look enough at the photographs Halbach leaves behind, the world seen through their lost friend’s eyes.

    “I look at the pictures on her walls,” said Pitzen, “and I know the story behind every one of them.”

    Pitzen said her friendship with Halbach goes back to preschool. She said she will always remember her friend’s smile, her sincerity, her willingness to drop everything when someone needed her.

    “I want others to know that Teresa was always the kind of person that people just gravitated toward,” Pitzen said. “She was always bubbly and smiling. And she was always there to listen. If you didn’t go to her for advice, you could be sure she would search you down.”

    To a person, Halbach’s friends also fondly remembered another surprising trait, one that says something about her enthusiasm for life and which made each of them laugh as they explained.

    Halbach could not resist a karaoke stage. She was fabulous, Pitzen and Hillegas recalled, and became an absolute ham when she took the stage.

    “I think she liked the freedom it gave her,” Hillegas said. “She’d dance and point and play the character of the person in the song. We’re all going to do a karaoke in her honor.”

  23. Sarah Kluth now lives in Chicago but has remained close to Halbach since the two met in college in Green Bay.

    “I’ll never forget her genuineness, her sincerity, and how she honestly loved people,” Kluth said Saturday. “And she was such a faithful friend. I remember once I had to visit dairy farms for my job and I called Teresa and asked if she would go along and take some photographs. And there she was with her camera tromping through manure with me. It was just so cool to have a friend like that, who would laugh and say, I don’t care where we are or what we’re doing, I’m with you and that’s what is important.’ “

    So powerful was the connection Halbach had with her friends that many of them have spent the last couple of weeks tirelessly searching for her.

    Hillegas has done nothing else. He was the one who organized the searches and spent long days afield looking for his friend. It was what she would have done, he said.

    The search is over now, of course. And updated news on the search has been replaced on the family’s Web page with a poignant summation.

    “It seems as though we have achieved our goal of finding Teresa,” the note reads. “The hearts of our family go out to everyone who has a missing loved one or have had to cope with the murder of a family friend . . . We know we will see Teresa again in Heaven.”

    They would not target TH to save face for MTSO on some frivolous assault charge that had a positive ID (mistaken) from the victim and idiotic lab tech findings, and then let KZ actually pin a murder conspiracy on them without defending themselves. So as long as KZ is walking then it's not LE.

    But it's possible LE is so idiotic that RH is the murderer and he conned them into letting him plant the crucial evidence because they thought he was innocent.     I sometimes like to take my previous thoughts and turn them backwards to see if they make sense looking at this case from different angles.

    By phone record comparison between RH and TH, we know after a lengthy call on 10/25, their phone calls to each other stop. My first way of looking at it was they may have had an argument.

    (Speculation) So, after turning it around, I have to wonder if instead of calling, they were actually spending time with each other. Maybe they had made a recent decision to try a relationship one more time but keep it hush hush for now. Maybe this is what SB knows and why he blurted out his name.

    Maybe Ryan was already staying at the house a lot so no big deal that he just stayed there during the investigation and afterward. It would actually strengthen the jealousy motive if they were serious again

    If RH didn't want that known, he just admitted to seeing her Sunday but only that he was dropping something off for Scott and couldn't recall when. He says something about discussing Halloween party plans and she was going as a cowgirl.

    IIRC, Grandpa's birthday party was held in the afternoon at his house so what went on after that? I find it intriguing that not one of Teresa's friends mentions seeing her at any Halloween party at all. Well, after looking at the phone records again...

    On the 30th, both Teresa and Ryan don't make or receive calls after about 5:45 pm (hers, his - around 3:30) and they don't resume again until approximately 9 am on Monday am. Could they have actually been together?

    What if things got serious and Ryan found the nude pics, maybe read emails while she was gone to work and confronted her when she returned home?

    Your backwards thinking has merit, and your comment below (damage to the Rav4) raises a big red flag. This was a glaring error on his part, but as we so often mention, we know none of these players ever expected this saga to be put under the microscope. (Why TF accepted this at face value is another red flag)

    It is possible he has some involvement here. The LIE about the Rav4 damage, and the LIE about how he got into her phone records put him in really bad light. There had to be a motivation for him to do this. Motive. How much of this did FACTbender and LIEgert know? I suspect they knew far more and simply buried it.

    The 21 blocked number phone calls on Nov 4 is another huge red flag. Yes, more questions. Great post OP! Always question the narrative we have been told.

    The one thing about Ryan that I can't seem to let him off the hook over is the lie about the damage to her vehicle.

    If it had happened month's ago as supposedly reported by her family and friends, I have to believe her family, who worked with the organization to have the missing person's posters printed, would have certainly included that as a vehicle identifier.

    According to Tom P., she was really proud of her car. He saw her 4 to 5 days a week. Surely he would have noticed the damage.

    S. Schmitz said her vehicle looked new.

    I'm convinced KZ took her Rav and knows the pole, which she included a pic of in her motion for PCR, is exactly what damaged Teresa's vehicle.

    I also think she believes that Ryan's call to TH on 11/1 at 6:42 that only shows a 4 second duration is because he interrupted the greeting with the input of the 4 digit code and deleted voicemails.

    Oddly, the one person we can trust is SA because he saw the vehicle on 10/31 and there is no way a lifetime scrap yard salesman would let a vehicle with a broken part drive away from his scrap yard without trying to sell the owner the part and get back the money he just paid to list the van for sale.

    It raises the question if there was another RAV4 on the lot because if SA had seen the broken light then he would've said that when he reported that when he gave a description. "oh yeah, she had a broken front turn signal lens" He probably would've had a voicemail telling her to come back and buy the part.

    And, oddly, if he had even a wit of sense and he was trying to cover his tracks if he were guilty, then he would've said that he remembered her driving away with a broken light when she left...because he would've known that he had already broken the light when he stashed the vehicle after killing her.

    It's so ponderous...so blatantly obvious who the murderer is.

    But we all know that there was no damage to the light prior to 10/31 and anyone who claims there was is responsible for the damage between 10/31 and 11/5

    There are so many implausibilities but it helps me to resist the conclusion that LE framed SA but simply consider that they are so incompetent that they give the impression that they framed him by accidentally cross contaminating everything from the RAV4 to the Bullet to the blood to the bones. There is every reason to conclude the LE involved are too incompetent to get out of their own way. They reek not so much of corruption but of arrogant incompetence. That is barely distinguishable from corruption, but is different.

    Every single element that doesn't add up can be attributed to complete ineptitude and the reason I prefer that excuse is because it explains why the framing scenario is not blatantly supported. If they were going to frame him then wouldn't they also intentionally cross contaminate 100 articles in his garage? If they had access to the body and possessions then they would hide some in his bedroom, along with TH articles. But they did none of the things that would make it a slam dunk. Why not? Because, I think, they didn't intentionally do any of it, they are simply inept and began following their own trail of bread crumbs in a circle that led them in a circle back to the can of bread crumbs that they had opened. Add to that the vendetta against SA and you have a group of LE who became obsessed with proving an implausible scenario and then were too incompetent to investigate without blundering through all the evidence. There may also be a third party who planted evidence who was not LE and then tipped off LE about where to look.

    It's like the West Memphis 3 tragedy; the LE involved did not seem corrupt to me, they just appeared totally over their heads but trying to appear that they were still capable so they invented a narrative and refused to deviate despite how implausible and unsupported it was. They were too proud to admit they had no clue how to proceed. In that case, if I recall correctly, they only had one fiber from one shoelace that they claim came from a carpet inside a suspect's house...completely flimsy claim but most likely false, or, at best, cross contamination. And that's why they brought up the Heavy Metal music argument and ritual slaying out of desperation. That's an argument of an incompetent prosecutor given too much room to run by an incompetent judge.

    In Avery's case the framing scenario requires me to believe LE had all the evidence to frame him but then botched the frame job so badly that it's impossible to think he's guilty. Then I look at their 'aw shucks' response to the 1985 train wreck and I start to think they are simply a collection of dog catchers and janitors who conned their way to LE jobs and don't have any investigative skills and don't even know when they are following the clues that they had left behind while they were looking for other clues.

    Remember the DNA on the bullet was not complete and was tested by Culhane whose competence is in doubt. The bullet does not prove anything even if it were a perfect DNA match because we can't prove where it came from, who actually shot the rifle it came from, or how the DNA got on it.

    After looking into his phone records a little more and comparing them with TH's... its fairly obvious that he was contacting her frequently (every two days for a while) at odd hours of the night (after midnight) and was most often leaving VM.

    Over the course of a month he contacted her almost 10 times while she only called him back 2 or 3 times. Each call he made to her was on average less than 1:00min... rarely they had a conversation lasting more than 5 minutes.

    While I now understand he was calling a government office his phone records compared to her are still suspect.

    There are multiple examples on TH call records to show she forwarded his calls strait to VM, checked her VM and did not call him back.

    Thankfully the records KZ provided are from 01/2005 and forward. One can get a feel for her calling/answering habits. It also seems like his last phone conversations with her VM were on 10/26. He doesn't attempt to contact her again until AFTER she went missing.

    I think it’s fairly easy to believe RH was the one who deleted her VM's.

At no time should a person of interest be allowed to contaminate potential crime scenes and evidence with their current-day DNA.     Before anybody "knows" anything, the ex-bf is basically recruited by LE to coordinate searches for a missing woman...he is showing the cops where TH keeps her personal items...he is lying about voicemail deletions, he is oddly forgetful about his last encounter with TH, he is miraculously prophetic in "assigning" POG to surreptitiously gain access to the ASY, and "borrows" her a camera no less, and the Sheriff's cell number TOO, wow, what a fuckin' incredible series of coincidences huh...

    Personally, I think the cops included RH in a hands-on capacity to address the potential discovery of his DNA on items of evidence such as the Rav4, they would have a plausible explanation.

    Sorry everyone but I'm still sticking with my first gut instinct from way back on that "other" sub... It was RH and SB. If you want to talk motive, opportunity and direct connection to the victim, it doesn't get any clearer than these two.

    SB telling MW that TH's car wasn't "anywhere to be seen on that Tuesday,” shows he knew something was up. His inability to look at the camera during his first news interview. Sketchy as hell.

    Then we had RH deleting voicemails from TH's phone after "guessing" her username and password. Then they both created a fake call record of her cell phone calls to hide calls they didn't want the police to know about, then....if that's not enough, they are the ones that directed the search and assisted POG in "finding" the RAV4.

    These two are the most logical suspects.

    They planted the RAV4 and entered the property during the search. Remember they were on the log sheet twice. Signed out twice, but only signed in once.

    They played AC and that's why he called in the plates that night.

    Then JL had to come up with the RAV4 key in order to fix the mess.

    OK my pick is RH, with MH being the tipper-offer to Zellner. LE did a lot of planting. Watching the videos of MH and RH, including the one where MH is really intently watching RH lying on the stand. I reckon RH fed MH a story but MH had his doubts all along and only half believed Him.

    I did veer sharply to LE having killed her at one point too but have gone away from that and here is my main reason; IF LE had killed her, they would have gotten her blood and put it EVERYWHERE at SA's property. The fact that none of her blood was in SA's trailer makes me think LE only came across her cremains.

    she was killed in her vehicle or near it, by RH, and then he burned her body. LE found her cremains at one location and the empty vehicle at another, and put in into the yard. etc.

    I gather MH is still saying he thinks BD is guilty, but this could be a cover/smokescreen for the fact he knows differently now, and turned RH in as a suspect.

    In my opinion, they allowed a shit ton of people on the property and gathered so many volunteers deliberately and for one simple purpose. They hoped that by having so many people in and out that it would be easier for nefarious types to come and go without being noticed. It almost worked for them too, but they got cocky. That's why we see a second "log out" for RH and SB in the log sheet, but there is no matching "log in" that corresponds with that 2nd log out. They slipped inside unnoticed, but by time they tried to slip back out, someone likely caught sight of one of them and made conversation with them on the way back out, at which point, the two of them then had no choice but to sign out because they had eyes on them.

    It's also pretty likely that whoever that was that they got stuck talking to had no idea why the two of them were there, it probably seemed innocent enough, but RH knew if he and SB did not sign out, it would seem suspicious and he had to keep up appearances that everything was on the up and up.

    The question is, who was it that they bumped into? (If my theory is correct anyway).

    Framing someone who you absolutely believe is guilty is not hard, one can easily argue that he's doing the morally best choice. That is what AC's involvement probably was in the case with the key and the car only imo, the same as most everyone that was in on the frame up.

    Next easiest thing is framing someone who might be guilty, it's a bit more of a stretch to convince oneself it's the moral thing to do, but it gets easier with experience. And if the person in question posseses a whole lot of stubbornness or lacks critical thinking, he can simply convince himself that the defendant is guilty to lessen the guilt.

    Murder to frame someone, even burning a body... boy that's a whole different ballpark. AC is not the type.

    As for LE's involvement in the murder, at the absolute worst they moved the cremains from the nearby pit to SA's burn pit. Anything else is way too extreme imo.

    It could be just me but framing someone who you absolutely know is guilty but would get away with the crime if you didn't manipulate evidence is morally not that difficult of decision to make.

    Yes, it would also seem less risky if you firmly believed SA was guilty. Then when evidence appears to contradict your belief, you negate, avoid or redirect it until your beliefs remain true. Plus, if you have committed an overt act to frame someone, your psyche likely doubles down on your steadfast belief. Tunnel vision and group think bias will further take you to coerced confessions.

    To me, of all of these theories, only the ones where LE believe they are framing a guilty guy make sense.

    If LE came up with the plan to murder LE, they would have done it before the depositions began. Teresa had been going to ASY since June 2005. They had opportunity before the depositions began. Also, they would have had her body to plant DNA, blood and hair, but they didn't, which means the body was deposed of by the killer, preventing them from planting evidence that Teresa was killed in Avery's trailer or garage. The best they could do was months later find a spent bullet in his garage with her DNA planted on it, yet Teresa's blood no where in the trailer or garage.

    I hope I'm totally wrong and there is smoking gun level evidence inculpating RH (or somebody other than SA.) This case is like Rorschach of whatever biases we all bring to it.

    The SAIG forum is no different from this one. Lot's of reasonable extrapolations from the data over there that add up to "guilt" in their case.

    At this point, I'm totally done with the forensic evidence and it's all down to Brady, Denny, and prosecutorial misconduct. Having a reasonable alternative suspect is helpful here, but it doesn't really matter if RH is guilty or not here for KZ's purposes. It only matters that RH was not adequately excluded when (a) the crime scene is a confounding mess and (b) it's clear he likely had motive and opportunity.

    Everything else is kind of waste of time I think.

    The fact that he had such huge gaps in phone activity is what RH will never be able to explain. I can't believe we aren't discussing why he had such big gaps in cell phone usage. To me the only logical explanation is that he powered his phone off anytime he was near ASY. If his phone was on it could ping a tower and even back in 2005 he would have been smart enough not to take a powered on cell phone anywhere near ASY. I will give it to RH. He's not an idiot as far as knowing what could be tracked, traced, and forensically investigated. He managed to distance himself just enough that he likely just got away with murder when millions of people have eyes on this case. I hope I'm wrong and he is brought to justice if he indeed committed the crime.

    I don't think Teresa had cell phone coverage in the vicinity of Avery Auto Salvage, and the same may have been true for Ryan. Even in 2017, opensignal.com shows that AT&T (Cingular acquired AT&T in 2005 and the Cingular adopted the AT&T name in 2007) was very weak in that area.

    First, good post. I think overall, this is not a new concept, but I like the picture you paint, the actual scene that someone would have walked in to, had this been a true story of the events of that day, which we know was not a true story.

    However, you made an excellent point on the flip side of your scenario and I'm not sure you realize it.

    You did entertain the idea:

    what if someone like a partner couldn't reach her and became concerned immediately?

    You used it to suggest that SA would never have done this murderous act even if he wanted to, because he simply had no known window of time to work within. Anyone could come looking for her any second, the minute she didn't call back into work or reach another appointment. If someone couldn't reach her, they would become concerned.

    I think the real interesting thing you unlocked here, maybe unintentionally, is the fact that there WASN'T anyone that came looking for her. Yes, we know it was three days, but that's precisely the point. It was three days.

    Only someone that knew her schedule, knew enough about her day to day plans and how to evade anyone asking questions would have had enough nerve to pull something like this off.

    But then I also ask, is that even possible? Even if the killer was someone that knew her well, how would the killer know for certain that no family member would be asking about her. It was freaking Halloween for God's sake! Her mother or sister didn't question anyone where she was when she didn't call or come over for trick or treating with her sister?

    I suspect they did when you consider SB's comment to MW that specifically on that Tuesday, November 1st, he recalled that "Her car wasn't anywhere to be found".

    I wrote many times on that point, suggesting that his comment is loaded with a clue; that people were in fact aware she was missing. Why did it take two more days to do anything?

    None of it adds up.

    This has caused so much anguish for everyone when we started reading over the reports because there are countless examples of them asking questions and then not following up.

    I often wondered/theorized that this was simply because LE really just was trying to give the impression that they did a full investigation and trying to make it look like they followed leads and questioned everyone.

    They had to go through the motions, but it was a show and nothing more, IMO.

    It's sort of obvious to me anyway because I feel they didn't ever really persist in any incriminating questions and when it seemed that the questions they did ask were about to lead to something good or open a can of worms, they abandoned the interview.

    One such one for me always has been when they questioned TH's room mate Scott B. At one point he stated during his interview, that on Tuesday, which would have been November 1st, he recalled that Teresa's RAV4 "wasn't anywhere to be found".

    I have long argued that this seemingly simple statement holds much more weight than it has been given credit.

    "Wasn't anywhere to be found", suggest to me that Scott was actively looking for Teresa and or her car for whatever reason. "Anywhere to be found" strongly suggests that some sort of elevated level of search was conducted by Scott, either by himself or with others.

    I agree, it does nothing to quantify the elevated level of searching he may be referring to, but it definitely sounds like he is saying it was much more than a quick glance from the house window to the driveway to see if her car was there, otherwise he would have just said, her car wasn't in the driveway Tuesday.

    If someone had made his statement to me and I was the LE officer interviewing that person, I would have immediately asked, "Why Tuesday? Why was Tuesday something that stuck out more than Monday or Wednesday"? I would have also asked for some clarification as to what he meant by "Her car wasn't anywhere to be found".

    I would have asked, "Why were you looking for it"? "Where did you look for it"? "Who helped you looked for it"? Did something make you suspicious or worried about it not being anywhere"? "Were you already aware on Tuesday, that no one had seen Teresa for a couple of days"? "If you were concerned enough to look for her car, why didn't you tell someone"? "Did you tell someone"? "Did anyone else know her car or her hadn't been seen"?

    Maybe these questions would have not turned into anything or provided anything. Maybe he just misspoke his words and there wasn't anything to it, true, however, wouldn't you at least ask for some clarification based on that response, just to make sure?

    I think you would, especially if you were really trying to find Teresa. I think, if you already knew what happened to her or at minimum had a preconceived narrative that you wanted to project as truth, you wouldn't want to risk the real truth being revealed, then you wouldn't ask more questions because you know it would open a can of worms.

    Look at how many times Brendan was asked the same questions over and over and treated like a suspect even when he was being interviewed the first time and even when he repeatedly kept saying he didn't know or didn't do anything. We now have proof that the way they questioned him were improper. I would suggest that this plays in part to how they handled questioning everyone else.

    I posit that if this was a sexually motivated killing, the murderer would have done it again by now.

    When a person is killed in a rage or for personal motives, such as jealousy, they wouldn’t necessarily kill again, because the focus of their rage is gone now. They might still exhibit narcissistic traits and/or stalking behaviour though.

    BUT if the motive was a sexual one, surely the killer/s would strike again eventually. They got away with it the first time, right? If TH’s tragic murder had really been based on a sexual motive, there would be other murders and/or rapes in Wisconsin with this MO by now. Had it been anyone in the family, they would have to go in this category, especially considering the recent discoveries from the computer. But neither ST nor BoD have had convictions for sexually motivated crimes afaik. Feel free to correct me if I’m wrong. Discovered or not, sexual motivated crimes occur repeatedly, according to the linked study, which states that perpetrators commit “high rates of both repeat rape and multiple types of offending.”

    Either is possible, even though admittedly I’m in the RH camp as the possible suspect. Have there been other, similar cases in WIS? I’m sure I haven’t seen posts here that would have indicated so by now, but I’d be interested to hear if you know of any. Locals? My dear local photographer colleague (wink, wink, nudge, nudge) have you heard of any similar cases?

    (74) Explain why Ryan Hillegas accessed Teresa Halbach’s Cingular account at 5:48 p.m., before the investigators arrived at Ms. Halbach’s residence.

    (84) Why do the investigators not discover who had possession of Ms. Halbach day planner?

What did Ryan learn at 6:24 PM on November 3rd when he called the number listed on Teresa's "minute used" report for the 2:27 PM incoming call, the caller who Teresa talked to for almost five minutes? This is the 414-425-8712 number that the State's narrative has as Dawn from Autotrader calling but Dawn messed up her rehearsed testimony at trial and said Teresa called her to ask for mailing labels.

    I think at some point Remiker realized he was supposed to get on board the Avery is guilty train. But both he and Wiegert apparently didn't understand that in the beginning.

    should be an audit trail for report writing<< Especially since they are legal documents used in trials. Or at least the basis for how the person who wrote them testified. I think it should be agency policy that LE retain notes taken during an investigation, at least for a certain period of time. However, that might mean that LE would just stop taking notes since they wouldn't want to be pinned down to their first impressions.

    I think you may be right about Remiker. And I agree about Wiegert. That 9 am phone call on 11/5 between he and Remiker says a lot about him, imo. I think he was arrogant, thought he was smarter than most, and had adopted a kind of "world weary" persona that he thought went with his profession. I think he was quick to make assumptions and was neither a detail person or a deep thinker. I also think, which is also just an assumption, that he believed the ends justified the means, which might explain his and Fassbender's behavior with Brendan. These are all just 25 cent psychological theories, of course, of someone we know only from MAM and the reports and testimony in this case.

    In the pre lim hearing in which RH testifies, he is being asked why he gave Jerry Pagel's number to Pam-who later discovers the RAV4 at Avery Salvage Yard. His answer:

    A. I gave Pam -- Pam Sturm, I gave her Jerry Pagel's number that morning. The cell phone coverage out in that area is absolutely horrid. And to get a call out to -- most of the time when I used my phone out there, I only had 30 seconds or a minute to talk before your phone cut off on you. But I gave Pam that number, Jerry Pagel's number, that morning, with the intent that if she was going into the car lot and needed to call somebody quick, and get somebody out there, that would be the best way for her to.

    Sounds to me that:

    He knew the reception at the Avery Salvage Yard was poor. How did he know that if he had never been there at that point?

    He knew that Pam would need to call Pagel when she got to the car lot, considering he did not provide Pagel's phone number to anyone else.

    Expanding upon the original post of Ryan testifying in pre-lim that the reason he gave Pagel's number to Pam because of the "horrid" reception of the area. Area being ASY, as she was going into the car lot...I have noticed an incredible coincidence with his call records.

    "Absolutely horrid" is exactly how one would describe the frustration of trying to communicate extremely important information but getting cut off over and over. One or two dropped calls wouldn't really be memorable. Usually, when you drop calls a couple of times, it is too frustrating to keep trying so you hold off until you are in a better area. That wouldn't be possible when your task has to be done in that area and you're relying on your phone to communicate information vital to that task. I imagine that anxiety and frustration RH felt during that time frame was memorable and "horrid" and that memory slipped out during testimony...being unprepared for the question. Frustrating Buting and Strang didn't catch this.

    And those calls coincidentally line up with when Chuck saw lights in salvage yard. No way that could have been made up at that exact time RH has the odd phone activity. Clearly when Chuck and SA reported this to LE, they had no idea what RH's phone records would reveal.

    My guess is cell service was fine IN the salvage yard because none if the Avery's mention bad cell service/dropped calls. More likely, somewhere AROUND the salvage yard cell service was bad.

    Obviously, if cell service was bad IN the yard, it wouldn't matter who Pam was calling cause that doesn't change her bad cell phone reception.

    However, her calls to say someone waiting AROUND the salvage yard could be difficult if that person was just outside the yard where their signal wasn't consistent. So hypothetically, if RH was waiting outside the yard in case POG had a hard time finding it, he'd know from being there the night before that his service was iffy...SO then it would make sense to give her Pagel's number where he would not be in a bad service area if she couldn't get RH.

    Actually, I wonder if it's possible that POG and NS were sent to first distract Earl while RH planted car (and maybe the night before was scoping out area to put rav) and then after distracting him, they go to the spot and find it. I'm sure LE knew exactly were all of the Avery's were and knew they were all gone.

    Anyway, to me it makes the most sense that RH was around the yard and the concern was him not getting service if POG couldn't find car. I'd love to see POG and NS cell records cause I doubt we'd see a call to KH like one would expect.

    Remember her call, "I don't wanna put the...you know".

    How does the killer know the roommates schedule?

    These are the second set of clues:

    Answer: Whoever the person is that hacked the phone needs her mail to retrieve her phone bill to retreive a replacement password.

    A girl is killed at a remote location.

    There is no unusal DNA on her items or her vehicle.

    The killer must have access to her appointments.

    These are your third set of clues:

    Answer: The person that enters her home regularly.

    A girl is killed and suspects have evident wounds.

    Murderers usually are compelled to follow the crime.

    The killer knows exactly where the victims car is.

    These are your fourth set of clues:

    Answer: Ryan and Bobbie Dassey.

    So here is the SOLID proof:

      Ryan told on himself when he testified when he had all the right answers until it was time to ask when the last time he saw her and he drew a blank. He could not remember if it was morning or night, dark or light!

      Ryan was the one that bragged how he guessed her password and hacked into her computer and then her phone records.

      He was at her house three times a week and knew how to make it look like she had been there, buying himself time.

      Her roommate was his bestfriend.

      Ryan gave the police her Auto Trader fax showing her appointments from the day she was killed.

      His DNA was on every thing she owned while she was alive and would not show as suspect.

      Ryan led the world in the search for the girl he murdered.

      Ryan has three long claw marks on the back of his hand, all parellel to each other -- consistant markes are made by strangled victims.

      Ryan smiled the entire time he testified.

      This is how I put it all together.

      Ryan knew Bobbie Dassey. Both have unexplained wounds, suggesting they have fought. On the faxes, it showed Bobby Dassey's mother as an appointment.

      This means he had a motive to go to this appointment as a jealous ex, and this places him with her the last day, in the remote location.

      And what if I told you that I think that Ryan has her car keys that are missing... he was the stalker and he was insane with jealousy. And he knew bobby Dassey and he knew Scott Tadych. And the fax from Autotrader didn't say Steven Avery, it said Barb Janda...

      He simply grabbed that fax off her machine, but Teresa, herself, flipped the appointments around, as she he was calling her none stop so she blocked his number...

      She flipped the appointments in hopes to confuse Ryan. He is lurking around Avery Road but she still wasn't coming and still wasn't coming. And he is so wicked that he thinks she has decided to meet Bobby Dassey in the salvage yard, so he goes there and sneaks about. Meanwhile, Teresa gets in and gets out in like 5 minutes at Avery's.

      She wants to hurry as she has blocked Ryan from calling her.... she leaves and is heading to Greenbay with her cowgirl costume.... Ryan comes speeding up aside her and is screaming for her to pull over and swearing. She speeds up, as she knows he has lost it completely.... he catches up and swerves at her on purpose, and she over compensates to avoid him slamming her, and she looses control and hits the ditch, wrecking her car.... Before she has even gotten herself out of the car, he opens the door and yanks her out and begins to strangle her, deciding that no one can have her if he can't. She claws his hand with one hand and grabs, struggling to pull his other hand off her throat.... he is kneeling in the road, her limp body in his hands... his DNA is all over her stuff, all the time, any way, so no worries.... Her heart is at rest so there is no big amount of blood from where she hit her head on the dash... He lays her in the trunk and then grabs her keys. He waits till after dark and parallel park her RAV4 near the Salvage Yard. He grabs her cell phone, camera and PDA and runs in the dark cover of night to his vehicle.

      He waits for Scott, his BFF and her roommate, to go to work and he uses her house key to continue to stalk her even after death, opening her mail and basically making sure nothing points the finger to him, hacking her accounts, and living there until he knows Scott is coming home. He leaves just before that.... but this makes Scott think she has been home.

      Ryan's voice is in the back ground yelling "her car is over here" when Colburn calls her plates into dispatch.

      The killer needed her password to unblock his number and delete incriminating voicemails.

      Pretty good. What would Bobby's motive be? Would Ryan really have to swerve at her? She could have conceded to meet up with him, this seems much easier and more likely using your theory.

      Mr Juan, consider this, T.H. was taken down after she left the S.A. property. She was driving along when a car either passed her and bumped her front left bumper, or someone pulled out and she braked but hit the other vehicles bumper.

      The turn signal was knocked out of T.H. vehicle and someone with accident scene training picked that turn signal up and tossed it in the back of T.H. vehicle like cops do at accident scene clean up.

      They have her at the rear of her car talking to her, toss the turn signal in and bash her in the head with an, take your pick, axe, club, hammer, gun.

      That axe makes sense from another guy swinging one around to kill his girl friend and kids/dog.

      Three people were there that day. Teresa Halbach, one driving T.H. car after she was dumped in the back of the rav4 with a bleeding head, and the other person driving the mark vehicle.

      The club at work which is more than a club. Your pretty much right on the county worth bring sweat to the players who will be called out and have to pay.

      Like in the Begotka testimony of people watching from the sand dunes back in 1985, they were watching from the junk yard hill and other places.

      How did they make it all come together is easy. That lawsuit had investigators,cops and community leaders in the club watching S.A.

      I know how that goes since I experience the nefarious powerful circling me with wicked minds waiting to pounce and take me down.
